In his work, Jules Coleman has held that the rule of recognition, if conceived of as a shared cooperative activity, should be the gateway through which to incorporate moral constraints on the content of law. This analysis, however, leaves unanswered two important questions. For one thing, we do not know when or even why morality becomes a criterion of legality. And, for another thing, we still do not know what conception of morality it is that we are dealing with. In (...) this article, we will attempt to clarify in greater depth what relations there are between the social practice of law and morality. We will thus see how the cooperative nature of social practices imbues law with a moral force, and how this makes it possible to establish a "weak" connection between law and morality: To see this, we will need to single out some basic features of cooperative social practices, thus setting out a suitable framework for the view just mentioned. In this paper, we provide an analysis of the concept of legal personality and discuss whether personality may be conferred on artificial intelligence systems (AIs). Legal personality will be presented as a doctrinal category that holds together bundles of rights and obligations; as a result, we first frame it as a node of inferential links between factual preconditions and legal effects. However, this inferentialist reading does not account for the ‘background reasons’ of legal personality, i.e., it does not explain why (...) we cluster different situations under this doctrinal category and how extra-legal information is integrated into it. We argue that one way to account for this background is to adopt a neoinstitutional perspective and to update the ontology of legal concepts with a further layer, the meta-institutional one. We finally argue that meta-institutional concepts can also support us in finding an equilibrium around the legal-policy choices that are involved in including (or not including) AIs among legal persons. Para além das inegáveis ambiguidades da sua vida, encontramos no seu caminho de pensamento a prova de uma vigorosa crítica da ideologia compreendida no seu sentido mais radical. O seu pensamento pode ser compreendido como uma destruição "sistemática" dos momentos fundadores em torno dos quais se constituiu uma parte da reflexão ocidental (ontoideológica), enquanto que afirmação ideológica (autoreferencial) de verdade e valores que mascaram e justificam o poder do (...) homem sobre e contra o outro homem. No coração desta Destruktion está uma experiência do pensamento que dispõe para a escuta de um ser cujo poder essencial é o de deixar-ser, sem revendicar um poder-saber sobre aquilo que é dado. Neste lugar de abertura ex-statica, que constitui o abismo (Ab-Grund) de todo o pensamento autocentrado e que não se dá sem riscos, abre-se a possibilidade de uma nova compreensão antropológica e ética. /// This article attempts to offer a re-reading of the paradoxical relevance of Heidegger for the present times. Beyond the undeniable ambiguities of his life, we can find in the course of his thought a vigorous critique of ideology in the most radical sense of the word. His thought may be understood as a u systematic" destruction of the foundational moments upon which Western thought (as onto-theological) is established. This is done to the degree that it conceals a self-referring ideological affirmation of truth and values that hides and justifies the exercise of power of human beings over and against each other. At the heart of this Destruktion, there is an experience of thought disposed to attentively hear a being whose essential power consists in letting-be, without claiming knowledge as a power to impose itself on what is given. In this space of ex-static opening, constituting the abyss of all self-centered thought together with the risks that it involves, the possibility of a new anthropological and ethical understanding is in the offing. The work of Giorgio Agamben, one of Italy's most important and original philosophers, has been based on an uncommon erudition in classical traditions of philosophy and rhetoric, the grammarians of late antiquity, Christian theology, and modern philosophy. Recently, Agamben has begun to direct his thinking to the constitution of the social and to some concrete, ethico-political conclusions concerning the state of society today, and the place of the individual within it. In Homo Sacer, Agamben aims to connect the problem (...) of pure possibility, potentiality, and power with the problem of political and social ethics in a context where the latter has lost its previous religious, metaphysical, and cultural grounding. Taking his cue from Foucault's fragmentary analysis of biopolitics, Agamben probes with great breadth, intensity, and acuteness the covert or implicit presence of an idea of biopolitics in the history of traditional political theory. He argues that from the earliest treatises of political theory, notably in Aristotle's notion of man as a political animal, and throughout the history of Western thinking about sovereignty, a notion of sovereignty as power over "life" is implicit. The reason it remains merely implicit has to do, according to Agamben, with the way the sacred, or the idea of sacrality, becomes indissociable from the idea of sovereignty. Drawing upon Carl Schmitt's idea of the sovereign's status as the exception to the rules he safeguards, and on anthropological research that reveals the close interlinking of the sacred and the taboo, Agamben defines the sacred person as one who can be killed and yet not sacrificed—a paradox he sees as operative in the status of the modern individual living in a system that exerts control over the collective "naked life" of all individuals. We present recent results on the model companions of set theory, placing them in the context of a current debate in the philosophy of mathematics. We start by describing the dependence of the notion of model companionship on the signature, and then we analyze this dependence in the specific case of set theory. We argue that the most natural model companions of set theory describe (as the signature in which we axiomatize set theory varies) theories of $H_{\kappa ^+}$, as $\kappa (...) $ ranges among the infinite cardinals. We also single out $2^{\aleph _0}=\aleph _2$ as the unique solution of the continuum problem which can (and does) belong to some model companion of set theory (enriched with large cardinal axioms). While doing so we bring to light that set theory enriched by large cardinal axioms in the range of supercompactness has as its model companion (with respect to its first order axiomatization in certain natural signatures) the theory of $H_{\aleph _2}$ as given by a strong form of Woodin’s axiom $(*)$ (which holds assuming $\mathsf {MM}^{++}$ ). Finally this model-theoretic approach to set-theoretic validities is explained and justified in terms of a form of maximality inspired by Hilbert’s axiom of completeness. (shrink)

