The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. A series of recent experimental studies have cast doubt on the existence of a traditional tension that aestheticians have noted in our aesthetic judgments and practices, viz. the problem of taste. The existence of the problem has been acknowledged since Hume and Kant, though not enough has been done to analyse it in depth. In this paper, we remedy this by proposing six possible conceptualizations of it. Drawing on our analysis of the problem of taste, we argue that the experimental (...) results in question are not a real challenge to its existence. This work presents a model-theoretic approach to the study of first-order theories of classes of BL-chains. Among other facts, we present several classes of BL-algebras, generating the whole variety of BL-algebras, whose first-order theory has quantifier elimination. Model-completeness and decision problems are also investigated. Then we investigate classes of BL-algebras having (or not having) the amalgamation property or the joint embedding property and we relate the above properties to the existence of ultrahomogeneous models.

Notwithstanding fundamental methodological advancements, scientific information about disorders of consciousness (DOCs)—e.g. Vegetative State/Unresponsive Wakefulness Syndrome (VS/UWS) and Minimally Conscious State (MCS)—is incomplete. The possibility to discriminate between different levels of consciousness in DOC states entails treatment strategies and ethical concerns. Here we attempted to investigate Italian clinicians’ and basic scientists’ opinions regarding some issues emerging from the care and the research on patients with DOCs. From our survey emerged that Italian physicians working with patients with DOCs give a central role (...) to ethics. Current Italian regulation regarding basic research conducted in patients with DOCs apparently risks to be inadequate to support scientific advancement, and would deserve a different assessment compared to ordinary treatments. We think the results of our survey deserve attention from an international audience because they exemplify the difficulty to define a shared approach to the issues related to patients with DOCs and the necessity to better assess both the ordinary and experimental treatment of patients with DOCs at the ethical and legal level. The first issue of _Artificial Intelligence and Law_ journal was published in 1992. This paper provides commentaries on landmark papers from the first decade of that journal. The topics discussed include reasoning with cases, argumentation, normative reasoning, dialogue, representing legal knowledge and neural networks.

Enrico Müller legt hier die erste philosophische Gesamtdarstellung zur Bedeutung der Griechen für Nietzsches Denken vor. Er zeigt, wie sich in Auseinandersetzung mit dem Griechentum Nietzsches eigene Philosophie entwickelte, und problematisiert deren Abgrenzungen von der Logosphilosophie der griechischen Klassik. Müller kommt dabei zu dem Schluss, dass auch Nietzsches Philosophie letztlich auf die Vorgaben der sokratisch-platonischen Dialektik angewiesen bleibt.

Local seed systems remain the fundamental source of seeds for many crops in developing countries. Climate resilience for small holder farmers continues to depend largely on locally available seeds of traditional crop varieties. High rainfall events can have as significant an impact on crop production as increased temperatures and drought. This article analyzes the dynamics of maize diversity over 3 years in a farming community of Yucatán state, Mexico, where elevated levels of precipitation forced farmers in 2012 to reduce maize (...) diversity in their plots. We study how farmers maintained their agroecosystem resilience through seed networks, examining the drivers influencing maize diversity and seed provisioning in the year preceding and following the 2012 climatic disturbance. We found that, under these challenging circumstances, farmers focused their efforts on their most reliable landraces, disregarding hybrids. We show that farmers were able to recover and restore the diversity usually cultivated in the community in the year following the critical climate event. The maize dynamic assessed in this study demonstrates the importance of community level conservation of crop diversity. Understanding farmer management strategies of agrobiodiversity, especially during a challenging climatic period, is necessary to promote a more tailored response to climate change in traditional farming systems. In this paper I argue that Rawlsians have largely misunderstood the idea of an overlapping consensus of reasonable comprehensive doctrines, thereby failing to delineate in an appropriate way the place of comprehensive doctrines in political liberalism. My argument rests on two core claims. The first claim is that (i) political liberalism is committed to three theses about the overlapping consensus. The first thesis concerns the subject of the overlapping consensus; the second thesis concerns the function of the overlapping consensus; the (...) third thesis explains how the overlapping consensus can serve its function in accordance with political liberalism’s commitment to epistemic neutrality. The second claim on which my argument relies is empirical: (ii) Rawlsians typically deny at least one of the three theses to which political liberalism is committed. Based on (i) and (ii), I conclude that Rawlsians have hitherto provided unconvincing accounts of the place of comprehensive doctrines in political liberalism. (shrink)

