This article examines the municipal ID card programs in New Haven and San Francisco. With a municipal ID card, undocumented immigrants can access basic city services and identify themselves with police and other city officials. The article draws on twenty-eight interviews with key stakeholders to show that city officials navigated the conflicting demands of ID card supporters and opponents to create a local membership policy focused on improving city administration, not expanding the rights of undocumented immigrants. In capitalizing (...) on their discretionary administrative powers to develop programs that safeguard the health, safety, and welfare of all city residents, officials in New Haven and San Francisco managed to promote the integration of undocumented immigrants into city affairs without upsetting the federal monopoly over immigration and citizenship powers. This new form of local bureaucratic membership has implications for the urban citizenship literature and illustrates that city officials have some freedom to develop programs that benefit undocumented immigrants. This article attempts to open the debate on a territorial development perspective that fixes the interest in organized territories that are characterized by the existence of a community with a local identity, politically and administratively regulated. We conceive these territories as subjects of development promotion interventions. For this we propose a model for the creation of Municipal Development Forums, which with the participation of local actors, can generate a tailor-made Local Development Program. The development program will consider a diagnosis (...) of the productive profile of the territory and its relationship with the characteristics and origin of goods or services consumed at the municipality. Based on the diagnosis, the causes of the decoupling between the local production system and consumption needs can be detected. And with this, find a way to readjust local production systems to meet the demand for goods and services of the inhabitants, generating new companies and encouraging local consumption. (shrink)

Food issues are generally regarded as agricultural and rural issues. The urban food system is less visible than such other systems as transportation, housing, employment, or even the environment. The reasons for its low visibility include the historic process by which issues and policies came to be defined as urban; the spread of processing, refrigeration, and transportation technology together with cheap, abundant energy that rendered invisible the loss of farmland around older cities; and the continuing institutional separation of urban (...) and rural policy. Despite its low visibility, the urban food system nonetheless contributes significantly to community health and welfare; to metropolitan economies; connects to other urban systems such as housing, transportation, land use, and economic development; and impacts the urban environment. We examine existing or potential city institutions that could offer a more comprehensive look at the urban food system. Dutch municipalities are confronted with an increased number of prescribed environmental tasks and also with a growing demand, both from the central government and environmental pressure groups, to undertake environmental activities on their own initiative. This development over-taxed the information management of most municipalities. In the past few years, computer technology was introduced to relieve part of this pressure (e.g., by automation of registration systems). This paper attempts to open the debate on the idea of local and territorial development of microregional nodes in the Province of Buenos Aires. Under this approach, a model that proposes the creation of Municipal Development Forum, with the participation of local actors, generate local development program is proposed. The proposal is formulated for territories over 5,000 and below 30,000 inhabitants. This criterion is based on the applicability of the proposed model to municipalities with potential for territorial development, large (...) and balanced internal consumption, but where progress is hindered by the proximity of one or two political jurisdictions of a larger productive scale that have became regional administrative centers. The development program will consider a diagnosis of the productive profile of the territory and its relationship with the characteristics and origin of goods or services consumed at the municipality. This territorial development model aims to move towards self-sufficiency on goods and services, to create new jobs and to promote effective and efficient use of local resources. In short, we propose to tackle territorial development from an innovative perspective, focusing on the creation of Municipal Development Fora that foster the improvement and growth of the productive system, the creation of jobs, local identity and the consumption of goods and services locally produced. A wave of recent scholarship has warned about the potential for discriminatory harms of algorithmic systems, spurring an interest in algorithmic accountability and regulation. Meanwhile, parallel concerns about surveillance practices have already led to multiple successful regulatory efforts of surveillance technologies—many of which have algorithmic components. Here, we examine municipal surveillance regulation as offering lessons for algorithmic oversight. Taking the 2017 Seattle Surveillance Ordinance as our primary case study and surveying efforts across five other cities, we describe the features (...) of existing surveillance regulation; including procedures for describing surveillance technologies in detail, requirements for public engagement, and processes for establishing acceptable uses. Although the Seattle Surveillance Ordinance was not intended to address algorithmic accountability, we find these considerations to be relevant to the law’s aim of surfacing disparate impacts of systems in use. We also find that in notable cases government employees did not identify regulated algorithmic surveillance technologies as reliant on algorithmic or machine learning systems, highlighting definitional gaps that could hinder future efforts toward algorithmic regulation. We argue that finer-grained distinctions between types of information systems in the language of law and policy, and risk assessment tools integrated into their implementation would strengthen future regulatory efforts by rendering underlying algorithmic components more legible and accountable to political and community stakeholders. This paper aims to assess selected municipalities’ performance of citizen-centric investment planning, governance and transparency, financial management, and support for youth programming in Kosovo. In completing this assessment, the Municipal Performance Management System of the Ministry of Local Government Administration in Kosovo was utilized. Selected municipalities are based on the Municipal Performance Report of 2019. Eight from Albanian majority municipalities in the top