Friedrich Müller has made important methodological contributions to constitutional theory. Our aim in this chapter is to contextualize his approach by comparing it to previous and current contributions. The first part of the paper addresses the relation between the hermeneutic tradition and his theory. In the second part, we discuss the specific characteristics of his Structuring Legal Theory. Finally, we point to some critical aspects of the theory.

Founding our analysis on the Geneva-Brussels approach to quantum mechanics, we use conventional macroscopic objects as guiding examples to clarify the content of two important results of the beginning of twentieth century: Einstein–Podolsky–Rosen’s reality criterion and Heisenberg’s uncertainty principle. We then use them in combination to show that our widespread belief in the existence of microscopic particles is only the result of a cognitive illusion, as microscopic particles are not particles, but are instead the ephemeral spatial and local manifestations of (...) non-spatial and non-local entities. In this paper, we report on an experiment with The Walking Dead (TWD), which is a narrative-driven adventure game with morally charged decisions set in a post-apocalyptic world filled with zombies. This study aimed to identify physiological markers of moral decisions and non-moral decisions using infrared thermal imaging (ITI). ITI is a non-invasive tool used to capture thermal variations due to blood flow in specific body regions that might be caused by sympathetic activity. Results show that moral decisions seem to (...) elicit a significant decrease in temperature in the chin region 20 seconds after participants are presented with a moral decision. However, given the small sample involved, and the lack of significance in other regions, future studies might be needed to confirm the results obtained in this work. (shrink)

This is a finely edited editorial project, which summarizes the work of more than two decades done by a group of scholars—the Colombian School—lead by Fernando Zalamea, a pioneer of Peirce studies, and pragmatism in general, in Latin America.The structure of the volume unfolds in three dense chapters, each corresponding to a specific mathematical context connected to various aspects of Peirce's work. Broadly speaking, in the first chapter, Gustavo Arengas proposes the theory of higher category theory as a natural framework to represent the main traits of Peirce's semiotic; in the second chapter, Francisco Vargas develops a thorough set-theoretical model of Peirce's continuum; in the third chapter, Arnold Oostra, in a truly Peircean spirit, formalizes the notion of Intuitionistic Existential Graphs, emphasizing the idea that intuitionistic logic is the most natural context to represent and understand Peirce's diagrammatic logic. The fourth and last chapter, penned by Zalamea, provides the reader with a solid summary of the main results presented in the volume along with a robust road map to navigate through the technical details of the text.Mathematics, as implied by the title of the volume, is at the core of this project, and the authors do not shy away from the complexity, details, and depth of it in order to shed light on some of the most fundamental and groundbreaking nature of Peirce's ideas. That level of rigor and formal soundness is certainly one of the strengths of the volume, although readers who may not be acquainted with at least some basic notions of category theory or with the mathematics of Peirce's work, may find some of the text a bit terse—this is not a casual reading and it does require a certain level of commitment in order to appreciate the depth of the provided insights. On the other hand, all the background material is clearly laid out, making the volume a self-contained work which can be thoroughly enjoyed by a general audience.The real upshot of recasting some of Peirce's intuitions within the fabric of formal mathematics is not only that of providing the instruments to clarify those ideas, but also that of highlighting the role that Peirce's work has been playing in the development of modern mathematics in many relevant aspects, from the very genesis of category theory—which today is widely regarded as a necessary and unifying language in several fields of the mathematical and physical sciences—to the development of non-standard analysis, just to mention a few of them.An elegant instance of such perspective is offered by Gustavo Arengas in the first chapter, where it is argued that ∞-categories can be used to model the natural order of hierarchies implicit in Peirce's conception of the basic triadic relation between sign, object, and interpreter. What, at first glance, may seem just a simple analogy, unfolds onto a methodical and enlightening analysis of Peirce's semiotic, as the author builds [End Page 374] the connections with the relevant categorical constructions in a precise manner. Most of the rest of the chapter focuses on Peirce's notions of the pragmatic and pragmaticist maxim, and the use of basic structures such as monads, limits, presheaves and sheaves as the natural environment to better convey their meaning, both from a mathematical and a philosophical perspective. This study aimed to evaluate if eye blinks can be used to discriminate players with different performance in a session of Nintendo Entertainment System (NES) Tetris. To that end, we developed a state-of-the-art method for blink extraction from EAR measures, which is robust enough to be used with data collected by a low-grade webcam such as the ones widely available on laptop