Le présent ouvrage comble une lacune. La recherche, en effet, n'avait jamais pris en vue de manière systématique et détaillée l'ensemble de la philosophie schellingienne dans son rapport à la théologie. (C'est d'autant plus surprenant si l'on se rappelle que la pensée de Schelling représente le dernier essai de grand style d'établir une médiation entre ces deux disciplines.) En pratiquant sur toute l'œuvre une coupe longitudinale - depuis les premiers écrits critiques sur le mal et le mythe, à travers la (...) spéculation théogonique des Ages du monde, jusqu'aux développements christologiques et ecclésiologiques de la dernière période - le livre retrace le devenir de la théologie de Schelling, s'intégrant dans sa pensée comme l'une de ses composantes. Cette méthode permet de mettre en évidence la façon dont le philosophe théologien s'est critiqué lui-même dans les diverses phases de sa longue carrière et a modifié ses positions initiales pour tenter d'échapper à la synthèse idéaliste de la foi et du savoir, sans parvenir toutefois à se dégager entièrement du schéma de l'identité. Le present ouvrage etudie le rapport complexe entre cette notion du sacre et les eclaircissements heideggeriens sur le divin et la mediation poetique. Il s'articule en quatre parties, dont la premiere expose la genese de l'interpretation (...) heideggerienne du sacre. La deuxieme partie propose une etude thematique du nouveau lexique que Heidegger, au contact notamment de la poesie de Holderlin, introduit dans sa meditation du sacre. La troisieme partie entreprend une serie de discernements critiques, en se laissant instruire par les principaux travaux qui ont examine explicitement la comprehension heideggerienne du sacre, du divin, et du poete. Dans une perspective synthetique, la quatrieme partie, enfin, s'efforce de ressaisir l'approche de Heidegger par le biais de ce qui la deborde, en la faisant dialoguer avec d'autres pensees philosophiques et theologiques marquantes; ce qui conduit a considerer, entre autres, la difference du sacre et du Saint. Degage a partir des developpements diachroniques de la premiere partie, le triptyque du sacre, du divin, et du poete structure aussi bien les synchronisations thematiques de la deuxieme partie que les discernements critiques fournis par la troisieme, et il est assume, tout en etant "depasse", par les chapitres systematiques de la derniere partie. We present a preliminary high-level formal theory, grounded on knowledge representation techniques and foundational ontologies, for the uniform and integrated representation of the different kinds of (quali- tative and quantitative) knowledge involved in the designing process. We discuss the conceptual nature of engineering design by individuating and analyzing the involved notions. These notions are then formally charac- terized by extending the DOLCE foundational ontology. Our ultimate purpose is twofold: (i) to contribute to foundational issues of design; and (ii) to support (...) the development of advanced modelling systems for (qualitative and quantitative) representation of design knowledge. Product structures are represented in engineering models by depicting and linking components, features and assemblies. Their understanding requires knowledge of both design and manufacturing practices, and yet further contextual reasoning is needed to read them correctly. Since these representations are essen- tial to the engineering activities, the lack of a clear and explicit semantics of these models hampers the use of information systems for their assessment and exploita- tion. We study this problem by identifying different interpretations of structure rep- resentations, (...) and then discuss the formal properties that a suitable language needs for representing components, features and combinations of these. ABSTRACT Between 1796 and 1814, two of late Enlightenment Germany's most prominent historians offered striking revisions to earlier accounts of European history. The renowned journalist, historian, and Slavicist August Ludwig Schlözer published a critical edition and translation of the Old Slavonic Primary Chronicle alongside a detailed historical commentary. This commentary presented Russia as an important protagonist in Europe's emergence from barbarism to Enlightened modernity. By contrast, his colleague Johann Gottfried Eichhorn published several historical works arguing that France had failed to (...) cultivate a mature bourgeoisie and, consequently, had not become a fully modern polity. Building on the work of J. G. A. Pocock and Michael Printy, this article examines the thought of Eichhorn and Schlözer as political responses to the crises of the Revolutionary and Napoleonic period. It thereby offers both a fresh assessment of the work of two major Enlightenment intellectuals and an analysis of how notions of European modernity were reconfigured in a period of profound political turmoil. Researchers in political sciences, communication or sociology who are interested in the public sphere are not as concerned with a civil and solidarity-based economy perspective. Conversely, economists and sociologists working on the civil and solidarity-based economy often do not use the concept of the public sphere in their conceptual equipment. This type of compartmentalization is partly due to an opposition between work, defined as an alienating activity, and political activity defined as an action typical of the free man that many (...) authors claim to borrow from Hannah Arendt and introduces a radical dichotomy between the economic and public spheres. However, as a historical investigation clearly indicates, the analytical distinction between the political order and the economic order cannot be transformed into an empirical dissociation. The civil and solidarity-based economy thus invites the researcher to think about economic activity and political activity together in order to look further into the concept of public sphere. Many criticisms have been made of optimization theory (Laville, 1999a). These objections may be explained by the fact that human rationality is bounded – that decisions are constrained by cognitive limitations (Simon, 1982). In the present paper, I will show that if rationality is bounded, then we must study the processes of decision. My thesis is that cognitive limitations lead to procedural rationality. Although this assertion has already been sustained implicitly by Simon (1959) and explicitly by Mongin (1986), it (...) has not been argued in sufficient depth. (shrink)