The idea of an ?inversion principle?, and the name itself, originated in the work of Paul Lorenzen in the 1950s, as a method to generate new admissible rules within a certain syntactic context. Some fifteen years later, the idea was taken up by Dag Prawitz to devise a strategy of normalization for natural deduction calculi (this being an analogue of Gentzen's cut-elimination theorem for sequent calculi). Later, Prawitz used the inversion principle again, attributing it with a semantic role. Still working (...) in natural deduction calculi, he formulated a general type of schematic introduction rules to be matched ? thanks to the idea supporting the inversion principle ? by a corresponding general schematic Elimination rule. This was an attempt to provide a solution to the problem suggested by the often quoted note of Gentzen. According to Gentzen ?it should be possible to display the elimination rules as unique functions of the corresponding introduction rules on the basis of certain requirements?. Many people have since worked on this topic, which can be appropriately seen as the birthplace of what are now referred to as ?general elimination rules?, recently studied thoroughly by Sara Negri and Jan von Plato. In this study, we retrace the main threads of this chapter of proof-theoretical investigation, using Lorenzen's original framework as a general guide. (shrink)

Numenius is an author who straddles the line between Middle Platonism and Neoplatonism. In this contribution, I focus on the differences between the second and the third God, which emerge from analyses of the relevant fragments. Numenius emphasizes, on several occasions, how the second God (i.e., the demiurge) has a dual nature. In this paper, I investigate the role of the demiurge in Numenius and examine in what sense the second and third God are “one.” On the one hand, Numenius (...) seems to be stressing the unity of the second and third levels of reality, but on the other hand, he also appears to be differentiating them. The present analyses concentrate on fragments 19F, 24F, 29T and 30T (respectively 11, 16, 21, and 22 in des Places’ edition). My purpose is to demonstrate that, according to Numenius, the second and the third God are one because they both can be regarded as demiurgic. Thus, Numenius conceives a kind of “double demiurgy,” which preserves the distinction between the second and the third God, who are distinguished from an ontological point of view, but who, at the same time, share a demiurgic function. The second God is then the paradigm, whereas the third God is immanent in matter as a ruling principle of the cosmos, which is similar to the World Soul, as he operates on matter in order to make it rationally ordered. Pride is a fundamental element in Hume's description of human nature. An important part of the secondary literature on Hume is devoted to this passion. However, no one, as far as I am aware, takes seriously the fact that pride often appears in pairs with vanity. In Book 2 of the Treatise, pride is defined as the passion one feels when society recognizes his connection to a ‘cause’, composed by a ‘subject’ and a (positive) ‘quality’. Conversely, no definition of vanity (...) is provided. Despite Hume's fluctuating vocabulary, I hold that a conceptual difference between pride and vanity exists. To support this claim, I analyse the common features of these two passions, showing that both pride and vanity (a) are indirect passions, (b) are self-regarding passions, and (c) have the same structure. Supported by textual evidence, I then claim that vanity is a desire of reputation, a desire to feel pride, when pride is not (yet) in place, because its cause is only imaginary and not real. Nonetheless, I underscore that, at times, ‘vanity’ means simply pride and call for greater attention on this ongoing oscillation. In conclusion, I explore the implications of this account of vanity for social interactions in Hume's philosophy, which illustrates its intrinsic ambivalence. (shrink)

In section 1 we argue that the adoption of a tenseless notion of truth entails a realistic view of propositions and provability. This view, in turn, opens the way to the intelligibility of theclassical meaning of the logical constants, and consequently is incompatible with the antirealism of orthodox intuitionism. In section 2 we show how what we call the potential intuitionistic meaning of the logical constants can be defined, on the one hand, by means of the notion of atemporal provability (...) and, on the other, by means of the operator K of epistemic logic. Intuitionistic logic, as reconstructed within this perspective, turns out to be a part of epistemic logic, so that it loses its traditional foundational role, antithetic to that of classical logic. In section 3 we uphold the view that certain consequences of the adoption of atemporal notion of truth, despite their apparent oddity, are quite acceptable from an antirealist point of view. The paper is devoted to an examination of the epistemic account of the notion of deductive inference recently provided by D. Prawitz, and based on the notion of ground. This is part of the general scenario constituted by the “Proof-theoretic semantics”, presented since the ’70s of the last century as an alternative to the standard model-theoretic explication of the notion of logical consequence.Our argument pivots on the so-called “Curry–Howard Correspondence”, which exploited the idea of considering proofs as proper mathematical objects (...) in a remarkable way. A sort of rational reconstruction of this idea is outlined, tracing it back to Hilbert and Husserl’s investigations. (shrink)

