The goal of this thesis is to develop the foundation and structure for a virtue ethics theory grounded in a specific notion of care. While there has been a recent revival of interest in virtue ethics theory, the theory has its roots in Aristotle's work as well in the medieval writings of Thomas Aquinas. Aquinas worked out many of Aristotle's ideas in much more detail. However, while Aquinas offers a very rich and compelling ethical theory, it is problematic because it (...) is very tightly wrapped in his theology. A key component in Aquinas's theory is charity. Charity is one of Aquinas's theological virtues, which express the relationship between humans and God. Charity is the love of God and of neighbor and he construes it as the foundation for all the other virtues. My thesis explores the idea of replacing charity with the virtue of care. The virtue of care to be used in this essential role is primarily based on recent work on the ethics of care by Nel Nodding. The virtue of care, as I develop it, combines three interrelated parts: instinctive, maternal and relational care. By comparing and contrasting care and charity, I demonstrate that the virtue of care can fill the role of charity. In this capacity care can serve as a naturalistic foundation for a virtue ethics theory. Since the ethics of care is relatively new, it has yet to take shape. I propose building a care-based virtue ethics theory on the structure of Aquinas's theory. This new care-based virtue ethics theory also benefits from utilizing many of the components of Aristotle's theory which are found in Aquinas's work. My argument is that care can fulfill the role of charity in Aquinas's theory. Care-based virtue ethics theory is a completely naturalistic version of Aquinas's virtue ethics theory. My thesis contains both the foundation for this different kind of care-based virtue ethics theory and some direction for future work on revising Aquinas's theory using the virtue of care. Externalists argue that motivation is external to moral judgments on the grounds that people can be unmoved by their moral judgments. I reply that people sometimes act indifferently to their moral considerations not because their moral judgments lack motivation but because their moral judgments are obstructed by rival desires. It appears that the moral motivation wanes while the moral judgments linger. In reality, however, the moral motivation is only made inconspicuous by the motivation of the opposing desires. In this thesis I am going to explore the relationship between happiness and imprisonment. I will discuss three theories of happiness - hedonism, life satisfaction theories and emotional states theories. I will argue that the main problem of these theories is that they take happiness to consist only of psychological states. Because of this, I will turn my attention towards those theories that evaluate happiness in terms of how well life is going for the person who is living it. I (...) will argue that my Aristotelian account is the most plausible way to understand the relationship between happiness and imprisonment. This is because it takes into account both the external circumstances and the psychological and emotional life of pnsoners. Through this thesis, I will show that my account of happiness in prison accomplishes three tasks: i) it solves the problems encountered by the other theories of happiness in the evaluation of prisoners' happiness, ii) it does not suffer from two of the main objections to the other objectivist theories of happiness, and iii) it can help us to investigate the happiness of prisoners empirically more accurately. This 183-page introductory part of my dissertation is an overview of some key debates in philosophical moral psychology and its methodology.

