After the era of nihilism, ethical issues have been gradually focused on how to rebuild a value of “Being”. Thinkers tend to reaffirm the significance of one’s own Being and try to find a way of existence in order to resist against nothingness. In such an epoch, Levinas contends that the ethics “for the Other” and the existence are inextricably linked. Furthermore, he notes that the value of existence is not revealed against the nihilism, but realized with the ethics “for (...) the Other” in one’s act of assuming the burden of existence. The meaning of “Being” is thus revealed in the effort of “for the Other” and in the noble will of making the sense of responsibility beyond ones’ own Being to reach the Other.Después de la era del nihilismo, las cuestiones éticas se han ido enfocando gradualmente en cómo reconstruir un valor de “Ser”. Los pensadores tienden a reafirmar la importancia del propio Ser e intentan encontrar una manera de existir capaz de resistir contra la nada. Children's utterances from late infancy to 3 years of age were examined to infer their conception of knowledge. In Study 1, the utterances of two English-speaking children were analysed and in Study 2, the utterances of a Mandarin-speaking child were analysed – in both studies, for their use of the verb know. Both studies confirmed that know and not know were used to affirm, query or deny knowledge, especially concerning an ongoing topic of conversation. References to a third party were (...) rare. By implication, 2-year-olds have a conception of knowledge that underpins their exchange of information in conversation. Implications for the child's developing theory of mind are discussed. Connecting research and production, art research represents a breaking of the barrier between creation and academia. However, there is also a contradiction contained in this kind of research deriving from its methods, since the process of art-based practice must, by its very nature, involve the subjectivity of the artist. I use my own studies as the research object to discuss this issue, and this article presents the problems I encountered during my artistic practice and research of ambiguous roles. This paper (...) has two main points of focus. First, I explore how the fallacy of self-referentiality is presented in paintings and films, and, second, I draw on my short film practice during my master’s study period to explain how the shots present a continuum in relation to the “absent one” and produce interface effects. However, the second point is not necessarily the result of the first one. This kind of connection and contradiction between practice and cognition in the process of art research is that I will analyse and discuss here. (shrink)

The past decade has seen major advances in cognitive, affective and social neuroscience that have the potential to revolutionize educational theories about learning. The importance of emotion and social learning has long been recognized in education, but due to technological limitations in neuroscience research techniques, treatment of these topics in educational theory has largely not had the benefit of biological evidence to date. In this article, I lay out two general, complementary findings that have emerged from the past decade of (...) neuroscience research on emotion and social processing, with a view to beginning a dialogue about the meaning of these findings for educational theory. First, emotion and cognition are intertwined, and involve interplay between the body and mind. Second, social processing and learning happen by internalizing our subjective interpretations of other people's beliefs, goals, feelings and actions, and vicariously experiencing aspects of these as if they were our own. Together, these two results from neuroscience could have important implications for the design of learning environments; to discover these will require reconciling established educational learning theories with the current neurobiological evidence. As argued above, if we examine each "form of knowledge" within a modern historical context, it seems that we can see a sequentially transformational and coincident historical line that links the material, then the institutional, and then the cultural, while maintaining the sequential development of the linked trends from beginning to end. Even a summary of Lin Yusheng's hypothesis is a continuation of the "mind's" function orientation. This framework, however, must still answer the following question: In the process whereby "forms (...) of knowledge" become intimately connected with transformational events or time sequencing, do they appear in the form of a totalitarian theoretical model, or do they exert their influence in the form of the dispersed role of a discourse? More concretely, in the case of China: When the traditional "forms of knowledge" of modern Chinese intellectuals—for example, the methodology and behavior within the "thought discourses" of the Confucian School—faced the challenge of the West, did they use "a comprehensive theory" to undertake self-adjustment? Michel Foucault raised a query about the role of totalitarian discourse in saying: "At the beginning of any research I expressed a query about these long-established ‘unified’ models. Traditionally, according to these ‘unified’ models we differentiate infinite, repetitive and fecund territories within the discourse. Must we necessarily, on these ‘unities’ which actually are not unities, pile up yet another even more obscure and even more controversial ‘unitary’ model?". (shrink)

