Do citizens of liberal democratic states have a moral right to engage in civil disobedience? Famously, Joseph Raz argued that they do not. In this article, I defend his argument against some recent challenges, but show how it is tied to a particular model of civil disobedience. On this model, the purpose of civil disobedience is to protest and prevent particularly egregious violations of justice. A moral right to civil disobedience can be grounded on a different model, where the function (...) of civil disobedience is to identify and counterbalance democratic deficits. Against the widespread tendency amongst theorists of civil disobedience to want to defend civil disobedience as the exercise of a moral right, however, I do not then argue for the adoption of the democratic model. Whilst I acknowledge the reasons behind wanting a rights-based defence, and concede that different kinds of civil disobedience might have to be defended on different grounds, I sound a note of caution. The meta-theoretical relation between moral grounds and political function uncovered in this article works both ways. It should make theorists more mindful of the self-understanding to which a rights-based moral defence of civil disobedience commits protesters. (shrink)

This article reinterprets the Dialectic of Enlightenment as a retelling of the Christian myth of the Fall. Through its account of the aporia, which Horkheimer and Adorno maintain stands at its core, the Dialectic of Enlightenment rearticulates the doctrine of original sin. The human condition is presented as tragic, and the source of this tragedy is inscribed into the very structure of human subjectivity. While the Dialectic of Enlightenment refuses to abandon hope, emancipation is reconceptualised on the model of redemption; (...) a kind of fulfilment of human nature, which would at the same time be an escape from it. Horkheimer and Adorno dispense, however, with any transcendent source of grace. Instead, the activity of philosophy itself takes on redemptive quality. (shrink)

