This study addresses the social aspect of the duty of pilgrimage through the documentation method based on sociological perspective. The aim of this paper is to determine the social gains of people through the pilgrimage. Religion is an phenomenon that people need in every aspect of their daily life. Because religion is one of the phenomenon that deeply affect the individual and society. The pilgrimage, which is one of the sociological expressions of religion, and maintains its existence in (...) the form of creed, worship and religious community, is instrumental in strengthening and consolidating the faith and feeling the feelings of brotherhood. For instance; spiritual fundamentals of integration are based on Quran by means of worships such as salaat, fasting and alms with the pilgrimage as well as the messages serving as guidance for socio-cultural integration. In accordance with this, worships, with its psychological effects, lead people to attain social aspects such as brotherhood, solidarity, protecting each other, enduring and overcoming distresses together, accomplishing societal sharing by meeting on the common ground of benefaction in the establishment and subsistence of the Islamic community. The pilgrimage, on that sense, is required to have its principal qualification once more in where the historical, social, political and economic issues of the Islamic world are discussed and solutions addressing such issues are delivered accordingly. Following modernization paradigm and some local dynamics conducive to development, some Asian countries emerged as economic tigers in the world. Conversely, other Asian countries including Bangladesh failed to taste economic development despite having monetary and technological aids from some developed nations. Drawing on some social and historical trajectories of the divergent contours of Asian development/ underdevelopment, the paper examines the state of development in Bangladesh. The study has found that Japan is the first country in Asia to achieve modernization, (...) and it was followed by other Asian tigers such as Korea, Taiwan, Singapore, Malaysia and currently China and India. We found that all these Asian tigers exert a developmental model which is characterized by ‘endogenous’ modernity and economic nationalism largely driven by, among other things, long-term economic vision and strong political leadership. While the history of Bangladesh has witnessed various cultural nationalisms, the nation has failed to generate any unified economic nationalism since its independence in 1971. We suggest that Bangladesh needs a long-term development vision—a key thrust for economic nationalism—focusing more on some socioeconomic and legal aspects that have historically become major impediments for development. Jainism is a religio-philosophical school of India which reacted against the Brahmanic/Vedic tradition and established as a school of thought. As a way of life it started as a Sramanic movement (the non-Brahmanic ascetic tradition) to attain the truth. Jains metaphysics and epistemology are purely logical and conducive for all. Jainism always is against the physical and psychological violence, and believes that it is the Ekanta (one sided view of reality) philosophy, which leads to violence. According to the Jains, Ekantavada (...) is a very rigid view, thus partial in nature. Any school asserting this claim for the absolute truth logically thus rejecting all the other views that basically leads towards dogmatism and in toleration; which further aggravated and leads toward violence. Mahavira as a champion of Ahimsa (nonviolence) carried out this concept from the domain of practical behaviour to the domain of intellectual and philosophical discussion. The Jaina principle of respect for the other life gave rise to the principle of respect for the views of others; thus they advocates Anekāntavāda. According to them, non-violence is the goal and Anekāntavāda becomes the tool. Its Syadvada is basically a logical inclusivity which accepts diversified aspects of truth. Consequently, it tells that a complete understanding of any truth requires the consideration and acceptance of a variety of viewpoints. This pluralistic view of the Jains is to be effective well to combat social violence and evils too. The world is in the pyramid of violence that can only entail massive destruction of this phenomenal world in any moment. I think, this pluralistic approach of Anekāntavāda is to be considered as the panacea to overcome all types of rigidities and bigotries of the present society as well. Islamic financial institutions (IFIs) are emerging as prominent players in the financial world and are increasingly known for their conservative socially responsible investment (SRI). Being the Shari'a regulators and monitors of IFIs, the Shari'a departments are expected to implement the Islamic perspective of SRI – drawn from Shari'a principles – in their respective institutions. The purpose of this paper is to develop an SRI framework applicable to IFIs and other Shari'a compliant entities and assess its applicability within Shari'a departments of (...) two Islamic banks. This paper involves cross-case analysis based on interviews with Shari'a department officials in two settings differentiated by their respective independence. The proposed framework consists of required, expected and desired SRI aspects as applicable to IFIs. The findings reveal that the required aspects are uniformly observed by the two cases. There are, however, variations when it comes to observing the expected and desired ethical SRI aspects that may be driven by the independence of the Shari'a boards. This inconsistency and non-adherence of expected and desired aspects may lead to reputational risks in the long run. (shrink)

To a student audience seduced by the claims of a ‘secular Christianity’, Professor Gordon Rupp once urged the combined loyalties of ‘worldmanship’ and ‘other-worldmanship’. The Muslim world shows little friendship to secularist ideologies which explicitly reject the eschatological dimension, but Muslims are increasingly involved in secularising processes; many of these are ‘Islamised’, if they are compatible with Islamic social or political ideals, and the stigma of bid‘ah , innovation, is thereby avoided. A Lebanese author, Muhammad Darwazah, in his Dustūr (...) al-Qur’ ānī , Cairo 1956, advocated a ‘Qur'ānic Constitution’ for the modern world since the Qur'ān’s world-view is both in-worldly and other-worldly: ‘Islam is a religion of the world , of government, society, morals and order, to the same extent as it is a religion of faith and belief and the next world .’. Islam as both religion and socioeconomic system is based on five main pillars, that is – five basic acts considered mandatory by Muslims, summarized in the hadith of Gabriel. One of them is zakāt (almsgiving), i.e. giving 2.5% of one’s wealth to the poor and needy. In contrary to Christian religion, where question of charity is rather of a voluntary matter, the role of zakāt in Islam is much more rigidly described. Almsgiving is considered as a duty of (...) a pious Muslim towards the poor. Thus in Islamic economy, strongly based on Islam principles given by Allah to Muhammad, zakāt is imposed by law and is not considered a charity but duty rather. The notion of zakāt is mentioned in Qur-an over a 100 times, solely or in conjunction with other commandments. On a basis that zakāt is to be paid as a part of total wealth exceeding given minimum wealth (nisab) it is then justifiable to say that zakāt is principally a tax. A role of this essay is to shed some light on a utilisation and role of zakāt in Islamic economies in socioeconomic context, with an example of Islamic Republic of Pakistan, where in 1980 the Zakāt Ordinance was imposed. The concept of zakāt is present in many Islamic countries, but its nature varies, being dependent from the interpretation of religious law in a given country. Everywhere though, its social role as an important tool maintaining social justice is strongly expressed. Of course zakāt system also has its drawbacks and is subjected to much criticism. Gendered Morality offers a textual-critical examination of gender in Islamic metaphysics and virtue ethics. Through a close reading of how masculinity and femininity are constructed, the book argues that the historically contingent nature of gender hierarchy, characterized as Islamic and ethical, is at odds with the overarching goal of Islamic ethics as earthly justice. Because the book moves beyond the typical Qur'anic and jurisprudence-based discourses about women's status, it makes a lasting contribution to our understanding of gender in the ethical (...) philosophy of Islam. Social and political scientists, historians and others, have put forward a number of widely differing views concerning the ‘character’ of Islamic millenarian and/or Mahdist movements in Africa. The same is true of course with regard to the opinions ofscholars concerning the transformative capacity of Islam as an ideology. In this paper I want to look at one aspect only of Islamic millenarianism in the West African context, viz. its allegedly revolutionary character.