ranking, and two municipalities with higher scores from minority municipalities. The paper aims to highlight (...) three critical local government issues in ten selected municipalities: 1) The way of governing municipalities assessed according to the applicable legislation and 2) The provision of services in terms of quantity and quality, when possible and 3) Youth-oriented capacity building for municipal staff for better youth services. The paper will produce findings on capacity building needs and support needed on youth and citizen-centric investment and capacity building needs. A non-exhaustive list of needed capacities is produced, while the findings from the evaluation will be used to develop a capacity-building manual for municipal staff on youth-oriented municipal services. The research aims to identify the reality of modern methods applied in the process of performance assessments of employees in the municipalities of Gaza-strip, Complete Census method of community study was used, (571) questionnaires were distributed to all members of the community study, (524) questionnaires were recovery with rate of (91.76%). The most important findings of the study: There were statistically significant relationship differences between the applications of modern methods in the performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the evaluation criteria that fit the required performance and the application of standards evaluations on performance of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the use of methods, models for the evaluation of appropriate functions and the application of the performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the feedback and the application of performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the efficient, professional assessors and the application of the performance assessments of employees in the municipalities of Gaza-strip. There was statistically significant relationship between the extent of awareness of subordinates, participation in the evaluation of their performance and the application of the performance assessments of employees in the municipalities of Gaza-strip. The research also concluded a series of recommendations, including: that the design of evaluation models must be done with the participation of the employees and inform them of it, and that a date must be set to provide feedback and discuss the results with them, that they should be allowed grievance in front of an ad hoc committee in accordance with the known system. Direct manager must inform employees of their performance assessment date, discuss the results of the evaluation with them, and others should be involved with the direct manager of employees in their performance evaluation. The application of modern methods of performance evaluation through the good and purposeful planning should be used, analyzing and employing the results in administrative decisions regarding the employees, and the application of modern methods must be used in an effective and efficient performance evaluation. This study presents the case of a Metropolitan Municipality in the Aegean Region of Turkey, which undertook a series of initiatives to conduct projects on environmental protection and sustainability. This case study was conducted as two separate studies as a part of Horizon 2020-funded ECHOES project under Work Package 6, aiming to gain insight into the collective magnitudes of energy-related choices and behavior. The starting point of the process is marked, in 2015, by the municipality becoming a party to the (...) Covenant of Mayors movement, joining around 8,000 signatories from over 50 countries. In line with European Union’s climate targets and associated energy-related policies, signatories of the Covenant of Mayors aim to decrease carbon emissions by 20% by 2020 and by 40% by 2030. In order to enhance the design and operationalization of policies for achieving these targets, each partner in the Covenant of Mayors is required to develop a Sustainable Energy Action Plan. The SEAP is to be prepared within 2 years of becoming a party to the Covenant of Mayors and involves action plans and projects in order to operationalize the strategies for achieving the associated targets. To this end, this study analyzes the Metropolitan Municipality’s SEAP and its components, which include zero-emission public transportation project, transformation of existing buildings to a more energy-efficient standard and related energy audit studies, a project for decreasing waiting periods in traffic via a Smart Traffic System, a pedestrianization project, and a project for increasing the use of geothermal energy for district heating. This study set out to identify the internal and external factors, as well as bottom-up and top-down mechanisms involved in various phases of the preparation and implementation of the SEAP. The research method was expert interviews, incorporating viewpoints and perceptions of stakeholders from different levels of the municipality. Among the key results are understanding the roles of enthusiasts and frontrunners in such initiative and the importance of top-management and central government support. (shrink)

In this commentary, we respond to the editorial letter by Professor Luciano Floridi entitled “AI as a public service: Learning from Amsterdam and Helsinki.” Here, Floridi considers the positive impact of municipal AI registers, which collect a limited number of algorithmic systems used by the city of Amsterdam and Helsinki. We question a number of assumptions about AI registers as a governance model for automated systems. We start with recent attempts to normalize AI by decontextualizing and depoliticizing it, which (...) is a fraught political project that encourages what we call ‘ethics theater’ given the proven dangers of using these systems in the context of the digital welfare state. We agree with Floridi that much can be learned from these registers about the role of AI systems in municipal city management. The lessons we draw, on the basis of our extensive ethnographic engagement with digital wellfare states, are distinctly less optimistic. (shrink)

The article analyzes the forms of public participation in the implementation of local self-government at various stages of municipal reform. It studies the consolidation of various forms of participation in federal laws on local self-government. The analysis of data from the annual Monitoring of the development of the local government system has been carried out, which makes it possible to assess the real prevalence of various forms of public participation. It is shown that the new Draft Law on (...) local self-government reinforces the general trend towards reducing the municipal sphere and simplifying the institutional organization of local self-government. This, in turn, leads to a reduction in the total number of forms of public participation in self-government, a reduction in their demand and a reduction in the space of deliberative democracy as a whole. At the same time, there is a reduction in both power and advisory forms of participation. (shrink)

