Elizabeth Anker y Bernardette Meyler, profesoras de literatura y de derecho respectivamente, involucradas ambas en los últimos años con el movimiento “derecho y literatura”, editan en 2017 New Directions in Law and Literature.

Nancy Jecker’s essay Nothing to be Ashamed of: Sex Robots for Older Adults with Disabilities 1 presents a provocative application of the capabilities approach. Her ethical argument for providing access to sex robots for older adults with disabilities proceeds in five parts: 1. Older adults frequently suffer disabilities that impair sexual functioning. 2. The ability to function sexually is linked to central human capabilities, including: the ability to generate a personally meaningful life narrative; be physically, mentally and emotionally healthy; experience (...) bodily integrity; feel and express a range of human emotions; affiliate deeply with others; and reflect on and choose a plan for their life. 3. Society should take reasonable steps to support these human capabilities at a minimal threshold as part of a broader duty to respect human dignity. 4. Providing access to sex robots comprises part of reasonable efforts to support the six capabilities at a minimal threshold. 5. Therefore, society ought to make reasonable efforts to ensure access to sex robots for older adults with disabilities that impair sexual functioning. I am sympathetic to this line of reasoning, having proposed a series of legal reforms that would facilitate sexual expression among older adults with cognitive impairments as well.2 3 …. (shrink)

La fenomenología distingue el cuerpo-objeto (Körper) del cuerpo vivido (Leib); se interesa por este último y por el cuerpo que se nos manifiesta en nuestras experiencias y les da expresión. Este cuerpo fenoménico es el punto cero de nuestras vidas, el anclaje de nuestra existencia. La fenomenología de Simone de Beauvoir le aplica la diferencia sexual.Esta contribución continúa la hermenéutica de Beauvoir centrándose en su conocida máxima, “no se nace mujer, se llega a serlo”, teniendo en cuenta que las interpretaciones (...) se dan desde y para determinadas situaciones. La nuestra es el siglo XXI y las investigaciones fenomenológicas y feministas. Dado que la traducción es un modo de interpretación, señalaremos cómo El segundo sexo ha contribuido a comprender el devenir mujer. Para ello, en primer lugar, expondremos nuestra concepción hermenéutica de la traducción. Destacaremos después el “estilo” fenomenológico de Beauvoir y las influencias recíprocas con Merleau-Ponty para abrir la posibilidad de una diferencia sexual sin determinismos. (shrink)

Category-based induction is an inferential mechanism that uses knowledge of conceptual relations in order to estimate how likely is for a property to be projected from one category to another. During the last decades, psychologists have identified several features of this mechanism, and they have proposed different formal models of it. In this article; we propose a new mathematical model for category-based induction based on distances on conceptual spaces. We show how this model can predict most of the properties of (...) this kind of reasoning while providing a solid theoretical foundation for it. In this paper, we outline a comprehensive approach to composed analogies based on the theory of conceptual spaces. Our algorithmic model understands analogy as a search procedure and builds upon the idea that analogical similarity depends on a conceptual phenomena called ‘dimensional salience.’ We distinguish between category-based, property-based, event-based, and part-whole analogies, and propose computationally-oriented methods for explicating them in terms of conceptual spaces.

This Article uses age as an entry point for examining how temporal and methodological issues in egalitarianism make substantive equality an unattractive goal for vulnerability theory. Instead, vulnerability theory should adopt a continuous doctrine of sufficiency, which is a better fit with vulnerability theory’s underlying aims and rhetoric. Instead of evaluating what individuals have in relation to others, sufficiency refocuses the inquiry on whether we have enough throughout the lifecourse. Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. In Gärdenfors and Makinson :197–245, 1994) and Gärdenfors it was shown that it is possible to model nonmonotonic inference using a classical consequence relation plus an expectation-based ordering of formulas. In this article, we argue that this framework can be significantly enriched by adopting a conceptual spaces-based analysis of the role of expectations in reasoning. In particular, we show that this can solve various epistemological issues that surround nonmonotonic and default logics. We propose some formal criteria for constructing and updating (...) expectation orderings based on conceptual spaces, and we explain how to apply them to nonmonotonic reasoning about objects and properties. Con ocasión del 80 aniversario de la Universidad Iberoamericana y de su Departamento de Filosofía hemos querido recuperar y comentar uno de los dos primeros libros que se publicaron en lo que entonces se llamaba Centro Cultural Universitario. El libro que nos ocupa es fiel testimonio de la época en que fue publicado. Las conferencias del padre jesuita Ledit son ejemplo de la manera de entender la historia moderna y contemporánea de muchos pensadores católicos preconciliares. La cristiandad medieval había realizado (...) una síntesis con el pensamiento griego. La modernidad fue la paulatina separación de esta filosofía perenne abierta a la trascendencia, con el resultado de una razón soberbia y orgullosa de su finitud; una de sus consecuencias fueron los sistemas totalitarios de la primera mitad del siglo xx, los cuales en su confrontación llevaron al estallido de la Segunda Guerra Mundial. Truthmaker says that things, broadly construed, are the ontological grounds of truth and, therefore, that things make truths true. Recently, there have been a number of arguments purporting to show that if one embraces Truthmaker, then one ought to embrace Truthmaker Maximalism—the view that all non-analytic propositions have truthmakers. But then if one embraces Truthmaker, one ought to think that negative existentials have truthmakers. I argue that this is false. I begin by arguing that recent attempts by Ross Cameron and (...) Jonathan Schaffer to provide negative existentials with truthmakers fail. I then argue that the conditional—if one embraces Truthmaker, the one ought to embrace Truthmaker Maximalism—is false by considering worlds where very little, if anything at all, exists. The conclusion is that thinking that negative existentials do not have truthmakers, and therefore rejecting Truthmaker Maximalism, need not worry Truthmaker embracers. (shrink)