As a fiqh (Islamic jurisprudence) term, the concept of “ignorance” ex-presses uncertainties in legal transactions and, in Islamic law, is accepted as a situation that negatively impacts the legitimacy of contracts. If the sale is deferred, clarification of the delivery time of the price to be paid for the goods sold, the number of installments, etc. during the contract is considered essential for the validity of the transactions in order not to damage the principle of mutual consent in purchase and (...) sale transactions and to avoid conflicts between the parties. However, not every uncertainty is considered an obstacle to the validity of the contract, and minor uncertainties that do not lead to disputes are tolerated. The fiqh sources of four Islamic sects contain many examples of these uncertainties. This study firstly examines the effect of ignorance on the validity of purchasing contracts in Islamic law using the issues in classical fiqh sources and then analyses the housing sales contract of TOKI’s (housing development administration of Turkey) “my first house social housing project” in this context from a fiqh perspective. In addition, the study addresses the related housing sales contract in terms of the juristic preference method by considering the aspect of meeting an important need of society and realizing the purpose of this project. Then, while evaluating the issue from a juris-prudential point of view, the study discusses that the absolute and strict interpretation of the rule of “ignorance renders the contract void,” which is adopted by ignoring the public interest, does not produce favorable results. This article presents the Islamic bioethical deliberation on the issue of sex assignment surgery for infants with disorders of sex development or intersexed as a case study. The main objective of this study is to present a different approach in assessing a biomedical issue within the medium of the Maqasid al-Shari’ah. Within the framework of the maqasidic scheme of benefits and harms, any practice where benefits are substantial is considered permissible, while those promoting harms are prohibited. The concept of Maqasid (...) al-Shari’ah which is the mechanistic interpretation of Qur’an and Hadith presents the holistic attention of Islam on many life activities, including healthcare. Indeed, this concept encompasses many aspects of worldly life, both for the human individual and collectively for the whole society. In healthcare, the practice of SAS on DSD newborns has presented an assortment of implications on the future livelihood of the affected individual. The process of decision-making seems to be very multifaceted since every element such as the determination of the ‘correct’ sex and the urgency of early surgery must consider the benefits and harms, as well as the child’s rights and best interest. The application of the concept of Maqasid al-Shari’ah, would convey a pragmatic approach that is often disregarded in Western medicine. This approach considers the right of the individual to live life optimally, individually and socially and practice his faith, precisely, in accordance with the assigned gender. (shrink)

On environmental protection and social conditions from Islamic perspctives in Indonesia.

Islam is a religion of vast dimensions which has inspired great civilizations and today offers many men and women comfort and ethical guidance. In this paper I suggest that the tension between the Qur'an accepted as the perfect timeless word of God and the encultured dynamic Islam of nearly a quarter of the world's population results in contending perspectives of women's role and rights. The Qur'an gives men and women spiritual parity, but there are verses in the Qur'an (...) that some feminists find difficult to reconcile with the modern rights of women. Most Islamic feminists make a clear distinction between cultural practices and the pure word of God. 1 There are profound differences in the status of women within and between predominantly Muslim countries. In some countries it is illegal for women to drive a car, or to move freely outside the home, in others women have become heads of state. The decision to wear the veil, often a sign of empowerment in Europe, is in parts of the Islamic world obligatory. Voices representing an exclusivist, literalist understanding of Islam have entered the mainstream of Muslim lives due in part to the fact that Wahhabism imposes a narrow, sectarian view of Islam, and the Saudi government with its massive oil wealth propagates this puritanical form of Islam across the world. Some traditionalist maulanas and maulvis are concerned above all with women's modesty and enforce customs that refine, purify and protect their chastity. They, like some Islamic feminists, position Islamic rights and roles for women with regard to the exoticized and eroticized `other' — in this case Western civilization, Western imperialism and the rise of Western feminism. `The West' becomes for traditional interpreters a kind of contemporary jahilya. There are also many progressive Muslim scholars who seek to articulate a historically accurate, non-idealized, now challenged, now challenging, view of Islam with an uncompromising emphasis on social justice, equality and pluralism. This paper argues that the ongoing, postcolonial battle against Western `imperialism' demands epistemological humility. Nevertheless, women are fighting for basic human rights and freedoms in parts of the Islamic world where the State, religious authorities and the patriarchal family assume the right of legal and moral surveillance. In considering the nature of violence to Muslim women in Pakistan and the UK, I hope to show that accusations of orientalism should not deter us from recognizing the courage of women activists who themselves risk imprisonment and of the struggle of women victims of rape and domestic violence to overcome feelings of shame and dishonour. I argue that both the private and public spheres need to be made safe for all Muslim women, and not just a professional elite. This can only be achieved by a fuller recognition of women's rights encapsulated in law and all aspects of public life. (shrink)

One of the contexts for the development of social capital and spiritual health is cultural capital. The relationship between religion as an independent variable and social capital as a dependent variable has been analysed. This article aims to analyse the role of cultural capital in the development of social capital and spiritual health from the perspective of religion and negative Islamic teachings. This study attempts to answer the question, 'what is the role of cultural capital on the (...) development of social capital and spiritual health from the perspective of negative Islamic teachings?' In this article, an attempt has been made to compare the negative aspect of education in the form of the Qur'anic concept of 'cultivation', with its positive aspect in terms of principles, approach and method, in order to return to the model arising from Qur'anic and mystical teachings. The research method is descriptive and analytical, and data processing is interpretive and critical. Data collection has been performed utilising documentary and library study methods. The research findings demonstrate that 'ethics, science, values, norms, rituals and