The article examines how the rules on formation of contract and on mistake, contained in the various transnational model rules that have been published over the past two decades, have taken shape. The approach adopted here is based on an analysis of the ‘textual stratification’ of European private law. The relevant instruments (Convention on Contracts for the International Sale of Goods, Principles of European Contract Law, UNIDROIT Principles of International Commercial Contracts, Draft Common Frame of Reference, Principes contractuels communs) are (...) analysed and compared in their historical sequence. To what extent and why have the texts been transformed in the process? The article demonstrates that there is a very considerable common ground reflecting the state of the art of comparative research in these fields over the past hundred years. It also highlights issues on which consensus must still be reached and it suggests patterns towards reaching such consensus. It is argued that the Principles of European Contract Law, rather than the Draft Common Frame of Reference, should provide the point of departure for future discussions. At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following article aims (...) to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). They find that pro‐social experience depends on the degree to which movement patterns are distributed and diversified, but not the degree to which movement patterns are simply unitary.

Was Anselm zu einem leuchtenden Vorbild für die Theologie heute werden lässt, ist nicht seine Gelehrsamkeit, sondern das Wagnis, auf die Anfragen seiner Zeit durch mutige und eigenständige Synthesen des christlichen Denkens zu antworten. Das Denken in diskreten Einheiten von Urteilen scheint ihnen jedoch nicht zugänglich zu sein, damit auch nicht die Unterscheidung von Bejahung und Verneinung und von wahr und falsch. Wie ist das Denken und damit das objektive Erkennen beim Menschen entstanden? Welche Rolle spielt das Gehirn bei Mensch und Tier? Wir Menschen leben in zwei Welten, die paradoxerweise zugleich eine ist. Das Tageslicht, Gerüche, die Hauswand, an der (...) wir entlanggehen und die wir nicht durchschreiten können diese unsere Lebenswelt unterscheidet sich zunächst nicht von der des Hundes, der uns begleitet. Tiere nehmen sinnlich wahr wie wir, sie erschrecken wie wir bei einem lauten Geräusch, sie zeigen dieselbe freudige Erregung wie wir. Zugleich gibt es für uns eine andere, wiewohl identische Welt, von der die Tiere offenbar nichts wissen: Wir Menschen machen die Dinge zu Objekten der Erkenntnis; dieselbe Sonne, die uns blendet und die sich im Tageslauf langsam von Osten nach Westen bewegt, steht, so erkennen wir, fest im Zentrum des Planetensystems. Wir spüren die Kälte, aber wir erkennen in ihr zugleich die Ursache der Eisbildung; kein Tier weiß, was eine Ursache ist, kein Tier kann sich wundern, und auch denken kann es nicht. These: Natürlich können Tiere denken. "Ach, Sie werden es nicht glauben, aber unser Leo versteht jedes Wort." Gegenthese: Natürlich können Tiere nicht denken. Some of the short pieces attributed in various Arabic manuscripts to Alexander of Aphrodisias in fact derive from Proclus's Elements of Theology. Twenty such pieces were published in 1973 by G. Endress, who traced the unnamed translator to the circle of Kindi. Another such piece is here identified, published, and assigned to the same translator. Its beginning and end seem to have been revised by a later transmitter. Section II of the article adduces a parallel case where the original Arabic (...) version still exists. Section III surveys a number of related pieces that would also appear to have been changed in transmission. Section IV argues that most if not all were once united in a single collection of Proclus and Alexander. Section V argues that since certain changes of detail were evidently made during or soon after translation, the general arrangement of the Kindi-circle Alexander, as of the Kindi-circle Liber de Causis and the Kindi-circle, is also likely to be peculiar to the Arabic tradition. The text from which Proclus Arabus was first translated need not have differed substantially from the transmitted Greek. (shrink)

Measurement instruments assessing multiple emotions during epistemic activities are largely lacking. We describe the construction and validation of the Epistemically-Related Emotion Scales, which measure surprise, curiosity, enjoyment, confusion, anxiety, frustration, and boredom occurring during epistemic cognitive activities. The instrument was tested in a multinational study of emotions during learning from conflicting texts. The findings document the reliability, internal validity, and external validity of the instrument. A seven-factor model best fit the data, suggesting that epistemically-related emotions should be conceptualised in terms (...) of discrete emotion categories, and the scales showed metric invariance across the North American and German samples. Furthermore, emotion scores changed over time as a function of conflicting task information and related significantly to perceived task value and use of cognitive and metacognitive learning strategies. Sustainable development (SD) – that is, “Development that meets the needs of current generations without compromising the ability of future generations to meet their needs and aspirations” – can be pursued in many different ways. Stakeholder relations management (SRM) is one such way, through which corporations are confronted with economic, social, and environmental stakeholder claims. This paper lays the groundwork for an empirical analysis of the question of how far SD can be achieved through SRM. It describes the so-called SD–SRM (...) perspective as a distinctive research approach and shows how it relates to the wider body of stakeholder theory. Next, the concept of SD is operationalized for the microeconomic level with reference to important documents. Based on the ensuing SD framework, it is shown how SD and SRM relate to each other, and how the two concepts relate to other popular concepts such as Corporate Sustainability and Corporate Social Responsibility. The paper concludes that the significance of societal guiding models such as SD and of management approaches like CSR is strongly dependent on their footing in society. (shrink)

