  2. Vertical precedents in formal models of precedential constraint.Gabriel L. Broughton - 2019 - Artificial Intelligence and Law 27 (3):253-307.
The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the (...)

Sleeping away the Factory, Healing with Time: Gaston Bachelard, the Poetic Imagination and Testről és lélekről/ On Body and Soul.Saige Walton - 2020 - Paragraph 43 (3):348-363.
Gaston Bachelard distinguishes the radical novelty and newness of the imagination from pre-existing sensory impressions. In this article, I explore Bachelard's connections between time, the imagined image and poetic form, and I consider their implications for the cinema. Concentrating my analysis on Ildikó Enyedi's Testről és lélekről/ On Body and Soul — a film that alternates between doubled worlds, depictions of human and animal life — I draw out the temporality and the diversity of Bachelard's imagined images. Bringing Bachelard's instant, (...)

Vertical glaciology: The second discovery of the third dimension in climate research.Dania Achermann - 2020 - Centaurus 62 (4):720-743.
The history of climate research in the 20th century has been characterised by a crucial shift from a geography-oriented, two-dimensional approach towards a physics-based, three-dimensional concept of climate. In the 1930s, the introduction of new technology, such as radiosondes, enabled climatologists to investigate the high atmosphere, which had previously been out of reach. This “conquest of the third dimension” challenged the surface-oriented, geographical notion of climate patterns and opened up climatology to a three-dimensional approach, which deeply changed the character of (...)

Plato's view on time, a key aspect of his doctrine of forms, is influenced by his reception of Parmenides, but the way in which Plato takes up and modifies Parmenides' view is a matter of ongoing scholarly debate. In this article, the author analyzes Plato's revision of Parmenidean time by exploring four temporalities: the eternal present, timeless eternity, the enduring present, and the instant between time and eternity. Through this examination, she uncovers the common origin of both the eternal present (...)

When, in Plato’s Parmenides 155e4–157b5, Parmenides refers to the instant (ἐξαίφνης), he is alluding to a paradox of Zeno, and not to an argument of Plato. Thus, in the second part of the Parmenides, the speaker is a fair representation of the historical Parmenides, and not a figment of Plato’s imagination.

This paper introduces this mini-series on vertical equity in health care. It reflects on the fact that by and large equity policies in health care have failed and that there is a need for positive discriminationto promote equity better in future. This positive discrimination is examined under the heading of`vertical equity'. The paper considers Varian's notion of 'envy' as a basis for equity in health care but concludes that this is not a helpful route to go down. Better (...)

The instant of change in medieval philosophy and beyond.Frédéric Goubier & Magali Roques (eds.) - 2018 - Boston: Brill.
Since antiquity, philosophers have investigated how change works. If a thing moves from one state to another, when exactly does it start to be in its new state, and when does it cease to be in its former one? In the late Middle Ages, the "problem of the instant of change" was subject to considerable debate and gave rise to sophisticated theories; it became popular and controversial again in the second half of the twentieth century. The studies collected here constitute (...)

Solutions to the urban problems of the future must assume the new reality of megacities. The inevitable technological progress must find a balance with the ‘bio-ecological' recovery of the natural environment. In the vertical bionic city, all these occur; bio intelligence and giant structures of the city are merged into a single. These structures try to survive by relying on working together as a single organism alive, as ants work in their nest. What makes them so efficient? What makes (...)

This paper analyses the formation of power of the Christian regime of truth in the context of Foucault’s concept of strategic formations. The main emphasis is on the sexual formation of power in three focal points of its agency. The first focal point is formed around the conflict between the Old Testament truth regime and the Canaan cult of fertility. The second focal point is formed around the influence of ancient philosophical thought, primarily through the philosophy of stoicism, which sees (...)

In this paper I explore consciousness and intelligence in the setting of conventional neuroscience and cognitive science. To be conscious is to be aware but awareness is not always intelligence. Intelligence is task driven, and comes at a later stage in development than consciousness. Consciousness and intelligence are sometimes interdependent on each other, but have always been known as separate entities; an attempt to associate them, results in a lot of debate. This paper hypothesises the growth of consciousness to be (...)

This paper will argue that the puzzles about instantaneous velocity, and rates of change more generally, are the result of a failure to recognize an ambiguity in the concept of an instant, and therefore of an instantaneous state. We will conclude that there are two distinct conceptions of a temporal instant: (i) instants conceived as fundamentally distinct zero-duration temporal atoms and (ii) instants conceived as the boundary of, or between, temporally extended durations. Since the concept of classical instantaneous velocity is well- (...)

Vertical/compatible theoretical integration provides an alternative way of unifying sociocultural anthropology and related disciplines. It involves analyzing theoretical statements for their implicit and explicit assumptions at multiple levels of analysis and then determining whether these assumptions are compatible with consensus in the relevant disciplines (e.g., does the sociological theory include an assumption at odds with consensus psychology?). Incompatibilities indicate a need for further research. This approach is much more likely to salvage the bulk of humanities-oriented anthropology than is that (...)

By countering the claim that vertical toleration is redundant given a commitment to the Rawlsian version of the liberal democratic ideal, and by articulating a version of that ideal that shows this claim to be false, the paper reaffirms the (...)

Many philosophers hold that ‘one-instant worlds’—worlds that contain a single instant—fail to contain time. We experimentally investigate whether these worlds satisfy the folk concept of time. We found that ~50% of participants hold that there is time in such worlds. We argue that this suggests one of two possibilities. First, the population disagree about whether at least one of the A-, B-, or C-series is necessary for time, with there being a substantial sub-population for whom the presence of neither an (...)

This anthology concerns limit-decision problems, chiefly as treated in the fourteenth-century Latin West. A central problem taken up concerns the instant of change: in a change from ø to not-ø such that before instant t there is ø and after t not-ø, at t is there ø, or not-ø, or neither, or both? For medieval thinkers, the answer often depended on what kind of item was at issue. They standardly distinguished permanent items, the whole of which exists simultaneously, from successive (...)

Näive Realists have recently proposed that illusions occur in circumstances that are ‘non-paradigmatic’ or with which we are insufficiently familiar. While this proposal may work for many of the illusions philosophers normally discuss, I argue in this paper that there are other illusions that do not fit this pattern. In particular, the vertical-horizontal illusion (VHI) occurs in circumstances that are both familiar and paradigmatic, while disappearing (or becoming attenuated) in more unusual circumstances.