A Defence of the Perceptual Account of Emotion Against the Alleged Problem of Ambivalent Emotion: Expanding on Tappolet Tappolet (2005) has defended the perceptual account of emotion against a problem which some have raised against it, stemming from the phenomenon of ambivalent emotions. According to Tappolet, we can explain cases of ambivalent emotions unproblematically. To persuade us of this, she draws our attention to circumstances in which it seems entirely appropriate to have conflicting emotions with respect to the same situation. (...) On her perceptual account of emotions, in such situations our emotions disclose two values, e.g., danger and attractiveness, at the same time. My aim here is to defend Tappolet by expanding on the considerations she adduces. In order to do this, I utilize Prinz's notion of "valence". Using this terminology, I shall show that the undeniable co-instantiation of emotions that are our intuitions classifies as "contrary", for example, fear and attraction does not actually constitute a contradiction. Causalists and Evidentialists can agree about the right course of action in an (apparent) Newcomb problem, if the causal facts are not as initially they seem. If declining $1,000 causes the Predictor to have placed $1m in the opaque box, CDT agrees with EDT that one-boxing is rational. This creates a difficulty for Causalists. We explain the problem with reference to Dummett's work on backward causation and Lewis's on chance and crystal balls. We show that the possibility that the causal (...) facts might be properly judged to be non-standard in Newcomb problems leads to a dilemma for Causalism. One horn embraces a subjectivist understanding of causation, in a sense analogous to Lewis's own subjectivist conception of objective chance. In this case the analogy with chance reveals a terminological choice point, such that either (i) CDT is completely reconciled with EDT, or (ii) EDT takes precedence in the cases in which the two theories give different recommendations. The other horn of the dilemma rejects subjectivism, but now the analogy with chance suggests that it is simply mysterious why causation so construed should constrain rational action. (shrink)

Siegel recently distinguishes between seven possible ways in which our perceptual access to social information can be biased by flawed practice of either individuals or social structures, two of which, namely attention and cognitive penetration, imply that it is the content of perception, as opposed to that of judgments, that is biased. Both attention and cognitive penetration, however, rely on cognitive states imposing top-down influences on perceptual states. As such, perceptual bias resulting from them is to a large extent merely (...) a derivation of cognitive bias. In this paper, I propose another way in which our perception can be biased, namely, as the result of faulty assumptions made by the visual system. Furthermore, I argue that in contrast to cognitive penetration and attentional direction, perceptual bias arising in this way is fundamentally perceptual and does not depend on inputs from one’s cognitive system. This sort of perceptual bias, if it exists, would have important implications for how we conceptualize social bias and pose special challenges to traditional interventions designed to counteract bias. Social emotions about others’ minds, for example, admiration for virtue and compassion for social pain, play a critical role in interpersonal relationships, motivation, and morality. However, historical biases toward studying emotions as automatic reactions generated within a solitary individual limit our ability to study emotions about others’ minds, which are inherently complex, social, and subjective. Here, I argue that a microdevelopmental approach, that is, considering these emotions as dynamic, context-dependent mental constructions actively organized from simpler cognitive and affective psychological components, (...) may help to overcome the difficulties of studying these emotions by providing new perspectives on: reliably inducing these emotions; parsing the ensuing experiences into component psychological processes organizing over time; and relating these component processes to patterns of brain activation. Criminal attempts require intent to commit an offence. But what constitutes such intent? Some cases are fairly straightforward. I act with intent to convert stolen goods if I intend that the goods I purchase be stolen. A man acts with intent to commit rape if he intends that the sexual intercourse be non-consensual. Other cases leave room for reasonable disagreement. Did a man intend to convert criminal property when he purchased goods which he suspected might be stolen? And did a (...) man intend to rape a woman when he tried to have intercourse with her and was reckless about consent? Does recklessness as to the circumstance elements of an offence suffice for intent? Building on the view that attempts are failed attacks (as opposed to acts of endangerment), I argue that recklessness about circumstances is not enough for intent since such recklessness amounts to an act of endangerment. This is not to suggest that a man does nothing wrong in trying to have sex with a woman while being reckless about consent; it is to argue that he should be convicted of an endangerment offence, rather than an attempt. If we take seriously the idea that attempts are failed