The human immunodeficiency virus since its genesis has continued to affect a large number of the population in the African region and has caused exponential deaths. At the same time, new infections have been reported in South Africa. However, religion as a vehicle of change through the institution of the church has been acting on the contrary, since it discourages the use of condoms and moralising the pelvic area in its characterisation against the commandment of God. Such a perspective has (...) largely been drawn from the Christian doctrine. We argue that in its condemnation and moralisation of the virus, the church, through its pastors, engaged in biblical discourse.Contribution: The article applies a qualitative phenomenological approach and system theory as theoretical lenses. Furthermore, the article locates the study within Christian communities located in Thulamela Municipality, Limpopo province. It proposes Christian practices that can be useful in combating the virus. In the science of administrative and constitutional law, administration science and many other sciences, including political science, it is widely accepted that the basic, inherent feature of a municipality, deciding the essence of the territorial self-government unit as an entity of public administration, is the self-reliance it is entitled to. The self-reliance of territorial self-government units is even defined as a constitutional norm.In principle, self-reliance is perceived as a fundamental attribute of a decentralised public authority and constitutes one of the (...) fundamental systemic principles of the Republic of Poland. It was formulated expressis verbis in art. 165 par. 2 of the Constitution of the Republic of Poland, which states that the self-reliance of territorial self-government units is subject to judicial protection, meaning that TSGUs can defend themselves against illegal attempts, not grounded in the law to interfere in their self-reliance. This protection seems to encompass both the private-law and public-law spheres of territorial self-government activity.The essence and guarantees of territorial self-government units’ self-reliance also arise from other constitutional principles, including the aforementioned decentralisation principle, subsidiarity principle, separation of powers, supremacy of the nation and democratic state under rule of law.The goal of this article is to interpret the principle of municipal self-reliance in the context of constitutional principles of law, in the light of the Polish Constitution. The purpose of the study is to reveal the essence of digital technologies in the municipal government system, to identify the main problems of their transformation in the territory of the subjects, and to develop directions for the mechanism of adaptation of the relationship between different management structures in the conditions of digitalization of processes. The article considers the author's vision of the development of digital technologies in the territorial aspect. In particular, the problems of technical equipment of (...) remote territories are considered, in particular, the problems of training personnel and territorial access to Internet resources are touched upon. When evaluating the legislative and regulatory acts of the Russian Federation, it is clear that digital technologies require a separate approach to solving problems of both legal and economic nature, while we focus on their relationship. It is obvious that when developing the strategic direction of digital technologies, the adapted elements require some adjustments and additions, which is currently being carried out. Such changes and additions are promoted not only through legislative and regulatory activities, but also on the basis of scientific research, which in turn develop new directions that contribute to solving problems in the development of digital technologies, not only in the management system, but also in the areas of business, professional education, training and retraining of personnel, etc. As a result, the identified problems in the resource provision of digital technologies allowed us to develop measures that specify the strategic direction. The article considers approaches in order to study large municipal entities and their economic potential. The authors specify that large municipal entities in modern conditions have a multifunctional structure, so they propose an interdisciplinary approach to their study. The article discusses such approaches to analyzing large municipalities as: philosophical; research from the perspective of social sciences and the humanities (political science, sociological, psychological, historiographic and ethnographic approaches). The authors analyze large municipalities from the perspective of the geographical approach; (...) urban theory; urban planning and architecture. The problem of studying large municipalities in the legal sciences is separately investigated. With the help of the economic approach the authors show that at the core of urbanization and the emergence of large municipalities there are three effects: comparative advantage, concentration effect, and localization effect. The authors give classification of large municipalities. The authors propose a systematic approach to analyzing large cities, representing the unity of the functional approach, open systems methodology and the factor approach. Under the latter, it is proposed to understand the economic potential of the city, which presupposes the possibility of efficient use of available resources and their maximum inclusion in social reproduction in order to meet the needs of the municipality population. The authors substantiate the classification of the economic potential of a large municipal formation, which consists of: the resource (basic and used), innovative and infrastructural potentials. Abstract:We aim in this paper to explore several related challenges to contemporary analytical legal theorists who accept as theoretically foundational the state-based view of legality and legal system advanced by H.L.A. Hart. We contend that this approach contains internal explanatory problems which limit the view’s capacity to account for novel prima facie legal phenomena outside the typical experience of the law-state. We supplement the analytical approach by advancing the rudiments of what we call an ‘inter-institutional theory of legality,’ a (...) theory of legality derived from a morally-neutral, descriptive-explanatory picture of legal system qua system of legal institutions. Our theory additionally enables us to account for the novel prima facie legal phenomena we identify, and to conclude that while prior analytical legal theorists’ approaches to legality and legal system were historically right to depart from the example of the municipal legal system, that example and departure point are no longer most salient, so explanation of the legality within the state is no longer sufficient as a general explanation of legality.Resumen:En este artículo los autores se