Metrics shape our social worlds in many and more ways. Everyday quantifications of our preferences, our behaviors and our relationships, alter us and the institutions that we constitute. This essay takes a brief look at the metrics of business ethics through two analytic devices. Representation explains the notion that metrics can capture or demonstrate ethics and performativity explains the notion that metrics can shape or constitute ethics. The analytic distinction between representation and performativity is obscured in practice when metrics become (...) targets, indeed much of the social power of metrics comes from their use as targets. Hence, we should pay attention to the world of practice in which measuring and doing are entangled. However, we should not lose sight of the limitations of measurement and the possibility that there are areas of ethical life best left unmeasured. (shrink)

The increasing global demand for energy necessitates devoted attention to the formulation and exploration of mechanisms of thermal heat exchangers to explore and save heat energy. Thus, innovative thermal transport fluids require to boost thermal conductivity and heat flow features to upsurge convection heat rate, and nanofluids have been effectively employed as standard heat transfer fluids. With such intention, herein, we formulated and developed the constitutive flow laws by utilizing the Rossland diffusion approximation and Stephen’s law along with the MHD (...) effect. The mathematical formulation is based on boundary layer theory pioneered by Prandtl. Governing nonlinear partial differential flow equations are changed to ODEs via the implementation of the similarity variables. A well-known computational algorithm BVPh2 has been utilized for the solution of the nonlinear system of ODEs. The consequence of innumerable physical parameters on flow field, thermal distribution, and solutal field, such as magnetic field, Lewis number, velocity parameter, Prandtl number, drag force, Nusselt number, and Sherwood number, is plotted via graphs. Finally, numerical consequences are compared with the homotopic solution as a limiting case, and an exceptional agreement is found. (shrink)

Some clerics (ulama) in the Islamic world are of the view that practical politics is closely related to Islam, which regulates how an order of state is run. This view historically departs from Islamic constitutional jurisprudence texts that justify political Islam. Likewise, some Islamic boarding schools’ (pesantren) clerics, better known as kyai in Indonesia, are of the view that practical politics is not only a world affair but also an activity based on the application of Islamic legal principles in achieving (...) public welfare. This study aims to determine the academic basis of pesantren ulama in making decisions to be active in practical politics in Indonesia. Using a qualitative approach through interviews, the results of this study indicate that the political decisions of pesantren ulama are strictly based on the perspective of political Islam and fiqh principles that justify the involvement of ulama in politics. Furthermore, the conclusion leads to three perspectives in political motivations for pesantren’s ulama: to gain power, to preach Islamic values, and to demonstrate the existence of ulama in modern state administration.Contribution: The contribution of the study is to describe the permissibility of politics as an alternative to preaching and to show the existence and ability of ulama in state administration. This paper seeks to examine the constitutional and legal implications of Islam in Malaysia with a focus on fundamental liberties and particular reference to freedom of religion; conversion of non-Muslim minors to Islam; Hudud law, `Islamic dress,' offenses against precepts of Islam; and, women, Heads of State and Islam. These areas are chosen as a result of cases in civil courts contesting fundamental liberties, and debate in the public domain. The problems which have surfaced revolve around the following concerns: subjecting (...) non-Muslims to Islamic law or principles; subjecting Muslims and non-Muslims to an Islamic fiqh principle contrary to humanistic principles; the problems of a dual legal system with attempts to demarcate jurisdiction but at the cost of fundamental liberties; and, the relevance of the ``Islamic state" vs. ``secular state" issue in rights adjudication. The courts appear to be in a conundrum when dealing with these cases, and this suggests a conflict in the application of Islamic and civil laws. These issues are not new; they have persisted for a long time. Recently court decisions have aroused a public perception that the problem is one of Islam versus the non-Muslim. This tends to be perceived in ethnic terms as well, specifically as a contest between the Malays, who are mostly Muslims, and other races. The author calls for increased secularization in Malaysia as a way to resolve these issues. (shrink)

This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. Jama’at-i-Islami is one of the most prominent religious parties of Pakistan that also take active part in the politics of the country. The party is credited with the introduction of Islamic element in the political and constitutional set up of Pakistan. This paper highlights the efforts of the party for the enforcement of Islamic Constitution soon after the creation of Pakistan up to the enforcement of the Constitution of 1956. The style, ideas and politics of the party regarding the Islamic (...) Constitution in Pakistan from 1947 to 1956 are the main focus of the discussion. The second part of the paper deals with the contribution of the Jama’at in the Ahmadiyah issue. How reluctantly the party was involved in the issue and in what way could it win the sympathy of the people as a main leading force of the campaign against Ahmadiya influence in 1953 have been examined in the course of the discussion. Among the civilization challenges, recognizing the human freedom and drawing its constraints have continuously been contestable. Hence, the recognition, definition, pledge and delineation of the boundaries of freedom have a special position in the declaration of rights. In the meantime, considering the historical intersection of jurisprudential