Bearing on mind the idea of the proverb “Justice Delayed is Justice Denied” Macedonian Legislator within the new Code of Criminal Procedure has introduced several legal mechanisms for accelerating the criminal procedure. The most important instruments among them, by all means, are the Guilty Plea and Sentence Bargaining. In this article, the author elaborates the practical implementation of these CPC’s provisions and performs analysis of its implementation by the Basic Court Skopje 1 in Skopje, as the biggest and most caseload-burdened (...) court in Macedonia, and by the Public Prosecution Office in Skopje. The analysis discovered several weak points, which should be properly addressed, both through theoretical scrutiny and through introduction of amendments to the CPC or through production of a general opinion by the Supreme Court. Only through these amendments to the legal provisions of the CPC can be expected to have improved court practice in a manner which would accentuate the real/just benefits of these instruments for accelerating of the criminal procedure. Several conclusions and suggestions for improvement or specific issues, which were determined as problematic were developed, such as: tackling the impact of a guilty plea by one of the codefendants to the other codefendants who did not plead guilty; treatment of the altered statement by one of the codefendants during the plea agreement and its use against the other codefendant; and the burden of proof and amount of evidence which is necessary to support the sentence bargaining process. Several legal scholars have recently argued that U.S. tort law’s physical-emotional distinction commits tort to the objectionable position of mind-body dualism, but they have not considered the distinction’s role as an aid to judicial cognition and decision-making. Drawing primarily on the law of negligent infliction of emotional distress, this essay argues that tort’s physical-emotional distinction is not a relic of mind-body dualism but a heuristic that judges have used to structure and simplify the difficult but unavoidable task of drawing lines (...) between legally cognizable and non-cognizable harm. The analysis has at least three normative implications: (1) users of tort’s physical-emotional distinction should clarify that they neither endorse dualism nor depreciate emotional harm; (2) because judicial expertise may not extend to the task of drawing lines between legally cognizable and non-cognizable harm, judicial performance in this area may be more adequate than critics suggest; and (3) although it may not be possible to determine the optimal way of drawing lines between legally cognizable and non-cognizable emotional harm, moral-philosophical tools such as Rawlsian and Scanlonian contractualism may be able to identify partial or pro tanto considerations for choosing among different ways of doing so. We define what it means for a function on ω1 to be a collapsing function for λ and show that if there exists a collapsing function for +, then there is no precipitous ideal on ω1. We show that a collapsing function for ω2 can be added by forcing. We define what it means to be a weakly ω1-Erdös cardinal and show that in L[E], there is a collapsing function for λ iff λ is less than the least weakly ω1-Erdös (...) cardinal. As a corollary to our results and a theorem of Neeman, the existence of a Woodin limit of Woodin cardinals does not imply the existence of precipitous ideals on ω1. We also show that the following statements hold in L[E]. The least cardinal λ with the Chang property ↠ is equal to the least ω1-Erdös cardinal. In particular, if j is a generic elementary embedding that arises from non-stationary tower forcing up to a Woodin cardinal, then the minimum possible value of j is the least ω1-Erdös cardinal. We consider the possible complexity of the set of reals belonging to an inner model M of set theory. We show that if this set is analytic then either 1M is countable or else all reals are in M. We also show that if an inner model contains a superperfect set of reals as a subset then it contains all reals. On the other hand, it is possible to have an inner model M whose reals are an uncountable Fσ set (...) and which does not have all reals. A similar construction shows that there can be an inner model M which computes correctly 1, contains a perfect set of reals as a subset and yet not all reals are in M. These results were motivated by questions of H. Friedman and K. Prikry. (shrink)

We present a direct proof of the consistency of the existence of a five element basis for the uncountable linear orders. Our argument is based on the approach of König, Larson, Moore and Veličković and simplifies the original proof of Moore.