attacks, and that attacks and endangerments constitute different types of moral wrong, we have good reason to preserve this distinction in our offence labels by insisting that the fault element for attempts should require at least knowledge or belief as to the relevant circumstances of an offence. In his classic book “the Foundations of Statistics” Savage developed a formal system of rational decision making. The system is based on (i) a set of possible states of the world, (ii) a set of consequences, (iii) a set of acts, which are functions from states to consequences, and (iv) a preference relation over the acts, which represents the preferences of an idealized rational agent. The goal and the culmination of the enterprise is a representation theorem: Any preference relation that (...) satisfies certain arguably acceptable postulates determines a (finitely additive) probability distribution over the states and a utility assignment to the consequences, such that the preferences among acts are determined by their expected utilities. Additional problematic assumptions are however required in Savage's proofs. First, there is a Boolean algebra of events (sets of states) which determines the richness of the set of acts. The probabilities are assigned to members of this algebra. Savage's proof requires that this be a σ-algebra (i.e., closed under infinite countable unions and intersections), which makes for an extremely rich preference relation. On Savage's view we should not require subjective probabilities to be σ-additive. He therefore finds the insistence on a σ-algebra peculiar and is unhappy with it. But he sees no way of avoiding it. Second, the assignment of utilities requires the constant act assumption: for every consequence there is a constant act, which produces that consequence in every state. This assumption is known to be highly counterintuitive. The present work contains two mathematical results. The first, and the more difficult one, shows that the σ-algebra assumption can be dropped. The second states that, as long as utilities are assigned to finite gambles only, the constant act assumption can be replaced by the more plausible and much weaker assumption that there are at least two non-equivalent constant acts. The second result also employs a novel way of deriving utilities in Savage-style systems -- without appealing to von Neumann-Morgenstern lotteries. The paper discusses the notion of “idealized agent" that underlies Savage's approach, and argues that the simplified system, which is adequate for all the actual purposes for which the system is designed, involves a more realistic notion of an idealized agent. This paper addresses the issue of finite versus countable additivity in Bayesian probability and decision theory -- in particular, Savage's theory of subjective expected utility and personal probability. I show that Savage's reason for not requiring countable additivity in his theory is inconclusive. The assessment leads to an analysis of various highly idealised assumptions commonly adopted in Bayesian theory, where I argue that a healthy dose of, what I call, conceptual realism is often helpful in understanding the interpretational value of (...) sophisticated mathematical structures employed in applied sciences like decision theory. In the last part, I introduce countable additivity into Savage's theory and explore some technical properties in relation to other axioms of the system. (shrink)

This thesis examines some of the legal philosophical issues that are implicated in the problem of outcome luck. In the context of criminal law, the problem asks whether we should hold agents criminally liable for the consequences of their actions given that those consequences are never wholly within anyone’s control. I conclude that outcomes should matter to an agent’s liability and punishment, and I make this argument indirectly by examining some of the foundational questions in legal theory. The thesis begins (...) by considering a current trend in some areas of philosophy. This trend involves attempts to address philosophical problems surrounding luck by doing conceptual analyses on the nature of luck. Chapter 1 critically examines modal theories, which conceptualize luck, as well as the related concept of risk, in terms of close possible worlds rather than probabilistic likelihood. I argue that not only are modal theories uninformative, but conceptual analyses on luck are unhelpful in addressing philosophical questions surrounding luck. Chapter 2 then returns to the traditional notion of luck as lack of control, and focuses on the relationship between luck, risk, and culpability. Some theorists argue that culpability, for any offence, is in part a function of the degree of risk the agent imposes on others. In the context of criminal law, degrees of luck and risk can both be understood in terms of degrees of control, so the suggestion that culpability is a function of the level of risk imposed (and thus of the degree of control an agent exercises) is attractive for insulating culpability judgments from luck. However, I argue that this view is mistaken because culpability is only sensitive to risk in reckless actions, but not in purposeful actions. The problem of outcome luck may raise different questions for reckless actions and purposeful actions. Chapter 3 looks at the mens rea element of criminal attempts, which is crucial for understanding the problem of luck in the context of purposeful actions. I