computers. Our results show a significant decrease in blink rate per minute (blinks/m) during the first minute of playing (...) Tetris. After having defined 3 groups of proficiency based on in-game performance (Novices, Intermediates, and Experts) we found out that expert players display a significantly lower decrease in blinks/m compared to novices during the first minute of gameplay, which shows that Tetris players' proficiency can be detected by looking at eye blinks/m variations during the early phase of a game session. This difference in blinks/m is observed throughout the entire game session, which supports the general conclusion that proficient Tetris players have a lower decrease in blinks/m, even when playing more difficult levels. Finally, we offer some interpretations of this effect and the relationship that our results may have with the visual cognitive workload experienced during the gameplay. (shrink)

This comprehensive textbook is devoted to classical and quantum cosmology, with particular emphasis on modern approaches to quantum gravity and string theory and on their observational imprint. It covers major challenges in theoretical physics such as the big bang and the cosmological constant problem. We consider the classical concept of time of permanence and observe that its quantum equivalent is described by a bona fide self-adjoint operator. Its interpretation, by means of the spectral theorem, reveals that we have to abandon not only the idea that quantum entities would be characterizable in terms of spatial trajectories but, more generally, that they would possess the very attribute of spatiality. Consequently, a permanence time shouldn’t be interpreted as a “time” in quantum mechanics, but as a measure (...) of the total availability of a quantum entity in participating to a process of creation of a spatial localization. This paper focuses on Kant's account of physical geography and his theory of the Earth. In spelling out the epistemological foundations of Kant's physical geography, the paper examines 1) their connection to the mode of holding-to-be-true, mathematical construction and empirical certainty and 2) their implications for Kant's view of cosmopolitan right. Moreover, by showing the role played by the mathematical model of the Earth for the foundations of Kant's Doctrine of Right, the exact relationship between the latter and physical geography (...) is highlighted. Finally, this paper shows how, in Kant's view, the progress of physical geography can be assured if and only if the free circulation of human beings is established and regulated by law. Therefore, examining the mutual relationship between the theory of Earth and the foundations of right opens new perspectives on the relationship between epistemology and practical philosophy within Kant's system. Uno dei principali problemi nello studio della mente e della sua "collocazione" consiste nell'identificazione del corretto Livello di Astrazione a cui le varie descrizioni fenomeniche e le corrispondenti ipotesi esplicative possono essere sviluppate e confrontate. L'articolo contribuisce all'attuale dibattito metodologico in filosofia della mente analizzando due nozioni fondative, quella di modello e quella di simulazione, sulla base del concetto di Livello di Astrazione. L'ambito è quello del Metodo delle Astrazioni, proposto in Floridi e Sanders [2003]. Il Metodo delle Astrazioni si (...) basa su una particolare branca dell'informatica teorica, quella dei Metodi Formali (Roever e Engelhardt [1998]; Woodcock e Davies [1996]), dove la matematica discreta è utilizzata per descrivere analiticamente le specifiche del comportamento di sistemi che elaborano informazioni. I sistemi sono descritti in termini di osservabili e regole di transizione, cioè come sistemi di transizione. Le descrizioni comportano l'utilizzo di variabili che rappresentano osservabili nella realtà, astraendo da altri eventuali osservabili. L'idea di fondo del Metodo delle Astrazioni è che tale processo di filtraggio sia ineliminabile in qualsiasi accesso alla realtà. Il tentativo di sondare un sistema in maggiore profondità produce una maggiore astrazione delle teorie e degli oggetti teorici che descrivono tale sistema. Il Metodo delle Astrazioni si presenta quindi come uno strumento per organizzare e chiarificare le varie teorie che intendono fornire una spiegazione della realtà o della conoscenza. La principale tesi dell'articolo è che "modello" e "simulazione" non possano essere pensati come nozioni a sé stanti, ma che la loro natura possa essere chiarita nei termini di tipi di relazioni tra sistemi di transizione. Nello specifico, si argomenta che la relazione di simulazione è una relazione tra gli osservabili di sistemi di transizione, mentre il modello è una relazione tra le regole di transizione di questi sistemi. Dati questi due nuovi tipi di relazioni, è possibile arricchire con ulteriori strutture di analisi il Metodo delle Astrazioni, estendendo la sua applicabilità. We prove that every quasi-Hopfian finitely presented structure _A_ has a _d_- \(\Sigma _2\) Scott sentence, and that if in addition _A_ is computable and _Aut_(_A_) satisfies a natural computable condition, then _A_ has a computable _d_- \(\Sigma _2\) Scott sentence. This unifies several known results on Scott sentences of finitely presented structures and it is used to prove that other not previously considered algebraic structures of interest have computable _d_- \(\Sigma _2\) Scott sentences. In particular, we show that every (...) right-angled Coxeter group of finite rank has a computable _d_- \(\Sigma _2\) Scott