Maharam algebras are complete Boolean algebras carrying a positive continuous submeasure. They were introduced and studied by Maharam [D. Maharam, An algebraic characterization of measure algebras, Ann. of Math. 48 154–167] in relation to Von Neumann’s problem on the characterization of measure algebras. The question whether every Maharam algebra is a measure algebra has been the main open problem in this area for around 60 years. It was finally resolved by Talagrand [M. Talagrand, Maharam’s problem, preprint, 31 pages, 2006] who (...) provided the first example of a Maharam algebra which is not a measure algebra. In this paper we survey some recent work on Maharam algebras in relation to the two conditions proposed by Von Neumann: weak distributivity and the countable chain condition. It turns out that by strengthening either one of these conditions one obtains a ZFC characterization of Maharam algebras. We also present some results on Maharam algebras as forcing notions showing that they share some of the well-known properties of measure algebras. (shrink)

The paper questions some of the premises in studying academic spin-offs in developed countries, claiming that when taken as characteristics of ‘academic spin-offs per se,’ they are of little help in understanding the phenomenon in the Eastern European countries during the transitional and post-transitional periods after 1989. It argues for the necessity of adopting a path-dependent approach, which takes into consideration the institutional and organisational specificities of local economies and research systems and their evolution, which strongly influence the patterns of (...) spin-off activity. The paper provides new findings and original arguments in support of Balazs’ seminal theses (Balazs 1995, 1996) about the emergence of academic spin-offs during the early transition. It reveals key economic and policy mechanisms bearing on academic entrepreneurship in Eastern Europe, such as the tensions between economic and political nomenclatures of former Communist Parties, where the dismantling or preservation of the power of political nomenclature resulted in different patterns of development—rapid reforms in the ‘first wave’ of EU accession countries or the establishment of rent-seeking and assets-stripping economies in countries like Bulgaria and Romania, making the transition period especially difficult. In the latter, a specific economic environment emerged, unknown in Western Europe and in the ‘champions’ of transition—such as suppression of the authentic entrepreneurship in a number of economic sectors, disintegration of corporate structures, etc. Thus, the paper reveals the common ground behind the two conflicting tendencies in post-socialist academic spin-offs, partially outlined in other research (Simeonova 1995; Pavlova 2000): as an authentic form of academic entrepreneurship grasping the opportunities opened up by the economic crisis and compensating failures in science and technology policy on the one hand, and as specific rent-seeking strategy draining valuable public assets on the other (the latter, in turn, boosting the negative attitudes in local scientific communities). The paper provides new findings about the evolution of the academic spin-offs in Bulgaria along the two polar trends and their positive and negative repercussions on parent research institutions. While art and science still functioned side-by-side during the Renaissance, their methods and perspectives diverged during the nineteenth century, creating a still enduring separation between the "two cultures". Recently, artists and scientists again collaborate more frequently, as promoted most radically by the ArtScience movement. This approach aims at a true synthesis between the intuitive, imaginative methods of art and the rational, rule-governed methods of science. To prepare the grounds for a theoretical synthesis, this paper surveys the fundamental commonalities and differences (...) between science and art. Science and art are united in their creative investigation, where coherence, pattern or meaning play a vital role in the development of concepts, while relying on concrete representations to experiment with the resulting insights. On the other hand, according to the standard conception, science seeks an understanding that is universal, objective and unambiguous, while art focuses on unique, subjective and open-ended experiences. Both offer prospect and coherence, mystery and complexity, albeit with science preferring the former and art, the latter. The paper concludes with some examples of artscience works that combine all these aspects. (shrink)

The scientific novelty of the research consists in identifying and substantiating the interrelations in the process of social reproduction, which provides innovative educational and educational activities in a music college. As a result, the authors have developed a technology of social audit of the process of reproduction of the socio-cultural potential of youth in a music (...) college. The technologization of the process made it possible to develop a model for managing the reproductive processes of the socio-cultural potential of college youth based on the principles of a project-oriented approach. In this book we attempted to gather together a set of chapters that describe new ways of approaching questions about aesthetics and innovation. Rather than going over old ground, the chapters describe attempts to break out in new directions. The book begins with a description of von Ehrenfels development of a Gestalt theory of aesthetics so evocative of the Vienna of 1900 that readers will wish that they had been there to experience the intellectual excitement and ends with a survey (...) the very latest research on brain scan research on perception of art. In between, we encounter chapters as diverse as a description of cognitive effects on art perception and on the analogies between oscillations in art history and waves in the physical world. About half of the book contains chapters by well known western psychological aestheticians and half chapters by Russian scholars many of whom will be new to western readers. As well as describing new methods and results, the chapters by Russian scholars will be novel to most western readers, because the Russian perspective on aesthetics and innovation is rather different than the traditional western perspectives. Looking at phenomena from new viewpoints never hurts and very often helps in science. (shrink)

This book's critical approach addresses the anachronism, essentialism and ethnocentrism that underlie contemporary theoretical and methodological uses of the term «cosmopolitanism». It explores the concept of cosmopolitan reason from the viewpoints of comparative literature, psychoanalysis, phenomenology, postcolonialism and moral philosophy.