art' are the most important elements of embodied cultural capital, which are effective in the development of social capital. CONTRIBUTION: Therefore, there is a substantial relationship between religion, negative Islamic teachings, the development of embodied cultural capital and the development of social capital and spiritual health. Sayyid Qutb, executed in 1966 by the Egyptian government but still broadly influential today, was deeply convinced that Islam provides an ideal framework for all of human existence individual and social, political and economic, intellectual and spiritual. In recent years, researchers have paid special attention to religiosity and the practice of religious beliefs. If people put religiosity at the forefront of their affairs and maintain the roots of religion in various aspects of work and family life, they will see God present and watchful in doing all things, and the result of such a vision will be the successful performance of deeds and walking the path of perfection. Having a heartfelt belief in the value of work (...) and adhering to it will result in a greater desire to work. Religiosity is a variable that can be related to job variables. In addition, it can play an important role in the behaviours of employees. In Islam, work is a virtue and is necessary to balance the personal and social life of the individual. Given the importance of this issue, the present study aimed to evaluate the relationship between Islamic religiosity and job satisfaction of Muslim teachers in Malaysia. In total, 2200 Muslim teachers of Kuala Lumpur and Penang were selected for the study by simple random sampling. Data were collected by using standard questionnaires and analysed by Pearson's correlation coefficient in Statistical Package for the Social Sciences (SPSS). According to the results, there was a significant and positive relationship between teachers' Islamic religiosity and job satisfaction as P = 0.784 and T = 0.000 which was less than the Sig level of 0.05. CONTRIBUTION: According to Islamic teachings, working for a Muslim is like worship. Based on the findings of this research, teachers with higher Islamic religiosity enjoy higher job satisfaction. Indonesia has received Islam over the past millennium During this period, Islam has intermingled in varying degrees with Buddhism, Hinduism, and indigenous animism in different parts of the archipelago. Consequently, beliefs and practices diverge. Nevertheless, Islam has an overwhelming if diverse presence in Indonesia. There exists a limited pluralist model of regulating or `managing' religious diversity in contemporary Europe. This pluralist model, however, is in contrast to the limitations that appear at the state level, which reflect an increasingly illiberal, secular Europe. Such contrast stems historically from tensions that exist between the national and transnational aspects of the model itself, but it also reflects the emerging debates on religious pluralism and the democratic state. With the settlement of post-colonial migrants (with Muslims constituting a (...) large majority) a public debate on the role of religion in Europe has resurfaced as these communities exist outside the historical formation of Western church-state relations and are challenging the very underpinning of what comprises a `liberal' democratic state. In particular, it is the role of Islam in secular Europe that frames several questions in this debate: to what extent is it necessary to regulate religious freedoms in the `public sphere' in order to protect the democratic state? What restrictions on minority religions should be considered `necessary in a democratic society’ and what limitations should be placed on state interference in minority religions as protection against the undue influence of a dominant social group? Against this backdrop, this article explores the historical social formation of religious pluralism in the European context and examines the legal and political frameworks at the national and regional levels to `regulate' diversity. This book offers the first comprehensive introduction to one of the most significant Arab thinkers of the late 20th century and the early 21st century: the Moroccan philosopher and social theorist Mohammed Abed al-Jabri. Eco-Islam is often discussed from a theological perspective, but there are hardly any studies on the activist’s practices, their experiences and reasoning. In order to fill this gap and to emphasise the importance of studying lived religion, this article presents three interviews with young Eco-Islam activists in Germany. By using the method of cultural analysis, the author compares, summarises and abstracts their statements and activities, so that a comprehensive configuration is revealed. Cultural analysis focuses on cultural constellations and (...) tries to think historical, social and biographical components together. To understand the Eco-Islam activist’s perspectives at a deeper cultural level, the author firstly represents a thick description of the statements and activities of her three respondents. Afterwards, she scrutinises the actors’ practices and processes by applying the dimensions of belief, practice and community on their everyday life and performative action. At last she filters three related themes on a cultural constellational level. Contribution: In this article, the author simultaneously highlights the implicit connections of eco-Islamic Activism to aspects of Othering and empowerment, aspects of (re-) interpretation of religious norms and aspects of transgressing environmental activism and the idea of an Islamic community. Basic characteristic of Islamic heritage law, principally it has accepted the two-to-one ratio between the male and the female children/siblings in division of heritage. In Islamic inheritance law, the main/basic reason why the share of the male is twice the share of the female is no “value” judgments given to female/women in creation and gender in Islam, on the contrary, are real realities related with the roles and financial obligations that man and woman have undertaken, in other words, related (...) with “socio-economic structure/fact” in the family and society structure foreseen by Islam. As a matter of fact, “need principle” is based on in division and succession of heritageand a fair arrangement has been made in accordance with the rights and responsibilities of the husband and wife in Islamic Law. In some classical tafsīr books, the concept of “degree” in the verse “... Men have a degree (right) over women” (Al-Baqara 2/228) mentioning the mutual rights and responsibilities of women and men; and the expression of “lil al-dhakari mithlu haẓẓ al-unthayain” in the verse –the inheritance of man is the share of two women– (Al-Nisā 4/11) mentioning the inheritance shares of boys and girls is interpreted against the woman by disregarding the intended purpose and socio-economic contexts of these verses. As a result of this interpretation, the share of men in inheritance is twice the share of women in Islamic law is ontologically (existential/creation) based on a justification that “man is superior to woman”. In this article/study, an analyticallook atthe interpretations in some classical tafsīr books on the axis of “daraja/degree” and “lil al-dhakari mithlu haẓẓ al-unthayain” that today sheds light on