Why do Americans, and so often, American writers, profess moral sentiments and yet write so little in the traditionally "moralistic" genres of maxim and fable? What is the relation between "moral" concerns and literary theory? Can any sort of morality survive the supposed nihilism of deconstruction? Jefferson Humphries undertakes a discussion of questions like these through a comparative reading of the ways in which moral issues surface in French and American literature. Humphries takes issue with the "amoral" view of deconstruction (...) espoused by many of its detractors, arguing that the debate between the theory's advocates and opponents comes down to two opposing literary and moral traditions. While the American tradition views morality as a rigid system capable of being enforced by injunctions along the lines of "Thou shalt" and "Thou shalt not," the French tradition conceives of morality as a function of a relentless and unsentimental pursuit of truth, and finally, an admission that "truth" is not a static thing, but rather an ongoing process of rigorous thought. The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of law. The (...) reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. This article shows how sixteenth- and seventeenth-century arguments about historical evidence and elite humanist traditions of textual criticism and historical method evolved into the secular political theory of the eighteenth century. It shows how the French crown sponsored scholars who worked on empirical, source-based history as a tool for political prudence, but as this critical historical methodology became public, the crown realized it could be used against its interests, as in the case of the Affaire de Thou. In the (...) mid-seventeenth century, Colbert sought to suppress the old royal humanist historical tradition; however a number of political critics such as Amelot de La Houssaye and Pierre Bayle worked to publicize the tools of historical, political criticism, setting the stage for Enlightenment critics of absolutism such as Durey de Meinières and ultimately Montesquieu and Gibbon. The present article tries to show the originality of Lukács’s theory of Actuality (Wirklichkeit) by comparing it with the same notion in Hegel’s Logic. It results that Lukács’s interpretation of Marxism and the Russian Revolution depends on a clear and independent theoretical position with regard to Hegel and his Idealistic theory of Modality. Particular importance is given to the new conception of the Dialectical interplay between the notions of Objective Possibility and Historical Necessity.

The starting point of our research is the recent discussion within history of education about the aim and scope of historical educational research. More specifically, it deals with the relationship between the past and the future and is characterized by two clashing paradigms. The recent discussion within history of education is from the perspective of philosophy of education extremely interesting. Particularly intriguing is the way in which history of education defines its role of giving shape to a (...) future. Given the criticism of the means‐end reasoning and the fact that ‘utopia’ in some sense always implies this, and that it plays itself nearly always a role when a stance is taken concerning history of education, what is defended here is the need of a different way to think about the relationship between the past, the present and the future thus to give ‘utopia’ a different place. Therefore we make use of Emile Cioran's History and Utopia. Cioran's criticism of the utopian position can be indicated by the following three sets. Not the past, neither the future, but the present is what one should be concerned with; not unity but diversity; not finding the solution, the final truth, but making room for the freedom of the human being. I first read of him in these pages a decade or so ago, and even though I was thinking a lot about pragmatism and democratic theory, and shared many of his interests, I didn't much like his philosophy. While I liked his style, the vocabulary seemed awkward. His finite idealism confused me. I had problems with his ontology, and his tendency towards historicism seemed odd. I even wrote an essay critical of The Midworld (New York: W. W. Norton, 1982), though I never made an aggressive effort to publish it. [End Page 289]This is a good thing, because I would have regretted publishing that essay. I say this because both Michael J. McGandy's The Active Life: Miller's Metaphysics of Democracy, and the new edited collection of Miller's writings entitled The Task of Criticism, do an excellent job of revealing the contemporary significance of Miller's work. Collectively, they have convinced this skeptic that the midworld and its ontology of functioning objects are an important contribution to contemporary American philosophy.The Task of Criticism faces several challenges. First, George P. Brockway supervised the publication of five volumes of Miller's collected works, and Fell himself edited a 1990 volume on Miller's philosophy (The Philosophy of John William Miller, Lewisburg: Bucknell University Press), followed by Stephen Tyman's Decrying the Ideal (Carbondale: Southern Illinois University Press, 1993). Colapietro published Fateful Shapes of Human Freedom: John William Miller and the Crises of Modernity (Nashville: Vanderbilt University Press) in 2003. Do we really need another volume? Second, Miller's brand of idealism is not very fashionable these days. Is there any hope that pragmatic idealism can inform contemporary social theory, and make a contribution to the very real and concrete problems faced by modern democratic institutions?I believe that the answer to both of these questions is "yes." Recognizing the importance of previous volumes devoted to Miller's philosophy, the editors present The Task of Criticism as the first comprehensive introduction to Miller's philosophy, and it attempts to cut a middle ground between a complete collection of essays and a "best of" anthology. The editors want to provide a framework for understanding Miller's philosophy, and in this attempt they succeed admirably.Why? Because the editors have provided a structure for Miller's thought that was lacking in earlier collections, and by focusing on the issues of philosophical method, historiography, and community, they have provided a framework for understanding Miller's philosophy. In so doing, they have also firmly established the continuing relevance of Miller's work. It addresses the presence of the past character of art both in Hegel and contemporary philosophy and aesthetics. The book's innovative contribution lies in unifying the Hegelian thesis with discussions of contemporary art and philosophy. The author not only offers a Hegelian exegesis but applies the idea (...) of the past character of art to themes that are both related to Hegel's philosophy, such as the French Revolution and the modern state, Kantian aesthetics, and religion and the sacred space disclosed for art, and going beyond Hegel, such as