Reasoning with quantifier expressions in natural language combines logical and arithmetical features, transcending strict divides between qualitative and quantitative. Our topic is this cooperation of styles as it occurs in common linguistic usage and its extension into the broader practice of natural language plus ‘grassroots mathematics’.We begin with a brief review of by changing the semantics of counting in natural ways. A first approach replaces cardinalities by abstract but well-motivated values of ‘mass’ or other mereological aggregating notions. A second approach (...) keeps the cardinalities but generalizes the meaning of counting to work in models that allow dependencies between variables.Finally, we return to our starting point in natural language, confronting the architecture of our formal systems with linguistic quantifier vocabulary and syntax, as well as with natural reasoning modules such as the monotonicity calculus. In addition to these encounters with formal semantics, we discuss the role of counting in semantic evaluation procedures for quantifier expressions and determine, for instance, which binary quantifiers are computable by finite ‘semantic automata’. We conclude with some general thoughts on yet further entanglements of logic and counting in formal systems, on rethinking the qualitative/quantitative divide, and on connecting our analysis to empirical findings in cognitive science. The overarching topic of this dissertation is the semantics and pragmatics of definite descriptions. It focuses on the question whether sentences such as ‘the king of France is bald’ literally assert the existence of a unique king or simply presuppose the existence of such a king. One immediate obstacle to resolving this question is that immediate truth value judgments about such sentences are particularly unstable; some elicit a clear intuition of falsity whereas others simply seem awkward or strange. Because of (...) these variations, truth value judgments are generally considered unreliable. In the first chapter of the dissertation, an explanation of this phenomenon is developed. It is observed that when these types of sentences are considered in the context of a discourse, a systematic pattern in judgments emerges. This pattern, it is argued, should be explained in terms of certain pragmatic factors, e.g. whether a speaker’s utterance is interpreted as cooperative. A detailed and general explanation of the phenomenon is then presented which draws importantly on recent research in the semantics and pragmatics of questions and focus. It is shown that the behavior of these judgments can be systematically explained, that truth value judgments are not as unreliable as standardly assumed, and that the proposed explanation best supports the conclusion that definite descriptions presuppose rather than assert existence. In the second chapter, the following problem is investigated. If definite descriptions are assumed to literally assert existence, a sentence such as ‘Hans wants the ghost in his attic to be quiet’ is incorrectly predicted to be true only if Hans wants there to be a ghost in his attic. This prediction is often considered evidence against Russell’s quantificational analysis and evidence in favor of the referential analysis of Frege and Strawson. Against this claim, it is demonstrated that this problem is a general problem about the existence commitments of natural language determiners, i.e. not an argument in favor of a referential analysis. It is shown that in order to avoid these undesirable predictions, quite radical changes to the semantic framework are required. For example, it must be assumed that a sentence of the form ‘The F is G’ has the open sentence ‘x is G’ as its asserted content. A uniform quantificational and presuppositional analysis of definites and indefinites is outlined which by exploiting certain features of so-called dynamic semantics unproblematically assumes that the asserted contents indeed are open sentences. In view of the proposed quantificational/presuppositional analysis, the dissertation is concluded by a rejection of the argument put forward by Reimer and Devitt that definite descriptions are ambiguous between attributive and referential uses. Reimer and Devitt’s argument is based primarily on the assumption that definite descriptions are conventionally used to communicate singular thoughts and that the conventional meaning of a definite description therefore must be fundamentally indexical/directly referential. I argue that this argument relies crucially on tacit assumptions about semantic processing for which no empirical evidence is provided. I also argue that the argument is too general; if sound, it would be an argument for an indexical treatment of most, if not all, other determiners. I then conclude by demonstrating that the view does not explain any new data and thus has no clear motivation. In short, this dissertation provides a detailed pragmatic explanation of a long-standing puzzle about truth value judgments and then outlines a novel dynamic semantic analysis of definites and indefinites. This analysis solves a significant problem about existence commitments — a problem that neither Russell’s nor the Frege/Strawson analysis are equipped to handle. Current dynamic-epistemic logics model different types of information change in multi-agent scenarios. We generalize these logics to a probabilistic setting, obtaining a calculus for multi-agent update with three natural slots: prior probability on states, occurrence probabilities in the relevant process taking place, and observation probabilities of events. To match this update mechanism, we present a complete dynamic logic of information change with a probabilistic character. The completeness proof follows a compositional methodology that applies to a much larger class of dynamic-probabilistic (...) logics as well. The orthodox definition of hope suffers from an exclusion problem: it is unable to exclude subjects without hope. In fact, the orthodox definition even allows for despair to be falsely classified as hope. This problem suggests two basic desiderata for a successful analysis of hope: it should solve the exclusion problem, and it should have the resources to explain why, in a given situation, a subject does or does not form a hope. Bearing these desiderata in mind, I assess two (...) recent hope‐accounts offered by Jack M. C. Kwong and Cheshire Calhoun. I then offer my own view, which is based on the Jamesian notion of a “live possibility”. I suggest that a possibility needs to reach a certain probability threshold in order to count as live, and according to my account, to hope is to desire the truth of such a live possibility. This view is well‐equipped to solve the exclusion problem, and it can explain why a subject does or does not hope. (shrink)