As I will use the term, an object is a mereological sum of some things just in case those things compose it simply in virtue of existing. In the first half of this paper, I argue that there are no sums. The key premise for this conclusion relies on a constraint on what, in certain cases, it takes for something to ground, or metaphysically explain, something else. In the second half, I argue that in light of my argument against sums, (...) Universalism, which is perhaps the most widely accepted answer to the Special Composition Question, is false. (shrink)

Este texto recoge parte de las reflexiones y del desarrollo del capítulo 5 del libro La barbarie que no vimos: Fotografía y memoria en Colombia. Aquí algunas preguntas que se intentan responder en este ensayo: ¿son las tecnologías las únicas responsables de la imposibilidad de ejercer una contemplación activa frente al infortunio de los demás? A propósito de la Parábola del Buen Samaritano, ¿este habría sido reemplazado por el espectador distante o implicado? ¿Qué sucede cuando ese espectador, de tanto ver (...) naufragios, termina fatigado? ¿Y de tanta fatiga, se vuelve indiferente? ¿Qué significa ser espectadores de naufragios en una época en la que la catástrofe no es ocasionada exclusivamente por fuerzas naturales sino por los propios seres humanos? ¿Es posible hallar hoy alguna orilla segura para reconocernos distanciados y salvados de las catástrofes ajenas? Dada la especie de clausura al que las historias de las ideas en Colombia han llevado al expediente sobre las relaciones entre positivismos y tradicionalismos, y ante la necesidad de construir unos criterios de reconocimiento del "positivismo", creo necesario hacer un trabajo preliminar de reproblematización de esas relaciones en el nivel global, utilizando los aportes de historiadores y filósofos europeos y colombianos, a lo que dedicaré las páginas siguientes. Lo que sorprende en la literatura más reciente sobre las relaciones entre (...) tradicionalismos y positivismos es el señalamiento de una serie de singulares parentescos, contra lo que hemos pensado habitualmente. As it is presently employed, grounding permits grounding many things from one ground. In this paper, I show why this is a mistake by pushing for a uniqueness principle on grounding. After arguing in favor of this principle, I say something about it and kinds of grounding, discuss a similar principle, and consider its import on a formal feature of grounding, ontology, and ontological simplicity.