Why has power in the West assumed the form of an "economy," that is, of a government of men and things? If power is essentially government, why does it need glory, that is, the ceremonial and liturgical apparatus that has always accompanied it? In the early centuries of the Church, in order to reconcile monotheism with God's threefold nature, the doctrine of Trinity was introduced in the guise of an economy of divine life. It was as if the Trinity amounted (...) to nothing more than a problem of managing and governing the heavenly house and the world. Agamben shows that, when combined with the idea of providence, this theological-economic paradigm unexpectedly lies at the origin of many of the most important categories of modern politics, from the democratic theory of the division of powers to the strategic doctrine of collateral damage, from the invisible hand of Smith's liberalism to ideas of order and security. But the greatest novelty to emerge from _The Kingdom and the Glory _ is that modern power is not only government but also glory, and that the ceremonial, liturgical, and acclamatory aspects that we have regarded as vestiges of the past actually constitute the basis of Western power. Through a fascinating analysis of liturgical acclamations and ceremonial symbols of power—the throne, the crown, purple cloth, the Fasces, and more—Agamben develops an original genealogy that illuminates the startling function of consent and of the media in modern democracies. Predicates such as tall or to know Latin, which intuitively denote permanent properties, are called individual-level predicates. Many peculiar properties of this class of predicates have been noted in the literature. One such property is that we cannot say #John is sometimes tall. Here is a way to account for this property: this sentence sounds odd because it triggers the scalar implicature that the alternative John is always tall is false, which cannot be, given that, if John is sometimes tall, (...) then he always is. This intuition faces two challenges. First: this scalar implicature has a weird nature, since it must be surprisingly robust (otherwise, it could be cancelled and the sentence rescued) and furthermore blind to the common knowledge that tallness is a permanent property (since this piece of common knowledge makes the two alternatives equivalent). Second: it is not clear how this intuition could be extended to other, more complicated properties of individual-level predicates. The goal of this paper is to defend the idea of an implicature-based theory of individual-level predicates by facing these two challenges. In the first part of the paper, I try to make sense of the weird nature of these special mismatching implicatures within the recent grammatical framework for scalar implicatures of Chierchia (Structures and beyond, 2004) and Fox (2007). In the second part of the paper, I show how this implicature-based line of reasoning can be extended to more complicated properties of individual-level predicates, such as restrictions on the interpretation of their bare plural subjects, noted in Carlson (Reference to kinds in English. The apparent cost of such arguments is the rejection of scientific theories that appeal to common knowledge. My proposal is to accept the arguments without rejecting the theories. On my proposal, common knowledge is shared by ideally rational people, who are not just mathematically simple versions of ordinary people. They are qualitatively different from us, and theorizing about them does not lead to predictions about our behavior. (...) We can no longer speak of a state of war in any traditional sense, yet there is currently no viable theory to account for the manifold internal conflicts, or civil wars, that increasingly afflict the world's populations. Meant as a first step toward such a theory, Giorgio Agamben's latest book looks at how civil war was conceived of at two crucial moments in the history of Western thought: in ancient Athens (from which the political concept of stasis emerges) and (...) later, in the work of Thomas Hobbes. It identifies civil war as the fundamental threshold of politicization in the West, an apparatus that over the course of history has alternately allowed for the de-politicization of citizenship and the mobilization of the unpolitical. David Kaplan famously argued that mainstream semantics for modal logic, which identifies propositions with sets of possible worlds, is affected by a cardinality paradox. Takashi Yagisawa showed that a variant of the same paradox arises when standard possible worlds semantics is extended with impossible worlds to deliver a hyperintensional account of propositions. After introducing the problem, we discuss two general approaches to a possible solution: giving up on sets and giving up on worlds, either in the background semantic framework or (...) in the corresponding conception of propositions. As a result, we conclude that abandoning worlds by embracing a truthmaker-based approach offers a promising way to account for hyperintensional propositions without facing the paradoxical outcome. Mereological universalists, according to whom every plurality of entities has a fusion, usually claim that most quantifications are restricted to ordinary entities. However, there is no evidence that our usual quantifications over ordinary objects are restricted. In this article I explore an alternative way of reconciling Mereological Universalism with our usual quantifications. I resort to a modest form of ontological expansionism and to the so-called interpretational modalities. Quantifications over ordinary objects are the initial stages of the expansion. From these initial (...) stages, expansions can proceed upwards (fusions of entities in the domain of quantification are added), downwards (parts of entities in the domain are added), and sidewards (entities which are mereologically disjoint from the entities in the domain are added). These expansions are driven by a variety of epistemic and pragmatic reasons and raise different kinds of problems. At each stage, a modalized version of Mereological Universalism is true. By contrast, only at some especially rich stages, standard, non-modalized Mereological Universalism is true as well. Among these especially rich stages, there is a final, metaphysically pre-eminent stage of mereological plenitude. In the last part of the article I discuss some problems and limitations of expansionism. (shrink)

What is a paradigm? -- Theory of signatures -- Philosophical archeology.