foundations with the modernist thoughts, defining the concept of freedom and delineating its boundaries will be crucial. This definition provides a groundwork for elucidating and interpreting other Articles via identifying their positions in creating solutions (...) to the problems of public administration. The current study is an effort to recognize the concept of freedom and its boundaries in the constitutional system of the Islamic Republic of Iran via employing a descriptive-analytical method. Our findings indicate that the perception of freedom in the Constitution of the Islamic Republic of Iran is convoluted and interpretable. Because of the existing ambiguities in balancing among the historical concerns, the boundaries of freedom can be redefined based on the temporal and historical circumstances by the pressure of social forces. Ethical considerations, especially those religiously driven, play a significant role in shaping business conduct and priorities. Profit levels and earnings constitute an integral part of business considerations and are relevant and closely linked to prevailing ethics. In this paper, Islamic prescriptions on profit maximization are introduced. Islamic business ethics are outlined as well. It is suggested that while Islamic teaching treats profits as reward for engaging in vital activities necessary for serving societal interests, profit maximization is not sanctioned and therefore (...) should not be the goal of ethically guided business ventures. This book offers comparative ontologies of both Islam and liberalism as discourses more broadly construed. The author argues that, despite recent efforts to speak of overlapping consensuses and discursive congruence, the fundamental categories that constitute 'Islam' and 'Liberalism' remain very different, and that these differences should be taken seriously. Thus far, no recent scholarly works have explicitly or meticulously broken down where these differences lie. The author rigorously explores questions related to rights, moral epistemologies, the role of religion in the (...) public sphere, and more general approaches to legal discourse, via primary and canonical sources constitutive of both Islam and liberalism. The term non-governmental organisations (NGOs) has been well-known for the development of human rights, charity works and organisational developments. On the other hand, some NGOs also have their specialised roles to help the community such as in conflict resolution, cultural preservation, policy analysis and information provision. Apart from that, there are many categories of NGOs: Islamic-oriented non-governmental organisation (IONGOs), faith-based organisation (FBO), humanitarian NGOs (HNGOs) and government organised NGOs (GONGOs). However, in this research, the researchers focus on how IONGOs compare (...) with NGOs in assisting the lesbian, gay, bisexual, and transgender (LGBT) community based on four hijrah NGOs: Persatuan Islah Movement, Persatuan Insaf Pahang, Hijrah Republique Network and Usrah Iqrak. These four NGOs were chosen because of their roles in assisting the LGBT community. In this research, the researchers adapt the qualitative research by using a case study method; phenomenological approaches and a document analysis have also been applied as well. The result shows that these four IONGOs are different from the NGOs based on the seven typologies applied: intersection, distinct, substantive, subset, co-existing, atomistic grouping and constitutive. The implications of this article highlight the fact that IONGOs are different from the LGBT NGOs in Malaysia as they focus more on spirituality and an Islamic pathway. Hence, future research should include focus group interviews with all the members in NGOs that assist the LGBT hijrah in the community. This article takes a critical look at three conceptions of Islamic education. I argue that conceptions of Islamic education ought to be considered as existing on a minimalist–maximalist continuum, meaning that the concepts associated with Islamic education do not have a single meaning, but that meanings are shaped depending on the minimalist and maximalist conditions which constitute them, that is, tarbiyyah (nurturing), ta`lim (learning) and ta`dib (goodness). I then explore some liberal conceptions of cosmopolitanism, showing how these notions connect with (...) meanings of Islamic education. Finally, I show how maximalist views of Islamic education connect with cosmopolitanism, while minimalist views of Islamic education seem to undermine the pursuit of cosmopolitanism. (shrink)

There exists a limited pluralist model of regulating or `managing' religious diversity in contemporary Europe. This pluralist model, however, is in contrast to the limitations that appear at the state level, which reflect an increasingly illiberal, secular Europe. Such contrast stems historically from tensions that exist between the national and transnational aspects of the model itself, but it also reflects the emerging debates on religious pluralism and the democratic state. With the settlement of post-colonial migrants (with Muslims constituting a large (...) majority) a public debate on the role of religion in Europe has resurfaced as these communities exist outside the historical formation of Western church-state relations and are challenging the very underpinning of what comprises a `liberal' democratic state. In particular, it is the role of Islam in secular Europe that frames several questions in this debate: to what extent is it necessary to regulate religious freedoms in the `public sphere' in order to protect the democratic state? What restrictions on minority religions should be considered `necessary in a democratic society’ and what limitations should be placed on state interference in minority religions as protection against the undue influence of a dominant social group? Against this backdrop, this article explores the historical social formation of religious pluralism in the European context and examines the legal and political frameworks at the national and regional levels to `regulate' diversity. Globalization has consequences for the religious sphere, but it does not constitute a break with the previous situation. It constitutes rather an acceleration of a process begun