sentence, as well as any strongly rigid Coxeter group of finite rank. Finally, we show that the free projective plane of rank 4 has a computable _d_- \(\Sigma _2\) Scott sentence, thus exhibiting a natural example where the assumption of quasi-Hopfianity is used (since this structure is not Hopfian). This paper deals with the semantic issues of epistemological contextualism - the doctrine according to which the truth-conditions of knowledge ascribing sentences vary depending on the context in which they are uttered. According to the contextualist, a sentence of the form "S knows that p" does not express a complete proposition. Different utterances of this same sentence, in different contexts of utterance, can express different propositions: "know" is context-dependent. Little attention has been paid to a precise formulation of the semantic (...) contextualist thesis grounding epistemological contextualism. My goal is then to assess differences and similarities between "know" and context-sensitive terms in a natural language – in particular pure indexicals and demonstratives: my remarks are a strong argument against the postulation of an indexical element in ascriptions of propositional knowledge. In The Explanatory Dispensability of Idealizations, Sam Baron suggests a possible strategy enabling the indispensability argument to break the symmetry between mathematical claims and idealization assumptions in scientific models. Baron’s distinction between mathematical and non-mathematical idealization, I claim, is in need of a more compelling criterion, because in scientific models idealization assumptions are expressed through mathematical claims. In this paper I argue that this mutual dependence of idealization and mathematics cannot be read in terms of symmetry and that Baron’s non-causal (...) notion of mathematical difference-making is not effective in justifying any symmetry-breaking between mathematics and idealization. The function of making a difference that Baron attributes to mathematics cannot be referred to physical facts, but to the features of quantities, such as step lengths or time intervals taken into account in the models. It appears, indeed, that it does not follow from Baron’s argument that idealizations do not help to carry the explanatory load at least for two reasons: mathematics is not independent of idealizations in modelling and idealizations help mathematics to carry the explanatory load of a model in different degrees. Although the field of psychiatry has witnessed the proliferation of studies on Gene x Environment (GxE) interactions, still limited is the knowledge we possess of GxE interactions regarding developmental disorders. In this perspective paper, we discuss why GxE interaction studies are needed to broaden our knowledge of developmental disorders. We also discuss the different roles of hazardous versus self-generated environmental factors and how these types of factors may differentially engage with an individual’s genetic background in predicting a resulting phenotype. Then, (...) we present exemplar studies that highlight the role of GxE in predicting atypical developmental trajectories as well as provide insight regarding treatment outcomes. Supported by these examples, we explicate the need to move beyond merely examining statistical interactions between genes and the environment, and to investigate specific genetic susceptibility and environmental contexts that drive developmental disorders. We propose that further parsing of genetic and environmental components is required to fully understand the unique contribution of each factor to the etiology of developmental disorders. Finally, with a greater appreciation of the complexities of GxE interaction, this discussion will converge upon the potential implications for clinical and translational research. (shrink)

Intimacy: From Transformation to Transmutation The paper reflects the historical and current dynamism of the concept of intimacy. Besides differences between scientific disciplines in understanding what the substance of intimacy is, the recent discourse on change in intimacy has been dominated by the transformation theme introduced by Anthony Giddens (1992). Led by reflections of Richard Sennett (1986) the author draws attention to the opposite aspect of change in intimacy—the change in content, or the "transmutation" of intimacy. Transmutation of intimacy—the substitution (...) of the satisfaction of intimate needs with identity creation—not only contests the very essence of intimacy, but also constitutes a significant challenge for the project of intimate citizenship (Plummer 2003). In this dissertation we explore projective Fraïssé theory and its applications, as well as limitations, to the study of compact metrizable spaces. The goal of projective Fraïssé theory is to approximate spaces via classes of finite structures and glean topological or dynamical properties of a space by relating them to combinatorial features of the associated class of structures. Using the framework of compact metrixable structures, we establish general results which expand and help contextualize previous works in the field. Many proofs (...) in the domain of projective Fraïssé theory are carried out in a context dependent fashion and have thus far eluded clean generalizations. A reason is to be found in the lack of a clear understanding of which spaces are amenable to be studied via projective Fraïssé limits. We give both positive and negative results in this direction. We isolate a combinatorial condition which entails a correspondence between finite structures and