Milton Friedman's famous methodological essay contains, along with much else, some strands that look as though they were taken from the “empirical-scientific” fabric described by Karl Popper. Think, for example, of Friedman's conviction that the way to test a hypothesis is to compare its implications with experience. Or of his more or less explicit espousal of the view that while no amount of facts can ever prove a hypothesis true, a single “fact” may refute it. Or of his assertion that (...) hypotheses are to be accepted only as provisionally true, and then only after repeated efforts to refute them have failed. Through the narrative of the contributors, the book demonstrates how mourning is intertwined with politics and how politics involves a struggle over which losses and whose lives can, or should, be mourned.

A number of jurisdictions, including England and Wales after their adoption of the 1991 Criminal Justice Act, require that sentences be `proportionate' to the severity of the crime. This book, written by the leading architect of `just deserts' sentencing theory, discusses how sentences may be scaled proportionately to the gravity of the crime. Contemporary theories of criminalisation address, with varying emphasis, themes concerning the harmfulness and the wrongfulness of the conduct. In his article for the present issue, Antony Duff relies chiefly on notions of wrongfulness as the basis for his proposed criminalisation doctrines; whereas in their 2011 volume on criminalisation, Andrew Simester and Andreas von Hirsch invoke both wrongfulness and harmfulness as prerequisites for prohibiting conduct. The present article assesses the comparative merits of these approaches, and argues in favour of the (...) latter, two-element perspective. In this article, the author puts forward a number of reasons suggesting why the two-element approach is preferable. These reasons include, firstly, an inductive argument—that the kinds of wrongful conduct for which criminalisation seems a plausible response are those that include an element of harm or risk of harm. Secondly, a defining role for the state is one of resource-protection: of safeguarding the means and resources through which citizens can live good lives. Thus the concept of citizens’ living resources—and the related conception of harm—should be made a constitutive and explicit element of criminalisation theory, rather than subsuming resource-protection under a general rubric of wrongfulness. Thirdly, a two-element approach provides reciprocal limiting principles concerning the scope of criminalisation. One can, for example, employ wrongfulness requirements to limit the criminalisation of conduct that has remote harmful consequences; and, conversely, use a harmfulness requirement as means for restricting the criminalisation of wrongful acts. Traditionally, transitional justice has referred to that field of theoretical scholarship that proffers recuperative strategies for political societies divided by a history of violence. Through the establishment of truth commissions, public confessionals and reparative measures, transitional justice regimes have sought to establish restorative conditions that might help reconcile historical antagonists both to each other and to the trauma of their shared past. Because of some of the theoretical lapses in this scholarship some have turned recently to the field of radical (...) democratic and ‘new pluralist’ thought – and especially to agonistic literature – to foreground a theory of post-conflict reconciliation based not on the principles of the sublimation of difference, but rather the perpetual deferral of accord. This essay works both to underscore that effort, as well as to problematize it. Through unorthodox readings of Giorgio Agamben, Jean Améry and Sheldon Wolin, the essay argues that an emphasis on messianicity as the temporal mode of political repair is ultimately less productive for what I call an agonistics of reconciliation than a more nuanced approach to what Wolin calls ‘fugitive democracy’. Where the former is allied with a problematic politics of mutual respect, the latter affirms a more germane politics of abiding resentment. In the end, a startling conclusion is drawn from reading agonistic reconciliation through Wolin: democracy may be a political experience reserved for scenes of transitional justice alone. (shrink)

The decline of the rehabilitative ethos in sentencing theory in the post_1960's is a story that has been told often, and need not be rehearsed here. Penal treatment programs, once tested for their effectiveness, showed scant success _ or at most, succeeded only in limited categories of cases. Doubts grew also about the fairness of making the severity of a person's sentence depend upon his responsiveness to treatment. As penal rehabilitation diminished in influence, the key question for penologists and (...) reformers became: what conception of sentencing should follow it? My article, as well as Michael Tonry's and John Donahue's in the present volume, is devoted to this question, of the choice of sentencing rationale.I will focus, particularly, on a sentencing theory that became influential in the late 1970's and 1980's in this country and western Europe, and continues to have considerable influence today : namely, the proportionalist or 'desert' model for sentencing. I shall address briefly what this theory's main tenets are and how it differs from traditional retributivism; what has made it attractive to liberal criminologists and penal reformers during the last three decades; and whether and to what degree it has continued value and usefulness for the future. Most contemporary political theories of sovereignty – from Giorgio Agamben to Achille Mbembe – have argued that the