with the birth of nation-states. The impact of the values of modernity is general, since even those in power, whatever their tendency, invoke values of democracy, progress, freedom and justice, whereas submission is what was required of subjects. Nevertheless, people today look to religion for fixed reference points, because of the brutal transition from (...) the Middle Ages to the 20th and 21st centuries, and because modernity is not a endogenous phenomenon. Islam then is playing the role of bulwark against western hegemony. It is also instrumentalized both by the powers that be and by the oppositions, all of whom give themselves over to displays of one-upmanship over fidelity to Islam. Does Islam then maintain its relevance in the context of globalization? The fact is that the bases on which social relations are now founded no longer permit discrimination on the ground of sex or religion, and that there is a loosening of the grip of traditional ritualism and that more and more Muslims are looking for an understanding of the faith that is freed from old-fashioned dogmas. These new givens are being demonstrated particularly when it comes to the exercise of power and the condition of women. As a result, traditional conceptions are destined to evolve, particularly concerning the status of the Koran, the growing awareness of the historical process that made the Koran into a juridical code, the archetype that has been stuck to the person of the Prophet, and the alienation that consists in the sacralization of every human act. Islam, one of the worlds great faiths, was born as a result of the revelation of the Quran to the Prophet Muhammad (c. 570-632) in Arabia. A proper understanding of the Islamic present depends on an accurate knowledge of the way in which Islamic thought developed from medieval times onwards. For instance, Islam evolved a sophisticated theology and set of philosophical systems of its own, which owed something to the impact of Greek thought, but became uniquely Islamic because of the (...) vital presence within that faith of the Quran. Furthermore, Islam soon came into contact with Greek philosophy and science, and a translation movement into Arabic began. The roles of Kason and Revelation, and the primacy that was to be given to one or the other, came to the fore. Problems which had also vexed Christianity such as anthropomorphism, free will and predestination provided intellectual stimulation for Islamic thinkers, while the mystical impulse, articulated in Islamic Sufism, imbued the writings of several of the theologians and philosophers considered in these volumes. The spread of Islam from the Arabian Peninsula to the North Africa and al-Andalus in the west, to the Chinese borders and the Indian Subcontinent in the east, helped Muslims to establish close contact with many different cultures. One of the consequences of this is that both the increase in scientific accumulation and the emergence of new needs in military, financial and similar aspects accelerated the studies on geography. Islamic geographers of the first period, not only did they describe the (...) cities to which they travelled but also they depicted the cities about which they could collect data. These first works, which can be considered as a kind of written maps, have some common features, although they are written in different geographies and revealed by different schools. One of these common points is the terminology that they used in depictions of cities. This terminology suggests that there was a common city typology among Muslim geography scholars that stands out in the depiction of cities. In this study, particularly we will try to answer a number of questions such as what the concepts of authors are and what they mean and the relationship between these concepts by examining the uses of authors in their works.SummaryThe depictions of settlements which were designated as madīna in the works of the medieval Muslim geographers have some common characteristics. One of them is the terminology used by the authors in depictions of cities. In this study, particularly I tried to answer a number of questions such as what the concepts of authors are and what they mean and the relationship between these concepts by examining the uses of authors in their works. Then, a common city typology which is prominent in the depiction of cities among the Muslim geography scholars has been put forward. The structural elements that are considered to constitute this typology also revealed the topographic elements of a city at that time.The cities conquered by muslims had a great impact on the emergence of the terminology used by Muslim geographers in depicting cities. I can say that especially Persian influence; the cities in Iran, Khurāsān which were captured from the Sāsānians and Mā Warāʾ al-Nahr districts was effective. However, geography writers did not restrict using this terminology for only these regions, they also had continued to use in depiction of other regions such as North Africa and al-Andalus. This means that a common language and terminology emerged and started to be used.Geography authors point to five main elements that I have examined in separate titles while describing Islamic cities that they called "madīna". These are kuhandiz, shahristān, rabad, the part so-called “the adjacent agricultural fields / agricultural fields surrounded by wall” by us and the last part rustāq connected to main city center. Depending on ways of development of cities, these elements sometimes developed from inside to out, in other words from center to environment, sometimes surrounded by independent walls and sometimes adjacent to each other. However, a city did not have to have all these elements at the same time. This situation was totally related to development level of city, and the cities which had all these elements were the military, administrative and economically developed centers of the period. From the methodical point of view, it should be noted that the examples given in the study were selected from among the other cities in order to ensure that to understand the subject in best way and ensure that the silhouette on the city typology is seen better. Because it is possible to find examples of each element in all city depictions of Islamic