Partant de la prémisse selon laquelle « la loi assure la primauté de la personne, interdit toute atteinte à la dignité de celle-ci et garantit le respect de l’être humain dès le commencement de sa vie », l’auteur pose deux grandes questions relevant de l’éthique sociale : « La » personne, n’est-ce pas « toute » personne, parce que nulle n’est plus démunie de dignité qu’une autre? Le pacte social n’est-il pas fondé sur la certitude de la naissance de sujets (...) égaux en droit? À la lumière de ces dernières, l’auteur croit qu’il est permis de se demander si ces principes sont aussi parfaitement respectés qu’emphatiquement affirmés dans les sociétés occidentales pluralistes, surtout lorsque l’on examine la condition des personnes les plus vulnérables de nos communautés. La bioéthique est à la mode. Il faut " être pour "! La prochaine étude par le législateur français des lois " bioéthiques " en témoigne. Avortement, fabrication d'enfants " prêts-à-porter ", recherche biomédicale, clonage, génétique, rien n'échappe à la bioéthique. Et si, cheval de Troie pénétrant le droit, la morale, les déontologies, elle ne constituait qu'une habile machine de subversion des sciences médicales, d'appropriation globale de l'être humain. Des médecins, des philosophes, parlementaires, juristes engagés dans l'examen des doctrines et (...) mécanismes bioéthiques se sont posés la question. Leur réponse n'est vraiment pas celle du " consensus ". Elle impose au public savant et aux gens prétendus ordinaires et à leurs représentants dans la Cité, une réflexion, un retour vers une nouvelle liberté de penser. (shrink)

What is bioethics? For those involved in the study or the teaching of bioethics this question is a fundamental one. This book proposes a series of possible answers to this question, converging on the idea that bioethics is a myth. As a whole, the book is a response to the so-called French “bioethical” laws (1994) and to the “bioethics” they propagate. It is therefore, for the French-reading English-speaker, a good introduction to these and to the debates around them. Gérard (...) Mémeteau, professor of law and director of the newly established Centre de Droit Médical at the University of Poitiers, documents in his article on the one hand the inconsistencies of the French legal approach, and on the other his own regret at being forced to admit these inconsistencies. This work challenges the textbook assessment of Schopenhauer as militant atheist and absolute pessimist. In examining Schopenhauer's grappling with religion, theology and Kant's moral philosophy, Mannion suggests we can actually discern a 'religious' humility in method in Schopenhauer's work, seen most clearly in his ethics of compassion and his doctrine of salvation. Given current debates between theologians and philosophers in relation to 'postmodernity' and 'postmodern thought', this book illustrates that Schopenhauer should be a key figure in such debates.

This article offers a new theory about how using lotteries to distribute scarce benefits satisfies beneficiaries' claims. In the first section of the article I criticize John Broome's view and on the basis of these criticisms set out four desiderata for a philosophically adequate account of claim satisfaction by lottery. In section II I propose and defend a new view called the dual structure view, so called because it posits that claimants have two types of claims in the relevant scarce (...) benefit distribution cases under discussion. This view meets all the desiderata set out in section I. Section III draws out the practical implications of my view for a variety of temporally extended cases, including the distribution of corneas to patients who have suffered corneal degeneration. In the fourth chapter of the Hippocratic treatise De mortis II 1 an unnamed illness is discussed which arises allegedly from an overabundance of blood in the vessels around the brain. The author of the chapter, however, disputes this aetiology.

On a charge of murder or manslaughter it must be shown that the person killed was one who was in being.