We investigate two under-explored factors in mitigating the risk of corporate fraud and regulatory enforcement against fraud, namely institutional investors and political connections. The role of institutional investors in the effective monitoring of a firm’s management is well established in the literature. We further observe that firms that have a large proportion of their shares held by institutional investors have a lower incidence of enforcement actions against corporate fraud. The importance of political connections for enterprises, whether in a developed market (...) such as the United States or an emerging market such as China, has been established by previous studies. However, we find evidence of another positive effect of political connections: they may reduce the incidence of enforcement action against corporate fraud. We also find that political connections play a more significant role in reducing regulatory enforcement incidents against non-state-owned enterprises and firms in weaker legal environments, whereas institutional ownership plays a more important role in reducing regulatory enforcement incidents against state-owned enterprises. We discuss four interconnected issues that we believe have hindered investigations into how language may affect thinking. These have had a tendency to reappear in the debate concerning linguistic relativity over the past decades, despite numerous empirical findings. The first is the claim that it is impossible to disentangle language from thought, making the question concerning “influence” pointless. The second is the argument that it is impossible to disentangle language from culture in general, and from social interaction in particular, so (...) it is impossible to attribute any differences in the thought patterns of the members of different cultures to language per se. The third issue is the objection that methodological and empirical problems defeat all but the most trivial version of the thesis of linguistic influence: that language gives new factual information. The fourth is the assumption that since language can potentially influence thought from “not at all” to “completely,” the possible forms of linguistic influence can be placed on a cline, and competing theories can be seen as debating the actual position on this cline. We analyze these claims and show that the first three do not constitute in-principle objections against the validity of the project of investigating linguistic influence on thought, and that the last one is not the best way to frame the empirical challenges at hand. While we do not argue for any specific theory or mechanism for linguistic influence on thought, our discussion and the reviewed literature show that such influence is clearly possible, and hence in need of further investigations. IntroductionBorderline personality disorder patients are often subjected to inpatient compulsory care due to suicidal behaviour. However, inpatient care is usually advised against as it can have detrimental effects, including increased suicidality.AimTo investigate what motives psychiatrists have for treating borderline personality disorder patients under compulsory care.Materials and MethodsA questionnaire survey was distributed to all psychiatrists and registrars in psychiatry working at mental health emergency units or inpatient wards in Sweden. The questionnaire contained questions with fixed response alternatives, with room for comments, (...) about the respondents’ motives for practising compulsory care of borderline personality disorder patients. The responses were analysed quantitatively with descriptive statistics, and comments were analysed with qualitative descriptive content analysis.ResultsThe psychiatrists’ views were divided on when it was justified to treat borderline personality disorder patients under compulsory care, as were their views on borderline personality disorder patients’ decision competence. When there was an assessed risk of harm, 53% were positive to compulsory care of decision-competent borderline personality disorder patients and another 31% because they considered the patients to be decision incompetent in such situations. Adding the risk of harm caused many respondents to alter their assessment of the patient from decision competent to decision incompetent.ConclusionThe large variations in doctors’ opinions indicate that the care of borderline personality disorder patients is arbitrary. Further, the assessed risk of harm increases the use of compulsory care, even though such care is advised against in clinical guidelines, has questionable legal support, and could lead to an increased suicide risk over time. We investigate the major mathematical theories of space from a modal standpoint: topology, affine geometry, metric geometry, and vector algebra. This allows us to see new fine-structure in spatial patterns which suggests analogies across these mathematical theories in terms of modal, temporal, and conditional logics. Throughout the modal walk through space, expressive power is analyzed in terms of language design, bisimulations, and correspondence phenomena. The result is both unification across the areas visited, and the uncovering of interesting new questions.

We distinguish four alternative standards of fair prices based on egalitarian, basic rights, capitalistic and libertarian approaches. We investigate which standards are guiding the perceptions of price fairness of citizens and coffee trade organizations. We find that there is a divergence in views between citizens and key players in the coffee market. Whereas citizens support the concept of fairness derived from the basic rights approach, holding (...) that the price should provide coffee farmers with a minimum level of subsistence, representatives of Dutch coffee traders hold the capitalistic view that the free world market price is fair. ObjectiveIn Belgium, people with an incurable psychiatric disorder can file a request for euthanasia claiming unbearable psychic suffering. For the request to be accepted, it has to meet stringent legal criteria. One of the requirements is that the patient possesses decision-making capacity. The patient’s decision-making capacity is assessed by physicians.The objective of our study is to provide insight in the assessment of decision-making capacity in the context of euthanasia for patients with psychic suffering caused by a psychiatric disorder.MethodTwenty-two semistructured interviews (...) with psychiatrists and neurologists were analysed with NVivo, a qualitative analysis software to code and organise transcribed data.ResultsDifferent views and approaches regarding decision-making capacity in the context of euthanasia emerged from the data.Most of the physicians have some knowledge of the cognitive ability approach on decision-making capacity. According to this approach, four abilities constitute decision-making capacity: communication, understanding, appreciation and reasoning. We observed differences in the way these abilities are valued in relation to competence. Some physicians take additional elements into consideration when assessing decision-making capacity.Physicians acquired their knowledge on the subject in many different ways. Most of the physicians reported that decision-making capacity was not part of their training.ConclusionWe conclude that physicians assess decision-making capacity in different ways and that personal values and beliefs influence their approach. As such, a common approach in assessing the decision-making capacity of a patient among the interviewed physicians is lacking. Less arbitrariness could be obtained by consistently implementing the cognitive ability approach. (shrink)