The parallel distributed processing (PDP) perspective brings forward the important point that all semantic phenomena are based on analog underlying mechanisms, involving the weighted summation of multiple inputs by individual neurons. It falls short of indicating, however, how the essentially discrete nature of semantic processing may emerge at the cognitive level. Bridging this gap probably requires attractor networks.

Un foisonnement d'expériences associatives et coopératives s'est manifesté dans les différents pays européens depuis les années 1970, particulièrement dans le champ des initiatives locales et des nouveaux services relationnels. Selon la grille d'analyse adoptée qui privilégie le potentiel de démocratisation, ces pratiques peuvent être mieux comprises à travers une perspective d'économie solidaire que par les références habituelles au tiers secteur, à l'économie sociale et aux organisations non gouvernementales. Néanmoins, comme l'interdépendance entre actions collectives et publiques s'avère déterminante dans l'histoire européenne (...) pour organiser une résistance à l'utopie d'une « société de marché », le devenir de l'économie solidaire est étroitement lié à la reconnaissance par les pouvoirs publics. Tant au niveau national qu'international celle-ci reste partielle et la pertinence d'un soutien ne fait pas consensus comme le montre la position de l'Union européenne.A large amount of associative and cooperative experiments has arisen everywhere in Europe since the 1970s particularly in the fields of local initiatives and new “relational” services. Our framework of analysis shows these practices are better understood by a civil and solidarity-based economy perspective, emphasizing their potential of economic democratization, rather than by the usual references to third sector, social economy or non-governmental organizations. Nevertheless, since collective and public action has interacted decisively in European history to organize resistance against the utopic vision of the “market society”, the future of this solidarity-based economy appears to be closely linked to its recognition by public policies. But at the European and national levels, this still remains partial and the relevance of such an economy is a highly controversial subject as the European Union’s position demonstrates. (shrink)

L’auteur retrace l’histoire du droit de l’environnement dans l’entrelacement des droits privés, administratif, constitutionnel et international public. Elle montre que les notions de préjudice écologique, de sécurité humaine et de Droits de l’Humanité permettent, par-delà une simple responsabilité éthique, d’incarner juridiquement un véritable ordre public écologique.

L’auteure retrace les controverses qui ont émaillé l’histoire du principe de précaution en France dans les trente dernières années après son adoption au niveau international et européen. Elle montre que le principe de précaution constitue une dimension nouvelle de la rationalité adaptée aux défis de la société contemporaine.

The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

In this paper I attempt to bring together (at least) two very different debates: one on justice, mercy and particularity, the other on the play of exclusionary reasons. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

Stakeholder engagement and dialogue have a central role in defining the relations between organisations and their internal and external interlocutors. Drawing upon the analysis of dialogic motifs, power–conflict dynamics and sociopolitical perspectives, and based on a set of interviews with the stakeholders of a consumer-owned cooperative, the research explores the dialogic potential of stakeholder engagement. The analysis revealed a fragmented picture where the co-design and co-implementation aspects were mainly related to the non-business areas of cooperative life, while business logic dominated (...) the most central aspects. Stakeholder engagement was mainly related to consensus building, while dialogic engagement based on a pluralistic understanding was only partially considered and then neglected. The social capital in the local area, the growing size of the organisation and the related power structure embrace stakeholder engagement, influencing the orientation of the dialogic dynamic. The analysis indicates that a dialogic exchange is a relative concept which depends on the interests involved and the topics discussed. It also reveals that the key factors in the democratisation of stakeholder engagement are a mutual understanding and long-term opportunities. Common sociopolitical aspects are also important, but they do not necessarily guarantee the creation of dialogism paths. The research contributes to the critical dialogic literature in revealing whether and how stakeholder engagement has been implemented in a specific setting. It also shows the limitations of voluntarist stakeholder engagement initiatives. (shrink)