The Studiengruppe für Systemforschung was dissolved in 1974. Several members of the group moved to the Research Centre Karlsruhe. There, despite their new institutional surroundings, they remained faithful to the Studiengruppe’s conceptual foundations, and developed a new Institute for Technology Assessment and Systems Analysis. This has since become the leading technology assessment group in Germany.

Auf der Arbeitstagung der Deutschen Gesellschaft fur Soziologie im Oktober 1961 hielten Karl R. Popper und Theodor W. Adorno Referate zur -Logik der Sozialwissenschaften-. Dies leitete den -Positivismusstreit- in der deutschen Soziologie ein, an dem sich prominent vor allem Jurgen Habermas auf Seiten der Kritischen Theorie der Frankfurter Schule und Hans Albert auf Seiten des Kritischen Rationalismus beteiligten. Der daraus entstandene Sammelband, der 1969 kurz vor dem Tod Adornos erschien, wurde im deutschen Sprachraum viel gelesen und diskutiert. Das -Adorno-Jahr- 2003 (...) und das -Popper-Jahr- 2004 gaben Anlass, sich mit den Fragen erneut auseinander zu setzen, die der Positivismusstreit aufgeworfen hat, und sie aus heutiger Sicht neu zu beleuchten. Dies wurde in den Referaten eines Symposiums der Karl Popper Foundation Klagenfurt unternommen. Dieser Sammelband beinhaltet die uberarbeiteten Referate dieses Symposiums. In ihnen werden die methodologische, die politische und die soziologische Dimension der damaligen Auseinandersetzungen mit heute dominierenden Themen und Positionen konfrontiert, was bisher in der einschlagigen wissenschaftlichen Diskussion nicht erfolgt ist.". This paper embeds the core part of Discourse Representation Theory in the classical theory of types plus a few simple axioms that allow the theory to express key facts about variables and assignments on the object level of the logic. It is shown how the embedding can be used to combine core analyses of natural language phenomena in Discourse Representation Theory with analyses that can be obtained in Montague Semantics.

English summary: The wide-ranging work of Ernst Fraenkel lead to the foundation of postwar political science. In his role as "American in Berlin," Fraenkel helped shape the foundation of modern comparative government theory. Fraenkel's impressive, and in retrospect exemplary, biography, from being a Jewish labor lawyer in the Third Reich to an emigrant to the United States, allowed for him to be described as a commanding figure of the young field of political science of the Adenauer era. Reinhard Dorn (...) illuminates Fraenkel's integrative state and constitutional understanding in two parts. In the first section, he presents foundations and individual components of constitutional-sociological thought, whereby he focuses particular attention on sociological and policy-sociological aspects. The second section documents the performance range of Fraenkel's constitution sociology by comparing Anglo-American and continental European constitutional thinking with its respective constitutional reality, all based on his own interdisciplinary analysis. This book radically simplifies Montague Semantics and generalizes the theory by basing it on a partial higher order logic. The resulting theory is a synthesis of Montague Semantics and Situation Semantics. In the late sixties Richard Montague developed the revolutionary idea that we can understand the concept of meaning in ordinary languages much in the same way as we understand the semantics of logical languages. Unfortunately, however, he formalized his idea in an unnecessarily complex way - two outstanding researchers in (...) the field even compared his work to a `Rube Goldberg machine.' Muskens' work does away with such unnecessary complexities, obtains a streamlined version of the theory, shows how partialising the theory automatically provides us with the most central concepts of Situation Semantics, and offers a simple logical treatment of propositional attitude verbs, perception verbs and proper names. One of the most persistent problems of marketing has been the question of what is meant by ‘marketing’. In the fifties and sixties discussion focused on the alleged scientific character of marketing. “Is marketing an art or a science?” was the principal question of the day [14], [5], [28]. This preoccupation with the procedures and the conceptual framework of marketing was followed by an eager interest in the contributions which clarification of marketing concepts could make to attaining the objectives of (...) marketing managers. Managerial marketing and management science in marketing are the results of this identification of marketing with the objectives of its managerial users [16], [25].