the sociological-historical background of depriving the daughter from the heritage will be made. Summary: Just as there is no way to determine a person’s sex, it is not either possible by reason to have such an opportunity. - With the possibility of medical intervention nowadays - sex is determined by the discretion of the Supreme Creator rather than will. Indeed, it is mentioned in the Qur’ān: To Allah belongs the dominion of the heavens and the earth; He creates what he wills. He gives to whom He wills female [children], and He gives to whom He wills males (Al-Shūrā 42/49.)In addition to human biological sex, there is also social gender. Indeed, the term “sex” refers to being biologically female or male, while the term "gender" refers to the social and cultural identity of a woman or man, or the social roles that occur in the historical process.Accordingly, while it is not possible to determine biological sex (in normal circumstances in advance), determining gender is shaped by the cultural will of individuals and societies. As a matter of fact, gender is shaped according to the religions, customs and cultures of the societies and it shows differences according to time, culture and family structure. In this context, in the pre-Islamic Arab society, the gender of the girl or the woman was shaped by the custom of the ritual and customs. Indeed, it is a known fact that during the period of Jahiliyyah, in terms of social gender, the girl/woman has been deprived of many social and economic rights, especially heritage. The Qur’ān has brought the girls who, in the period of Jahiliyyah, were oppressed in terms of gender, deprived of many social and economical rights, treated as second class human, embarrassed of themselves and buried alive, to the same position as man. In this context, as it is in every field in the direction of social structure and social conditions of that day, also in the field of inheritance law, a number of regulations were made in the Qur’ān and the Sunnah being the main sources of Islam. The divisions of the inheritance were connected with religious and legal rules and the shares of the inheritance of the sons and daughters were determined by naṣṣ (verses and hadiths).However, in Islamic inheritance law, as a requirement of the structure of family and society accepted by Islam, in principle, “two-to-one” measures have been adopted between male and female children. As a matter of fact, in this aspect, it is mentioned in the Qur’ān: Allah instructs you concerning your children: for the male, what is equal to the share of two females (Al-Nisā 4/11.)On one hand, the principle that Islamic law brings between boys and girls; Seems to be an inequality in terms of the arrangement in which "the inheritance share of the male child is twice the share of the female child", while on the other hand, within the border of in the family foreseen by Islam, this regulation has not been seen as an injustice and inequity by Muslim societies, because in Islamic family law, a man is obliged to ensure the livelihood of the family after marriage. He is also obliged to give his wife her mahr when marrying.In Islamic inheritance law, “necessity principle” is taken as the basis of responsibility that women and man have undertaken in family and society. Therefore, even though giving nothing at all to those who are not in need and giving less to those who are in less need, giving too much to those who are in much need might seem contrary to the principle of equality, it is a necessity of the principle of justice and fairness. As a matter of fact, while "law equality, necessity in sharing" principle, law is arranged according to people's qualifications, goods and wealth sharing is divided according to the needs of people. In this context, there has been a fair division in Islamic heritage law based on the necessity, (distributive) justice and fairness principle. Indeed, the French philosopher Roger Garaudy (1913-2012), who chose /converted to Islam, evaluates the following about the proportion of male child in the Qur'an to that of female child: “When we consider that in the Arab society all the obligations of the family and of the care of the parents and of all the things that we call ‘social security’ today are put on the shoulders of the husband, the hereditary male child's share must be twice as high as the female child’s is”.As Garaudy argues, the difference in the inheritance of women and men in Islamic inheritance law is not a legal discrimination/inequality, but a form of divisiveness stemming from a need based on the role and responsibility that women and men have undertaken in the family and society. Therefore, giving nothing to those who need nothing, giving little to those who need little, and giving a lot to those who need a lot,even though may seem contradictious to the principle of equality, it becomes a necessity of equity and (distributive) justice principle. In this case, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child, is social and economic reasons and it is possible to rank them as follows:1) According to Islamic law, women are not obliged to make their own economic livelihoods. The woman’s economic responsibility belongs to her father or brothers before marriage, and then to her husband after marriage. 2) When a woman is married she is not responsible for herself or other family members’ livelihood. The male is obliged to make a living for himself, his wife and his children.3) While married, the male is obliged to give the wife mahr. The woman has no such responsibility.As it is understood from the above explanations, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child is not about the ontologically “value” based on creation and sex given to the woman (girl child) in Islam. On the contrary, it is the real facts concerning the family and society structure that Islam predicts, the roles and financial obligations that man and woman have undertaken, namely “socio-economic structure/fact”.In some commentaries in classical commentary books, the rights and responsibilities of women and men are referred to, like: the word “degree” mentioned in: …but the men have a degree over them [in responsibility and authority (Al-Baqara 2/228), and the talk about the inheritance shares of boys and girls in: for the male, what is equal to the share of two females (Al-Nisā 4/11). Eventually, the concepts “lil al-dhakari mithlu haẓẓ al-unthayain” have been associated with the gender of the woman/girl child ontologically (based on social fact) by ignoring the referent purpose and socio-economic contexts of these verses. As a result of these interpretations, it was desired that the Islamic law principle of inheritance share of male child being twice the share of female child, ontologically, should be based on a justification that “man is superior to woman”.In this study, some of the era’s dominant culture classical interpretations grounding women's inheritances share on her gender and based on the axis of the concepts of "degree" and “lil al-dhakari mithlu haẓẓ al-unthayain” in the related verses of the Qur'ān will be elaborated. The basic resources of the Islamic Society are generally the Qur'an, the Sunnah, the mind, science and culture. The Islamic society that emerged with the migration of Muhammad from Mecca to Medina in 622 was the beginning of a