In this article, I examine the legal position of those who perform caregiving work within the context of a cohabiting relationship through a novel relational vulnerability lens. I argue that the state, through privatising and devaluing caregiving labour, situates carers within an unequal and imbalanced relational framework, exposing them economic, emotional, and spatial harms. Unlike universal vulnerability, which is inherent and unavoidable, relational vulnerability can be avoided and reduced if the state were to acknowledge that humans are embodied and relational (...) rather than self-sufficient and rational. Law’s treatment of cohabiting carers reflects the state’s broader tendency to value economic self-sufficiency, while confining caregiving to the private family. I argue that the state has a duty to respond directly to relational vulnerability and should aim to make cohabiting carers resilient. Resilience must involve the provision of material resources but should also have a normative commitment to achieving autonomy and equality for those marginalised by law and state policies. (shrink)

Teaching ethics is crucial to health sciences education. Doing it well requires a willingness to engage contentious social issues. Those issues introduce conflict and risk, but avoiding them ignores moral diversity and renders the work of ethics education irrelevant. Therefore, when (not if) contentious issues and moral differences arise, they must be acknowledged and can be addressed with humility, collegiality, and openness to support learning. Faculty must risk moments when not everyone will “feel safe,” so the candor implied in psychological (...) safety can emerge. The deliberative and social work of ethics education involves generous listening, wading into difference, and wondering together if our beliefs and arguments are as sound as we once thought. By forecasting the need for candid engagement with contentious issues and moral difference, establishing ground rules, and bolstering due process structures for faculty and students, a riskier and more relevant ethics pedagogy can emerge. Doing so will prepare everyone for the moral diversity they can expect in our common life and in practice. (shrink)

The question of a genealogy of race and gender is first and foremost a question of methodology. By bringing to bear the critical tools provided by Foucauldian methodology on the construction of race and gender in the specific historical case of Levittown, this chapter explores the manner in which the stories that inform our sense of “the way things are,” are shaped historically. Moreover, the chapter argues that the significance of the institutions and discourses becomes apparent only once they are (...) placed within the context of the play of relations of power and the deployment of bodies of knowledge. A genealogical analysis of Levittown reveals that the concepts of race and gender are not only essential to any conception of modern subjectivity, but also for the products of a network of relations of power. Many studies have emphasized the importance of medical, insurance, and workplace systems treating individuals fairly in work disability prevention and return-to-work. However, ethical theories and perspectives from these different systems are rarely discussed in relation to each other, even though in practice these systems constantly interact. This paper explores ethical theories and perspectives that may apply to the WDP–RTW field, and discusses these in relation to perspectives attributed to dominant stakeholders in this field, and to potential differences in different jurisdictional (...) contexts. Literature was sought primarily in biomedical ethics, business ethics, and public administration ethics. In biomedical ethics, four ethical principles are dominant: autonomy, beneficence, nonmalevolence, and justice. Business ethics involve theories on Corporate Social Responsibility, social contracts, and organizational justice. Public administration ethics focus on constitutional theory, citizenship, social equity, virtue, and public interest. Several concepts were identified as relevant for ethical analyses in the WDP–RTW field, including justice; individual autonomy; nonmalevolence; economic and social responsibility; and social contracts. These concepts provide a vocabulary that may be used to analyze stakeholders’ actions and interactions in RTW processes. It was also noted how the power balance between stakeholders will influence which ethical perspectives will influence RTW. Jurisdictional differences that influence RTW processes with regard to stakeholder responsibilities were identified, as well as varying beliefs as to who is the client in different compensation systems. A social contractual approach may inform an analysis of cultural and legal differences. (shrink)