Clarifying the essential experiential structures at work in our everyday moral engagements promises both (1) to provide a perspicacious self-understanding, and (2) to significantly contribute to theoretical and practical matters of moral philosophy. Since the phenomenological enterprise is concerned with revealing the a priori structures of experience in general, it is then well positioned to discern the essential structures of moral experience specifically. Phenomenology can therefore significantly contribute to matters pertaining to moral philosophy. In this paper I would like to (...) contribute to the relatively small yet burgeoning field of phenomenological ethics. I endea­vour to do so by first identifying and consolidating the basic level of sense-bestowal, and then outlining the a priori structures of volition in order to demonstrate how such phenomenologically discerned structures are required for moral experience. Specifically, in section one I locate moral experience as at the level of meaning that is phenomenologically identified as the life-world, and then vindicate the life-world by illustrating how it is immune to naturalistic rationalisation. By thus both securing the level of meaning that is of concern and importantly delimiting the scope of our analysis, I proceed in section two to relate the volitional analyses of Aristotle, Husserl, and Heidegger. This relation is achieved thanks to a conceptual point of con­tinuity: ‘prohairesis’. By examining the function of this concept (as an intentional structure) and its phenomenological continuity, the ground is then prepared for further phenomenological analyses of the virtues. This Thesis reconsiders the prospects for an approach to global justice centring on the proposal that every human being should possess a certain bundle of goods, which would include certain members of a distinctive category: the category of capabilities. My overall aim is to present a clarified and well-developed framework, within which such claims can be made. To do this, I visit a number of regions of normative and metanormative theorising. I begin by introducing the motivations for the capability approach, (...) and clarifying some of its most distinctive features. Next, I focus on Martha Nussbaum's version of the approach, and identify several problems therein. The most important concerns epistemology, and especially the challenges that constructivist theories pose. The middle part of the Thesis presents an alternative, based on the work of John McDowell, which I argue has superior prospects. Then, I turn to two further problems: that of making sense of the universalistic aspirations of cosmopolitanism, and that of integrating the microscopic prescriptions of ethics with the macroscopic analyses of political philosophy. Using the Aristotelian interpretation of its core framework that I have developed, I conclude that the capability approach can provide compelling answers to important questions about global justice. This thesis examines the concept of civil disobedience, and the role the latter can play in a democratic society. It aims to offer a moral justification for civil disobedience that departs from consequentialist or deontological considerations, and focuses instead on virtue ethics. By drawing attention to the notion of civic virtues, the thesis suggests that, under some circumstances, an act of civil disobedience is the very act displaying a virtuous disposition in the citizen who disobeys. Such disposition is interpreted in (...) light of a duty each individual has to respect her fellow citizens as autonomous agents. This grounds, in turn, a moral obligation to respect the law. The central claim of the thesis is that the obligation towards the law is fulfilled not only through acts of obedience but also, under different circumstances, through acts of disobedience. The status of non-violence as a necessary component of civil disobedience is questioned, and it is argued that a degree of force or violence may be permissible in civil disobedience, when it is compatible with the duty to respect others’ autonomy. Subsequently, the thesis offers an analysis of ‘reasonableness’ as a civic virtue, and by comparing three different approaches to the issue of reasonable disagreement among democratic citizens, it defends the deliberative approach as the most suited for treating fellow citizens as autonomous agents. The last two chapters focus on the importance, for an act of civil disobedience, of the agent’s willingness to accept the legal consequences of her law-breaking behaviour. It is argued that a civil disobedient has an obligation to face the prospect of being punished for the breach of the law. However, in considering the behaviour of a virtuous civil disobedient who appears at her criminal trial, it is also claimed that she should plead not guilty and aim to persuade her fellow citizens that she does not deserve to be punished, because what she did does not constitute a criminal wrong. In doing so, this thesis depicts civil disobedience not as a merely permissible form of behaviour, but as a morally praiseworthy conduct within a democratic community. (shrink)

A familiar point in the literature on the epistemology of disagreement is that in the face of disagreement with a recognised epistemic peer the epistemically virtuous agent should adopt a stance of intellectual humility. That is, the virtuous agent should take a conciliatory stance and reduce her commitment to the proposition under dispute. In this paper, we ask the question of how such intellectual humility would manifest itself in a corresponding peer disagreement regarding knowledge-how. We argue that while it is (...) relatively straightforward to recast this debate in terms of a reductive intellectualist account of knowledge-how, whereby knowledge-how just is a matter of having a particular propositional attitude, the issue becomes more complex once we turn to anti-intellectualist positions. On these views, after all, such a disagreement won’t be just a matter of disagreeing about the truth of a proposition. Accordingly, to the extent that some kind of conciliation is plausibly required of the virtuous agent in the face of a recognised peer disagreement, this conciliation will not consist simply in belief revision. We propose a novel way to address this problem. We claim that what is required of the epistemically virtuous agent when confronted with peer disagreement regarding knowing how to φ is that thereafter she should be disposed to employ her way of φ-ing across a narrower range of practical circumstances than beforehand. Moreover, just as an agent needs to call on her intellectual virtues in order to determine the extent of conciliation required in an ordinary case of epistemic peer disagreement, so the intellectual virtues will play an important role in determining this shift in dispositions to φ that occurs as regards epistemic peer disagreement about knowledge-how. As Kant claimed in the Groundwork, and as the idea has been developed by Korsgaard 1997, Bratman 1987, and Broome 2002. This formulation is agnostic on whether reasons for ends derive from our desiring those ends, or from the relation of those ends to things of independent value. However, desire-based theorists may deny, against Hubin 1999, that their theory is a combination of a principle of instrumental transmission and the principle that reasons for ends are provided by desires. Instead, they (...) may say, there is just one principle, a principle of, if you will, instrumental transmutation: if one desires the end, then one has reason to take the means. This paper starts by giving an interpretation of the notorious question "Why be moral?" Then, to answer that question, it develops an account of why some moral reasons -- specifically, the moral reasons that ground moral requirements -- are sufficiently weighty that they outweigh all countervailing reasons for action.