new civilization. This civilization has created a society based on the unity of belief, which goes beyond the principles of language, color, race, geography, blood ties and nationality. According to the French-born Muslim philosopher Roger Garaudy, this society had a very different, (...) universal and transcendent character than the previous ones. Because the principles of the Arab society from which the prophet came, on the contrary, were based on the principles of tribe, cognate and nationality. While this society was based on the rich-poor, male-female, slave-master and black-white distinctions, the Islamic society abolished all these distinctions and was based on the principles of equality, justice, right, law and piety. The purpose of this society, which is the dual aspect of the Islamic society, which is based on the material and spiritual aspects of the Islamic religion, which is based on happiness in both the world and the hereafter, is to order goodness and prevent evil. Thus, the civilization in question both strengthened its own social structure and contributed to world peace. Garaudy opposes those who say that the Islamic civilization is not original but a product of collection and imitation, and says that this civilization is original and noble and its source is based on revelation. It is a region where great civilizations that left their mark on history such as Sassanid, Byzantine, Mesopotamian, African, Indian and Chinese civilizations were influential in the geography where Islamic civilization spread. While Garaudy attributes the reasons for the collapse of this great civilization, which dominated three continents, to the loss of its lively and dynamic character, he also lists some other reasons. He stated that the most important of these are sectarian bigotry and Muslims' distancing from understanding the Qur'an. According to him, the Qur'an is not a book that addresses only the seventh century. He says that the Qur'an addresses every age on its own terms. During the periods when this address of the divine revelation was fully understood, the Islamic society saw peaks in many areas. For example, during the Andalusian Umayyads, Islamic civilization rose to the position of the most developed country in the world. But when it moved away from its main sources, the decline started and the Islamic civilization went into a collapse. (shrink)

Created as a social being, human beings communicate and interact with other people in society. Their economic activities are also part of this communication.Transactions such as shopping and lending are also an element of the economy. Troughout history, legal systems have laid down rules regulating these activities,and imposed orders and prohibitions. Studies comparing Islamic and Jewish legal systems, which originated from revelation and still applied by their followers, are less than those made in terms of the history of religions. (...) The aim of this study is to contribute to the comperative studies in the field of law by examining the similar and differente aspects of both legal systems in terms of contractual contract. It has been determined that there are more similarities in the provisions of Islamic law and Jewish law regarding the issue of lending. The fact that the sources of these two legal systems are the same is the most natural reason for similarity.The differences are due to the interpretations of the Jews that changed religious rules in order to ensure harmony between the law and the life conditions that changed over time. Can democracy be at once radical and Islamic? In this paper I argue that it can. My argument is based on a comparison and contrast of certain aspects in the social-political thought of two contemporary authors: Axel Honneth who defends a particular conception of radical democracy, and Rached al-Ghannouchi who defends a particular conception of the Islamic state. I begin with Honneth’s early articulation of his model of radical democracy as reflexive cooperation, which he presents as an alternative (...) that reconciles Arendtian republicanism and Habermasian proceduralism while avoiding their weaknesses. I also refer to his more mature conception of democracy by way of highlighting his understanding of democracy as a process of constituting civil society. This is significant for the purposes of this paper since it forms the most important link between Honneth’s radical democracy and Ghannouchi’s Islamic model of political rule. I then introduce Ghannouchi’s theoretical account of the Islamic state with a focus on his conception of shura (consultation) in order to bring to the fore both the similarities and dissimilarities with Honneth’s theory of democracy. By this point I will have identified Islamic resources for a conception of democracy that, like Honneth’s democracy as reflexive cooperation, shares with proceduralism an instrumental view of democratic procedures, and with republicanism a strong connection between the pre-political social level and politics. Next, I ask whether this conception of radical Islamic democracy can square its dual commitment to pluralism and Islamic unity. Again, I draw on Ghannouchi’s thought to respond to the challenge, doing so in a way that brings out the agonistic dimension in radical Islamic democracy. I conclude by making explicit how radical Islamic democracy carves out a conceptual space in which proceduralist, republican and agonistic features are combined. (shrink)

It is social secularization that has become one of the main forces that has shaped the modern image of Europe. Secularization has affirmed the secular spirit inherent in modern man. Therefore, we Europeans now live in a secularized society. This is manifested in the fact that the appeal of citizens to God, the scale of appeals to religious (...) interpretation in finding out different aspects of reality, the participation of religious institutions in solving life's problems of society and personality are significantly reduced. The language of religion and its concepts are increasingly distant from everyday experience. There is less and less mutual space between the life of the modern world and church preaching. The focus of this paper is on the network aspect of Islamic movements, i.e. what networks are, what their structure is and what some of their properties are. The discussion focuses on scale-free networks, their properties and networks value expressed in social capital and formulated in the Strength of Weak Ties theory by Granovetter. Al-Qaeda has been the most frequent reference in the research on the transnational Islamic networks, so somewhat unintentionally al-Qaeda’s example often appears in this paper as (...) well. Within Muslim communities, the ‘ulama are considered the most crucial corporate social agency that drives the ideological and spiritual energy to the members of the society who find religious teachings necessary for their individual and social, if not always political, lives. However, when the ‘ulama of Bangladesh gathered under the umbrella platform of Hefazat-e-Islam in 2010, agitated by the numerous upheavals of the government’s policies, scholars and members of the civil society often dubbed them as regressive, reactionary, (...) and insensitive to modern changes. While anthropologists have challenged this dichotomy, this article aims