proponen explorar diversos retos que enfrentan los teóricos analíticos del derecho contemporáneos, los cuales han aceptado que una perspectiva estatista del sistema jurídico y de la legalidad —introducida por H. L. A. Hart— es fundamental como punto de partida en la teoría. Los autores sostienen que este enfoque contiene problemas explicativos internos que limitan su capacidad para explicar fenómenos jurídicos prima facie novedosos que no se ajustan a la experiencia paradigmática de un derecho-estado. Los autores reformulan el enfoque analítico mediante la introducción de las bases de lo que deno minan una “teoría de la legalidad interinstitucional”, esto es, una teoría de la legalidad derivada de una noción moralmente neutral, descriptiva y explicativa del sistema jurídico como un sistema de instituciones jurídicas. Esta teoría permite, además, explicar los fenómenos jurídicos prima facie novedosos que identifican los autores; y concluir que si bien los enfoques anteriores hacia el sistema jurídico y la legalidad de los teóricos analíticos estuvieron históricamente en lo correcto al tomar como punto de partida el ejemplo de un sistema jurídico municipal, ese ejemplo y punto de partida han dejado de ser relevantes, dicho ejemplo y punto de partida no resulta suficiente, por lo que la explicación de la legalidad dentro de los confines del Estado no es suficiente para una explicación general de la legalidad. Introduction. The need for a transition to a new system of motivating state and municipal employees’ activities has been widely discussed in recent years. Moreover, some government bodies have taken certain actions in this direction. But in general, there have not been any significant changes. The authors of the article are convinced that the transition to more effective management is impossible without changing the civil servants’ remuneration system, which should motivate them to achieve significant results in the (...) areas for which they are responsible. The paper considers the conceptual approach of transferring the civil servants’ remuneration to a new system, shows the advantages of using performance indicators to stimulate the employees’ activities. The purpose of the article is to justify the reasonability of using performance indicators when remunerating state and municipal employees. Methods. Within the framework of the systems approach, the authors use structural and functional analysis, as well as general scientific methods: abstraction, comparison, description and explanation. Scientific novelty. The authors show possibilities of using the personnel performance indicators in the state and municipal service in order to increase their motivation for obtaining significant results in their work. Results. The authors analyze the conditions for successful implementing the key personnel performance indicators in the state and municipal service, describe the typical mistakes militating the effectiveness of the personnel performance indicators in public authorities. The authors develop some recommendations to improve the use of the personnel performance indicators in the system of state and municipal administration. Conclusions. The proper use of key performance indicators of state and municipal employees will significantly increase their motivation in order to achieve high efficiency in their work. At the same time, the personnel performance indicators must be balanced and matched taking into account the goals of the organization. (shrink)

Our case study draws on emerging ideas of degrowth, showing how degrowth values and strategies may emerge where cities rely heavily on global food systems, and contributes to literature on food for degrowth in local contexts. Degrowth rejects the imperative of economic growth as a primary indicator of social wellness. A holistic understanding of wellness prescribes radical societal transformation, downscaling and decreasing consumption, strengthening community relationships and promoting resilience. Building on Bloemmen et al. (2015), we apply a holistic model of (...) degrowth in a small-scale context, embedded within larger capitalist economies, to examine degrowth opportunities and constraints in Edmonton, Canada. Emergent themes in interviews reveal opportunities and challenges for local food for degrowth, by altering local food supplies, reducing food waste and decreasing consumption. We explore the role of social relationships in food justice work, increasing food knowledge, and building capacity for local, sustainable food production. (shrink)

This study presents an evolutionary game to model interactions among stakeholders with potential conflicts, including the operational enterprise of incineration plant, the local government, and the residents nearby. System dynamics is used to simulate the change of strategic actions corresponding to the three players, in order to seek for the evolutionary stability strategies. A numerical case is proposed to demonstrate the game theory application, in which the impacts of governmental incentive and punishment on the player’s actions are investigated. The (...) results indicated that administrative penalty is effective not only in motivating the enterprises to upgrade treatment facilities for ensuring environmental quality but also in helping the local government and residents to approach dominant strategies. AbstractSocial Ecological System research highlights the importance of understanding the potential of collective actions, among other factors, when it comes to influencing the transformative configuration of agri-food systems in response to global change. Such a response may result in different desired outcomes for those actors who promote collective action, one such outcome being food sovereignty. In this study, we used an SES framework to describe the configuration of local agri-food systems in Andean Ecuador in order to understand which components (...) of the SES interact, and how they support outcomes linked to five food sovereignty goals. Through a survey administered to mestizo and indigenous peasants, we analyze the key role played by the Agroecological Network of Loja in transforming the local agri-food system through the implementation of a Participatory Guarantee System. This study demonstrates that participation in the RAL and PGS increases farmers’ adoption of agroecological practices, as well as their independence from non-traditional food. Additionally, RAL lobbying with the municipality significantly increases households’ on-farm income through access to local markets. Being part of indigenous communities also influences the configuration of the food system, increasing the participation in community work and access to credit and markets, thus positively affecting animal numbers, dairy production and income diversification. The complexity of the interactions described suggests that more research is needed to understand which key factors may foster or prevent the achieving of food sovereignty goals and promote household adaptation amid high uncertainty due to global change. Background