Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. Autor prostredníctvom skúmania literárnych diel Charlesa Dickensa, Williama Makepeaca Thackeryho, George Eliotovej a Thomasa Hardyho vytvára mozaiku viktoriánskej morálky Anglicka 19. storočia. Dospel k záveru, že uvedená doba vôbec nebola taká puritánska, ako si ju zvykneme predstavovať a morálne problémy, ktoré ľudstvo rieši v priebehu svojho vývoja sú vo svojej podstate univerzálne, hoci nie totožné. Líšia sa vo svojich individuálnych podobách, v akých sa s nimi stretávame v jednotlivých obdobiach dejín ľudstva.

We make use of natural induction to propose, following John Ju Sakurai, a generalization of Bell's inequality for two spin s=n/2(n=1,2,...) particle systems in a singlet state. We have found that for any finite integer or half-integer spin Bell's inequality is violated when the terms in the inequality are calculated from a quantum mechanical point of view. In the final expression for this inequality the two members therein are expressed in terms of a single parameter θ. Violation occurs for θ (...) in some interval of the form (α,π/2) where α parameter becomes closer and closer to π/2, as the spin grows, that is, the greater the spin number the size of the interval in which violation occurs diminishes to zero. Bell's inequality is a relationship among observables that discriminates between Einstein's locality principle and the non-local point of view of orthodox quantum mechanics. So our conclusion may also be stated by saying that for large spin numbers the non-local and local points of view agree. (shrink)

The application of the state immunity doctrine with regard to the guarantee of access to court in the case-law of the European Court of Human Rights has been proved to be a complicated issue. In the ECHR’s case-law before the case Cudak v. Lithuania, the application of the state immunity doctrine had been considered as a proportionate restriction of the right of access to court even in cases of the realization of the protection of the jus cogens norm which was (...) very much criticized by the scholars of international law. Thus, the referral of the case Cudak v. Lithuania to the Grand Chamber could or should change the ECHR’s case-law in this sphere or at least develop certain criteria which would afford ground for a more effective protection to the right of access to court in cases of the application of the state immunity doctrine despite the fact that this right is not absolute. However, the case Cudak v. Lithuania has not fully satisfied these aims. Contrary, the case Cudak v. Lithuania left much obscurity, giving a strong indication that, what regards the realization of the right of access to court, the state immunity doctrine is more a material than a procedural ban, since the argumentation given by the ECHR in this case does not guarantee practical protection of this right. Ker nimamo avtorskih didaskalij, je celoten svet drame (vključno s psihično in materialno realnostjo) predstavljen izključno z besedami, ki jih govorijo dramski liki. Roman Ingarden imenuje takšen način predstavljanja shematična reprezentacija: na ta način predstavljeni predmeti so namreč samo skicirani, nešteta nedoločena mesta v njihovi predstavitvi vabijo bralca, da jih v procesu konkretizacije alirekonstrukcije zapolni z intelektualnimi in domišljijskimi operacijami in se pri tem opira na svoje znanje in izkušnje. Tako konkretizacijo kot rekonstrukcijo je treba ločevati od literarnega dela samega; (...) ker ju oblikuje bralec s svojo domišljijsko dejavnostjo, predstavljata oviro pri spoznavanju dela samega. Ingardnovo teorijo so kritizirali prav zaradi tega, ker daje bralcu preveč manevrskega prostora pri konstituiranju in tudi pri rekonstrukciji literarne umetnine (Ray, Kos, Holub, Calinescu). Zdi se, da te kritike temeljijo v nekoliko poenostavljenem razumevanju Ingardnove izredno kompleksne analize, v kateri se kaže, da je vloga bralca sicer omejena s tekstom, a vendarle vitalnega pomena za sekundarno eksistenco literarne umetnine. V članku so obravnavani neverbalni dejavniki motivacije v Sofoklovi tragediji; razdeljeni so v tri skupine: značajske poteze, dramska klima in čutne izkušnje. Članek se zaključi z analizo Odisejeve neverbalne motivacije v tragediji Ajant, ki predstavlja poseben primer, saj je tu odločilni dejavnik motivacije Odisejeva izkušnja numinoznega. (shrink)