emergency powers claimed by the Bush administration under the auspices of the War on Terror epitomized what Carl Schmitt calls a state of exception. If so, I argue, perhaps it is time for new visions of sovereignty to emerge, ones attendant to the eccentricities of the present conjuncture. Occupy Wall Street and the Arab Spring are but two obvious examples of counterpublics that (...) seem to have presented new modalities of sovereign life worth reflecting upon. Hardly states of exception, these are scenes of sovereignty that are more fraught and precarious, more democratic. I argue that the theories of sovereignty of George Bataille and Frantz Fanon may hold clues for coming to terms with these new sovereign scenes. Though often under-emphasized in the scholarly literature on Bataille and Fanon, for both thinkers sovereignty is a condition of existence, an expression of a surreal mode of esthetic experience and poetic beauty. I argue that drawing attention to the comparison of the political thought of Bataille and Fanon, and especially to the value of surrealism for contemporary political theory generally, holds promise for those of us interested in challenging the Schmittian consensus. At stake is a refreshed understanding of sovereignty, not as norm or exception, but as a condition of political life lived by everyday subjects caught in a surreal state in-between. (shrink)

Emerging research has highlighted the utility of measuring individual differences in decision-making competence (DMC), showing that consistently following normatively rational principles is associated with positive psychosocial and health behaviors. From another level of analysis, functional theories of personality suggest that broad trait dimensions represent variation in underlying self-regulatory systems, providing a mechanistic account for robust associations between traits and similar life outcomes. Yet, the degree to which broad dispositional personality dimensions predict global tendencies to respond rationally is less understood. In (...) a large online community sample (N = 804), we tested the associations between HEXACO personality dimensions, a 6-factor structural trait model, and a subset of DMC indicators (Applying Decision Rules, Resistance to Framing, Recognizing Social Norms, and Consistency in Risk Perception). Additionally, we examined gender differences across the DMC, first considering the potential for measurement non-invariance across groups for the DMC. We observed partial measurement invariance between men and women; only the Applying Decision Rules scale showed evidence of differential functioning across groups. Controlling for these differences, analyses revealed that higher Conscientiousness, Honesty/Humility, and Openness were associated with higher DMC scores. Ǝ has a winning strategy in G(At(A)) ⇐ A ∈ RaCAω, Ǝ has a winning strategy in H(At(A)) ⇒ A ∈ RaRCAω for 3 ≤ n < ω. We use these games to show, for γ ≥ 5 and any class K of relation algebras satisfying RaRCAγ ⊆ K ⊆ ScRaCA₅, that K is not closed under subalgebras and is not elementary. For infinite γ, the inclusion RaCAγ ⊂ ScRaCAγ is strict. For infinite γ and for a countable relation algebra A we show that A has a complete representation if and only if A is atomic and Ǝ has a winning strategy in F(At(A)) if and only if A is atomic and A ∈ ScRaCAγ. The central question in this book is why it seems reasonable for the words of our language to divide up the world in ordinary ways rather than other imaginable ways. Hirsch calls this the division problem. His book aims to bring this problem into sharp focus, to distinguish it from various related problems, and to consider the best prospects for solving it. In exploring various possible responses to the division problem, Hirsch examines series of "division principles" which purport (...) to express rational constraints on how our words ought to classify and individuate. The ensuing discussion deals with a wide range of metaphysical and epistemological topics, including projectibility and similarity, alternative analyses of natural properties and things, the inscrutability of reference, and the relevance of such pragmatic notions as salience and economy. The final chapters of the book develop what Hirsch contends is the most promising response to the division problem: a theory in which constraints on classification and individuation are seen to derive from the necessary structure of "fine-grained" propositions and the necessary dependence of some concepts on others. In _Why Knowledge Matters_, influential scholar E. D. Hirsch, Jr., addresses critical issues in contemporary education reform and shows how cherished truisms about education and child development have led to unintended and negative consequences. Hirsch, author of _The Knowledge Deficit_, draws on recent findings in neuroscience and data from France to provide new evidence for the argument that a carefully planned, knowledge-based elementary curriculum is essential to providing the foundations for children’s life success and ensuring equal opportunity for (...) students of all backgrounds. We confirm a conjecture, about neat embeddings of cylindric algebras, made in 1969 by J. D. Monk, and a later conjecture by Maddux about relation algebras obtained from cylindric algebras. These results in algebraic logic have the following consequence for predicate logic: for every finite cardinal α ≥ 3 there is a logically valid sentence X, in a first-order language L with equality and exactly one nonlogical binary relation symbol E, such that X contains only 3 variables (each of which (...) may occur arbitrarily many times), X has a proof containing exactly α + 1 variables, but X has no proof containing only α variables. ​This book describes argumentative