El siguiente trabajo se propone analizar críticamente la concepción clásica y monológica de la imparcialidad del juez, su respectivo correlato institucional y las consecuencias para interpretar el vínculo que debería tener con los afectados. Para ello se realiza un análisis reconstructivo de El Federalista de Hamilton, Madison y Jay. En primer lugar, se analiza en tal documento el concepto de imparcialidad y sus supuestos teóricos. En segundo lugar, se señala el modelo constitucional derivado. En tercer lugar, se muestra cómo, a (...) pesar de los giros y la distancia teórica del "nuevo constitucionalismo", algunas de las ideas subyacentes en El Federalista permanecen vigentes. Finalmente, el trabajo intenta poner en práctica el marco teórico-normativo de la democracia deliberativa para el análisis histórico reconstructivo de la teoría constitucional. The following work intends to critically analyze the classic and monological conception of the Judge´s impartiality, its respective institutional correlate and the consequences to understand the bond that should have with those affected. For this, a reconstructive analysis of The Federalist by Hamilton, Madison, and Jay is made. In the first place, the concept of impartiality and its theoretical assumptions are analyzed in such document. Second, it shows how, despite the turns and transformations of the "new constitutionalism", some of this assumptions remain applicable. Finally, the paper attempts to put into practice the normative theoretical framework of deliberative democracy for the historical reconstructive analysis of constitutional theory. (shrink)

Este artigo considera o desenraizamento afetivo-religioso de Freud no seu contexto familiar e sociocultural e também visa mostrar algumas críticas que neofreudianos e cientistas fazem a Freud. Condicionado, conscientemente ou não, pelas representações (memórias) originárias, Freud não aprofundou as raízes afetivo-religiosas no chão pedregoso de sua infância. Suas primeiras experiências afetivo-religiosas (não tão positivas) foram como pedras escabrosas no chão de sua frágil existência. Com o drástico desaparecimento da babá Resi Wittek, as tenras raízes afetivo-religiosas do psiquismo de Freud praticamente (...) perdem a inicial vitalidade, tentando compensar essa perda com sua mãe, em nível de cuidados e afetos, que não podia corresponder. Ela poderia somente oferecer-lhe um suporte em nível narcisista (jovem e bonita). Ele somente recebeu esse apoio afetivo-religioso de seu pai (Jakob) mais tarde quando já marcado negativamente em seus relacionamentos com os primeiros objetos. Assim determinado, Freud se sente desamparado, em sua infância. Ao entrar na adolescência Freud se declara ateu influenciado pelo ambiente cultural eivado do cientificismo ateu e de um radical anticlericalismo. Sem raízes afetivo-religiosas profundas, em nível experiencial, Freud não poderia ser uma árvore robusta na dimensão religioso-espiritual, apesar de tanto se preocupar com ela. (shrink)

Research has shown that a majority of employed women experience sexual harassment and suffer negative repercussions because of it; yet only a minority of these women label their experiences “sexual harassment.” To investigate how people identify sexual harassment, in-depth interviews were conducted with 18 waitpeople in restaurants in Austin, Texas. Most respondents worked in highly sexualized work environments. Respondents labeled sexual advances as sexual harassment only in four specific contexts: when perpetrated by someone who exploited their powerful position for personal (...) sexual gain; when the perpetrator was of a different race/ethnicity than the victim—typically a minority man harassing a white woman; when the perpetrator was of a different sexual orientation than the victim—typically a gay man harassing a straight man; or when violence or the threat of violence was used. The authors argue that the hegemonic norms of acceptable sexual activity privilege heterosexual relationships, legitimize institutionalized forms of sexual exploitation in the workplace, and may protect assailants of the same race and sexual orientation as their victims from charges of sexual harassment. Se despliegan aquí algunas notas que permiten empezar a entender las notables conexiones entre el pensamiento chino y la obra de Borges. También se ofrecen algunas consideraciones laterales sobre los vínculos con otros aspectos de las culturas de Oriente Medio. En general, se intenta mostrar que conceptos fundamentales del pensamiento chino entran en poderosa armonía con la literatura, y aun con lo que puede considerarse una filosofía, de Borges.

Health care professionals use strategies during the physical examination to stay in control of their feelings, the behaviors of their patients, and to avoid allegations of sexual misconduct. To investigate how health care practitioners desexualize physical exams, the authors conducted 70 in-depth interviews with physicians and nurses. Three desexualizing strategies were general ones, used by both male and female health care providers, and were employed regardless of the characteristics of the patients: engaging in conversation and nonsexual joking, meeting the patient (...) clothed before the exam, and using medical rather than colloquial terms. Six strategies were used only in specific contexts or were used primarily by men or women. These gendered strategies include using a chaperone, objectifying the patient, empathizing with the patient, joking about sex, threatening the patient, and looking professional. The authors conclude that desexualizing the exam is gendered and, in some contexts, sexualized. Using certain strategies bolsters stereotypes about gender and heterosexual relationships in the hospital. (shrink)

This paper is a demonstration of an application of Semiotic Textology to a limited case study. The main aspects of Semiotic Textology, the theory elaborated by Petöfi, are presented; secondly the linguistic aspects of the interpretation of lines 133–134 of the Theognis of Megara’s poem, analysed in the framework of said theory, are presented. All the relevant syntactic, semantic, pragmatic information involved in text processing have been considered. Through fixed steps, it is shown that text processing is not exclusively a (...) grammatical activity, because within a theoretical interpretation an Interpreter needs a number of contextual hypotheses, in order to understand the author’s ontology. All around the world in March, due to COVID-19, competitive sport calendars were suddenly canceled, jeopardizing the training programs of athletes. Moreover, in Italy, the government banned all non-essential travel across the entire country from the beginning of March. Consequently, Italian cyclists were banned from leaving their homes and therefore unable to perform their ordinary training activities. The Italian Association of Professional Cyclists early on during that period noticed that several cyclists were experiencing a worrying decrease in their mental well-being (...) and asked the authors to set up an online Sport Psychology Intervention during lockdown to enhance the athletes' mental health. Through a number of unprecedented events and considerations, the aim of the current investigation was to assess the Italian cyclists' mental health during the lockdown and its changes after the SPI. We validated the Italian version of the Sport Mental Health Continuum Short Form —presented in Study 1—and then applied it to a sample of Italian professional cyclists—presented in Study 2—prior to and after the SPI. To achieve these objectives, the reliability and construct validity of the Italian version of the Sport MHC-SF were tested in Study 1. RM-MANOVA tests were run to evaluate the effect of SPI on cyclists in Study 2. A total of 185 Italian athletes were involved in the validation of the MHC in Study 1 and 38 professional cyclists in Study 2. Results from Study 1 suggested a three-factor higher order model of Sport MHC-SF [Model fit: χ2 = 471.252, p < 0.000; CFI = 0.951; RMSEA = 0.049; RMR= 0.048]. MCFA showed that the default model kept invariance among groups of athletes. Results from Study 2 highlighted that professional cyclists who followed the SPI were able to cope better with psychological stressors, showing improved well-being compared to the athletes that did not. No significant differences were found for emotional and social well-being. The present multi-study paper contributes to the theoretical field with a validated measure of Sport MHC-SF translated in the Italian language and culture. It also provides practical implications related to cases of reduced mental health due to injury, illness, or similar situations of home confinement in the future. (shrink)