geography writers. Kuhandiz, shahristān/madīna, and rustāq are the elements that can be seen in the pre-Islamic period. It is possible to think of the Islamic period as a period in which these words were conceptualized, new madīnas and rabads were formed, surrounded by walls and rabads were gradually transformed into madīnas. In geography texts, it is seen that there is a concept confusion between kuhandiž and buildings named qalʿa, ḥiṣār and ḥiṣn. However, as some writers hade tried to emphasize, "kuhandiz" had been using for these structures which were previously known as fortress (especially ḥiṣn or qalʿa) due to their proportion to shahristāns / madīnas of city centers, and were notably seen in the regions of Khurāsān and Mā Warāʾ al-Nahr. Kuhandižs represent the centers of pre-Islamic cities and were continued to be used for the same purpose in the early Islamic period. But, these old areas were gradually abandoned due to the development of new parts of settlement under Muslim administration. Shahristāns were residential areas where the majority of people lived. With the Islamic period, the word “shahristān” had been terminologically changed to “madīna” and use of this concept by scientific circles was gradually disappeared in time. At this point, it is one of the issues to be considered in the examination of geography works that the use of “madīna” in Arabic both for the concept of the city in which we examine the structural elements in this article, and for “shahristān” which is one of the elements of the city.As it is understood from the geographical texts, madīna was continued to be established by Muslims in cities for centuries. These are also examples of change in cities as a result of development and housing activities after the conquests. However, we don’t have much information in the geography works about the cities which had more than one shahristān /madīna before the inhabit of Muslims. As far as we can reach, the only example in our resources with multiple madīnas/shahristān belonging to the pre-Islamic period is Bukhara.As in the developed cities of the period such as Bukhara, Samarqand, Marw and Balkh, it is seen a generaly circular fortification wall which usually surrounded main center of cities including kuhandizs, madīnas/ shahristān and mostly later rabads. So, it is more appropriate to consider the areas between these walls and other parts of city (kuhandiz, shahristān/madīna, rabad) as an independent element because of the fact that they were lands with determined borders and were defined by separate concepts. I have used “adjacent agricultural area” for this element for now. Thus, this area constitutes one of the structural elements of the cities.Rustāqs were parts of Persian-Sāsānian urbanization and land administration, and had continued to be partially implemented during the Islamic period. They were the source of livelihood of the cities from foundation stage and were an indispensable tool of the society based on agriculture in that ages. Depending on size, the cities could have dozens of them. As can be seen in the case of Balkh, the rustāḳs especially connected to the big city centers were not composed of one or several villages. Moreover, these rustāqs could contain big settlements called madīna which were their centers. (shrink)

In this context, the poetry of Jahiliyyah, which is the source of the Qur'an's style and expressive power (expression/utterance), is important in terms of having the mentioned function.The work, which was introduced, fills a significant gap in the field by referring to the contacted function of the poem of Jahiliyyah in a theoretical and practical sense. The (...) work analyzes selected eulogies from the poems of important poets of the Jahiliyyah period in a deep way, taking into account the morphological and syntactic functions of the language. The work, which refers to the elements that should be considered in the analysis of poetry through the texts, draws attention with its didactic and dialectical style, on which the taste for language is based. Our study aimed to investigate what Muslim families in England have the opportunity to have religious education for their children and to examine the institutions or structures that provide Islamic education opportunities. Document analysis as a qualitative method was adopted in our study. Academic books and articles related to the subject, statistical records, various re-ports provided by the state and private institutions, school curricula, school inspection reports, and law articles, and some court decisions constitute the main data sources. Maximum diversi-ty (...) sampling from the purposeful sampling types was used in determining the schools that were examined their Islamic curriculum, and it was tried to include as many different curriculum examples as possible. The fact that religious lessons are compulsory in schools in England and that this lesson is taught with a multicultural approach can be seen as an opportunity. On the other hand, there is a flexible education system in England. Muslim faith schools, supplementary schools (madrasa, maktab, and mosque school), and the home-schooling system are places and structures where Islamic education is carried out within the scope of formal and informal education. It is seen that Muslim faith schools are allowed to be opened as 'voluntary aided schools' by defining their distinctive religious characters as Muslim. The number of ‘state-funded Muslim schools’ is very limited, but their existence carries symbolic weight as a recognition of the Muslim com-munity’s right to establish such schools. It is understood that Muslim faith schools were opened mostly in the category of ‘independent schools’. Although there are various discussions about it, it is also important for Muslims to have informal religious education, in addition to formal education; it is allowed to open schools that offer Islamic education under the name of madrasa, maktab or mosque school. Families who send their children to the community schools because of the insufficient number of Muslim faith schools send their children to madāris (singular: madrasa), makātib (singular: maktab), or mosque schools which are called as ‘supplementary schools’. Social and moral values are taught