V Heteronomiji umetnosti in avantgard se Aleš Erjavec ukvarja zlasti z radikalnimi politiziranimi avantgardami, se pravi s futurizmom in s konstruktivizmom, in tako nadaljuje svoje delo z začetka osemdesetih let 20. stoletja, ko je pričel svojo "ekspedicijo na severni pol človeškega duha". V pričujoči študiji so tako posebne pozornosti deležne radikalne avantgarde ter politična in ideološka vloga novejše umetnosti, še zlasti one z vzhoda. Nekateri vidijo v teh avantgardah skrajno obliko modernizma, drugi jih obravnavajo kot specifični vzhodnoevropski pojav, tretji pa (...) jih preprosto zreducirajo na njihove zahodne ekvivalente. Podobna ali celo še bolj neustrezna podoba spremlja postsocialistične avantgarde oziroma avantgarde tretje generacije. Te so bile imenovane nekonformistična in neuradna umetnost, vzhodni modernizem, konceptualna umetnost itd. Erjavec dokazuje, da se estetsko krilo teh avantgard v resnici navezuje na estetske avantgarde z začetka 20. stoletja, s čemer so klasične avantagarde s postsocializmom doživele svojo postmoderno ponovitev. In kakor avantgarde nenehno reflektirajo svoj odnos do siceršnje umetnosti, tako tudi estetika kot del filozofije reflektira svoj odnos do umetnosti in avantgarde, pa če ju dojemamo kot avtonomni ali heteronomni. V nadaljevanju obravnava novejšo zgodovino umetnosti in kulture v Vzhodni Evropi. (shrink)

Gregory Vlastos je v svoji znani rekonstrukciji argumenta »tritos anthropos« menil, da je regres tretjega človeka usodna napaka platonske teorije idej, saj vpeljuje najmanj dve protislovni logični značilnosti tega nauka: predpostavlja namreč dve načeli, samopripis in neistovetnost. Argument tretjega človeka zato obravnavam na podlagi upoštevanja omenjenih načel in njune veljavnosti v dveh inačicah, ki ju je podal Aleksander Afrodizijski. V prvi, ki je tradicionalno pripisana Aristotelu pod imenom O idejah in jo najdemo v Aleksandrovem komentarju k Metafiziki, in nato še (...) v Evdemovi inačici, kakršno domnevno ta navaja pri svoji aristotelski kritiki Platonove teorije idej. V drugem delu prispevka je narejena primerjava med Aristotelovima inačicama tretjega človeka in Platonovim pripoznanjem neskončnega regresa v obeh verzijah iz njegovega Parmenida: regres iz ideje velikega in regres iz idej kot vzorov, ki prav tako končujeta v neskončnem regresu novih idej: te po svojem bistvu ne bodo več ene, ampak brezmejno mnoge. Cieľom state je navrhnúť systematickú a vyčerpávajúcu klasifikáciu definícií. Táto klasifikácia vychádza z typológie, ktorú vypracoval Richard Robinson vo svojej knihe o definíciách, no v rôznych aspektoch ju ďalej dopracováva. Nová klasifikácia je založená na dvoch kritériách, a to kritériu predmetnosti a kritériu ilokučnej sily. Podľa kritéria predmetnosti možno definovať výrazy, pojmy, resp. objekty ; podľa kritéria ilokučnej sily možno zase rozlíšiť definície, ktoré opisujú existujúci systém, a definície, ktoré transformujú daný systém na nový systém. Napokon sa podľa týchto dvoch (...) kritérií vyhodnocujú niektoré známe druhy definícií. (shrink)

In his article Evgeny Borisov offers an original solution to Kripke’s sceptical problem of meaning. Its conceptual core is the point of view of the participant of speech acts. He believes that first-person statements of speech act participants like “I know for certain that the expression ‘e’ is used by me in the meaning of m” cannot carry any epistemic fallacies. As a criticism, I propose to point out that non-factual Cartesian semantics have serious epistemic flaws that make it vulnerable (...) to sceptical attacks and accusations of petitio principii. The paper deals with the questions of whether naturalization of ethical theory is possible and how radical it should be. The answer to these questions depends largely on the scientific explanations of the process of moral evaluation. The author concentrates on a moderate version of naturalization, which involves merely correcting the conclusions of normative ethics by appealing to scientific evidence. A good example of moderate naturalization is the project of debunking deontological moral principles of J. Green. From J. Green’s point (...) of view, the most important of such principles (“it is impermissible to harm other people as a means of achieving a utilitarian goal, but it is permissible to cause such harm as a side-effect of its achievement”) reflects the functioning of the emotional alarm system, which in the early ages of human history protected small groups from internal violence using contact means of harm. The means of harm have since expanded, but the inflexible emotional part of our psyche still dictates the limits of permissibility. This dictate has no reasonable grounds, and the abovementioned principle cannot claim to be objective and universal. The author shows that the data used by J. Green is different from the results of studies by Yu.I. Aleksandrov and K.R. Arutyunova on the impact of alcohol intoxication on making deontological and utilitarian moral evaluations. These results indicate that both the deontological and the utilitarian principles are partly based on the emotional subsystem. Accordingly, a normative ethicist is forced to choose as the scientific basis of his or her research some of the opposing scientific models that explain the process of making moral evaluations. Some of the models are consistent with the moderate naturalization project, others are not. The choice between models depends exclusively on already taken metaethical and normative preferences. The article shows that Borisov’s direct solution to the problem of skepticism about meaning using a special type of introspection is associated with the assumption of the agent’s direct access to their own consciousness. This assumption has two complicating consequences: the analogy with Moore’s paradox and the Platonic concept of meaning. It is also shown that direct access to meaning as a way of Borisov’s direct solution of the skeptical paradox significantly uses the performativity of the speech act, narrowing the (...) scope of analysis of the original problem. The little-studied problem of distinction in the analysis of the skeptical paradox of meaningful and formalized mathematics is noted. (shrink)