Natural language does not express all connectives definable in classical logic as simple lexical items. Coordination in English is expressed by conjunction and, disjunction or, and negated disjunction nor. Other languages pattern similarly. Non-lexicalized connectives are typically expressed compositionally: in English, negated conjunction is typically expressed by combining negation and conjunction (not both). This is surprising: if $$\wedge $$ ∧ and $$\vee $$ ∨ are duals, and the negation of the latter can be expressed lexically (nor), why not the negation (...) of the former? I present a two-tiered model of the semantics of the binary connectives. The first tier captures the expressive power of the lexicon: it is a bilateral state-based semantics that, under a restriction, can express all and only the distinctions that can be expressed by the lexicon of natural language (and, or, nor). This first tier is characterized by rejection as non-assertion and a Neglect Zero assumption. The second tier is obtained by dropping the Neglect Zero assumption and enforcing a stronger notion of rejection, thereby recovering classical logic and thus definitions for all Boolean connectives. On the two-tiered model, we distinguish the limited expressive resources of the lexicon and the greater combinatorial expressive power of the language as a whole. This gives us a logic-based account of compositionality for the Boolean fragment of the language. (shrink)

What is a rule, if it appears to become confused with life? And what is a human life, if, in every one of its gestures, of its words, and of its silences, it cannot be distinguished from the rule? It is to these questions that Agamben's new book turns by means of an impassioned reading of the fascinating and massive phenomenon of Western monasticism from Pachomius to St. Francis. For several decades now a set of researches from a wide range of different sectors has been developed which goes by the name of “science of complexity” and is opposed point by point to the paradigm of classical science. It challenges the idea that world is “simple.” To the reductionist idea that each process is the sum of the actions of its components it opposes a holistic view. The aim of the present article is to analyze the epistemological status attributed (...) in the science of complexity to several fundamental ideas, such as those of scientific law, objectivity, and prediction. The aim is to show that the hope of superseding reductionism by means of concepts such as that of “emergence” is fallacious and that the science of complexity proposes forms of reductionism that are even more restrictive than the classical ones, particularly when it claims to unify in a single treatment problems that vary widely in nature such as physical, biological, and social problems. Various kinds of observations show that the ability of human beings to both consciously relive past events – episodic memory – and conceive future events, entails an active process of construction. This construction process also underpins many other important aspects of conscious human life, such as perceptions, language and conscious thinking. This article provides an explanation of what makes the constructive process possible and how it works. ABSTRACT This article aims to show how the originality of Jaeggi’s contribution to recent debates in critical theory clearly emerges if one compares her approach with what in many ways represents its antecedent and constant point of reference: namely, the critical theory of Axel Honneth. This comparison offers a privileged way of grasping the advantages of Jaeggi’s approach with respect to that of Honneth. At the same time, reversing perspective, it permits us to focus on some open problems in Jaeggi’s (...) critical theory, which deserve to be discussed with care. The negativistic, formal and procedural character of her critical theory, while on one hand shielding her approach from the risks to which the most recent theory of Honneth is exposed – historical teleologism and ethical substantialism – on the other hand exposes her approach to the risk of an excess of formalism and proceduralism, rendering it unable to tackle the central problem for any critical theory: namely, the link with a critical praxis and with the struggles for the emancipation of one’s own time.