Outbreaks of infectious disease cause serious and costly health and social problems. Two new technologies – pathogen whole genome sequencing and Big Data analytics – promise to improve our capacity to detect and control outbreaks earlier, saving lives and resources. However, routinely using these technologies to capture more detailed and specific personal information could be perceived as intrusive and a threat to privacy. Method Four community juries were convened in two demographically different Sydney municipalities and two regional cities in (...) New South Wales, Australia to elicit the views of well-informed community members on the acceptability and legitimacy of: making pathogen WGS and linked administrative data available for public health researchusing this information in concert with data linkage and machine learning to enhance communicable disease surveillance systems Fifty participants of diverse backgrounds, mixed genders and ages were recruited by random-digit-dialling and topic-blinded social-media advertising. Each jury was presented with balanced factual evidence supporting different expert perspectives on the potential benefits and costs of technologically enhanced public health research and communicable disease surveillance and given the opportunity to question experts. Results Almost all jurors supported data linkage and WGS on routinely collected patient isolates for the purposes of public health research, provided standard de-identification practices were applied. However, allowing this information to be operationalised as a syndromic surveillance system was highly contentious with three juries voting in favour, and one against by narrow margins. For those in favour, support depended on several conditions related to system oversight and security being met. Those against were concerned about loss of privacy and did not trust Australian governments to run secure and effective systems. Conclusions Participants across all four events strongly supported the introduction of data linkage and pathogenomics to public health research under current research governance structures. Combining pathogen WGS with event-based data surveillance systems, however, is likely to be controversial because of a lack of public trust, even when the potential public health benefits are clear. Any suggestion of private sector involvement or commercialisation of WGS or surveillance data was unanimously rejected. (shrink)

While researchers have identified numerous problems with food systems, sustainable, just, and workable solutions remain scarce. Recent developments in the food justice literature, however, show which local food movements favor sustainability and justice as problem-solving measures. Yet, some of the ways that these approaches could work in concert are overlooked. Through focusing on how they are compatible, we can understand how such endeavors can improve the conditions for community control and reduce the detrimental effects of agribusiness. In this paper, the (...) author proposes a participatory budgeting project that involves a relatively new process called “vertical agriculture” to alleviate some of the harm that current agricultural practices cause. Decision support systems, which incorporate artificial intelligence and big data, are receiving significant attention in the public sector. Decision support systems are sociocultural artefacts that are subject to a mix of technical and political choices, and critical investigation of these choices and the rationales they reflect are paramount since they are inscribed into and may cause harm, violate fundamental rights and reproduce negative social patterns. Applying and merging the concepts of sense-making and translation, this article investigates the rationales, translations and (...) critical reflections that shape the development of a decision support system to support social workers assessing referrals concerning child neglect. It presents findings from a qualitative case study conducted in 2019–2020 at the Citizen Centre Children and Young People, Copenhagen Municipality, Denmark. The analysis shows how key actors through processes of translation construct, negotiate and readjust problem definitions, roles, interests, responsibilities and ideas of ambiguity and accountability. Although technological solutionism is present in these processes, it is not the only rationale invested. Rather, technological and data-driven rationales are adjusted to and merged with rationales of efficiency, return on investment and child welfare. Through continuous renegotiation of roles, responsibilities and problems according to these rationales, the key actors attempt to orchestrate ways of managing the complexity facing child welfare services by projecting images of future potentials of the decision support system that are yet to be realised. Since cycling can contribute to sustainability, shared-bicycle schemes have been encouraged as a green technology. In Chinese cities, however, dockless app-based bicycle-sharing systems have become a blight, resulting in tremendous waste. Ironically, this stems from the success of DABS—their rapid development and adoption. As an “emergent” technology, DABS in China consist in the confluence of existing technologies and extra-technological factors, situations different from the sum of their parts, where negative consequences are more difficult to identify and address. Additionally, DABS in (...) China are a case of private, app-based technology providing a good traditionally regulated by municipal governments. For these reasons, it provides valuable lessons: The negative consequences associated with DABS in China result from a lack of policy formulation and implementation, failing to consider and address extra-technological dimensions. Total factor productivity is not only the core of high-quality economic development but also a core indicator for measuring the quality of economic development. Improving total factor productivity is one of the most critical points in building a modern economic system. Firstly, this paper uses the DEA-Malmquist index method to measure and decompose the total factor productivity of China’s 30 provinces, municipalities, and autonomous regions from 2001 to 2017 and analyzes the characteristics of its temporal and spatial changes. From (...) a spatial perspective, the regional gap is relatively large. Secondly, we construct the index system of five dimensions and use this index system to comprehensively evaluate the improvement degree of China’s modernized economic system. The results show that the overall level of the improvement degree of China’s modernized economic system is relatively low, and the differences between provinces are great. Thirdly, this paper uses static and dynamic spatial econometric models to empirically analyze the effect of total factor productivity on the improvement degree of the modern economic system. The results show that the improvement degree of the modern economic system in China has obvious characteristics of time spillover and space spillover. Finally, we put forward countermeasures and suggestions on how to perfect the modern economic system. (shrink)