I provide a unified account of hope and fear as propositional attitudes. This “mirror account” is based on the historical idea that the only difference between hope and fear is the conative attitude involved, positive for hope and negative for fear. My analysis builds on a qualified version of the standard account of hope. The epistemic condition is formulated in terms of live possibility and the conative according to a non-reductive view on desire and aversion. This article discusses the meanings of “creativity”—tvorchestvo—as we encounter it in Georges Florovsky’s thought, first and foremost in his magnum opus Ways of Russian Theology (1937). Tvorchestvo had by this time become a key concept in Russian pre-revolutionary and later émigré thought. It is associated above all with Nikolai Berdyaev’s philosophy, but it also plays an important role in Sergei Bulgakov’s philosophy of economy. In both cases, it stands for the human response to divine creation. Moreover, and somewhat less famously, (...) it was also an epistemological concept in the religious idealism of Vladimir Solovyov as well as in Russian neo-Kantianism (Fyodor Stepun), where it stood for the active, synthetic faculty of our minds. Florovsky, meanwhile, used it as a description of how we should relate to the patristic heritage, but also to history more generally: Our attitude should be “creative,” active, as well as both backward- and forward-looking. This “return to the Fathers” was a central component of Florovsky’s neopatristic program, but, interestingly, in order to conceptualize this return, Florovsky took over a concept from traditions that his own approach otherwise firmly criticized. By analyzing Florovsky’s use of tvorchestvo, this article addresses the broader question as to the differences and parallels between the neopatristic movement and the legacy of the Russian Renaissance (Silver Age). The cosmological argument has enjoyed and still enjoys substantial popularity in various traditions of natural theology. We propose that its enduring appeal is due at least in part to its concurrence with human cognitive predispositions, in particular intuitions about causality and agency. These intuitions seem to be a stable part of human cognition. We will consider implications for the justification of the cosmological argument from externalise and internalise perspectives.

The type of mood or tense marking that causes counterfactuality inferences—as figuring prominently, but far from exclusively, in counterfactual conditionals—has not yet received a comprehensive and compositional analysis. Focusing on four languages, the paper presents under-appreciated facts and a novel theory where the mood serves to activate alternatives to modal operators, particularly one: the identity operator, often giving rise to counterfactual implicatures.

The article discusses the notion of culture as it appears and is conceptualized in the works of G.P. Fedotov. The analysis focuses on two articles by Fedotov published in Russian migr journals, "The Holy Spirit in Nature and Culture" of 1932 and "Eschatology and culture" of 1938, and in his magnum opus in a Western context, The Russian Religious Mind of 1946. The author proposes to analyze Fedotov's ideas as a theology of culture due to the profoundly religious meaning the (...) Russian migr thinker attributed to cultural products and production, regardless of their religious intention. By implication, Fedotov understood culture in a religious framework as the human experience of and response to the divine, though not necessarily as dependent on firm belief. Viewing Fedotov as a theologian of culture enables us, furthermore, to compare him with other thinkers across the West-East cultural gradient, most notably Paul Tillich. This approach contextualizes Fedotov in a post-Schellingian pan-European idealist tradition, to which Russian thinkers' analyses of religious experience and imagination have made seminal contributions, in particular from Vladimir Solov'ev on. The article discusses these issues within the framework of the perspectives of global intellectual history, entangled history, and transnationalized Russian studies. (shrink)