to understand the HI ‘ulama’s views on modern changes and how the ‘ulama safeguard the traditional integrity in legal, educational, and gender aspects within the domain of the Bangladeshi state mechanism. Based on anthropological notions of tradition and piety, this article argues that the ‘ulama’s position on education, woman, and legal questions is neither monolithic nor static; rather there is always discussion, debate, and dynamism within the ‘ulama itself. This paper examines the issue of Islamic political philosophy in terms of prophecy, revelation and divine law. It is important to note that philosophy, and Islamic politics are in a good relation with religion. In the present study I have developed this connection through the philosophical theories of the medieval philosopher Al-Farabi. What are the differences and similarities between philosophy and divine law, or between a philosopher and prophet? What are Al-Farabi’s most important political theories and what are the concepts (...) of virtuous city and democratic city? What is the philosophy of the Quran? Our study seeks to answer all this questions. The divine law sets the beliefs and actions of the Islamic community, while the theoretical aspects which relate to it are entrusted to the philosophers. Theology is a discipline which protects divine law and establishes the truth of a special revelation, political theology being complementary to political philosophy. Theology tries to develop a rational and coherent understanding of the divine law, to find out what is the prophecy and to differentiate the true prophets from the false ones. (shrink)

Turkish Islamic leader Fethullah Gülen offers a distinctive view of responsibility, which is explored here for the first time. Simon Robinson shows how Gülen's writings, influenced by both orthodox Islam and the Sufi tradition, contribute a dynamic, holistic and interactive view of responsibility which locates personal identity, agency and freedom in plural relationships. The Spirituality of Responsibility also explores the practice of responsibility in Gülen's life and in the Hizmet movement which he founded. Gülen has been at the centre (...) of many controversies, including in his Movement's relationship with the Turkish government. Charting Gülen's response, from the Israeli Gaza blockade through to more recent crises, the book critiques aspects of both this practice and underlying ideas, and argues that responsibility, focused in dialogue and peace-building, is continuing to evolve in the leadership and practice of the movement, providing a challenge to conventional views of governance and responsibility. This book is an important contribution both to the theological and philosophical debate about responsibility but also to the practice of responsibility focused in creative action, debates in business and contemporary society about responsible governance and enterprise. This paper examines the contribution of sociology to the Islamic proselytization. In the context of epistemology, it has the opportunity to develop based on five aspects: factors, systems, interpretative, developmentalism and participatory. The five principles can be developed based on sociological theories. Among these theories, for example are the phenomenology of Islamic proselytization, the social construction of Islamic proselytization, dramaturgy of Islamic proselytization, hermeneutics of Islamic proselytization, communicative acts of Islamic proselytization, and ethnomethodology of Islamic proselytization. Through a (...) sociological approach, the Islamic proselytization will be able to develop more quickly. In further, it can be said that the inclusion of social science is a form of pattern of science development based on the integration of science, namely the phenomenon of Islamic proselytization as an object of study and utilizing other sciences as an approach. ABSTRACT An important aspect of the nineteenth century debate on the relationship between science and religion concerned the popularity of deterministic views among scientists. An integral part of Comte's positivism, the idea of immutable laws that determined natural and social phenomena became an increasingly prevalent component of scientific perspectives in the Darwinian era. Referring to this tendency as ‘scientific fatalism,’ critics likened it to Calvinist predestination, which transformed the debate into one involving polemics about different branches of Christianity as (...) well. This paper focuses on a neglected aspect of this debate, namely, the role that references to Islam and Turks played in it. ‘Mohammedan fatalism,’ already a common theme in justifications of colonialism, promptly became a tool with which to condemn new scientific views. Comparing French, British, and American writings on the topic, the paper illustrates that while there emerged approaches that praised the fatalism of Muslims while making a case for scientific determinism, most scientists and thinkers resorted to condemning the fatalism of Muslims in order to distinguish their views from it. In this respect, the paper demonstrates how political and religious discourses played a significant part in the shaping of scientific discourse in the Victorian era. (shrink)

The paper explores the role and meaning of maṣlaḥa and its possible appropriation in the field of Islamic legal and economic thought, as laid down by various medieval and contemporary Muslim scholars. Questions that are pertinent to the research are the following: how has maṣlaḥa been incorporated in legal reasoning and what kind of meaning does it convey; what type of economic reading does it presuppose; do ethics, law, and scriptural sources play equally important role as reference in developing the (...) concept in economic terms, are some of the questions that this paper will try to provide answer to. Further, as there is a tendency to believe that Islamic economic thought cannot be equated only with legal and juridical underpinnings, it is pertinent to pose a question if economic ideas have flourished independently from its legal framework. Maṣlaḥa in its capacity has always remained part and parcel of Islamic legal theory, and has been rarely addressed within the frame of economic thought; therefore a new reading is required to deal with the position of economic teachings within Islamic tradition. The paper consists of three sections, whereby the contributions made by Muslim medieval scholars on Islamic economics will be presented. The first chapter provides a historical overview of Islamic law and the concept of maṣlaḥa in relation to the field of Islamic economics, including Abu Hamid al-Ghazali’s monumental Iḥya ‘ulūm al dīn, which presents a milestone in converging Sufi ethical teachings of Islam in accordance with the legal methodology of Islamic law. The second part aims to discern and examine the economic jurisprudence and economic theory in Islam as it is understood by some of the mainstream theoreticians of Islamic studies, advocating the view that Islamic economics is inextricably related to the gist of Islamic legal reasoning. In this section the ideas of Muhammad Baqr al-Sadr will be presented as he proposes a new reading of Islamic economics as a doctrine and not a science. The third part questions Islamic legal establishment and its normativity, the