What is the theoretical and applied responsibility of practical legal policies against environmental degradation? Which political-philosophical attitude is implicit in the International and European environmental legislation for reducing and preventing the environmental degradation? The concepts and means, developed to compare us with the environmental issue, are adequate to capture the reality of these emergencies? The basic thesis, I intend to discuss and defend, argues that there is a “question incompatibility” between political liberalism and environmental protection.

In the first part of this paper, published in issue 1 of Augustinianum 63 (2023), 9-45, we examined the question of whether Irenaeus of Lyons depended on the Exposition of Logia about the Lord of Papias of Hierapolis. In this second and final part we focus on the way Irenaeus used information which, since the first decades of the second century, had been attributed to presbyters of Asia and then in particular on the way he identifies the succession of presbyters (...) with that of bishops (primarily in Rome). He links the latter with Christian origins but also profoundly alters the function traditionally attributed to the presbyters themselves, within a system he devised in order to respond to urgent problems, in a context quite different from the era in which the traditions to which he appeals were born. El artículo aborda una aplicación pedagógica del recurso retórico clásico del decorum en la pedagogía agustiniana. Se ofrece en primer lugar una introducción a la formación retórica agustiniana para posteriormente hacer un recorrido de la obra del Obispo de Hipona, deteniéndose en dos de los así llamados “Diálogos de Casiciaco”, concretamente en el De ordine, y el contra Académicos. El artículo analiza también desde la perspectiva del decorum la ep. 29, destacando cómo el Obispo de Hipona aplica dicho recurso retórico (...) a la solución de conflictos. Se aborda, asimismo, el De catechizandis rudibus, en donde el decorum, desde una perspectiva pedagógica agustiniana significa poner al alumno en la sintonía de la enseñanza, ya que según el Hiponate, es preciso “conectar para enseñar”. This paper presents an approach for legal compliance checking in the Semantic Web which can be effectively applied for applications in the Linked Open Data environment. It is based on modeling deontic norms in terms of ontology classes and ontology property restrictions. It is also shown how this approach can handle norm defeasibility. Such methodology is implemented by decidable fragments of OWL 2, while legal reasoning is carried out by available decidable reasoners. Anger is arguably one of the most important emotions in a human being’s life. An array of contemporary studies show that, far from being detrimental, anger can foster one’s self-esteem, improve their social interactions, and even benefit physical and mental health. In his Treatise of Human Nature, David Hume explicitly recognized the importance of anger. And yet, few topics have been so neglected in the Hume scholarship as his account of this passion. The following chapter aims to fill the gap (...) in the literature by showing that Hume’s analysis of anger is worth studying and strictly connected to some of the most intriguing problems in his philosophy. The stated aim of cryptocurrencies is to free the monetary system from the need to trust financial intermediaries, by relying on incentive design and technology. Many descriptive studies, however, have questioned cryptocurrencies’ delivery on the promise of trustlessness. This paper promotes a normative analysis of trust in cryptocurrencies by discussing (i) whether trust is in principle eliminable, and (ii) whether trustlessness is in itself a desirable goal. These issues are closely related, we argue, to the further issue of what kind (...) of institutions cryptocurrencies represent. We discuss the cognitive functions played by cryptocurrencies through the lens of the “extended mind” hypothesis in the philosophy of mind and hence conceive of cryptocurrencies as mind-extending institutions. As the models of institutional mind extension differ in the fiduciary bond they assume exists between individuals and institutional resources, we compare the reliance-based model of “scaffolding institutions” with the trust-based model of “cognitive institutions,” showing that the ineliminability and desirability of trust lead to seeing cryptocurrencies as instances of the latter. In the end, our discussion suggests that trust is a necessary component of cryptocurrencies’ cognitive functions and its promotion helps to perform such cognitive functions more effectively and sustainably.