Članek obravnava Perelmanovo teorijo racionalne argumentacije z gledišča političnega diskurza in njegove vloge pri konstituciji skupnosti in njene identitete. V prvem delu analizirmo dve »formuli« komunikacije, kot ju ponujata politični diskurz in racionalna argumentacija, v luči pojmov homonimije in homologije, ki ju razumemo kot predpostavki za konsenz. V drugem delu pa obravnavamo etične in juridične implikacije Perelmanove konceptualizacije konsenza, pri čemer razkrijemo skrito platonovsko in aristotelovsko dediščino, ki postavi pod vprašaj Perelmanov poskus utemeljiti svojo »novo retoriko« v retorični in sofistični (...) tradiciji. Prispevek kritično obravnava znano Bobbievo tridelbo pravnega pozitivizma na pozitivizem kot splošni pristop k učenju prava, nauk o pravu in ideologijo. Avtor uvodoma opozori na nekaj problemov same tridelbe, nato pa se osredotoči na Bobbievo samoopredelitev znotraj nje. Na primeru Bobbieve obravnave pojmov temeljne norme in pravila priznavanja pokaže, kako ga njegovo kasnejše zavračanje teh dveh pojmov nezavedno privede do sprejemanja pravnega pozitivizma kot nauka o pravu in pravne ideologije – ki ju je sicer zavračal. Avtor vidi razlog za ta (...) nezavedni Bobbiev zdrs predvsem v njegovi vpetosti v specifično pravnokulturno okolje, ki ga prežema notranji pogled na pravo. Ob tem predlaga, da zavrnemo tridelbo pravnega pozitivizma in ga namesto tega proučujemo kot skupek ne vedno ločljivih stališč, ki tvorijo specifično pravnokulturno okolje. (shrink)

Pregledujem sedanje slepe ulice zahodne filozofije in predlagam nov začetek. V sedanjem trenutku prevladujejo tri najmočnejše pojmovne opcije; skepticizem, kognitivni privilegij in historicizem. Prvi je škandal, drugega zavračajo vse strani, tretji pa je trenutno dokaj zanemarjen. Historicizem ali zgodovinskost - pojem, daje mišljenje notranje historizirano, da je mišljenje zgodovina - je edini velik nov prispevek moderne filozofije k glavnim pojmovnim virom zahodne tradicije. Sodobna filozofija, posebno angloameriška analitična filozofija, je v bistvu nadaljevanje filozofije 17. stoletja in predkantovske filozofije 18. stoletja, (...) ki ju begajo »nepomembnosti« 19. stoletja; kontinentalna filozofija, v glavnem francoska in nemška, pa se je zdaj pripravljena prilagoditi ahistoricizmu analitične filozofije. Predlagam ponovno odkritje historicizma in prepoznam številne različne strategije, ki dajejo prednost taki politiki, za katero napovedujem, da bo še enkrat prišla na vrsto v naslednjem stoletju. Še posebej skrbno raziskujem vidike prve filozofije, zaprtih sistemov, rešitev problemov reference in predikacije, odnos med naravo in kulturo, odnos med realizmom in idealizmom in naravo ter funkcijo osebe ali sebstva. Ugotavljam, da se sodobna filozofija mora spoprijeti s prispevki Kantovega konstruktivizma in Heglove simbioze in iti preko obeh. Med dokazovanjem orišem splošno krivuljo zahodne filozofije vse do današnjih časov. (shrink)

»In vino metaphora« pomeni delno slavljenje Nietzschejevega preseganja nihi-lizma. Za afirmacijo življenja v voljo do moči kot izvoru vse dejavnosti, ki ustvarja vrednote se izkaže, da presega nihilizem, ki ga Nietzscheju pogosto očitajo njegovi kritiki. Ena od pomembnejših oblik volje do moči v tem smislu je intoksikacija ali dionizicno. V Nietzschejevem zgodnjem opusu je bilo dionizicno metafizično in umetniško načelo. Njegov kasnejši opus kontrastira dionizicno intoksikacijo z drugimi oblikami in dionizicno postane tako psihološki kot fiziološki pojav. Članek tudi primerja Nietzschejeve (...) poglede o intoksikaciji s pogledi Walter j a Benjamina ter ju obravnava v zvezi s pojavi kakršna sta rock glasba in severnoameriško izkustvo šestdesetih let.
