Two principal sources of imprecision in legal drafting (vagueness and ambiguity) are identified and illustrated. Virtually all of the ambiguity imprecision encountered in legal discourse is ambiguity in the language used to express logical structure, and virtually all of the imprecision resulting is inadvertent. On the other hand, the imprecision encountered in legal writing that results from vagueness is frequently, if not most often, included there deliberately; the drafter has considered it and decided that the vague language best accomplishes the (...) purpose at hand. This paper focuses on the use of some defined terminology for minimizing inadvertent ambiguity in the logical structure of legal discourse, where desired by the drafter. The current set of signaled structural definitions that are included in the A-Hohfeld language are first set forth and their use is illustrated in an extensive example from the treaty establishing the European Economic Community. The use of definitions in legal writing is widespread, butaddressed almost exclusively to controlling the vagueness of substantive legal terms; they are seldom used for structural purposes. Furthermore, their use in American legislative drafting is unsignaled. Here, attention is devoted to the relatively-neglected domain in legal discourse of imprecisely expressed logical structure, and the remedy offered, where desired by the drafter, is a set of signaled structuraldefinitions for use in controlling such imprecision. Different legal expert systems may be incompatible with each other: A user in characterizing the same situation by answering the questions presented in a consultation can be led to contradictory inferences. Such systems can be “synthesized” to help users avoid such contradictions by alerting them that other relevant systems are available to be consulted as they are responding to questions. An example of potentially incompatible, related legal expert systems is presented here ‐ ones for the New Jersey murder statute and (...) the celebrated Quinlan case, along with one way of synthesizing them to avoid such incompatibility. Like the concept "structure" a generation ago, "power" now figures prominently in the anthropological understanding of human action. This essay attempts to locate the concept of power in the cultural history of Anglo-Saxon political discourse. Discussion focuses on a specific domain of inquiry—"ethnopsychology"— and on one of the texts recognized as exemplary of that domain, Lutz's Unnatural Emotions. In a field largely concerned with matters of cognitive process, of knowledge structures and patterns of inference, the concept of "power" is (...) used to supply motivational force; motivation is the will to power. This is intelligible, however, only against the implicit background of Anglo-Saxon political theory, best represented historically in the work of Thomas Hobbes. It is argued that the circumstances of "post-modernity" make the return of Hobbesianism inevitable and that it is this tradition that ethnopsychology unwittingly reproduces in the quest to understand cognition, emotion, and agency. This book presents a thorough overview of a model of human functioning based on the idea that behavior is goal-directed and regulated by feedback control processes. It describes feedback processes and their application to behavior, considers goals and the idea that goals are organized hierarchically, examines affect as deriving from a different kind of feedback process, and analyzes how success expectancies influence whether people keep trying to attain goals or disengage. Later sections consider a series of emerging themes, including dynamic (...) systems as a model for shifting among goals, catastrophe theory as a model for persistence, and the question of whether behavior is controlled or instead 'emerges'. Three chapters consider the implications of these various ideas for understanding maladaptive behavior, and the closing chapter asks whether goals are a necessity of life. Cognitive science, at least as done by many philosophers, seeks to develop what one might call a content-based theory of cognition. These theorists generally seek to predict/explain cognition by employing generalizations between contentful states like beliefs and desires. In his book, From Folk Psychology To Cognitive Science, Stephen Stich argues that cognitive science should not attempt to employ content-based theories in its explanations of human (and other) behavior. For the most part Stich directs his arguments towards belief/desire psychology. Some of (...) his arguments, however, are directed at content-based theories in general. In this paper, I will be concerned with one of these more general arguments—the principle of autonomy argument.The conclusion of the principle of autonomy argument is that the predictions and explanations generated by content-based theories, in so far as they are possible, do not fall within the domain of prediction and explanation in cognitive science. We propose a model of motivated skepticism that helps explain when and why citizens are biased information processors. Two experimental studies explore how citizens evaluate arguments about affirmative action and gun control, finding strong evidence of a prior attitude effect such that attitudinally congruent arguments are evaluated as stronger than attitudinally incongruent arguments. When reading pro and con arguments, participants (Ps) counterargue the contrary arguments and uncritically accept supporting arguments, evidence of a disconfirmation bias. We also find a confirmation bias—the (...) seeking out of confirmatory evidence—when Ps are free to self-select the source of the arguments they read. Both the confirmation and disconfirmation biases lead to attitude polarization—the strengthening of t2 over t1 attitudes—especially among those with the strongest priors and highest levels of political sophistication. It develops a mathematical system in which there are no existence assertions but only assertions of the constructibility of certain sorts of things.
