BREVE RELATO DE UMA OUTRA EXPERIÊNCIA EDUCACIONAL: O ENSINO JURÍDICO NOS ESTADOS UNIDOS.

Michel Tournier was a philosopher before being a novelist. And even when he decided to become a novelist, he introduced himself as a « smuggler of philosophy ». But it is impossible to take full measure of this statement without considering the one and only philosophical text he ever published, in 1946: « L’Impersonnalisme ». This article, which he considered to be his « system of the world », is here presented in its historical and philosophical context.

Traditionally, writing is viewed as a code that stands in one-to-one correspondence to spoken language, which is therefore also viewed as a code. However, this is a delusion, which is shared by educators and has serious consequences for cognition, both on individual and on social levels. Natural linguistic signs characteristic for the activity of languaging and their symbolizations are ontologically different phenomena; speech and writing belong to experiential domains of different dynamics. These dynamics impact differently on the linguistic/behavioral strategies of (...) individuals and communities, viewed as second- and third-order living systems operating in a consensual domain as structure-determined systems. Failure to acknowledge this contributes to the spread of functional illiteracy in modern societies, which may lead to cognitive/communicative dysfunction. Technology-enhanced new literacies challenge the value of traditional written culture, raising questions about the relationship between speech and writing and their roles in human evolution. Brezhnev, the economy is taking on an entirely new scale of operations at the present stage. The basis of our economic power is coming to be industry with its numerous branches and a socialist agriculture organized on a large scale, advanced science, and skilled corps of workers, experts in (...) technology, and managers. Incomparably higher levels of the economy, of socialist social relationships, of culture, and of the consciousness of the broad masses of the workers are being attained. _Purpose._ The purpose of this research is to analyse and systematize modern philosophical and anthropological ideas about the nature, essence, causes and sources of collective violence. _Theoretical basis._ Given the complexity and multifaceted nature of the phenomenon of violence, the authors used a range of philosophical and general scientific research methods. In particular, the comparative method helped to identify the main advantages and disadvantages of using philosophical and anthropological approaches to studying the nature and patterns of violence in the social (...) environment. The use of the systemic and structural-functional methods contributed to a better understanding of the structure, features, mechanisms and criteria for ethical justification of the permissibility of collective violence. The psychological approach made it possible to analyse the role of social dissatisfaction, disappointment, relative deprivation and frustration in the process of radicalization of individuals and their readiness to use violence. _Originality._ The originality of this research lies in the application of modern analytical approaches to the study and philosophical understanding of the phenomenon of violence. It has been proven that at the current stage of social development, the following non-traditional forms of violence are becoming widespread: structural, symbolic, cultural, and psychological. It has been established that the main sources of collective violence are value, cultural, ideological and structural contradictions, as well as socio-psychological dissatisfaction, economic inequality and discrimination. _Conclusions._ Throughout history, violence has been an integral part of spiritual, social, value and economic transformations. The study of such a complex phenomenon requires the creation of an effective interdisciplinary theory that would take into account various anthropological, social, philosophical, psychological, physiological and biological dimensions and forms of its use. That is why there is a need to further improve scientific theories and approaches to studying the nature, forms and sources of violence. Taking advantage of a comprehensive approach, we have been able to establish that violence is a form of social influence that involves the use of physical force against individuals, social groups or institutions to cause physical, mental or moral harm and to subordinate their behaviour and will. A paper on how to adapt your probabilisitc beliefs when learning a conditional.

The article analyzes the effectiveness of quantum theories of mental experience in relation to two ontological problems - the problem of the existence of consciousness in the material world and the problem of the interaction of consciousness and body. A critical analysis of the quantum theories of consciousness by Penrose-Hameroff, M. Tegmark, G. Stapp, M. Fischer and M.B. Mensky shows that they fail to fully explain how complex physical systems generate mental experience without violating the principle of causal closure of (...) the physical world and the principle of epistemological completeness of physics. Quantum mechanics provides specific processes that are the physical basis of the psyche, but do not explain the phenomenal aspect of subjective reality. Nevertheless, the Heisenberg uncertainty principle gives an understanding of how the interaction of consciousness and body within the scientific picture of the world can be carried out without violating the law of energy conservation. It is shown that the quantum theories of consciousness currently being developed have a predominantly panprotopsychic character, which faces a problem due to the fact that the protomental property of physical systems must be expressed quantitatively and correspond to the value included in the physical equations. As a result, it is concluded that in order to develop quantum theories of consciousness more effectively, it is necessary to give an emergent character, not jumping from the quantum level to the psychic, but explaining the mechanism of the emergence of systemic properties during the sequential transition between different ontological regions of existence, including physical, chemical, biological, neurophysiological and psychic. A number of philosophers and legal scholars have pointed out a fact about punishment that had not been sufficiently appreciated by many traditional accounts, utilitarian, retributive, or ‘mixed’: that evil inflicted on the person punished is not an evil simpliciter , but rather the expression of an important social message—that punishment is a kind of language. The message which it is seen to communicate can broadly be described as condemnation by society of the crime committed. In what is still the (...) only attempt at a general and critical discussion— Anthony Skillen's ‘How to say Things with Walls’—this way of understanding punishment is termed ‘expressionism’. In this paper I propose to sort out the main varieties of expressionism in the philosophy of punishment, and to discuss some of their pros and cons. (shrink)

