This paper examines a number of questions about the degree to which the clinical practice of medicine is affected, if at all, by the legal systems in four countries: Chile, Germany, Japan and the United States. The focus on these four countries in four different regions of the world offers a unique perspective within which to examine medical treatment decisions made by patients and their proxies or surrogates, the potential role for universal written instruments such as advance directives, the cross-professional (...) tensions between clinical and legal concerns in very distinct cultures, and the degree to which legal activities can change or affect clinical realities in the context of these different political and health care systems. We have incorporated, whenever relevant, the insights of many disciplines, including the social sciences, in analyzing the existing interrelations between law and behavior in this specific context. Der Beitrag untersucht, inwieweit die klinische Praxis in vier Ländern mit unterschiedlichen Rechtssystemen und Berufskulturen durch Rechtsnormen oder das Verständnis von Recht beeinflußt wird. Es wird gefragt, welche Funktion rechtliche Interventionen bei der Veränderung von Verhaltensnormen in unterschiedlichen Gesundheitssystemen haben können. Folgende Themenbereiche werden diskutiert: Entscheidungen über die medizinische Behandlung, die von Patienten und ihren Angehörigen oder Stellvertretern getroffen werden; die mögliche Rolle umfassender schriftlicher Verfügungen wie z.B. der Patiententestamente ; die berufsübergreifenden Spannungen zwischen medizinischen und rechtlichen Belangen in sehr unterschiedlichen Kulturen; der Einfluß, den gesetzgeberische Aktivitäten im Kontext der verschiedenen politischen und Gesundheitssysteme auf die medizinische Wirklichkeit haben. Bei ihrer Analyse der in diesem Zusammenhang bestehenden Beziehungen im Verhältnis von Recht und Verhalten haben die Autoren die Erkenntnisse vieler Disziplinen unter Einschluß der Sozialwissenschaften, soweit sie als relevant erscheinen, in ihren Beitrag eingearbeitet. Dans cet article, nous décrivons un schéma et des modèles de représentation développés pour structurer les corpus de communication médiée par ordinateur (CMC) en suivant les recommandations de la Text Encoding Initiative (TEI). Nous considérons le discours CMC comme un échange dialogique entre humains, organisé de manière séquentielle. Nous insistons d’abord sur le fait que de nombreuses caractéristiques de la CMC ne sont pas traitées de manière adéquate par les schémas et les outils actuels d’encodage de corpus. Nous formulons donc (...) un ensemble de recommandations pour représenter la CMC avec des schémas d’encodage, en insistant sur le fait que la TEI nous semble être un cadre particulièrement approprié pour l’encodage des corpus CMC. Nous proposons une modélisation des unités de base de la CMC (énoncés, messages et actions non verbales) ainsi que des structures de niveaux macro- et micro des interactions dans les environnements de la CMC. À partir de ces modèles, nous introduisons le CMC-core, un noyau TEI pour l’encodage des corpus CMC, qui définit un ensemble de traits d’encodage spécifiques à la CMC sur quatre niveaux: (i) éléments, (ii) classes de modèles, (iii) classes d'attributs et (iv) modules de l'infrastructure TEI. La description du noyau proposé est illustrée au moyen d’exemples extraits des corpus des chercheurs du groupe SIG TEI CMC, représentant une grande variété de genres de la CMC (le chat, le wiki talk, le tweet, le blog, les interactions Second Life…). Le matériel décrit, i.e. les schémas, les exemples d’encodage et la documentation, est disponible sur le Wiki du SIG CMC TEI et accompagnera une demande d’enrichissement de la TEI (TEI feature request) au conseil de la TEI à la fin de l’année 2019. Son but est d’interroger la construction de la définition « naturalisante » des qualités attribuées à l’un et l’autre sexe. A partir de traités physiologiques sur les maladies des femmes, la réflexion porte sur trois points principaux. Pourquoi la lecture et la masturbation sont-ils devenus des problèmes médicaux? Comment un médecin neutralise-t-il le danger, pour une femme, de lire un (...) traité sur un sujet tel que la masturbation? Norbert Elias has notably influenced the historiography of the Early Modern Period since the 1970s. In the course of the borrowing of his concepts by different disciplines, the uniqueness of these concepts was nevertheless altered. This article aims to show that Elias' 'Sociology of configurations' proposed an original point of view on Longue Durée in history. It thus suggests: 1) to re-evaluate the historical dimension of Elias' sociology; 2) to question eventual contributions to present-day research to the history of medicine (...) and health. (shrink)

