Up to now researchers have maintained that Nietzsche’s philosophy has no concept of social justice or have hardly noticed such a concept. On the contrary, this article argues that social justice plays an important role in Nietzsche’s political thinking. It shows that his conception of justice is modelled after Plato’s antique concept of political justice. The main thesis of the paper is that this conception is embodied in Nietzsche’s notion of a well-ordered state or society. An additional thesis concerns the (...) anthropological basis of what Nietzsche holds to be a just social order. This basis is constituted by his conviction that people are not only fundamentally unequal but also extremely different in worth and rank. (shrink)

Según una influyente línea interpretativa, la mejor polis de Aristóteles debe ser considerada una politeia. Esta corriente predomina aún hoy entre los eruditos alemanes. En tanto paladina de la “social democracia aristotélica”, Martha Nussbaum pertenece también a esta línea exegética. En oposición a tales interpretaciones, este ensayo defiende la tesis de que Aristóteles pertenece a la tradición de pensamiento político aristocrático. Esta tradición se remonta a Teognis, Heráclito y Platón y se inicia como una crítica dirigida tanto a la decadencia (...) de la virtud aristocrática cuanto al ascenso de valores democráticos e igualitarios. Este trabajo demuestra que Aristóteles concibe las diferentes formas de constitución como manifestaciones de distintas concepciones de la justicia distributiva. Aristóteles mantiene una clara preferencia por una concepción aristocrática de la justicia, y, por tanto, por la aristocracia. La constitución de la mejor polis que detalla en los libros VII y VIII de la Política debe entenderse como una “verdadera aristocracia” en la que los cargos políticos son distribuidos según el mérito entre los ciudadanos que sean los mejores desde el punto de vista moral e intelectual. Der vorliegende Aufsatz ist ein Porträt von Martha C. Nussbaum, das die enorme Vielfalt ihres wissenschaftlichen Werks und ihrer Veröffentlichungen als Public Intellectual beleuchtet. Nussbaums Denken, das sich auch als Reaktion auf schmerzhafte Erfahrungen und als Widerstand gegen ihre soziale und kulturelle Herkunft interpretieren lässt, kann als feministisch, moralistisch, egalitaristisch und anti-elitär charakterisiert werden. Der vorliegende Text thematisiert Nussbaums Biografie, ihren intellektuellen Werdegang, und fokussiert auf folgende Themen: ihre Faszination für die antike Philosophie, ihren Fähigkeiten-Ansatz, ihren feministischen Liberalismus, ihre Philosophie (...) der Emotionen und ihre Rolle als „öffentliche Intellektuelle“. This article examines the development of ancient Greek theological thought from Hesiod to Aristotle. It argues against Aristotle’s and John Burnet’s accounts of the advance of early Greek philosophy. Complementing Werner Jaeger’s views, the paper claims that there is a process of rationalization within ancient Greek theology which does not progress in a linear fashion. Rationalization is defined as demystification and demythologization. The degree of ‘rationality’ of a theological view depends primarily on its degree of anthropomorphism. The less human characteristics (...) or behaviors are attributed to the Divine, the more ‘rational’ a view is. This article argues that the efforts of a group of Greek theologians to purge anthropomorphism were only partly successful. (shrink)