discuss a variation of what are sometimes referred to as impossible attempts, which have helped shape current English law. I argue that the current doctrine is largely correct, and that perhaps with the exception of few paradigm sexual offences, the mens rea element for attempts should require a direct intention as to the consequence element of an offence, and knowledge or belief as to the circumstance element of that offence. Chapters 4 and 5 then look at normative justifications of criminal punishment. In order to understand whether outcomes should matter for punishment, we must first understand whether and why punishment is an appropriate response to criminal offending. Here, I defend a communicative theory, where punishment is a communicative process between the offender, the political community, and the victim. What punishment communicates is the appropriate degree of censure that is warranted in response to the offender’s wrongdoing. And in doing this, it publicly recognizes the wrong that has been committed by the offender. Chapter 4 offers a detailed explanation of this account, and argues that the political community’s recognition of wrongdoing is a valuable aim of communication. Chapter 5 then takes up a crucial challenge against communicative theories of punishment, which is that such theories fail to take crime prevention seriously. Against this criticism, I will show that general prevention can in fact be an essential part of communicative punishment. And I will show that it is specifically the political community’s recognition of wrongdoing that entails punishment’s preventive aims. (shrink)

Using CiteSpace 6.1 software and information visualization analysis, we performed a search of literature in the Web of Science core collection database using thematic words such as “public health”, “ethics” and “autonomy”, we found that from January 1, 2020 to May 14, 2022, discussions on the concept of “autonomy” (...) within the field of bioethics/public health ethics were generally focused on the following topics: “informed consent”, “health care policy”, “health quality”, “information technology”, “ageism” and “elderly group”. In this paper, we distill and analyze four controversial issues: how can we avoid excessive restrictions on autonomy in the name of public health/public interest? How can we protect autonomy when using digital technology? How can we protect the autonomy and rights of the elderly? How can we advance the goals of public health by promoting autonomy? The COVID-19 pandemic is a unique historical opportunity to reshape the concept of autonomy within the field of public health ethics. Although the virus has bound the fate of humanity together, a reinvented concept of autonomy based on care and community ethics holds the promise of bringing solidarity, comfort, and hope to the world in the midst of the pandemic. Relationships between children and parents pervade the Star Wars saga, especially if people include surrogate parents. Anakin's relationship with his mother, Shmi, in the prequels impacts his trajectory toward the dark side. In The Mandalorian, Mando's role as a surrogate father to Grogu transforms them into a “Clan of Two”. But the most significant parent‐child relationship in the saga may be the one between Luke Skywalker and Darth Vader. Confucius's teachings highlight the importance of benevolence, social order, and ritual propriety (...) among other virtues and values. This chapter shows that understanding Luke's surrender to Vader in terms of Confucian filial piety makes sense of how Luke is able to overcome the allure of the dark side and become a Jedi. Confucius's Analects has a moral framework called “exemplarism”. This is the idea that moral knowledge and practice do not start with principles, rules, duties, consequences, or character traits. Objectives: To quantify the use of do-not-resuscitate orders in a tertiary-care children’s hospital and to characterise the circumstances in which such orders are written.Design: Retrospective study conducted in a 500-bed children’s hospital in Taiwan.Patients: The course of 101 patients who died between January 2002 and December 2005 was reviewed. The following data were collected: age at death, gender, disease and its status, place of death and survival. There were 59 males and 42 females with a median age of 103 months (...) . 50 children had leukaemias, and 51 had malignancies other than leukaemia. The t test and the χ2 test were applied as appropriate.Results: The study found that 44% of patient deaths occurred in the paediatric oncology ward; 29% of patient deaths occurred in the intensive care unit; and 28% of patients died in their home or at another hospital. Other findings included the following: 46 of 101 patients died after attempted cardiopulmonary resuscitation and 55 died with a DNR order in effect. The mean age at death was 9.8 years in both groups with or without DNR orders.Conclusions: From the study of patient deaths in this tertiary-care children’s hospital, it was concluded that an explicit DNR order is now the rule rather than the exception, with more DNR orders being written for patients who have been ill longer, who have solid tumours, who are not in remission and who are in the ward. This paper offers a fine analysis of different versions of the well known sure-thing principle. We show that Savage's formal formulation of the principle, i.e., his second postulate (P2), is strictly stronger than what is intended originally.