claim that legal norms have always been part of the Islamic economic reasoning. This claim rests upon the idea that Islamic legal patterns were also socially constructed, including some aspects of Islamic economic reasoning. Concluding remarks will draw upon the idea that despite the fact that Islamic legal and economic literature are based upon the religious scriptures of Islam, the Qur’an and Tradition, it is more appropriate to claim that they rest upon the ethical cosmology that surpasses purely theological concerns. Like other Arab countries, Jordan must find ways of responding to the rapid processes of change affecting many aspects of social life. This is particularly urgent in healthcare, where social and technical change is often manifested in tensions about ethical decision-making in the clinic. To explore the attitudes, beliefs and concerns relating to ethical decision-making among health professionals in Jordanian hospitals, a qualitative study was conducted involving face-to-face interviews with medical personnel in four hospitals in Amman, the (...) capital of Jordan. Data were analysed thematically in relation to a pre-existing set of ethical categories. Interviews were conducted with thirty-eight doctors covering most medical specialities. Five major themes emerged from the interviews: ethical awareness, ethical issues, the impact of religion on ethical decision-making, practical and theoretical resources for ethical decision-making, and challenges. While uncertainty was expressed about some aspects of Western approaches to ethics, participants strongly supported adoption of a range of Western bioethical principles, including cultural and ethical diversity, along with adherence to Islamic religious norms. A range of serious ethical challenges facing the Jordanian health system were identified, covering social, legal, managerial, and technical issues. Ethical decision-making in Jordan is complex, having to accommodate the needs of patients, the opinions of doctors and their families, the views of religious authorities, managerial considerations, and both local norms and international standards. Health professionals struggle with three sets of tensions that emerge out of the struggle between traditional, community-embedded forms of social organization and the demands generated by globalization and the influence of Western culture: the tensions between tradition and modernity, conservatism and pragmatism, and religion and secularism. Doctors in Jordan prefer approaches to ethical decision-making that realize a balance between the extremes, although the exact nature of where that balance should lie remains uncertain. (shrink)

This article presents a close reading of Ibn ʿAsākir’s biography of ʿUmar II in the Tārīkh madīnat Dimashq. Although there was an earlier and substantial historiographical tradition, Ibn ʿAsākir’s biography is distinct from those of his predecessors in two major ways. First, he strategically arranged his biography to emphasize or de-emphasize certain aspects of ʿUmar II’s life, including his youth, rise to the caliphate, and reputation as a redeemer. Second, Ibn ʿAsākir’s legitimizing historiography appears to be bi-directional. Namely, where (...) earlier biographers depicted ʿUmar II as the “fifth of the Rāshidūn,” bolstering the later Umayyad’s reputation through an association with earlier authorities, in Ibn ʿAsākir’s account problematic aspects of the early civil wars and fitna-ridden Rāshidūn period are also elided through the Rāshidūn’s association with the famously pious ʿUmar II. The context for this bi-directionality is to be found in the political and social environment in which Ibn ʿAsākir compiled his Tārīkh, where dual pressure from Crusader and Shiʿite opponents contributed to his articulation of a particular Sunni vision of political and religious continuity that relied heavily on ‘Umar II’s unique persona. This article aims to evaluate the types of customary marriage, the reasons that paved the way for its spread, the sociological approach of the people with statistical data, and the evaluation in terms of Islamic Fiqh (jurisprudence). In the study, it has been tried to reach the right result by considering the social reasons and legal norms together. In order to correctly evaluate people's orientation to customary marriage, statistical data was used in the study, thus it was aimed to (...) reveal the sociological dimension of the research. In the research, firstly, the definition of the concept of marriage, its elements, conditions and types were briefly explained and the conceptual, legal framework and imagination of marriage were drawn. Thus, the main concepts and norms in which the customary marriage will be evaluated and compared have been put forward. Afterwards, the definition of customary marriage, which is the main subject of the study, its types, the countries where it is spreading, statistical data, the reasons that paved the way for its emergence, and Islamic Fiqh from the classical to the present were made. As a result, customary marriage was performed in three different ways, two of which were permissible, one was not; It has been determined that the applicants for this wedding are generally those who want to have more than one marriage and the university students. It has been seen that this customary marriage has some positive and negative consequences, and those who look at its positive aspects are allowed, while those who consider its negative aspects are not. However, from the classical period to the present, it has been determined that it is permissible for the public to hide the two-witness marriage on the grounds that it fulfills the condition of announcement, even if it is demanded from the witness. Women are more visible in economic and public life than before. This visibility has led to a change in the social perspective towards women in recent centuries. Some provisions regarding women, which are generally accepted in classical fiqh teachings, have started to be discussed again. It has also started to be seen that the existence of different perspectives has emerged within these discussions. The issue of the amount of the victim's diya, which is included in the field of Islamic (...) criminal law, is one of the issues that has been discussed on a different ground recently in this context. The view that the diya penalty of a woman is half of that of a man has been generally accepted and practiced since the early periods of Islam. However, the issue, which has come to the agenda again with the conferences and articles written recently, has formed the basis of heated disputes. Considering the importance of the legal aspect of the subject, it is aimed to deal with the issue in detail in this study. Then, the evidences of the critical view that "the diya of a woman is the same as that of a man" will be explained. Finally, the points of disagreement on the subject will be determined, and a result will be tried to be reached by considering the opinions and evidences mentioned in the general framework. (shrink)