Today, the risk management of budget challenges throughout the budget process is greater than ever. The process of change has been driven by new information and communication technologies, resulting in e-government. The purpose of this scientific paper is to see whether budgetary challenges have an effect on the performance of e-government in complex financial systems based on factors F1, F2, F3, F4, and F5: lack of information, lack of cooperation, lack of resources and reduction of focus, lack of budget experts (...) and financial stability, and shortcomings and inconsistencies during the budget process. Therefore, this study aims to advance the understanding of how to manage risks from budgetary challenges by focusing on a novel approach to improve e-government performance in complex financial systems. Empirical research was based on three key issues: an approach to e-government, analyzing which variables need more attention to risk, and learning how to meet budgetary challenges to improve performance during governance. For this study, the data were conducted by Kosovo’s public institutions, more specifically at the central level and at the local level. A total of 38 questionnaires were analyzed and divided into three sessions, which were analyzed through three analyses, such as factor analysis, data reliability analysis, and multiple regression analysis, using SPSS version 23.0 for Windows. The research was conducted over the years 2017, 2018, 2019, and 2020, while the analysis involved several processes, where some of the factors were removed in order to make the model acceptable. In this case, 21 variables were tested and divided into 5 factors. The results showed that special attention should be paid to these factors to reduce budgetary challenges and increase the performance of e-government in complex financial systems, such as lack of resources, increasing the focus on risk management even after the transfer of funds from the ministry to the municipality, the selection of programs based on priorities and not on the basis of wishes and policies, having political stability, rule of law, and more control, and having regulations and guidelines from the practices of developed countries as well as taking into account the opinions of budget experts. The implications of this paper have to do with only a considerable number of variables, which were taken in the study as well as only in the municipalities of Kosovo. In this case, for other analyses by other researchers, other variables can be analyzed in other countries by making comparisons. (shrink)

This paper reports on a relationship between the University of Toronto and a non-profit, non-governmental (“third party”) certifying organization called Local Flavour Plus (LFP). The University as of August 2006 requires its corporate caterers to use local and sustainable farm products for a small but increasing portion of meals for most of its 60,000 students. LFP is the certifying body, whose officers and consultants have strong relations of trust with sustainable farmers. It redefines standards and verification to create ladders for (...) farmers, Aramark and Chartwells (the corporations that won the bid), and the University, to continuously raise standards of sustainability. After years of frustrated efforts, other Ontario institutions are expressing interest, opening the possibility that a virtuous circle could lead to rapid growth in local, sustainable supply chains. The paper examines the specificities of the LFP approach and of the Toronto and Canadian context. Individuals in LFP acquired crucial skills, insights, experience, resources, and relationships of trust over 20 years within the Toronto “community of food practice,” located in a supportive municipal, NGO and social movement context. This chapter discusses the theory of international law. In analytic jurisprudence, at least since the latter half of the twentieth century, the primary debate in general jurisprudence has been between legal positivism and its most ardent critic, Ronald Dworkin. The positivist tradition is represented here by its two most important theorists, Hans Kelsen and H.L.A. Hart. During their careers, Kelsen and Hart clashed over the best understanding of legal positivism. For his part, Dworkin devoted the bulk of his critical attention (...) to Hart's work. The chapter also focuses on the way in which each theorist builds his view of international law against the background of a more general jurisprudence. Hart argues that the differences between international law and municipal law might eventually be overcome. International law might be in a stage of transition that will bring it nearer in structure to a municipal system. (shrink)

In the modern world, risks are complex and systemic, and their effects are interconnected with the transformations in different layers of social systems. Global issues are not necessarily reflected in local contexts, and public perceptions of risks may differ significantly from expert assessments. The aim of the article is to reveal the differences between the opinions of the Lithuanian population and experts on economic, environmental, technological, geopolitical and social risks, and to compare the differences between the opinions of local experts (...) and Lithuanian public and the assessments of experts from the Global Risk Reports. The article presents the results of a representative survey of the Lithuanian population and an online survey of municipal experts. The results of the study show that expert and population perceptions quite often coincide, especially in the case of social and economic threats. The biggest discrepancies, when the experts assessed the risks as higher than the population, were revealed in the cases of COVID-19, floods, forest fires, energy disruptions, and the mines from war legacy. Public identified higher risks than experts in the case of traffic accidents, illegal tracking of persons, illegal use of bank accounts/cards, Astravets NPP, and increase in prices. In the perception of risks of Lithuanian population and municipal experts in 2020–2021 economic and social risks dominated, and global risks with long-term effects, such as ecological or geopolitical, were not reflected in the local perceptions. This biography, the first of Richard Spencer Childs, begins in the Progressive Era when Childs initiated and pursued two fertile ideas: the short ballot doctrine and the council-manager plan. Childs understood that the simplification of the task of the voter was a question pressing for solution and that the council-manager plan would transform municipal government. This comprehensive work discusses other aspects of Childs' broad reform agenda. His proposals included: county government reform; reform in state government administration; unicameral state legislatures; (...) reapportionment of state legislatures; selection of judges by appointment; replacement of elective county coroners with appointed