regular quasi-partitions of compact metrizable spaces. This correspondence greatly aids the combinatorial-toplogical translation. We apply this machinery to study a class of one-dimensional compact metrizable spaces, which we call smooth fences. To this end, we isolate a class of finite structures—finite partial orders whose Hasse diagram is a forest—whose projective Fraïssé limit approximates a distinctive smooth fence with remarkable properties. We call it the Fraïssé fence and characterize it topologically by carefully exploiting the bridge between the combinatorial and topological worlds. We explore homogeneity and universality features of the Fraïssé fence and the properties of its spaces and endpoints, and provide some results on the dynamics of its group of homeomorphisms. ABSTRACT The paper examines the role of shame as a motivator to engage in social struggles. The author first introduces a distinction between social and moral shame arguing that, while the former can lead to a passive submission to injustice, the latter usually works as a motivating force to resist it. He subsequently discusses three cases of injustice, in which the subject is respectively the victim, the actor, and the witness. The main thesis of the paper is that in all (...) three cases the subject may feel moral shame for tolerating injustice and therefore be motivated to resist it. The conditions under which moral shame arises are discussed, while the absence of moral shame is attributed, through reference to clinical studies, to psychic defence mechanisms, such as negation and rationalisation, which allow the subject to tolerate injustice when it would be too costly to fight it. Throughout the paper, the author engages in a discussion of Honneth’s theory of social struggles, reassessing the role of recognition within the moral grammar of social struggles while attributing the due importance to the desire to live up to one’s self-ideal. What does it mean “knowing through art”? This paper develops an approach of radical cognitivism, suggesting a new way of integrating aesthetics and cognitive sciences.

I propose that artworks represent a specific and homogeneous ontological kind, grounded in a common ontological core. I call this common core ‘non-universalizable embodied meaning’, and I argue that this common core explains how artworks unfold their ontological identity at the physical, intentional, and social levels on the basis of an original and irreducible mode of material embodiment and cultural emergence; this common core functions as the constitutive rule of art and institutes an axiological normativity, that is, normativity based on (...) aesthetic value; it has a central role both in the theoretical definition of art and in the identification, recognition, and fruition of the individual artworks; it enables artistic creativity, historical transformations of art, and the current, multifaceted state of art. The discourse regarding intentionality and interpretation in analytic philosophy of art, although ample and lively, has concerned itself almost exclusively with the literary medium. Starting from a paper published by Hans Maes, I discuss the complications that may arise in straightforwardly applying current intentionalist strategies to the realm of the contemporary visual arts. I first present a detailed account of the difference between hypothetical intentionalism and moderate actual intentionalism which will help to better understand the nature of Maes’s arguments in (...) his paper. I then argue that the characteristics which shape the approach of moderate actual intentionalism cannot be accommodated by certain contemporary visual artworks. I will demonstrate how in certain contemporary artworks, should a viewer be interested in accepting actual intentions within her interpretation, she will have to do so with an extreme intentionalist posture rather than a moderate actual one. Inquisitive first-order logic, InqBQ, is a system which extends classical first-order logic with formulas expressing questions. From a mathematical point of view, formulas in this logic express properties of sets of relational structures. This paper makes two contributions to the study of this logic. First, we describe an Ehrenfeucht–Fraïssé game for InqBQ and show that it characterizes the distinguishing power of the logic. Second, we use the game to study cardinality quantifiers in the inquisitive setting. That is, we study what (...) statements and questions can be expressed in InqBQ about the number of individuals satisfying a given predicate. As special cases, we show that several variants of the question how many individuals satisfy α(x) are not expressible in InqBQ, both in the general case and in restriction to finite models. (shrink)

We argue that legal argumentation, as the subject matter as well as a special subfield of Argumentation Studies (AS), has to be examined by making skilled use of the full panoply of tools such as argumentation and story schemes which are at the forefront of current work in AS. In reviewing the literature, we make explicit our own methodological choices (particularly regarding the place of normative deliberation in practical reasoning) and then illustrate the implications of such an approach through the (...) analysis of a case study in the English law of evidence. We argue that a clear distinction must be drawn between practical argumentation and stories. Because of the institutional separation between legal judgment and fact-finding in common-law jury trials, we argue for the combination of argument and story-based analysis. (shrink)