A través del presente ejercicio investigativo y hermenéutico se busca proponer la beneficencia como principio articulador entre la Teología Moral de la Persona, la Bioética y las Prácticas Biomédicas, con el fin de salvaguardar al ser humano de forma integral y desde el ámbito interdisciplinar, frente a la manipulación y menoscabo de la persona en su: dignidad, status antropológico, verdad ontológica y trascendente, lo cual nos lleva a proponer alternativas, dadas las nuevas circunstancias por las que atraviesa la humanidad; y (...) es aquí donde adquiere resonancia proponer la Beneficencia como principio articulador entre estas tres ciencias, dado que ella, como principio, está en los tres saberes de forma implícita y explícita y, las cuales, por su misma esencia, tienen puntos de convergencia como son: la determinación de su carácter moral, su estatuto de servicio, la salvaguarda de la riqueza de la vida, el reconocimiento y respeto por la dignidad humana, el reconocimiento de la multidimensionalidad del ser, y el cuidado que requiere toda persona humana en su fragilidad y vulnerabilidad. Además de lo anterior se cuenta con un abordaje teórico sobre la bioética como saber interdisciplinar; los principios de la bioética y la relación de la teología moral de la persona con la bioética. El artículo recorre el problema de las analogías y diferencias entre la prisión y la escuela, un tema agitado desde la década de 1980 en el seno del Movimiento Pedagógico Colombiano, a la luz de ciertas apropiaciones del libro Vigilar y castigar de Michel Foucault. En la segunda parte el texto recoge la tesis foucaultiana sobre el “fracaso de la prisión” y propone analizar este “fracaso” en el caso de la escuela moderna, a partir de análisis desarrollados en el marco (...) de los trabajos del Grupo de Historia de la Práctica Pedagógica en Colombia. Building upon the insights of scholars attuned to story, narrative, and myth, this article explores the relationship between myth, science, and religion. After clarifying the interplay of the three terms—story, narrative, and myth—and the preference for the term myth, this article will argue that myth can serve as a medium through which religion, neuroscience, and mental well‐being interact. Such an exploration will cover the role of myths in religion, the neurological basis of myth, and the practices of narrative psychology and (...) bibliotherapy. The article will conclude with suggestions for understanding and utilizing the relationship between myth and the scholarly study of the relationship between science and religion. This article ultimately suggests that myth can operate as a methodological aid to the science‐and‐religion field. (shrink)

Climate change exacts a devastating toll on health that is rarely incorporated into the economic calculus of climate action. By aligning health and environmental policy and collaborating across borders, governments and industries can develop powerful initiatives to promote both environmental and human health.

While concerned with how man achieves his status as a moral being, Friedrich Schiller develops a concept of play that serves as a bridge between our sensuous existence to the rational, realizing moral freedom. In what ways might we extend this concept to the non-human animal? Current research by play theorists and ethologists has shown that play behaviour in animals is both complex and crucial in determining social patterns, and Schiller’s account may have anticipated these observations. I argue that through (...) Schiller’s theory of play and our current research on animal play, it is possible to undermine the systematic removal of the animal from the moral realm that happens in modern philosophy. Through play theory, there is a possible way to undermine the assumption that animals are incapable of achieving the status of moral agents, providing an alternate route to the standard view of animals as moral patients. Este trabajo pretende comprender la ética como un modo específico de sabiduría, distinguiéndola de otros modos de sabiduría, como son la magia, el mito, la técnica, la religión y la filosofía. A su vez, se establece la importancia que tiene la virtud para el planteamiento de Polo de la ética como carácter propio de este modo de sabiduría. A continuación, se intenta establecer algunas similitudes y diferencias entre la antropología de Polocon la de Zubiri referida a la noción de virtud.

El tema del espacio público ha sido un problema filosófico tanto en la forma de teorizarse como en la de habitarse, lo que históricamente ha ocupado la atención de múltiples disciplinas, saberes e instituciones políticas. A partir de un ejercicio interpretativo en el campo de la sociología y antropología urbanas, se muestra que éste es el resultado de las contingencias y dinámicas ciudadanas propias que trascienden cualquier especulación teórica, pero que genera un modo de ser particular de los ciudadanos por (...) su comprensión y apropiación, en este caso, de los habitantes de Medellín. Este artículo estudia la razón de Zambrano desde sus albores como razón mediadora. Su rechazo del sistema va unido a su comienzo en la intuición y a su decurso temporal, que analizamos en relación con Bergson y Husserl. La razón poética va más allá de ese núcleo intuitivo para revelar re-flexivamente incluso lo invisible. Su inmersión en las profundidades, en la pasividad actuante, en las entrañas, en la multiplicidad de los tiempos es paralela a la fenomenología de la génesis merleau-pontiana, (...) a su poiesis carnal e incluso al telos de una razón ampliada al sentir. Current methods of obtaining an informed consent leave much to be desired. Patients rarely read consent forms or understand all of the risks, benefits, or alternatives associated with their treatment. Evaluating the advantages and disadvantages of treatment options often presents a more significant challenge for patients with lower levels of health literacy. This article reviews the evidence of shortcomings in our informed consent system and then explores the potential for a new approach to engage patients at all levels of health (...) literacy in their treatment decisions. Specifically, the article will examine the potential of shared decision-making to bridge gaps in knowledge, increase patient adherence to treatment, and improve health outcomes in low health literacy patient populations. Leveling barriers to treatment information for disadvantaged populations should be a public health imperative, especially if it can be shown to improve health outcomes and reduce health disparities.