This study is a contribution to the bioethical debate about new and possibly emerging reproductive technologies. Its point of departure is the intuition, which many people seem to share, that using such technologies to select non-disease traits – like sex and emotional stability - in yet unborn children is morally problematic, at least more so than using the technologies to avoid giving birth to children with severe genetic diseases, or attempting to shape the non-disease traits of already existing children by (...) environmental means, like education. The study employs philosophical analysis for the purpose of making this intuition intelligible and judging whether it is justified. Different ways in which the moral problems posed by reproductive technologies are often framed in bioethical debates are criticised as inadequate for this task. In particular, it is argued that the intuition cannot fully be made sense of in terms of harm to the children that such technologies help create. The study attempts to elaborate an alternative to that broadly consequentialist approach, by drawing on Martin Heidegger’s philosophy of technology, Hans Jonas’s ethics, and Aristotle’s practical philosophy, as it has been received and developed in the hermeneutical tradition. It is suggested that reproductive choices, unlike decisions for already born children, are characterised by a peculiar one-sidedness: the future child appears to the parents as something wholly theirs to decide about, not as a concrete other with whom they must interact in a responsive and attuned way. This is problematic because it means that such choices cannot call upon the particularised moral understanding only gained in interpersonal encounters. In particular, it makes them easily shaped by various tendencies, to which parents are always susceptible, to relate to children in instrumentalising ways, and at risk of reinforcing such tendencies. However, this does not mean that all uses of reproductive technologies are equally troubling. When selecting against severe disease the parents can rely on a widely shared illness experience to escape the dangers that one-sidedness involves. It is concluded that the intuition under discussion, thus explicated and in some ways qualified, makes sense morally. (shrink)

En este trabajo analizamos la reivindicación gadameriana del valor cognitivo de arte como un ejemplo de un modo de conocimiento que permite concebir de mejor manera la comprensión que tiene lugar en las ciencias del espíritu. Dicha reivindicación presupone el desconocimiento del valor cognitivo del arte operado por la subjetivización de la estética con Kant y una vuelta a los presupuestos de la tradición humanista. Por ello en la introducción presentamos en esquema los conceptos humanistas de tacto, gusto, sentido común (...) y juicio y comparamos el concepto de experiencia que corresponde a los mismos con la noción de experiencia modelada por la ciencia moderna. En la primera parte del trabajo examinamos en detalle la subjetivización de la estética que comienza con Kant y culmina con la “conciencia estética”. En la segunda parte examinamos cómo la reivindicación del valor cognitivo del arte corre pareja con el desarrollo de una ontología de la obra de arte. Concluimos señalando cómo el recorrido realizado facilita la comprensión de la especificidad de las ciencias del espíritu (humanidades). (shrink)

Often this combination of doctrines is held by philosophers interested in reviving an Aristotelean approach..

You might bear witness to some injustice, but can you witness the injustice itself? At first glance, it’s tempting to say “yes.” Sometimes we see things that provoke an immediate judgement that some act is wrong just as we sometimes see things that provoke the immediate judgement that e.g. the book is red or that our friend is angry. It seems like we perceive the injustice just as we perceive the redness or the anger. Natural as that position is, I (...) argue that it is a mistake and that those who have adopted it often confuse the perception of moral properties with the perception of morally relevant properties. This conception of the theory of legal reasoning is, however, too restrictive. in addition to providing a sound answer to these questions, a theory of legal reasoning should also give us an answer to the question of which judicial virtues are necessary to make good arguments.