In this paper (a sequel to ‘What Is Terrorism?’, Journal of Applied Philosophy, vol. 7 [ 1990]) I discuss both consequentialist and deontological justifications of terrorism. In the consequentialist context, I look in particular into Leon Trotsky’s classic defence of the ‘red terror’, based on the argument of continuity of war, revolution, and terrorism, and the claim that the distinction between the guilty and the innocent, combatants and noncombatants, is not relevant to modern warfare. On the deontological side, I discuss (...) Virginia Held’s recent attempt at justifying terrorism in terms of basic human rights and distributive justice. The conclusion reached is that terrorism remains almost absolutely morally impermissible. (shrink)

The sequent system LDJ is formulated using the same connectives as Gentzen's intuitionistic sequent system LJ, but is dual in the following sense: (i) whereas LJ is singular in the consequent, LDJ is singular in the antecedent; (ii) whereas LJ has the same sentential counter-theorems as classical LK but not the same theorems, LDJ has the same sentential theorems as LK but not the same counter-theorems. In particular, LDJ does not reject all contradictions and is accordingly paraconsistent. To obtain a (...) more precise mapping, both LJ and LDJ are extended by adding a "pseudo-difference" operator which is the dual of intuitionistic implication. Cut-elimination and decidability are proved for the extended systems and , and a simply consistent but -inconsistent Set Theory with Unrestricted Comprehension Schema based on LDJ is sketched. With the development of science, a lot of people don’t believe in the afterlife, but believe in biotechnology and the ability to overcome death, or at least delay it as much as possible. At the same time, the revolution in medical technology has created the illusion of controlling death. In this study we will consider the impact of scientific progress on changing transhumanity’s vision of death. The aim of the article is a socio-philosophical review of the dynamics and changes in (...) transhumanist ideas about obtaining human immortality from the ideas of cryonics to cybernetic modification of human nature. Research methods are comprehensive and based on philosophical-anthropological and philosophical-cultural analysis of transhumanist concepts of human immortality.Discussion. Comparing the arguments of transhumanists about overcoming death by various methods, it becomes clear that the possibility of obtaining immortality through cryonics technologies is no longer the subject of discussion by scientists and philosophers. The attention of philosophers N. Badmington, N. Bostrom, J.Wilsdon, YN Harari, A. Turchin and M. Bakhtin is focused on the possibility of modifying the human body into an eternal cyborg personality. Conclusion. Human modification for the sake of immortality or its cyborgization is the dominant idea of solving the problem of human mortality. The expansion of the boundaries of human nature and the same time of human existence is first of all a transition to a new qualitative level of existence. As a result it is the opportunity to transfer human thoughts, memories and consciousness into the digital form or to an artificial device. So transhumanists will be able to take refuge in digital immortality. And this immortality will depend only on the ability to build and store these devices. (shrink)