Barbara Taylor, Mary Wollstonecraft and the Feminist Imagination Ruth H. Bloch, Gender and Morality in Anglo-American Culture, 1650–1800 Barbara Taylor entitles her new book Mary Wollstonecraft and the Feminist Imagination. The imagination in question is Wollstonecraft's, but, like Wollstonecraft, Taylor is interested in the imagination more generally, both the problems that the imagination gets women into and the ways in which the feminist imagination can get women out of those problems and help them imagine a more just and equitable future. (...) Ruth H. Bloch's aim in Gender and Morality in Anglo-American Culture, 1650–1800, the newly published collection of her essays, is somewhat more modest. Although her chief objective is to analyze the transformation in American views about women, gender, the family, and religion in the era of the American Revolution, she also offers case studies in the use of a culturalist approach to feminist history. Although there are important differences in approach and subject matter between these two books, their similarities and areas of overlap—not the least of which is that their authors are two of the best feminist intellectual historians at work today—make it instructive to review them together. Today the IOM has a program budget of about $13 million, which includes both private and government funds, and (...) is regarded as a leading center for health policy research.After briefly explaining the structure and general goals of IOM, this article describes several new or anticipated projects as well as some recently completed reports that have a strong ethical component.The IOMThe IOM's distinguished membership is made up of health care professionals of all sorts, scientists working in health-related disciplines, and lawyers, economists, and others knowledgeable in and involved with policies and activities associated with health issues. It is organized around eight working groups or divisions: Health Sciences Policy; Health Care Services; Health Promotion and Disease Prevention, including AIDS activities; International Health; Biobehavioral Sciences and Mental Disorders; the Food and Nutrition Board; the Medical Follow-up Agency; and the Health Policy Fellowship Programs. Each of these divisions is assisted by an oversight board that provides advice on its activities.It is important to know at the outset that IOM has decided that each of the divisions will include consideration of human values and ethical issues in their activities. The President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research considered several such issues and produced important reports about them. However, the commission was funded only until 1983. The Congressional Biomedical Ethics Advisory Committee was authorized in 1985 to address these contentious issues, but it was caught in the crossfire of congressional abortion politics and subsequently died. A new model is needed to attempt to develop national consensus on these complex, contentious issues.The Board on Health Sciences Policy has wrestled with this idea. Faced with at least two major challenges, namely, worldwide poverty and inequalities, and ecological changes, our world is confronted with the issue of balancing the concern for the social needs of the present generation, as an expression of intragenerational responsibilities, with the care for the environment for future generations, as fulfilling intergenerational responsibilities. After demonstrating how the philosophical debate indeed validates the notion of intergenerational responsibilities, this article seeks to investigate the relationship between inter- and intragenerational responsibilities. Whereas this relationship (...) is often considered as a troubled and conflicting one, I aim to show that there are reasons to link the problems of global justice and ecological degradation. It will be argued that both global inequality and the ecological crisis are moral problems caused by a particular kind of development philosophy and lifestyle. Consequently, people have a responsibility to take these social and ecological issues into account in their daily lives. In the last section, some theological reflections are provided with regard to the idea of intergenerational responsibilities, their relationship to intragenerational responsibilities, and the contribution of theology as an inspirational source for change. It highlights the untapped utility of constructionist approaches for understanding how different meanings can ultimately affect wildlife and people.