here, including the teaching of the Qur'an, as well as sīrah (the biography of the Prophet), fiqh (jurisprudence), and Islamic history. It was understood that families who want to protect their children from the unhealthy envi-ronment of the school have the right to prefer home education, since the school is not compul-sory. In this sense, home-schooling can be considered as another opportunity for Muslim fami-lies to have their children Islamic Education. In addition to all these opportunities, the lack of a standard in these educational structures, the unqualified teachers, the inadequacy of curriculum development studies, and as a result, lack of qualified teaching materials are important problems. Economic limitations emerge as the first obstacle to increase the number of Muslim faith schools and to improve educational quali-ty. This situation threatens the quality of education by giving rise to poor buildings, insufficient resources, insufficient health and safety standards, and inexperienced management. Another threat to the quality of education is that teachers for independent schools do not have to have Qualified Teacher Status (QTS). While negative perceptions about Muslim schools have been identified as another challenge, it is expressed in various sources that Muslim students are frequently exposed to Islamophobia in various ways in public schools. Linking mosques and Islamic education institutions to radicalization and making them a subject of discussion is another noteworthy issue. Although there is no evidence of the relationship between Muslim schools and terrorist acts in England, Muslim schools are subjected to suspicions of being po-tential breeding grounds for future extremists. It seems necessary to take some actions for madrasahs who do not want to be under the con-trol of the state to reach certain standards and increase the quality of education. For example, Muslim supplementary schools should be united under the same roof of an association like The Association of Muslim Schools. This will help to attain certain standards, to increase the quality of education, and to create opportunities for various cooperation and sharing of experiences. Also, it should not be seen enough that the teachers in the madāris only have religious educa-tion, and their pedagogical competencies should be improved by subjecting them to various educational programs. Islam is present in the history of Cuba from very early times, but it did not begin to be practiced in an organized way until the 90s of the last century, when a religious revival took place in the country. Since then, and despite having different elements from Cuban customs, the practice of Islam has spread throughout the entire Island and its presence is increasingly notorious in the religious framework of the nation. That is why it is necessary to carry (...) out studies that try to give answers and look not only at the reason for the rise of the Islamic religion in Cuba but also at the significance of this religion for Cuban Muslims. Thus, it is proposed as a general aim to analyze the significance of Islam in the production of meanings and life projects of Cuban Muslims. To comply with it, a questionnaire and an interview were applied to some Muslims. This made it possible to show that Islam is the center of life for most of them, it is a way of concatenation for the development of various areas, it constitutes a lifestyle and influences the future perspectives of Muslims. It was thus demonstrated that there are high levels of religious regulation in the population studied. (shrink)

In this article we consider the forms of democratic participation that revolve around issues of religious faith and Islam. The context of such work is one in which a concern with the levels of participation in the political institutions of Western Europe and North America feature prominently in both journalistic and academic debate. The article speaks to debates that are concerned with the efficacy of specific forms of participation. In doing so we argue that we need to think carefully about (...) the forms of social action that constitute participation in the democratic process. We also need to think precisely about definitions of the political with which people engage. If we take the political as a domain in which the ethical settlement of society is contestable, the sorts of mobilization around faith communities that this article describes are clearly a form of political participation. Yet the article argues that the reasons many become involved in these forms of social organization in contemporary East London is precisely because they are seen as less complicit with mainstream political institutions of the British state. This article argues that women’s human rights were and are being violated in Afghanistan regardless of who governs the country: Kings, secular rulers, Mujahideen or Taliban, or the incumbent internationally backed government of Karzai. The provisions of the new constitution regarding women’s rights are analysed under three categories: neutral, protective and discriminatory. It is argued that the current constitution is a step in the right direction but, far from protecting women’s rights effectively, it requires substantial revamping. The constitutional commitment to (...) international human rights standards seems to be a hallow slogan as the constitution declares Islam as a state religion which clearly conflicts with women’s human rights standards in certain areas. The Constitution has empowered the Supreme Court to review whether human rights instruments are compatible with Islamic legal norms and, in case of conflict, precedence will be given to Islamic law. Keeping this in view, it is argued that Afghanistan’s ratification of the Women’s Convention without reservations has no real significance unless Islamic law dealing with women’s rights is reformed and reconciled with international women’s rights standards. The contemporary viewpoint of many scholars is that politics and religion are two parallel discourses which never meet; or that religion is a personal matter which should not be injected into politics. Their argument for taking this stand is that the two are incongruent and therefore, it is better these are left apart. But religion is associated with morals, truthfulness, honesty and a host of moral virtues all of which are mere playthings in the hands of so-called politicians, the consequence (...) of which may affect the citizens of the country negatively. The view taken here is the relationship between religion and politics has become symmetrically impossible to divorce one from the other. More importantly, the paper brings the democratic contribution of the Prophet Mohammed towards establishing a just and equitable society through his activities and the Medina Constitution, drafted during his time. Attention is given to the democratic administration of the successors of the Prophet with a view to establishing the fact that if Islam is practiced in its truest form, there are democratic values to be found in it. And if such Islamic virtues are made use of, they can not only sustain democracy, but also improve on it. (shrink)