Lifestyle refers to a set of personal and group behaviours related to normative and semantic aspects of social life. Any coherent set of behavioural patterns derived from religious teachings that exist in life can be considered a religious lifestyle. Considering that the dominant religion in Jordan is Islam, the present study focused on the Islamic lifestyle. In addition, given that the correct relationship between couples has been compared to life-giving blood in marriage, and since the quality of (...) marital role plays a determining role, the existence of communication skills in any of the couples can generate satisfaction and compatibility, whereas lack of awareness of these skills could cause misunderstandings and tension. Therefore, the current study aims to study the role of the Islamic lifestyle in communication skills of 250 Muslim couples of Jordan (Amman, Zarqa and Irbid) in 2022. Data were collected using questionnaires during four months, and the validity and reliability was confirmed. In addition, data analysis was performed in Statistical Package for Social Sciences (SPSS) and Linear Structural Relations (LISREL) using mean tests and structural equation modelling. According to the results, Islamic lifestyle had a positive, significant effect on the improvement of communication skills in Muslim couples in Jordan (P-value: 0.76; T-value: 7.92). Therefore, it is recommended that more attention should be paid to this issue by families, researchers and cultural authorities in the country.Contribution: Our findings revealed that Islamic lifestyle improved communication skills in Muslim couples, which demands special attention. By adhering to the Islamic lifestyle, couples can influence each other’s knowledge, emotions, education and growth, and try to have a realistic understanding of each other’s desires, needs, living environment and perceptions that each has in life issues. Furthermore, they can organise their role in the common life in appropriate ways to prevent problems and solve them in the event of problems. (shrink)

This paper examines the proposition that adopting a socially responsible, or philanthropic, management posture is not antithetic to the capitalist business model but rather can be seen as a sound approach to the development of long-term sustainability in business in a modern business environment, wherein a strand of corporate social responsibility is one core aspect of the composite utility function of the modern business. We suggest further that for many of the prominent/significant examples of the successful adoption of a (...) policy of informed benevolence in the management of employees that policy seems to be faith rooted – be that faith Christian, Buddhist, Jewish, Muslim or other. Indeed, even if one observed an organisation subject to an humanist or even atheistic based socially responsible management, one could see that as being rooted in that organisation’s ‘non-faith’ faith, or ethical bubble. Our argument also gives the lie to the proposition, in currency in some circles, that the term ‘business ethics’ is an oxymoron. To underpin the argument we cite examples (/set out mini-cases, or a mixture of these) from a range of faith based traditions including, Buddhism, the Quaker-Christian tradition, Judaism and Islam. Muslim legal culture is becoming more relevant to modern Ukraine, which can be explained, on the one hand, by the nature of Islam and, on the other, by the peculiarities of its current state in our country. After all, the internal logic of Islam, as a universal system that encompasses both religious and secular life, as one of the components of the awakening of Islam, involves recourse to Sharia, a strict adherence to which is an unmistakable criterion (...) for Muslims of deep religious faith. On the other hand, in addition to religious revival, in the lives of Muslims, social and economic, political, national and cultural problems need to be addressed and secular. This study aimed to analyse the contribution of infaq funds to the social and economic resilience of the community during the COVID-19 pandemic in West Papua, Indonesia. This study uses a mixed-method approach, combining qualitative and quantitative studies. Qualitative data were collected through focus group discussions with administrators, Dai [Islamic preacher] and mosque congregations to obtain information about the form and mechanism for disbursing infaq funds. Furthermore, the state of distribution of infaq funds is confirmed to the recipient community (...) with an online survey as quantitative data. The data obtained were tabulated and analysed with descriptive and inferential statistics using multiple linear regression assisted by SPSS software 25 version. The research findings show that: firstly, the form of the social-economic contribution of infaq funds is carried out by: (1) financial assistance, (2) social assistance, and (3) health assistance. Secondly, infaq, an instrument of Islamic economics, can contribute to tackling the social and economic impacts of the community amid the COVID-19 outbreak. Thirdly, of the three forms of assistance provided, the health assistance aspect contributed 38.320%, the financial assistance aspect amounted to 37.173% and 24.339% to social assistance. This study shows that the community most needed health and financial assistance from infaq funds during the COVID-19 pandemic.Contribution: This study complements the existing literature and provides a new scientific treasure. That the infaq fund, as a philanthropy, turned out to be able to contribute to realising the social-economic resilience of the community during a disease outbreak. The form of health, financial and social assistance from infaq funds is a priority in accelerating the community’s economic recovery. It can be a countermeasure to socio-economic impacts during disasters and disease outbreaks. (shrink)

The article examines the socio-political aspect of the new atheism. Within the framework of this phenomenon, initially associated with the four bestselling authors R. Dawkins, S. Harris, K. Hitchens, D. Dennett, who launched the “fight against religion” in the mid-2000s, a community and a weakly organized movement eventually formed. A number of connected questions are considered: characteristics of the phenomenon of new atheism (origins, sources, specifics); perception of atheism and new atheism by society in the USA and Great Britain; political (...) views of key figures of the new atheism, external assess­ment of their political influence; views and activity of supporters, external assessment of the socio-political influence of the movement. The article focuses on the aspects of the new atheism as a movement in the USA and the UK. The author comes to the fol­lowing conclusions: the “creators” of the new atheism scarcely touch upon the socio-po­litical agenda in their activities (the main foreign policy interest is the fight against Is­lamic terrorism); currently, the new atheism as a movement and a community reacts to politics rather than forms it; not all actions of new atheists aimed at reducing the social and political presence of religion or at reducing discrimination against atheists achieve their goals; the main achievement of the new atheism movement is that atheism as a worldview ceases to be a marginal agenda, and non-believers receive a formalized, pos­itively colored identity for themselves. The latter is important in the context of discrimi­nation of non-believers against believers, which in the United States takes place both in the public consciousness and even at the highest political level.
