The doctrine of Ultra Petita has been the subject of much criticism and poses a threat to constitutional justice. This article examines the doctrine in operation inside of Indonesia where the Constitutional Court appears to have expanded its jurisdiction by not only reviewing or analysing but also by invalidating or annulling acts. The impact of this is a creation of a high-degree of legal uncertainty and ambiguity in the judicial process. The article argues that instead of making use of the (...)

Fighting the COVID‐19 pandemic: A socio‐cultural insight into Pakistan.Sualeha Siddiq Shekhani, Farhat Moazam & Aamir Jafarey - forthcoming - Developing World Bioethics.
During the COVID‐19 pandemic, healthcare professionals around the world were driven by universal values of solidarity and duty to provide care. However, local societal norms and existing healthcare systems influenced interactions among physicians, and with patients and their families. An exploratory qualitative study design using in‐depth interviews was undertaken with physicians working at two public sector hospitals in Karachi, Pakistan. Using the constant comparison method of data analysis, several key themes were identified highlighting norms of kinship and interdependencies characteristic of (...)

The Covid-19 pandemic necessitated a shift to online teaching of bioethics, a field that relies on discourse and interactive teaching methods. This article investigates the pervasive influence of the pharmaceutical industry in Pakistan and primarily the attitudes of the medical community toward such interactions. We used an inductive approach informed by grounded theory principles to analyze interviews and focus groups with consultants, residents, medical students, and a pharmaceutical industry representative in Karachi and Lahore, and participant-observation data from two biomedical conferences. Data were then analyzed through a deontological and teleological ethical theoretical framework. Findings highlight the reasons leading to the continuation of (...)

Background:Suicide remains an important cause of premature deaths and draws much media attention. However, unsafe reporting and portrayal of suicides by the media have been associated with increased risk of suicidal behavior. Current evidence suggests that media capacity-building could potentially prevent suicide. However, there are still knowledge gaps in terms of a lack of data on effective strategies for improving awareness and safe reporting of suicide-related media content. This study aims to investigate the effectiveness of a workshop conducted with members (...)

One of the important features of this work is the introduction to some of the subjects of ijtihād (process of juristic legal reasoning), taqlīd (acting upon the word of another without asking for specific proof), ijmā‘ (consensus of jurists) and view’s of the companions of the Prophet. ʿAbd al-Bāqī b. Qāniʿ was a traditionist and evaluator of transmitters, one of the founders of the genre of biographical dictionaries devoted to the Com- panions of the Prophet. Ibn Qāniʿ has not attracted much attention from scholars— only Khalīl Qūtlāy has authored a doctoral dissertation, now published in fifteen volumes, that comprises Ibn Qāniʿ’s Muʿjam al-ṣaḥāba. In this essay I argue that Ibn Qāniʿ and his contemporaries relied on the chains of hadith transmission to extract the names of many (...)

Around the year 854, he left Baghdad to escape political persecution and died either in 860 or in 910, according to some sources. The details of his early life are unknown, and documentation of (...)

The history of Iraq in the twentieth century, and perhaps the Middle East more broadly, is punctuated by an intellectual shift that has, for the most part, escaped the attention of scholars. It might be characterized as a shift from a problem of representation introduced by the rise of left-wing politics, to a problem of experience created by its failure. This shift registers in the work of writers and artists, where the depiction of the social world gave way to an (...)

The great majority of commentators have evaluated the splitting of the moon. The vast majority of them think that it occurred in the Prophet’s period basing their view on the clear statement of al-Qamar 54/1 verse and on related rumors. However, some commentators claim that the moon will split on the doomsday, by referring to the context of the same verse. The same names criticize the rumors claiming that they cannot constituteevidence for the splitting of the moon. To those who (...)

In Islamic theological writings, under the heading of sustenance, the focus is generally on issues such as who is the provider of sustenance, whether haram is considered sustenance, and whether Allah’s consent exists for haram sustenance. Another issue that can be found between the lines of the subject of sustenance is whether it is haram for a person to work for sustenance or not. In fact, the pursuit of means of livelihood in order to sustain one’s life is, according to (...)

Early philosophical Ṣūfism: the neoplatonic thought of Ḥusayn Ibn Manṣūr al-Ḥallāğ.Saer El-Jaichi - 2018 - Piscataway, NJ: Gorgias Press.
This study challenges the conventional image of the tenth-century Sufi mystic Al-Husayn Ibn Manṣūr al-Ḥallāğ (d. 929) as an anti-philosophical mystic. Unlike the predominantly theological or text-historical studies which constitute much of the scholarly literature on Ḥallāğ, this study is completely philosophical in nature, placing Ḥallāğ within the tradition of Graeco-Arabic philosophy and emphasizing, in a positive light, his continuity with the pagan Neoplatonism of Plotinus and Proclus.