tools and strategies that can be used to guide policy decisions under conditions of great uncertainty. Contributing authors explore methods from philosophical analysis and in particular argumentation analysis, showing how it can be used to systematize discussions about policy issues involving great uncertainty. The first part of the work explores how to deal in a systematic way with decision-making when there may be plural perspectives on the decision problem, along with unknown consequences of what we do. Readers will see how argumentation tools can be used for prioritizing among uncertain dangers, for determining how decisions should be framed, for choosing a suitable time frame for a decision, and for systematically choosing among different decision options. Case studies are presented in the second part of the book, showing argumentation in practice in the areas of climate geoengineering, water governance, synthetic biology, nuclear waste, and financial markets. In one example, argumentation analysis is applied to proposals to solve the climate problem with various technological manipulations of the natural climate system, such as massive dispersion of reflective aerosols into the stratosphere. Even after a thorough investigation of such a proposal, doubt remains as to whether all the potential risks have been identified. In such discussions, conventional risk analysis does not have much to contribute since it presupposes that the risks have been identified, whereas the argumentative approach to uncertainty management can be used to systematize discussions. This paper draws upon Hannah Arendt's idea of the 'right to have rights' to critique the current protection gap faced by refugees today. While refugees are protected from refoulement once they make it to the jurisdiction or territory of a state, they face an ever-increasing array of non-entrée policies designed to stymie access to state territory. Without being able to enter a state capable of securing their claims to safety and dignity, refugees cannot achieve the rights which ought to be (...) afforded to them under international law. Drawing upon both legal theory and political philosophy, this paper argues that refugees today, just as the stateless in Arendt’s time, must be afforded the ‘right to have rights’, understood as a right to enter state territory. Patients are usually granted autonomy rights, including the right to consent to or refuse treatment. These rights are commonly attributed to patients if they fulfil certain conditions. For example, a patient must sufficiently understand the information given to them before making a treatment decision. On the one hand, there is a large group of patients who meet these conditions. On the other hand, there is a group that clearly does not meet these conditions, including comatose patients or patients in the (...) late stages of Alzheimer’s disease. Then there is a group of patients who fall into the range in between. At the lower end of this range are so-called ‘marginal agents,’ which include young children and patients in the middle stages of Alzheimer’s disease. They also do not meet the typical requirements for autonomy, which is why they are usually granted fewer autonomy rights. However, some of them are capable of ‘pre-forms’ of autonomy that express what is important to them. These pre-forms differ from mere desires and reflect the identification/authenticity condition of autonomy. They have something in common with autonomous attitudes, choices, and actions – namely, they express the _value_ of autonomy. As I will argue, autonomy is a value worthy of protection and promotion – even in its non-reflexive forms. Against this background, it becomes clear _why_ we have autonomy duties, more precisely positive, autonomy-enabling duties, towards marginal agents and why we should give them as much attention as autonomy duties towards competent patients. Zum anderen nimmt der Autor neuere politische Philosophien aus Frankreich in den Blick, die eine zeitgenossische Theorie "des Politischen" im Unterschied zu "der Politik" entwickeln. Die Arbeit legt die gemeinsame theoretische Basis der scheinbar weit auseinanderliegenden Argumentationsformen frei und beschreibt sie als zwei Seiten einer Entpolitisierung der Politik: (...) politische Technokratie einerseits, politische Ontologie auf der anderen Seite. Die Studie zeigt, in welcher Weise heute wichtige Theorien zentrale Aspekte von den autoritaren Staatslehren Hegels und Carl Schmitts ubernehmen. Some people have found my distinction between meaning and significance useful. In the following revision of that distinction, I hope to improve its accuracy and perhaps, therefore, its utility as well. My impulse for making the revision has been my realization, very gradually achieved, that meaning is not simply an affair of consciousness and unconsciousness. In 1967, in Validity in Interpretation, I roundly asserted that “there is no magic land of meanings outside human consciousness.” 