In this article we assess the general claim that Durkheimian sociology has reactionary, fascist, or totalitarian affinities, and the specific claim that Marcel Déat’s Durkheimian background was a significant factor in his becoming a Nazi sympathizer. We do so by comparing the different trajectories of the interwar generation of young Durkheimians and find that only one, i.e. Déat, can be said to have become fascist. Indeed, what characterizes this generation of Durkheimians is the variety of the ways in which they (...) responded to the crises of the interwar years, both politically and scientifically. Nonetheless, most remained on the political left, and during the war many younger members of the Durkheimian group either fled the country or were involved in the French Resistance. As the only personal link between the Durkheimian group and fascism, Déat’s career is of particular interest. Instead of Déat’s being an orthodox Durkheimian, his successive engagements embody the intellectual fragmentation and heterodoxy characteristic of the interwar generation. We outline Déat’s career by foregrounding the conjunctural and dispositional factors that we believe point toward a more plausible explanation of Déat’s transformation than does an internalist history-of-ideas approach according to which his political evolution can be explained by reference to an underlying intellectual continuity. Déat’s fascism is better explained by the repeated frustration of his political and intellectual ambitions that ultimately led to a fateful accommodation with Nazi power than by any tendency inherent to Durkheimian sociology. Prof. W.A. Dreyer played an important role in the continuous reformation of the Nederduitsch Hervormde Kerk van Afrika (NHKA). This contribution to his Festschrift is not about him. He would not want that. It is about the church and how his understanding of reformed ecclesiology became the basis on which the transformation from ‘ Volkskerk ’ to missional church took place. According to himself, that was his calling and his life’s work. The importance of his contribution cannot be understood without (...) the historical background in which it played out. Neither is it possible to envisage what really happened without acknowledging the theologians who played an important part in his life. This article therefore starts with a short overview of the history of the NHKA. It then proceeds with an overview of how important theologians in the NHKA influenced his ecclesiology. It concludes with three specific contributions that Prof. W.A. Dreyer made which makes him a key role player which led the NHKA on the way of Ecclesia reformata semper reformanda. Contribution: Prof. W.A. Dreyer became an important church leader in the Netherdutch Reformed Church. His leadership resulted in important changes in the church and especially in the ecclesiology of the church. This article, which is part of his Festschrift, gives an overview of his theological contribution through the lens of semper reformanda. By doing so, it indicates how important is the role of church leaders. All the research is based on his scholarly work. (shrink)

This book assists health care providers to understand the specific interplay of the roles and relationships currently forming the debates in pediatric clinical ethics. It builds on the fact that, unlike adult medical ethics, pediatric ethics begins within an acutely and powerfully experienced dynamic of patient-family-state-physician relationship. The book provides a unique perspective as it interacts with established approaches as well as recent developments in pediatric ethics theory, and then explores these developments further through cases. The book first focuses on (...) setting the stage by introducing a theoretical framework and elaborating how pediatric ethics differ from non-pediatric ethics. It approaches different theoretical frameworks in a critical manner drawing on their strengths and weaknesses. It helps the reader in developing an ability to engage in ethical reasoning and moral deliberation in order to focus on the wellbeing of the child as the main participant in the ethical deliberation, as well as to be able to identify the child’s moral claims. The second section of the book focuses on the practical application of these theoretical frameworks and discusses specific areas pertaining to decision-making. These are: the critically ill child, new and enduring ethical controversies, and social justice at large, the latter of which includes looking at the child’s place in society, access to healthcare, social determinants of health, and vaccinations. With the dynamic changes and challenges pediatric care faces across the globe, as well as the changing face of new technologies, no professional working in the field of pediatrics can afford not to take due note of this resource.