This is due to the transition of our state from the traditional model of the state, in which there is authoritarianism, secrecy, to a socially oriented society and a democratic, open state.Accordingly, there is a change in values, which is an integral part of the existence of any society and state. To replace the Soviet system of declaration of surrogatecollective, (...) paternalistic values, which existed for several decades, a new system is formed, which provides a clear orientation of Ukrainians to European values, the significant achievements of the Ukrainian people, the moral recovery of society, increasing values and culture of civil society. Honor and dignity of Ukrainians, which is an indispensable basis for the development of moral culture of society.The purpose and objectives of the article. Based on the achievements of modern science and philosophy, to analyze the essence of the moral culture of the people, the place of human dignity and its importance in moral culture; to characterize and classify the main factors of dignity formation in the moral culture of the people. The research methodology is complex and is based on philosophical-anthropological and philosophical-cultural analysis of the problems of formation of moral culture of the Ukrainian people and its structural element - human dignity. Research results.The most important, synthetic, integral consequence of human development is moral culture. Moral culture is the level of assimilation by an individual or a group of people of existing moral values in society, the degree of their involvement in the moral aspects of activity, a measure of personal moral development. Practical and spiritual factors include, first of all, ethnic stereotypes specific to a certain people (traditions, customs, rituals, typical traits of character and behavior, dominant emotions, folk crafts, entertainment, games), as well as historical memory, established symbols, folk shrines. Historical memory, preserving every page of life, the people’s struggle for social, political and national rights at all stages of its development, serves as a solid foundation on which national self-consciousness is successfully formed.Institutional factors are important for the formation of dignity in the moral culture of the people. These include nation- and state-building activities of public authorities, national elite, political parties, religious and public organizations. If the state creates conditions in society for the assimilation of the historical and cultural experience accumulated by the nation, it contributes to the education of national self-esteem, ie awareness of community members of their belonging to the nation, their duty to the community of like-minded people. Conclusions. Summarizing the results of the study, we can formulate the following conclusions. Human dignity in the moral culture of the Ukrainian people is the result of the interaction of a combination of many factors that determine its structure and content. The process of its formation is quite long, complex and contradictory. This is due to the fact that it is human dignity that provides the spiritual, ideological foundation for the functioning of national communities, contributing to the development of promising guidelines for the development of the nation and the state. The dynamics of life and environment destruction in the east of Ukraine is rapidly increasing. This article analyzes the main factors of contamination and destruction of the environment as a result of the military operations in eastern Ukraine. There were held the calculations of areas destroyed by fire, analyzed the dynamics of fires in the east of Ukraine and compared with the previous years, there were analyzed the soils in the Krasnolymanskyi region and water form Siverskyi Donets River. For a complete evaluation of the scope of environment destruction and pollution, it is necessary to conduct environmental monitoring, to develop an action plan on restoration of the environment. In the article, the authors attempt to analyze the various origins of libertarian paternalism - political, social, cultural, and try to explore the essence of this social and social phenomenon. Libertarian paternalism has both positive and negative features, which are actualized, in turn, by modern planetary challenges.The aim and the tasks: analysis of the essence of the social phenomenon of libertarian paternalism, and the study of its origins - political, social, cultural. Research methods are historical, structural and functional, systemic and (...) equitable.For the revision of specific projects, it is also the principle of consistency, objectivity, convergence from the abstract to the concrete. Research results: Democracy and human rights have found themselves in the grip of challenges, to which both the government and the private sector of the economy in particular react in a peculiar way. In the civilized world, the problem of social protection is acute; an ordinary person dramatically perceives the massive pressure of advertising, the media, certain structures that are interested, first of all, in the early sale of their products - material, spiritual and social. Libertarian paternalism is seen by the authors as a possible way to reconcile these issues, especially from the point of view of protecting the human rights and freedoms. Discussion. In this regard, other authors note that in the practical implementation of Nudge technology, people rarely follow the ideal interpretation of private well-being in terms of full satisfaction of needs. Opponents suggest in this regard that people can be guided by temporary benefits in terms of irrational consumer behavior, that is, the socio-psychological bases of consumerism are affected. Conclusion. Libertarian paternalism was created as a reaction to political, economic and sociocultural changes in society under the impact of globalization, informatization and revision of social programs in the governments.The concept of libertarian paternalism and its practical implementation of nudge technology is relevant and promising in the context of a constant increase in the level of welfare of citizens. Libertarian paternalism affects the most subtle sociophilosophical, socio-psychological elements of the consciousness of an individual who has become hostage to government programs and private projects. The price of a rational choice of an individual is his own freedom, in the context of modern realities of social life. (shrink)

The conceptual spaces approach has recently emerged as a novel account of concepts. Its guiding idea is that concepts can be represented geometrically, by means of metrical spaces. While it is generally recognized that many of our concepts are vague, the question of how to model vagueness in the conceptual spaces approach has not been addressed so far, even though the answer is far from straightforward. The present paper aims to fill this lacuna.