The ambition of “scientific creationism” is to prove that science actually confirms religion. This is especially true in the case of Muslim creationism, which adopts a reasoning of a syllogistic type: divine revelation is truth; good science confirms truth; divine revelation is henceforth scientifically proven. Harun Yahya is a prominent Muslim “creationist” whose website hosts many texts and documentary films, among which “Evidence of the true faith in historical sources”. This is a small audiovisual production which, starting from some archeological (...) files, seeks to demonstrate that Qur’an truth precedes science but is equally proven by it. In this paper, we examine the organization of the scientific and religious argumentative repertoires and, in particular, what in each of them is taken as evidence and gets access to an authoritative status. It leads us to show how much this type of Muslim creationism constitutes a kind of scientism. (shrink)

In a related vein, for certain social theorists writing on modernity, the uniqueness of the West is clarified through an imaginative [mis]interpretation of other cultures or civilizations. Too often, however, the apparent gains in Western self-insight reflect an ‘inability to constitute oneself without excluding the other’ (Cornelius Castoriadis). Ironically Castoriadis himself, in a project we might term an (...) ethnography of the West (see his writings on ecology, capitalism, rationality, contemporary culture, racism, Greek philosophy/history, and the environment) is prone to the same vice, especially in his identification of the West as the sole autonomous society. This article argues that in the shariainstitution of a legal autonomy, Islam and Islamism alike demonstrate an affinity with modernity as defined by Castoriadis. In the light of this Islamist autonomy, it concludes that Castoriadis’ vision of modernity as a struggle between opposed imaginaries of autonomy and rational mastery needs reformulating. (shrink)

The four books under review here are all very different, and yet they all set out to describe Islamic philosophy and they all succeed to a certain extent. Three of them are substantial texts, two by many authors, but actually the most interesting is the short book The Story of Reason in Islam by Sari Nusseibeh. It is a sustained discussion of the role of reason in Islamic culture, and actually constitutes an argument that extends from start to finish on (...) the topic—and it is a very potent argument at that. In many cases, mosques have been accused by anti-terror agencies as a potential place to spread transnational Islamic ideologies. This study examines the perceptions of mosque administrators (ta’mīr) about Pancasila, Islamic sharia and transnational ideology. This research took place in South Tambun, a densely populated subdistrict in Bekasi, West Java. Mostly populated by urbanites, it has heterogeneous religious understanding. A quantitative research method with descriptive statistics is used in this study to analyse the results of the survey conducted. Furthermore, a (...) qualitative technique is carried out through a series of interviews conducted with the respondents. Triangulation is carried out to increase the validity and credibility of the findings. The results showed that 40% of mosque administrators surveyed thought that transnational ideologies were not in accordance with the spirit of Pancasila. Meanwhile, the remaining 40% and 20% of respondents, respectively, consider transnational ideologies to be dangerous to social order, and divisive. The qualitative analysis shows that the respondents do not want the implementation of Islamic sharia and an Islamic state within the Indonesian constitutional framework.Contribution: This research can be used by policymakers and anti-terror agents to proportionally and participatively involve mosque administrators to narrow the wiggle room for the spread of transnational ideology. The article analyses Egyptian jurisprudence on the issue of apostasy, with a focus on conversion from Islam to Christianity. It argues that the Egyptian judiciary has failed to develop a harmonious relationship between Islamic law and the principle of freedom of religion. It looks at how the majority of cases examined before the Egyptian judiciary reveal a continued tension between freedom of religion as defined in international human rights law and its judges’ interpretation of Islamic law as a constitutive element (...) of public order. Recently, the Supreme Administrative Court tried to break through traditional barriers regarding the right of converts of Christian origin to record their re-affiliation to Christianity in their documents of identification, and pragmatically justified this precedent in light of the requirements of modern states, whereby identity cards should reflect the correct information of each citizen. Yet it argues that the court was not conscious of freedom of religion as a fundamental individual right, and moreover, that this precedent has not been followed with respect to converts of Islamic origin. Finally, the paper argues that, for a sustainable solution to the legal tensions concerning apostasy in Egyptian courts, a new perspective is required on the relationship between Islamic law and religious freedom whereby the universal understanding of freedom of religion can be legitimized from within Islamic