The current coronavirus pandemic has presented many scientific disciplines, including philosophy, with various theoretical and practical challenges. In this paper, we deal with three philosophical issues related to the pandemic and specific approaches to them. The first part of the article is dedicated to the analysis of the term?expert,? whose significance was highlighted at the outbreak of the pandemic. By examining Plato?s ancient and Goldman?s modern understanding of this concept, we will try to emphasize the importance of expert opinion in (...) crisis circumstances. In the second part of the paper, we will deal with the issue of public mistrust of scientific authorities as well as the problem of the flourishing of so-called conspiracy theories. Goldenberg?s and Cassam?s approach to this topic will help us see where the source of these problems might lie and what potentially harmful consequences they can produce. In the third part of the text, we list some of the main moral dilemmas we have faced since the beginning of the pandemic. Special attention is paid to Kant?s moral philosophy in which we find advice on how an individual should act in times of crisis. (shrink)

We are demonstrating that the Luttinger model with short range interaction can be treated as a type of Fermi liquid. In line with the main dogma of Landau’s theory one can define a fermion excitation renormalized by interaction and show that in terms of these fermions any excited state of the system is described by free particles. The fermions are a mixture of renormalized right and left electrons. The electric charge and chirality of the Landau quasi-particle is discussed.

Artificial intelligence research connected with learning theory ("deep learning," “machine learning,” analysis of the quality of learning, etc.) has existed for many years; however, there have been few investigations in that area conducted from a robust philosophical methodological basis.

In the academic year just past, the Expert Commission on Philosophical Disciplines of the Higher Certification Committee [VAK] processed 441 cases pertaining to the award of degrees and ranks. Of these, positive decisions were handed down in 333 cases, and negative decisions in 9 cases, while final decisions have not yet been taken on 99. Of the total number, 418 cases were examined, 114 of these for the degree of Doctor of Philosophical Sciences and 304 for Candidate in Philosophical Sciences, (...) and final decisions were taken on 323, while 95 were referred to further expert examination. In this article we consider the material dimensions of schooling as constitutive of the possibilities inherent in “fixing” education. We begin by mapping out the problem of “fixing education,” pointing to the necrophilic tendencies of contemporary education—a desire to kill what otherwise might be life-giving. In this sense, to “fix” education is to make otherwise fluid processes-of-living static. We next point to the material realities of this move to fix. After establishing the material consequences of perpetually fixing schools, we provide (...) a brief overview of two critical perspectives that might be shown as attempts to “unfix” education: critical pedagogy and unschooling. Though both offer critiques of normative education, these approaches are also bound by their failure to fully engage with the material dimensions of schooling. As such, both critical pedagogy and unschooling inadvertently cut off key possibilities for human flourishing within educational environments. In their rush to “unfix”—to counter the necrophilic tendencies of contemporary education—these approaches exclude or otherwise foreclose upon resistive challenges to the normative order that extend from the margins. In response, we turn to the possibilities for unschooling within the materially public spaces of schools. These are the spaces where fixity fails—possibility extends from unschooling in schools, from unfixing the process of fixing education. We end by considering the possibilities inherent in Community Service Learning as a valuable means to engage in a radically public, and unfixed, educational system. (shrink)

This paper examines different forms in which?Third Serbia? is being discursively constructed. This concept has recently been offered within the public arena as the alternative to the former division into?First? and?Second? Serbia. Although the name is the same,?Third Serbia? is not one but many. They all share an explicit call for overcoming cleavages and extremes, which are perceived as overdrawn, artificial, and/or removed from genuine concerns and interests of Serbian society. There is also a moral claim contained in this, since (...) what is offered is presented as better and more correct than the previous dichotomy. The various facets of?Third Serbia?, their similarities and divergences, will be explored based on the analysis of a corpus of texts from daily and weekly press in which this signifier is found.
