Conscious awareness of intentionality is considered to be a product of specialized monitoring processes which distinguish intentional, goal-directed actions from unintentional, passive/ reactive actions. When goals are not met or unfavourable conditions arise, this ability to distinguish intentional and unintentional enables us to direct adaptive efforts towards either changing plans and goals or towards altering the environment. The formulation is discussed in relation to monitoring theories of consciousness and the concept of 'locus of control', and is developed to explain several (...) common psychological disorders in terms of dysfunctional monitoring of intentions. It is suggested that it could provide a theoretical basis for psychological treatment methods. (shrink)

In Alabaster v. Barclays Bank plc and Secretary of State for Social Security (No. 2: [2005] E.W.C.A Civ. 508, [2005] I.R.L.R. 576.) Michelle Alabaster won a grand total of £204.53 (plus £65.86 interest) after eight years of litigation, which included two visits to the Court of Appeal and one to the European Court of Justice. This marathon resulted from the sex discrimination which Alabaster had alleged in relation to the calculation of her Statutory Maternity Pay (S.M.P.) whilst she was pregnant (...) 10 years earlier. The technicalities of the statutory schemes involved should not be allowed to disguise the important principle which finally emerges in the Court of Appeal and which underlines one of the longstanding criticisms of the equality legislation, namely the requirement that a woman must compare herself with a man in order to establish unlawful sex discrimination. Amidst the “lavender scare” of the Cold War, James Schuyler, “the great queer voice of the New York School,” subverted the state’s auditory surveillance of queer life. Refunctionalizing its tools of espionage as poetic tactics, Schuyler eavesdrops on errant conversations (the espoused) and joining (espousing) them in paratactic assembly. In so doing, Schuyler expands José Esteban Muñoz’s “queer optic,” the utopian capacity to see beauty amidst ruins, beyond the visual into a queer otic that drags into being a world of (...) freer espousal. I survey the aural surveillance of mid-century queer life before tracing Schuyler’s détournement of bugging, wiretapping, and overhearing in his 1969 Freely Espousing. In turn, I uncover the queer political commitments lurking beneath Schuyler’s classification as a pastoral lyricist concerned only with “leaves and flowers and weather.”. (shrink)

This case note considers the Court of Appeal decision in Royal Bank of Scotland v. Etridge (No. 2) and other appeals [1998] 4 All E.R. 705. It concerns the familiar scenario of a wife jointly mortgaging (or providing a guarantee for a mortgage of) the family home in order to secure financial support for a business run by her husband. The House of Lords decision in Barclays Bank v O'Brien [1994] A.C. 180 has given rise to a range of litigation (...) in this area, and the spotlight has now moved from the banks to an examination of the quality of advice given by solicitors. The banks have heeded the warnings in O'Brien and now insist that wives are told to obtain independent legal advice. It will be seen that, following Etridge, if the bank tells the solicitor to give the wife legal advice upon undertaking the transaction, that will be sufficient to protect the bank, notwithstanding that the advice was either inadequate or even not actually given. The onus to ensure that proper advice is given is shifted squarely on to the solicitor. The note concludes that the decision is indicative of the shift of judicial opinion against wives seeking to avoid charges over matrimonial homes and in favour of banks. (shrink)

Neuroscientists are searching for the engram within the conceptual framework established by John Locke's theory of mind. This framework was elaborated before the development of information theory, before the development of information processing machines and the science of computation, before the discovery that molecules carry hereditary information, before the discovery of the codon code and the molecular machinery for editing the messages written in this code and translating it into transcription factors that mark abstract features of organic structure such as (...) anterior and distal. The search for the engram needs to abandon Locke's conceptual framework and work within a framework informed by these developments. The engram is the medium by which information extracted from past experience is transmitted to the computations that inform future behavior. The information-conveying symbols in the engram are rapidly generated in the course of computations, which implies that they are molecules. (shrink)