legal traditions. In this chapter, we examine a few potential problems when inquiring into the ethics of medieval Christian and Islamic mystical traditions: First, there are terminological and methodological worries about defining mysticism and doing comparative philosophy in general. Second, assuming that the Divine represents the highest Good in such traditions, and given the apophaticism on the part of many mystics in both religions, there is a question of whether or not such traditions can provide a coherent theory of value. Finally, the (...) antinomian tendencies and emphasis on passivity of some mystics might lead one to wonder whether their prescriptive exhortations can constitute a coherent theory of right action. We tackle each of these concerns in turn and discuss how they might be addressed, in an attempt to show how medieval mysticism, as a fundamentally practical enterprise, deserves more attention from practical and moral philosophy than it has thus far received. In recent years, Islamic feminism has become a prevalent and controversial topic among scholars from Muslim countries and Western feminists. While respecting the efforts of Muslim activists, this paper argues that because Islamic perspective is inherently anti-pluralist, it is not conducive to feminism and even at odds with it. Since it is impossible to make any generalizations about Muslim countries, this paper focuses on the debate of Islam and feminism as it relates to Iran. Islamic laws that are the ground (...) for constitutions in many Muslim countries treat men and women unequally. In countries with a theocracy, Islam becomes a political system where the power of the ruling elite, which are the clerics, becomes an important obstacle on the way of reforms. As a worldview, Islam provides a fixed identity of women and men that is irreconcilable with any liberating theory. The significance of this discussion lies in the potential of celebration of “Islamic feminism” for reinforcing the fusion of religion and politics in a country such as Iran, which has a religious state. The abbot and apocalyptic theorist Joachim of Fiore (c. 1135–1202) created many enigmatic medieval diagrams. His Liber figurarum, produced in Cosenza and based on now-lost prototypes, consists of painted figurae that concretized the central tenets of his many apocalyptic treatises, sermons, hymns, and letters. These diagrammatic images are attributed to his hand or to the first generation of followers, and, collectively, they constitute a subcategory of apocalyptic art that elides narrative norms. This essay explores a single figura that features a (...) chromatic seven-headed dragon inspired by the twelfth chapter of the Book of Revelation. Analysis of the diagram and comparison to painted content in a contemporary polemical text reveals the figura’s pivotal role in the pictorial formation of anti-Islamic content in the twelfth and early-thirteenth centuries. This article examines the Radio Islam controversy of 1997, in which a South African Muslim radio station, affiliated with the conservative Deobandi organization Jamiatul Ulama, forbade women’s voices on its airwaves, citing the notion that women’s voices in this context were `awrah, and thus should not be heard on the radio. It locates this event and the legal, ethical and theological debates that ensued within the context of emergent post-apartheid constitutional discourses on gender and religious freedom, and post-apartheid religious media. (...) The article then situates these debates against the nature of ‘public’ religion during and after apartheid. Edward W. Said’s Orientalism has attained canonical status as the key study of the cultural politics of western representation of the East, specifically the imaginative geographies underwriting constructions such as the Middle East and the Islamic world. The Ottoman Empire overlapped both European and exteriorized Oriental space during much of the period that Said dealt with, yet while the existence of the empire is referred to in Said’s study, the theoretical implications of that presence for his critique of Orientalist discourse (...) are not. The material presence of the Ottoman state, in the Arabic-speaking lands, but also crucially, and for a longer period, much of south-east Europe and Anatolia, highlights long-standing Oriental geopolitical and cultural agency in the face of unidirectional narratives of western encroachment. Attention to the specific discursive manoeuvres undertaken by the West to handle that disruptive, intrinsic Ottoman presence in Europe itself may add traction to the notion that the Orient was imagined as a radically exterior point of comparison. It is argued that the history of western representation of the Ottoman Empire constitutes a pre-Orientalist discourse, whose dual, perennial purpose is to make pragmatic accommodation for an Ottoman Oriental material presence in Europe yet never to fully acknowledge its discursive presence as being of Europe. I argue that by supplementing Said’s critique with a full consideration of the Ottoman legacy, a reformulation is possible that integrates the Islamic Orient as an intrinsic component of historically informed notions of European space, while dissolving notions of the absolute distinction of that latter construct from the wider milieus in which it is embedded. The politics of nativism directed at Catholic immigrants in 19th-century America offer a fruitful comparative perspective through which to analyze the discourse and the politics of Islam in contemporary Europe. Anti-Catholic nativism constituted a peculiar North American version of the larger and more generalized phenomenon of anti-immigrant populist xenophobic politics which one finds in many countries and in different historical contexts. What is usually designated as Islamo-phobia in contemporary Europe, however, manifests striking resemblances with the original phenomenon of American nativism (...) that emerged in the middle of the 19th century in the United States. In both cases one finds the fusion of anti-immigrant xenophobic attitudes, perennial inter-religious prejudices, and an ideological construct setting a particular religious-civilizational complex in essential opposition to Western modernity. Although an anti-Muslim discourse emerged also in the United States after 11 September, it had primarily a geo-political dimension connected with the ‘war on terror’ and with American global imperial policies. But it lacked the domestic anti-immigrant populist as well as the modern secularist anti-Muslim dimensions. This explains why xenophobic anti-Muslim nativism has been much weaker in the United States than in Europe. (shrink)