This article compares inference to the best explanation with Bayes’s rule in a social setting, specifically, in the context of a variant of the Hegselmann–Krause model in which agents not only update their belief states on the basis of evidence they receive directly from the world, but also take into account the belief states of their fellow agents. So far, the update rules mentioned have been studied only in an individualistic setting, and it is known that in such a setting (...) both have their strengths as well as their weaknesses. In this article, our focus is on the topic of engagement and possibility of empathy with future generations. We acknowledge that empathy for future generations is practically unattainable in its strictest sense due to the lack of access to their potential mental states and the absence of direct interaction. Additionally, we will draw upon the arguments presented by Goldie and Slaby to address concerns regarding the potential paternalization that may arise in empathic relations towards future generations. However, despite these limitations, (...) it is important to emphasize that we are still engaged with future generations. Instead of adopting a paternalizing approach where we impose expectations on how they should feel, our engagement exposes us to the anticipated but unknown judgments of future generations. Throughout this article, we will argue that engagement with future generations brings out our own social self-consciousness and provides a basis of our connectedness and responsibility towards future generations. Purpose: This paper demonstrates the conceptual relevance of Maturana’s biology of cognition for the theoretical foundations of the language sciences. Approach: Stuck in rationalizing, rather than naturalizing, language, modern orthodox linguistics is incapable of offering a comprehensible account of language as a species-specific, biologically grounded human feature. This predicament can be overcome by using Maturana’s theory to stress that lived experience gives language an epistemological “lining.” Findings: The key concepts of Maturana’s biology of cognition provide a more coherent theoretical framework (...) for the study of language that can give new life to the language sciences by stressing languaging and the importance of connotation. Conclusion: Maturana’s concept of “languaging” allows the language sciences to depart from the view of language as a system of symbols. Instead, focus should be placed on how the relational dynamics of linguistic interactions trigger changes in the dynamics of the nervous system and the organism as a whole, and how their reciprocal causality is distinguished and described by the languaging observer in terms of mind, intelligence, reason, and self-consciousness. Bayesians have traditionally taken a dim view of the Inference to the Best Explanation, arguing that, if IBE is at variance with Bayes ' rule, then it runs afoul of the dynamic Dutch book argument. More recently, Bayes ' rule has been claimed to be superior on grounds of conduciveness to our epistemic goal. The present paper aims to show that neither of these arguments succeeds in undermining IBE.

Though the average person may take patriotism for granted as a natural feeling of loyalty to one's country, among philosophers the nature, moral standing, and political significance of patriotism have always been contentious. On the one hand, there are those who defend patriotic loyalty as either a duty or a virtue and extol it as an indispensable condition of a viable polity. On the other hand, critics of patriotism maintain that it is morally suspect to prefer one's country and compatriots, (...) and doing so offends against impartial justice and hinders universal human solidarity. Today patriotism is a topic of debate not only in moral philosophy but also in political theory, where it is often brought up as a test case in the confrontation between liberals and communitarians. These debates have produced much high-quality writing, the best of which is here presented in this wide-ranging collection of essays by philosophers and political theorists. All the main varieties of patriotism are covered—moderate and extreme, as well as ethnic/cultural and political—and both critics and defenders are given a hearing. Editor Igor Primoratz has also included articles that discuss the history of the term in moral and political discourse in the English-speaking world, the distinctively American type of patriotism, the relation of patriotism to nationalism and racism, and the tension between patriotism and universal human solidarity, especially as this issue relates to foreign aid. As the first anthology to treat patriotism in its own right, this work emphasizes that patriotism is a distinct moral and political outlook, and is not merely a variety of nationalism or the emotional underpinning of nationalist theories. As early as 1962, Jürgen Habermas was convinced that Karl Marx’s theoretical attempt to ‘turn Hegel the right side up’ had resulted in a one-sided embrace of revolution and a perilous rejection of legality and rights. Habermas would restate these remarks thirty years later in Between Facts and Norms, noting that the collapse of state socialism, with its characteristic disdain for legality and rights, culminated in the discrediting of revolutionary Marxism. This article revisits Habermas’s theoretical dichotomy between revolution and legality (...) in view of his ambivalent relationship to ‘Marx’s spectre’ and shows its significance for Habermas’s ongoing debate with Wolfgang Streeck concerning the tension between democracy and capitalism. Using textual evidence from Marx’s neglected journalistic writings before, during, and after the 1848 revolutions, the article offers a competing perspective of Marx’s views on legality and rights at a time when their respective fates were critically at stake. A careful reconsideration of Marx’s reflections and a confrontation with his spectre offers Habermas fruitful resources for responding to Streeck’s critique and for reviving the project of ‘radical reformism’ at a time when the liberal constitutional order finds itself under attack.