professional medical examiners; democratization of state political parties; and reform of the Presidential nominating system. Based on Childs' papers and personal interviews with Childs, this biography advances scholarship on the Progressive Era and contributes to the historiographical debate on the nature of reform. The Resolution of the Seimas of the Republic of Lithuania on the Approval of the State Sports Development Strategy for 2011-2020 states that it is important to create and develop a horizontal structure of public administration of sport, which includes many state administration areas and municipal institutions, which would allow to develop cooperation with non-governmental sports organizations and private sector of sports activities. To create legal and economic conditions for the fast development of active and healthy lifestyle and universal (...) sports clubs as primary subjects of the national sport system; to promote their contribution to non-formal sports education and employment of children and young people, development of various sports, interaction between amateur and professional sports. In this respect, the tasks have been set to create a multi-tier system of strategic cooperation with non-governmental sport organizations with public administration structures, to expand cooperation between municipal institutions in the field of sport, authorized by the Government of the Republic of Lithuania so that these resolutions include the National Sport for All Development Program implementation, enhancing the vitality of communities through sport, ensuring healthy lifestyle conditions and developing sports infrastructure through territorial planning documents and investment programs; to create and develop a system of partnerships in the field of sport between public and private sectors; to develop cooperation between institutions of all fields of management by developing and implementing physical activity, healthy lifestyles and work ability, social cohesion through sport, leisure employment and social prevention and other interinstitutional programs, accordingly reorganizing and expanding functions of the institution authorized by the Government, strengthening its administrative capacity. The implementation of the strategy is particularly relevant, as is the case at the level of municipal administrations and councils, to which functions are delegated to implement the priority functions of sport policy. Problems in the implementation of sport policy are analyzed by scientists as well as representatives of sports policy legislators. The aim of the research is to analyze how the sports policy of the Republic of Lithuania is formulated and implemented in the activities of municipal administrations and councils. Research methods -analysis of scientific literature, analysis of laws, analysis of sports management system. Research results and conclusions. The real role of municipalities and the priority to develop community sport, to promote the vitality of communities has not been realized yet. The role of private business for private investment in sports infrastructure for the development of sports movement and cooperation with socially responsible business representatives, the independent role of clubs and non-governmental organizations as a priority have also not been understood and finally not implemented. In the functional division of activities in the sport policy process, all chains of interaction between organizations, acting within the competence, must strive to implement laws and strategic goals of sports policy. In order to achieve these objectives, the activities of the institutions depend on the political decisions adopted jointly by the central government, public programs and projects. It is important that the executive structures are delegated the same kind of functions, so that the implementation of the policy is carried out consistently in all areas of the republic.Improvement of the process of implementing sports policy and the search for the improvement, trying to achieve the efficiency of activities of municipal administrations and councils must be the main goal of all institutions involved in it. The whole system of institutions involved in the development and implementation of sport policy is too centralized. Institutional differences in the management of interdependence and in the resolution of structural problems between national organizations and municipal organizations are very pronounced. This has a negative impact on the status of municipal territorial sports divisions, when grants are distributed from the state budget, selecting sportsmen, performing medical technological examination of promising sportsmen, setting up sports bases, and so on. Municipal elections are not the only channel of participation in the municipal policy nor are they the only participation-problem. But it is nevertheless useful to make research into them because they are the unique institutionalized possibility of participation.This participation-research deals with the different aspects of the municipal elections.The first thing to note is that a number of council-members are pointed out by elections without competition. This phenomenon is not very extended: 373 out of some 2,600 municipalities, 12 (...) % of the council members, 200,000 voters. There is no notable change of size since 1920 in this phenomenon.Compared to the legislative elections, candidatures are very stable and limited : an average of 2,3 candidates per seat. These limited candidatures also mean that in practically half of the cases municipal elections have a two-parties system, by which the electoral corps chose directly the Court of Mayor and Aldermen. But even in municipalities with more than two parties, this «direct choice of the government» is made in 75 % of the cases. In respect of these facts, participation is qualitatively much better than in the case of the parliamentary elections.Forsaking of choice is notably lower at municipal than at parliamentary elections. As to the use of preference-votes, the choice of the municipal electorate is richer than that of the national electorate not only because municipal electors more aften express their preference for individuals, but also and not in the least because, by this more frequent use of preference-votes, they have real participation in the choice of the councilmembers themselves.The possibilities of choice at municipal elections offer an original alternative : to vote beyond party-frontiers with the «mixed vote». This multi-party vote is but seldom used : by 2,5 % of the electorate.And even then those who tlus mixed way lose half of their votingcapacity. Generally seen however, the municipal elections show a more favorable participation-pattern than the legislative ones. This leads to the question if it can be imputed to the voters when something is wrong with municipal politics. Is this problem not-situated on a higher level of the participation-pyramid? (shrink)