Celan's poetry, Gramsci's criticism of Croce, human rights, and even the grunge rock band Pearl Jam. While all such frameworks attempt to challenge "the anthropocentric assumption that nonhuman matter is intrinsically passive or non-agential and thus external to or separable from (human) meaning," Figures of Entanglement enters this burgeoning conversation by centering the unique contributions of Karen Barad (xi, x). Readers may recognize this collection from a 2016 special issue of Review of Communication. Yet, with a new foreword by editors Christopher N. Gamble and Joshua S. Hanan and an afterword by Laurie Gries, this collection makes Barad's distinct approach to matter's rhetoricity even more apparent, underscoring its fruitful potential for new materialist rhetorics invested in ethical, political transformation.In the book's foreword Gamble and Hanan differentiate Barad's per-formative new materialism from "vital" as well as what they refer to as "negative" new materialisms to show the generative potential of Barad's framework and the notion of entanglement (x). Other new materialisms tend to be "inclusionary"—add matter and stir—and fail to complicate "the human" itself and its differences (xiv, xi). First, vital and negative new materialisms maintain a distinction between being and knowing, allowing humans to emerge with a unique capacity to "objectively observe and know the existence of something essential, determinate, and unchanging about [End Page 395] reality that precedes and remains unaffected by both its own activities and our observations of it" (xi). On the contrary, Barad's performative approach suggests that "no aspect of reality—including human thought, meaning, and observation—is in any sense external to matter or ever remains entirely unchanged by matter's ongoing performances" (x). Here, humans are not "outside" of observation, but all observation "human or otherwise" co-constitutes what is observed (xi). Second, failing to interrogate "the human" in an attempt to observe matter's vitality is an ethical flaw that makes other approaches less capable of grappling with difference: they have been charged with "erasing associations between race, gender, and matter" and (re)producing a homogenizing, "Western-colonialist notion of humanness" (xiv). In contrast, Barad's is a "thoroughly relational," performative new materialism (1).Barad's concept of "entanglement" draws attention to the indeterminacy of matter and meaning, but it is accompanied by an ethical imperative to examine how difference, human or otherwise, is produced and the implications of power imbalances that arise through these enactments. For Barad, the notion of entanglement does not dissolve difference; difference is what matters. Indeed, they give us a way of thinking about how performative intra-actions produce difference through material-discursive practices, or apparatuses—differences that may be expected but are not inevitable. Rhetorical scholars are therefore invited to interrogate the production of boundaries that cause harm and reconfigure them, rather than assume the discreteness of boundaries from the start. Gamble and Hanan thus make a convincing case for how Barad's work may contribute to important scholarship in decolonial and critical rhetorics for which vital and negative new materialisms are less equipped.Gamble and Hanan utilize the introduction to show how Barad's per-formative new materialism both "supports and affirms" rhetorical materialism, or rhetoric's materiality, and enriches it (5). Ushered in by Michael Calvin McGee, "standard" rhetorical materialism worked to challenge the centuries-old debate about rhetoric's secondary, supplementary status vis-à-vis philosophy by recognizing rhetoric as part of a "shifting and dynamic material history" (6). Scholars often turn to Livy’s famous digression on Aulus Cossus and the spolia opima (4.17–20) to shed light on his larger political inclinations. These readings generally regard Livy as either an Augustan (or at least a patriotic Roman) or an apolitical skeptic. Yet neither view, I argue, fully explains the Cossus affair. What is needed is an interpretation that recognizes the political nature of the Cossus digression and its skepticism toward Augustus. Attending to Livy’s rhetorical strategy in the digression allows (...) us to see it as an instance of oblique criticism of Augustus and his control over Roman life. The explanatory power of this reading extends to episodes from the life of Romulus as well. I argue Livy uses these stories to make a theoretical argument about the nature of despotism, namely, that it seeks to control narratives of the past just as much as it aims for political domination. Gracchus and Cicero are contrasted in 10.3; two of Vergil's verses (...) are again compared with their supposed models in ch. 11.4; a segment of Ennius′ Hecuba is contrasted with its Euripidean original in 13.27; Cato's and Musonius′ formulations of a similar sententia are confronted in 16.1; in 17.10 Vergil's description of Etna is compared to Pindar's; the value of Latin erotic poetry is weighed against the Greek in ch. 19.9, in which an Anacreontean poem and four Latin epigrams are cited; and finally in 19.11 a ‘Platonic' distich is set side by side with its Latin adaptation, composed by an anonymous friend of Gellius, though in this case no comparison of the poems is attempted. Proponemos analizar el alcance de las nociones roigeanas de "teoría y crítica" como categorías epistemológicas para un humanismo crítico latinoamericano desde una lectura alternativa de Teoría y crítica del pensamiento latinoamericano. Indagamos de qué forma estas categorías involucran la legitimidad del discurso filosófico, decisiones en torno del problema del sujeto y de la verdad y modos de entender la historia. Mostramos cómo Roig opera una ruptura, en el marco de lo que él denomina una ampliación metodológica en el campo del (...) quehacer filosófico, al imbricar conceptualizaciones epistemológicas con ejercicios reflexivos en los que el filosofar explora la experiencia vital, construye sus propias fuentes y se abre a una dimensión axiológica. En el marco de este desarrollo, Roig revisa el "legado", incorpora otras voces e interviene críticamente la estructura axiológica de los discursos y analiza sus formas de reconocimiento. Buscamos mostrar las herramientas teóricas y críticas que ofrece este libro en particular para discutir las condiciones y posibilidades del saber filosófico como saber práctico social, situado y liberador y los términos de los humanismos que supone o interpela. We propose to analyze the scope of Roig´s notions, "theory and criticism", as epistemological categories to reach a critical humanism of Latin America, based on the book Teoría y crítica del pensamiento latinoamericano, as an alternative reading. We evaluate how these categories involve the legitimacy of philosophical discourse, and the decisions taken on the subject´s problem, the truth and the possible ways to understand history. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates.