Objectives: Hospital ethics committees increasingly affect medical care worldwide, yet there has been little evaluation of these bodies. Israel has the distinction of having ethics committees legally required by a Patients' Rights Act. We studied the development of ethics committees in this legal environment.Design: Cross-sectional national survey of general hospitals to identify all ethics committees and interview of ethics committee chairpersons.Setting: Israel five years after the passage of the Patients' Rights Act.Main measurements: Patients' rights and informal ethics committee structure and (...) function.Results: One-third of general hospitals have an ethics committee, with committees concentrated in larger facilities. Hospitals without committees tended to lack any structure to handle ethics issues. Committees tend to be interdisciplinary and gender-mixed but ethnic mix was poor. Confidentiality is the rule, however, legal liability is a concern. One-third of patients' rights ethics committees never convened and most committees had considered fewer than ten consults. Access to the consultation process and the consultation process itself varied substantially across committees. Some patients' rights ethics committees attempted to solve cases, others only rendered decisions. Informal committees often refused to consider cases within Patients' Rights Act jurisdiction.Conclusions: Despite statutory requirement, many Israeli patients and clinicians do not have access to ethics committees. The scant volume of cases shows serious discrepancies between practice and Patients' Rights Act regulations, suggesting the need for education or revision of the law. Heterogeneity in committee function demonstrates need for substantial improvement. (shrink)

Manipulating sensory and motor cues can cause an illusionary perception of ownership of a fake body part. Presumably, the illusion can work as long as the false body part’s position and appearance are anatomically plausible. Here, we introduce an illusion that challenges past assumptions on body ownership. We used virtual reality to switch and mirror participants’ views of their hands. When a participant moves their physical hand, they see the incongruent virtual hand moving. The result is an anatomically implausible configuration (...) of the fake hand. Despite the hand switch, participants reported significant body ownership sensations over the virtual hands. In the first between-group experiment, we found that the strength of body ownership over the incongruent hands was similar to that of congruent hands. Whereas, in the second within-group experiment, anatomical incongruency significantly decreased body ownership. Still, participants reported significant body ownership sensations of the switched hands. Curiously, we found that perceived levels of agency mediate the effect of anatomical congruency on body ownership. These findings offer a fresh perspective on the relationship between anatomical plausibility and assumed body ownership. We propose that goal-directed and purposeful actions can override anatomical plausibility constraints and discuss this in the context of the immersive properties of virtual reality. (shrink)

In a context of associational professionalization that is modifying deeply the training offer designed for volunteers in social centers, our contribution (stemming from a doctoral research) proposes to consider the volunteers› accompaniment as an opportunity for employees› professional development in charge of welcoming them. The involved research has mobilized a theoretical framework that articulates work on emerging professionalism and professional ethos (Jorro, 2009; 2011) with communities of practice theory (Wenger, 2005). We propose to consider these accompaniment situations as a (...) cultural practice commitment (Billett, 2008) from the discovery of the acted-out-values that guide practices in the spaces concerned. Moral philosophers agree that welfare matters. But they disagree about what it is, or how much it matters. In this vital new work, Wayne Sumner presents an original theory of welfare, investigating its nature and discussing its importance. The Anderson Station massacre highlights problems with both sovereignty's fragmentation and biopolitics. Sovereign entities have power over and determine the value of human life. Over and over, Belter life is reduced to bare life. They are exploited and then exterminated when their “usefulness” runs its course. What we often see in these reductions of Belters to bare life is the way that capitalism corrupts—both other sovereign entities and as a sovereign. In The Expanse, the problems with the uncontrolled capitalist sovereign (...) and the influence of capitalism on other sovereign entities are stark. Adding in the aspect of biopolitics, a people considered inferior like the Belters, makes these problems even more stark. Even Ceres police detective Joe Miller says the Belter political organization, the Outer Planets Alliance, is beloved by the people it helped and feared by the ones who got in its way. (shrink)