The past two decades have witnessed a burgeoning literature on L2 writers' identities, especially their discoursal identities. In contrast, little attention is paid to the writers' felt sense of self when they write in an L2, which is an integral dimension of their autobiographical self. In this article, we provide empirical evidence of the nature of this aspect of L2 writer identity. To illustrate, we analyzed linguistic metaphors elicited from three groups of L2 writers, majoring respectively in Thai, Japanese, and (...) English in a Chinese university. Descriptive analysis shows that, due to challenges in content, language, organization, and cultural differences, a majority of L2 writers, especial Thai and Japanese L2 writers, experience a diminishing sense of self when they write in L2. In contrast, some L2 writers, especially English L2 writers, find writing in an L2 liberating, revealing the impact of their individual learning trajectories and pedagogical practices on L2 writers' felt sense of self. Findings suggest that L2 writers' identity work is both complex and dynamic. L2 writing teachers can utilize the metaphor questionnaire as a tool to facilitate their learner needs analysis and to raise L2 writers' metacognition. (shrink)

The ways in which partners manage their money provide important clues to gender inequality in and the nature of couple relationships. Analyzing data from nationally representative surveys, I examine changes across British cohorts born between the 1920s and 1990s in their household financial management, and how the changes vary across individuals and couples occupying differential income positions. The results show divergent, nuanced cohort trends toward gender equality in couples’ money management. Across successive cohorts of low-earning women, there has been a (...) subtle relaxation in the form of male control, reflected in a decrease in the proportion of men adopting “back-seat” management by retaining the majority of the couple’s money while delegating the chore of managing daily expenses to their partners. By contrast, the empowerment of high-earning women is reflected primarily in an individualization of financial management, evident in a cohort decrease in joint financial management and an increase in independent management. The trend of individualization is particularly prominent among couples in which both partners have equally high earnings. The findings provide new insights into and important extensions of the theorization of gender relations in and the individualization of couple relationships. (shrink)

Although previous research has examined the effectiveness of various levels of punitive reactions to misconduct, researchers have given leader leniency relatively inadequate attention. Prior studies consistently suggest the beneficial effects of reacting less punitively toward misconduct. The current research challenges this notion by delineating a mixed effect of leader leniency on subordinate psychological and behavioral reactions. Building on social exchange theory (i.e., reciprocity norm and rank equilibration norm) and motive attribution literature, the authors argue that when subordinates hold high levels (...) of instrumental motive attribution, leader leniency relates positively to subordinate psychological entitlement, which in turn leads to workplace deviance. In contrast, when subordinates develop high levels of value-expressive motive attribution, leader leniency is positively associated with their felt obligation toward leaders, which positively influences their subsequent organizational citizenship behavior. The results of a field study, a scenario experiment, and a recall experiment conducted to test these hypotheses confirm the double-edged effects of leader leniency. Interpretation from the perspective of the historical development of global imbalances can be defined as the persistent global imbalances, the current scale is not balanced and financial imbalances. Historically there have been two of the largest global imbalances, which lasted until World War I nearly half the world's imbalances and since the 1990s until 2007, before the outbreak of the financial crisis of the contemporary global imbalances. The external imbalance is sustained by the national economic systems, economic policy, the global (...) economic system system system and the global political system and other important systemic factors, it has brought the global economy a great threat to sustainable development, and eventually lead to crisis. The problem of global imbalances could be regarded as persistent, sweeping imbalances of current account and financial account from the historical perspective. There were two largest global imbalances, one lasted about a half century before the First World War, and the other lasted from 1990s to the financial crisis of 2007. There were several reasons for the long term external imbalance, such as the national economy policies, global economic system, global political system and other important systemic factors which led the sustained development of global economy to the economic crisis. In trying to establish the view that there are no non-living macrophysical objects, Trenton Merricks has produced an influential argument—the Overdetermination Argument—against the causal efficacy of composite objects. A serious problem for the Overdetermination Argument is the ambiguity in the notion of overdetermination that is being employed, which is due to the fact that Merricks does not provide any theory of causation to support his claims. Once we adopt a plausible theory of causation, viz. interventionism, problems with the Overdetermination will (...) become evident. After laying out the Overdetermination Argument and examining one extant objection to it, I will explicate the relevant aspects of an interventionist theory of causation and provide a characterization of overdetermination that follows from such an account. From this, I will argue that the Causal Principle that undergirds the Overdetermination Argument is false and hence the argument is invalid; and I claim that the only other available characterization of overdetermination would render a key premise in the argument false. Thus, the Overdetermination Argument fails to provide us with any reason to deny the causal efficacy of macrophysical objects, and therefore provides no reason to doubt their existence. (shrink)