In recent decades, there has been a significant increase in the interest taken by experimental researchers in issues that have traditionally belonged to the sphere of interest of the philosophy of mind, the philosophy of cognition, and even the theology of spirituality. The availability of new research methods, as well as the increase in the knowledge of the world, has opened another door to the reality in which we live. By studying the functioning of the human brain in specific laboratory (...) conditions, scientists are looking for the answers to questions that have been troubling us for centuries: what consciousness is, how do we recognize intentions, and what are spiritual experiences? This article deals with the topic of prayer as a specific religious experience in the context of neurocognitive research. In the 20th and 21st centuries, the frequency of such studies has increased significantly; for example, through the experiments of Nina Azari, Mario Beauregard, and Andrew B. Newberg. Selected experiments in the field of the neuroscience of spirituality and their results are discussed. Important philosophical questions about how we define prayer and other spiritual experiences in the context of the above research, the interdisciplinary nature of the research, as well as emerging problems and implications, e.g., the risk of reducing these phenomena to their biological base, the explanations of religious practices and experiences in cognitive science of religion have also been raised. Although typically realized by free items, degree modification has a number of morphological exponents in Polish, including the neoclassical prefix arcy-, which, while originally attaching to profession-denoting nouns with a view to indicating a higher rank in a hierarchy, has come to perform the function of reinforcement in conjunction with adjectival bases. Since the scarce previous research concerned with the aforementioned prefixal reinforcer builds only on lexicographic material, this paper offers a quantitative, corpus-based account of the productivity of the formative (...) at issue by providing its TTR (type-token ratio) and HTR (hapax-token ratio) measures, calculated by dividing the number of, respectively, types of adjectival bases and hapax adjectives by that of all relevant tokens, in two periods in the history of Polish, namely in the Baroque epoch, when arcy- gained a strong foothold in language practice owing to the then prevalent rhetorical tendency toward a profuse employment of elements of foreign provenance, and in contemporary Polish. The results of the empirical analysis indicate a dramatic decrease in the level of the bound form’s productivity over time, to the point that the probability of an arcy-adjective encountered by a language user being unique fell from nearly 30% in the Baroque period to less than 1% at present time, which can be accounted for in terms of the formative having been superseded by more recent, functionally analogous prefixes, particularly super- and mega-. Traditional Chinese culture, Confucianism, in particular, has a non-individualist conception of what it is to be human. It conceives of people fundamentally as members of social groups—specifically, the family, the clan, the political community and the state—not as atomic individuals as perceived in modern society. The communist ideology since the middle of the last century also emphasizes the significance of ‘the common good’ of the state which describes a specific ‘good’ that is shared and beneficial for all (or most) members (...) of a given community. Nevertheless, marketization and decentralization in China today have significantly challenged the notion of a state-oriented community that directly impacts China's healthcare system, beginning with the dismantling of the rural collectives and state-owned enterprises as part of the reform and opening process. This article will address healthcare challenges in China today, examining the conceptual/ethical issues raised by public healthcare, and contending that public health concerns should go beyond the dichotomy between individualism and collectivism. The article will argue that the family-oriented model of Confucianism offers an alternative way to look at what constitute a community and common goods. The Confucian approach to ethics is relevant to healthcare today. For example, it will be much easier to find a shared idea of common good in terms of complicated issues like healthcare; it would make sense to give a larger role to families via family savings accounts, and not have everything determined by the government. There is strong theoretical support for a relationship between various characteristics of religiousness and attitudes towards business ethics. This paper examines three frequently- studied dimensions of religiousness (fundamentalism, conservatism, and intrinsic religiousness) and their ability to predict students' willingness to behave unethically. Because prior research indicated a possible relationship between the religious affiliation of an institution and its members' ethical orientation, we studied students at universities with three different types of religious affiliation: evangelical, Catholic, and none.Results of the study lend (...) support to a negative relationship between the above-mentioned dimensions of religiousness and willingness to behave unethically. In addition, students at the Evangelical university were far less willing to engage in unethical behavior than were students at either the Catholic or the unaffiliated institutions. (shrink)

In this paper, I submit that it is the controlled part of skilled action, that is, that part of an action that accounts for the exact, nuanced ways in which a skilled performer modifies, adjusts and guides her performance for which an adequate, philosophical theory of skill must account. I will argue that neither Jason Stanley nor Hubert Dreyfus have an adequate account of control. Further, and perhaps surprisingly, I will argue that both Stanley and Dreyfus relinquish an account of (...) control for precisely the same reason: each reduce control to a passive, mechanistic, automatic process, which then prevents them from producing a substantive account of how controlled processes can be characterized by seemingly intelligent features and integrated with personal-level states. I will end by introducing three different kinds of control, which are constitutive of skilled action: strategic control, selective, top–down, automatic attention, and motor control. It will become clear that Dreyfus cannot account for any of these three kinds of control while Stanley has difficulty tackling the two latter kinds. (shrink)