This study aims to analyse the pros and cons of imposing penalties or fines in law enforcement regulations for violating health protocols in Indonesia. Some people consider that the norm of the fine sanctions in statutory provisions regulating health protocol violators is unconstitutional, but others say it is constitutional. As a country with the largest Muslim population in the world, a study of the perspective of Islamic law is essential. This article uses a normative legal research methodology using two main (...) approaches: the statutory and conceptual approaches. The results show that fines are found in the criminal law clusters and state administrative law. Penalties in state administrative law in their enforcement do not require intervention from other institutions. Still, they can be carried out directly by government officials whose authority has been determined in the laws and regulations. Meanwhile, from the Islamic perspective, the fine sanctions can be applied, in the context of hifz Al-Insan, in Maslahah Mursalah as part of the maqasid al-Syari’ah. The obligation to obey government regulations is part of a person’s obedience to God’s commands. Contribution: This study’s findings can support the government in enforcing the law to combat the spread of the coronavirus disease 2019 (COVID-19) in Indonesia and other countries because, constitutionally, the law is legal. Then, the legality of fines for violators of the COVID-19 health protocol, from an Islamic perspective, does not contradict maqasid al-shari’ah. So, there should be no doubts for Muslims to obey these regulations. (shrink)

Originally published in 1958. This volume brings into focus an area of Islamic religio-philosophical thought to which relatively little attention has been paid by modern scholars of Muslim thought. The importance of the subject lies in the fact that it constitutes a central point at the confrontation of the traditional Islamic and Hellenic thought currents.

The article explores a particular mode of time synthesis as carried out in the field of Islamic micro-finance in Indonesia. It approaches this financial experiment through Deleuze's tripartite division of time and the concept of promise advanced here. I argue that the analytical promise the concept of promise holds is partly related to its ability to circumscribe a field of practice that is at once theological and economic and partly to its privileging of the time of the future. What the (...) study of Islamic micro-finance offers to studies of Deleuze is a timely reminder that this explicit privileging is not adequate in and of itself for ‘relativising’ the effects of habit and memory on time, thought and politics. This is primarily because promising has a dual, ‘schizoid’ and distressed constitution: it is motivated as much by the affirmative ‘will to power’ as by the negative ‘will to improve’. (shrink)

This volume constitutes an attempt at bringing together philosophies of time--or more precisely, philosophies on time and, in a concomitant way, history--emerging from Christianity's and Islam's intellectual histories. Starting from the Neoplatonic heritage and the voice of classical philosophy, the volume enters the Byzantine and Arabic intellectual worlds up to Ibn Al-Arabi's times. A conscious choice in this volume is not to engage with, perhaps, the most prominent figures of Christian and Arabic philosophy, i.e., Augustine on the one hand and (...) Avicenna/Ibn Sina on the other, precisely because these have attracted so much attention due to their prominence in their respective traditions--and beyond. In a certain way, Maximus the Confessor and Ibn Al-Arabi--together with Al-Fārābi--emerge as alternative representatives of their two traditions in this volume, offering two axes for this endeavor. Arsalan Khan offers an ethnography of the normative vision that drives Pakistani Muslim men from diverse social and economic backgrounds to participate in a transnational Islamic piety movement: Tablighi Jamaat. Khan examines how Tablighis constitute the domain of religion in ritual and semiotic practice, how they place an ethical commitment to hierarchy at the heart of religion, and how this, in turn, becomes the basis for restructuring domestic and political life.

The purpose of this contribution is to shed some light on the inter-relationships between ethics and economics in Islamic religion, and mainly to assert that ethics constitute endogenous phenomena in Islamic economics. In Islam, economic behaviours and transactions cannot be separated from ethics and values. The Islamic principles are intended to govern, direct and control human beings’ behaviours in their daily economic lives. They are aimed at helping people to distinguish between good and bad things while they do any economic (...) activity. It is worth noting that the moral values in Islamic economics are derived from the main sources of Islam namely: the Quran (the holy book of Islamic religion) and Sunnah (the teachings and behaviours of the prophet of Islam: Muhammad PBUH 570-632 AD). Both of them represent the principal pillars of Shariah (Islamic laws and guidelines), which is seen by Muslims as the proper way to happiness, not only in economic life but in all aspects of life. Sunnism constitutes eighty percent of the Islamic world. The most academic and renowned religious seminary in the Sunni world is Al-Azhar University in Egypt, and it is from here that most verdicts on novel issues such as human cloning are decreed and disseminated throughout the Islamic and non-Islamic worlds. The perspective of this seminary and of other significant Sunni jurisprudential councils and figures are alluded to throughout this essay. I lay out the method of legal derivation employed by the Sunni (...) clergy and scholars and then illustrate how they have arrived at their prohibition on human cloning.