The article aims to present the results of empirical research and theoretical analyses concerning the transfer, co-creation, and utilization of scientific knowledge by various entities, emerging at the intersection of science and practice. The research was conducted using survey techniques and in-depth interviews among scientists engaged in research collaboration with entities outside the university, and through case studies of two institutions acting as external partners. Among them were the Lublin City Office and the Lublin Culture Workshops, a municipal cultural (...) institution. The work falls within the realm of social research, which directly (Zerubavel 1997) or indirectly (Sange 1990, Douglas 2011) addresses the functioning and adaptation of various social systems (in this case, institutions and organizations) from the perspective of the communicatively mediated cognitive processes occurring within them (Luhmann 2018, Weick 1995, Lenartowicz et al. 2016a, 2016b). In this context, the subject of cognition and the user of knowledge is not an individual human, but a social system/organization with the capacity to observe itself and its environment, to learn, and to anticipate its future (Hecker 2012; Walsh 1995, Luhmann 2018; Seidl 2006, Lant, Shapira 2001). It posits the existence of a kind of supra-individual rationality, which does not require something like a system's unique self-consciousness, akin to human consciousness, but operates on the principle of L. Fleck's thought collectives, which are emergent in nature with respect to individuals (Sady 2020, Luhmann 1990, Fleck 1986). The rationality of such collectives is defined by their belonging to a functional area of society, hence they differ in the case of entities belonging to the science, economy, politics systems, etc. The research focused on situations where, due to the need for knowledge, various organizations collaborate with scientific units. This research succeeded in characterizing the main stages of establishing and implementing such collaboration, and the main requirements associated with them. The study sought to determine the impact of the interaction of different rationalities on the nature of the co-created knowledge and to identify the conditions of its usefulness, both for external entities and for the scientific system. The adopted indicator of the usefulness of knowledge for the scientific system is the publication of results in scientific journals, while for external entities, its impact on the decision-making process, such as changing operational strategies. In this case, the mechanism of translating knowledge into changes in organizational practices was also examined, paying attention to the existing mechanisms of collective learning within the organization. In recent years, the international commons movement has increasingly joined forces with the global movement of municipalities, putting common ideas on the political agenda in many western countries. Commons have been widely discussed in literature. Broadly understood, commons refers to the practices for collective development, ownership, management, and fair access to resources and artifacts (social, cultural, economic, political, environmental, and technological). However, the concept remains vague, complex, and unclear, especially when it comes to different contexts in which new definitions are (...) needed to better understand the societal and cultural dimensions of urban commons. Decolonizing the notion of urban commons brings into visibility the unseen cultures, infrastructural systems, and communities showing where de-growth and separation can take place. Therefore, this analysis can provide new insights, opportunities, and the need for new theoretical, methodological, and shared approaches. There is a gap in transnational research and cultural understanding within the field of urban commons. This research opens new lines of inquiry relating to the definitions of commons in non-European countries. This may include longitudinal research on the decolonization and potential fragmenting of the commons and in particular 'commoning' mindset, more detailed empirical evidence of the cultural and communal concepts, and how these cultural diversities and new interpretations can be implemented in collaborative governance in a wider variety of non-western contexts. By challenging existing frameworks, this study facilitates the emergence of differentiated, dynamic, and non-linear forms of social and political subjectivity within various sociospatial domains. The article is devoted to the analysis of the upcoming reform of local self-government initiated by amend­ments to the Constitution of the Russian Federation (2020) and the Draft Federal Law No. 40361-8 «On general principles of the organization of local self-government in a unified system of public author­ity», submitted to the State Duma of the Russian Federation in December 2021. The purpose of the study is to identify and analyze trends in the development of the institutional organization of local (...) self-govern­ment, manifested in the context of the development of the new Draft Federal Law. It is shown that a special type of institutional organization is emerging in the sphere of domestic local self-government, which can be defined as institutional minimalism. Its main features are highlighted. It is concluded that the manifes­tations of institutional minimalism are possible only in the conditions of continuation of such trends as the strengthening state control and unification of local self-government, which previously existed, but were further strengthened in connection with the building of a unified system of public power. The article is devoted to the changes in the conceptual understanding of the institution of local self-government that has been taking place in the last three decades. The submission to the State Duma of the Russian Federation of the Draft Federal Law «On the general principles of the organization of local self-government in the unified system of public authority», which took place at the end of 2021, allows analyzing the trajectory of the development of the institute of local self-government (...) in post-Soviet Russia from the point of view of a more global time and conceptual perspective. The purpose of this work is to identify the trajectory of the development of the conception of local self-government in RF. Research attention is focused on identifying the conception of local self-government formulated in official documents, a gradual change in the conceptual interpretation of this institution. It is shown that the main shiftin the conceptual understanding of local self-government occurs along the axis of institutional independence / institutional dependence of local self-government on state authorities. The development of the conceptual understanding of local self-government in post-Soviet Russia proceeds along the trajectory from a public concept (local self-government as an independent activity) to a state one (local self-government as a form of exercising power) and to a hyperstate one (local self-government as a link in a unified system of exercising authority).