This paper gives a detailed analysis of Nussbaum's,,capabilities approach“ and her claim that it is a genuinely Aristotelian contemporary political philosophy. The paper comprehensively examines how Nussbaum bases her approach on human nature and questions her assertion that Aristotle's account of human nature and her approach are not metaphysical. It analyses the normative dimension of her,,capabilities approach“ and shows how she adopts and modifies Aristotle's doctrine of distributive justice in an egalitarian way. With reference to contemporary literature on Aristotle's _Politics_, (...) the paper criticizes that Nussbaum assimilates his political philosophy into modern values and notions, laying out several reasons supporting the thesis that Nussbaum's,,capabilities approach“ should not be regarded as an Aristotelian approach. English summary: How Niccolo Machiavelli is to be understood is still passionately argued today. The many facets of his political thought correspond to the diversity of perspectives among his interpreters. The authors of this interdisciplinary volume analyze Machiavelli's works in connection with transformations of thought on policy, rule and morality from the beginning of the early modern period through to the present. In addition to the interpretation of Machiavelli through the lens of his time, effects of his writings and thought (...) in contemporary discourse are focused upon. Topics not only include Machiavelli's relationship to the modern concept of the state and his experimental morality, but also his demonological style of reading and his presence amongst contemporary republicans and liberals, amongst thinkers such as Max Horkheimer and Michel Foucault, as well as in the empire debate. Additionally, the volume takes into account thus far little-explored aspects, such as Machiavelli's thinking style and methodology, as well as the literary-rhetorical dimension of his writings. Environmental theorists and practitioners generally accept that responsibility for environmental harm is best understood as common but differentiated, yet little work has been done to philosophically articulate this idea. This paper develops this theory by bringing Iris Marion Young's two-tiered model of responsibility to bear on the topic of addressing and redressing environmental damage. I demonstrate how her approach can satisfy the commonality criterion (i.e. that everyone has a role to play in confronting environmental harm), while still satisfying the differentiation (...) criterion (i.e. that different actors have different kinds and degrees of responsibility), and that it does so in a manner that is persuasive, politically useful, and reasonably acceptable to all sides. In aiming to satisfy the commonality criterion, the paper identifies traditional sustainable communities as environmentalist exemplars, emphasizing that these communities have a vital role to play in combatting our present ecological crisis. Rawls theorizes principles of justice as defining a ‘pact of reconciliation’ between diverse conceptions of the good. What does fulfillment of this pact entail when reasonable pluralism is recognized as having an environmental dimension? Fair acknowledgment of the plurality of citizens’ relationships with the natural world challenges the neutrality of aims conventionally used to justify ecocide, including the promotion of economic growth and development. This paper explores how ecocide constitutes a violation of equal basic liberties and state neutrality as per (...) Rawlsian political liberalism. Kalinowski conceives metaphysics as a set of propositions which can be axiomatized. This paper exposes the typical rules of an axiomatic system comparing them with the metaphysical system developed by Kalinowski. These rules are linguistic rules, but also admission-rules and transformation-rules. They always refer to the metaphysical propositions (wich are first or second propositions, as it is usual in logical systems). This paper tries to evaluate Kalinowski's attempt.

La llegada de la democracia y el auge de los diversos movimientos feministas, unidos a los cambios de mentalidad que se habían ido produciendo, hicieron que poco a poco la discriminación se fuera erradicando y la situación se (...) encamine hacia la igualdad.This text describes and analyzes the social, political and economic status of the woman during the dictatorship of Franco. The laws imposed by the dictatorship, with the moral protection of the Spanish Church, provoked a strong setback in the rights of the women. The arrival of the democracy and the summit of the diverse movements feminists joined the changes of mentality who had been taking place, they did that little by little the discrimination was eradicating and the situation intends towards the equality. En la conquista, colonización y evangelización de las Indias se dio una estrecha colaboración y alianza Iglesia-Estado, amalgama que reforzaba a ambas instituciones, aunque siempre bajo el control estatal, supervisada y coordinada por el Consejo de Indias. Las relaciones Iglesia-Estado en América pasaron por diversas modalidades: Patronato, Vicariato y Regalismo. En el siglo XVI rige el Patronato, basado en las concesiones Pontificias que ponía en manos de la Corona española el ‘cuidado’ sobre la Iglesia americana. Desde fines del XVI, religiosos (...) y juristas españoles elaboraron la teoría del Vicariato, según la cual los reyes, en virtud de la donación papal, eran Vicarios de la Santa Sede en las Indias y adquirían competencias en materia de disciplina eclesiástica. En el siglo XVIII el Regalismo asume ambas posiciones y las convierte en jurisdicción civil al considerar que los derechos esenciales del Patronato y el Vicariato no se basan en concesiones papales sino que son prerrogativas inherentes a la Corona, regalías o atributos del poder real. Desde un primer momento España pretendió justificar la conquista y ocupación de América. De todos los posibles títulos que se podían aducir en los albores del siglo XVI, los españoles optaron por poner en primer lugar la “donación pontificia” (bulas alejandrinas). De modo que en este artículo intentaremos exponer los fundamentos doctrinales de esta donación papal. En la práctica se generó una preocupación (controversia) por la situación material y espiritual en la que vivían los indios que desembocó en los planteamientos (...) del Maestro Francisco Vitoria que acertó a plantear en los términos exactos el problema de América. Las visitas eclesiásticas eran un medio para contactar y conocer la realidad diocesana, sus problemas y sus éxitos. Sin embargo, a veces chocaban con delicados problemas provocados por los grandes periodos de sedes vacantes, durante los cuales los miembros del cabildo, los dueños del gobierno y la administración de la diócesis podían hacer y deshacer a su antojo. Por lo tanto, era lógico quetemieran al nuevo obispo e intentaran evitar su visita.