1 That assertion would be true (...) if, godlike, we could oversee the whole of human consciousness, past, present, and future. But we language users, being limited creatures, intend our verbal meanings to go beyond what we can pay attention to at any moment. We intend our meanings to transcend our momentary limitations of attention and knowledge. Hence there is a land of meanings beyond past and present human consciousness—the land of the future. What I should have said originally is that there is no magic lance of meanings beyond the whole extent of human consciousness, past, present, and future. This correction of my original statements leads to a deepening of the concept of meaning.In 1960 I first proposed the analytical distinction between two aspects of textual interpretation. One of them, meaning, was fixed and immutable; the other, significance, was open to change.2 I acknowledged that significance, changeable or not, is the more valuable object of interpretation, because it typically embraces the present use of texts, and present use is present value. But I argued that, in academic criticism, the significance and use of a text ought to be rooted in its fixed meaning, since otherwise criticism would lack a stable object of inquiry and would merely float on tides of preference. The claim that one reader’s opinion is as valid as another’s would then be right, despite any indignant protest to the contrary. I did not wish to dissuade people from floating on the tides of preference if that was what they wished to do. I intended to provide a firm justification for those who wished to pursue historical scholarship. 3 I also assumed that even those who did not pursue historical scholarship might sometimes wish to exploit the possibility of historically fixed meaning. Using a variation of the rainbow construction and various pebble and colouring games, we prove that RRA, the class of all representable relation algebras, cannot be axiomatised by any first-order relation algebra theory of bounded quantifier depth. We also prove that the class At(RRA) of atom structures of representable, atomic relation algebras cannot be defined by any set of sentences in the language of RA atom structures that uses only a finite number of variables.

Let S be a signature of operations and relations definable in relation algebra, let R be the class of all S-structures isomorphic to concrete algebras of binary relations with concrete interpretations for symbols in S, and let F be the class of S-structures isomorphic to concrete algebras of binary relations over a finite base. To prove that membership of R or F for finite S-structures is undecidable, we reduce from a known undecidable problem—here we use the tiling problem, the partial (...) group embedding problem and the partial group finite embedding problem to prove undecidability of finite membership of R or F for various signatures S. It follows that the equational theory of R is undecidable whenever S includes the boolean operators and composition. We give an exposition of the reduction from the tiling problem and the reduction from the group embedding problem, and summarize what we know about the undecidability of finite membership of R and of F for different signatures S. Langst als der grosse Klassiker der Soziologie und Gesellschaftstheorie unserer Zeit anerkannt, ist Bourdieu in seiner Bedeutung fur politische Theorie wie politische Wissenschaft noch kaum gewurdigt. Die Frage des Staates und der Politik hangt direkt mit derjenigen der symbolischen Gewalt zusammen (und damit auch mit der Frage nach dem politischen Wert von politischer Wissenschaft, welche dann nicht mehr nur als Aufklarung, sondern auch als Kampf verstanden werden kann), welche Bourdieu (...) zufolge eben vom Staat "monopolisiert" wird. So ware der eigentlich politische Kampf der Kampf um die Hegemonie oder, wie Bourdieu es ausdruckt, um die legitime Sichtweise der sozialen Welt - um die "Soziodizee," die "Legitimation der sozialen Ordnung, wie sie ist." Der Begriff des Staates wird in Anlehnung an Max Webers Definition des Staatsbegriffs als Inhaber des Monopols nicht nur der legitimen physischen Gewaltsamkeit, sondern auch der legitimen symbolischen Gewalt konzeptualisiert. This contribution is an attempt to integrate the notion of conceptual blending (Fauconnier and Turner 1998; Fauconnier and Turner 2002; and Fauconnier and Turner 2003) and Linda Hutcheon’s (1985) view of parody as a form of repetition maintaining a critical distance, through the analysis of a multimodal Internet meme. The case study chosen is a parodic music video of the Knack’s classic hit My Sharona, showing the absurdity in everyday life during the times of the Covid-19 pandemic. Professors Battersby and Phelan have presented a lively challenge. They urge readers to reject the later, fuzzy Hirsch, in favor of an earlier, truer Hirsch.Their first objection is that Hirsch 2 has mistaken the nature of literary meaning. Battersby and Phelan reject the view that a literary work carries a general meaning analogous to the concept of “bicycle” that can be exemplified by all bicycles. They propose that a literary work is “more appropriately conceived as … a (...) Schwinn or even a red Schwinn three-speed with a blue seat and two flat tires”. They object to my adoption of Sir Philip Sidney’s claim that literature provides both the general concept and the particular example simultaneously. Weber's Ideal Type as a Method of Forming the Content of Theoretical Concepts in Social Sciences}. Max Weber introduced the ideal type as the specific method of concept formation in social sciences. But the ideal type is not established in social research. Instead, authors in philosophy of science until today try to reconstruct and interpret what Weber said about ideal types as well as what might be their importance in Weber's social theory. The thesis of the following paper is (...) that the difficulties in understanding Weber's ideal types are linked with Weber's intensional logic of concept formation. The thesis is defended in three steps. The first step deals with Weber's understanding of what is a scientific question in cultural sciences. Secondly Weber's critical arguments against positivism, hegelianism and historism are worked out. Thirdly, Weber's method of concept formation is reconstructed. (shrink)

In recent years, some professors of medicine have applied the results of decision theory to the practice of medicine. This paper argues that this agenda is deeply flawed and potentially unethical.

This paper explores the Offence Principle. It discusses whether two constraints, additional to the criteria stated in conventional analysis, ought to be met before the Offense Principle can be satisfied: (i) that offensive conduct must be a wrong, and (ii) that the conduct must also lead to harm. The nature of the Harm Principle, and its relationship to the Offense Principle, are also considered. The paper suggests that, even if all cases in which offense should be criminalized also involve harm, (...) nonetheless there may be good reasons to retain a separate Offense Principle. (shrink)

We prove that algebras of binary relations whose similarity type includes intersection, union, and one of the residuals of relation composition form a nonfinitely axiomatizable quasivariety and that the equational theory is not finitely based. We apply this result to the problem of the completeness of the positive fragment of relevance logic with respect to binary relations.

The goal of this paper is to propose a model that distinguishes between irony and humor in the context of literary texts. The comparative model was constructed based on existing models, and elaborated on them, substantiating the model through textual analysis focusing on cues for irony and cues for humor . The research was based on four conceptual paradigms: pragmatic studies of irony, pragmatic studies of humor, a pragmatic approach to the study of literary texts, and theories of text interpretation. SummaryA discussion of the relations between mathematics and reality has a double aspect: it may concern the status of mathematical concepts and their right to be considered as part of “reality”. But the history of scientific concepts shows that attempts to single out a so‐called reality are arbitrary and futile, and the intrusion of ontological thinking in science apparently has never been fruitful.Another way to look at the problem is to investigate the use of mathematical methods to attain knowledge or (...) power about “reality”, by which is generally meant physics . Many examples from the history of sciences show that it is almost impossible to tell in advance whether a mathematical concept or theory will be useful or not.For the time being, it has not yet been possible to apply mathematics in a significant and pregnant way to various sciences. It is advocated that what is needed are not sophisticated mathematical developments, but some rather simple mathematical structures that still have to be described and applied. The present trends in mathematics, which emphasize the understanding of simple and basic mathematical concepts, allow us to hope that significant progress in these directions can be expected. When historians, archivists, and museologists turn to Eastern European photos from family albums or collections—for example, photos from the decades preceding the Holocaust and the early years of the Second World War—they seek visual evidence or illustrations of the past. But photographs may refuse to fit expected narratives and interpretations, revealing both more and less than we expect. Focusing on photos of Jews taken on the main avenues of Cerna˘u?i, Romania, before the Second World War and during the city’s occupation (...) by Fascist Romanians and their Nazi-German allies, this essay shows how a close reading of these vernacular images, both for what they show and what they are unable to show, can challenge the “before, during, and after” timeline that, in Holocaust historiography, we have come to accept as a given. Melanesian ethnography has been a substantial and enduring presence in Strathern’s comparative project of anthropology. The cornerstone of this project was The Gender of the Gift, where a model was established for demonstrating the analogies between Melanesian societies based on a system of common differences. The comparisons created in this work were centred on a real and radical divide between Melanesia and the West. Strathern’s subsequent comparative work has examined the debates surrounding new social and technological forms in the West (...) (e.g. new genetic and reproductive technologies) through drawing analogies with Melanesian social forms; she has simultaneously highlighted the limits of these comparisons. Her intention in this comparative project has been to expand the range of concepts and language used to understand western social and technological innovations that potentially affect the world at large, so that debate is not simply circumscribed by western preoccupations and concerns. As mediated through the analysis of Strathern and the other Melanesian anthropologists she draws on, the voices and interests of non-westerners can potentially inform and even reform the grounds of such deliberations.
