Arbitration and insolvency proceedings are legal instruments governed by different objectives and different legal principles. While in arbitration the autonomy of the parties plays a major role, all insolvency proceedings are collective proceedings where autonomy of the parties is strictly limited, the majority of issues are regulated by binding legal provisions and strong controlling powers are vested into insolvency court. Therefore, in this article the authors analyse the issues of compatibility between insolvency proceedings and arbitration. The Lithuanian legal framework which (...) was in force until 30 June 2012 was ambiguous. According to the wording of Article 11 of the previous Law on Commercial Arbitration, disputes connected with bankruptcy shall not be submitted to arbitration. It was not entirely clear whether this provision was restricted to ‘core’ insolvency issues such as opening and conduct of the proceedings, appointment of the office holder, administration of the estate, liquidation etc. or it also included all other questions related with insolvency. The jurisprudence of the Lithuanian courts gave a broad meaning to the restriction expressed in the Law on Commercial Arbitration. Accordingly, such questions as verification of claims and disputes with the creditors were also excluded from arbitration after announcement of bankruptcy of the debtor. The authors argue that distinction should be drawn between cases in which an insolvent enterprise is a claimant and where it is a defendant. It is also important to draw a line between arbitration agreements entered into before announcement of bankruptcy and arbitration agreements concluded by the bankruptcy trustee with the consent of the majority of creditors. In this article, the new Law on Commercial Arbitration which has entered into force on 30 June 2012 is analysed and according to which an insolvent enterprise remains bound by arbitration agreement in both cases where it is a claimant and where it is a defendant. Several contentious issues of the new law are identified and analysed in the article, such as the position of other creditors in the proceedings, relation between arbitration and restructuring procedure, enforceability of arbitration agreement in cases where an insolvent enterprise lacks funding to pay arbitration costs etc. (shrink)

The main subject of the present research is the enforcement of the European Union law in the domestic legal order. This topic was chosen considering the Treaty of Lisbon amending the Treaty on the European Union and the Treaty establishing the European Community and especially its declaration No. 17 on primacy of EU law. This article will explain the meaning of primacy of the European Union law and the resulting problems in some EU Member States, as well as possible solutions (...) to tackle the problems. The primacy of the European Union law over the national law was recognised as one of the constitutive principles of the European Union. The article includes relevant provisions of the Lisbon Treaty that deal with the rules concerning the legal requirements of the primacy of the European Union law in the EU primary law. The European Court of Justice has developed the meaning of the principle of primacy, which means that the European Union law should take precedence over national law (even over constitutional provisions) and should there be any conflicts between EU law and national law, every national court is obliged to apply the law of the European Union. The main issue of this article is analysing the principle of primacy of the European Union law over the Lithuanian law. (shrink)

From the perception of the peak of the spiritual quest and the decline of organized religion, I seek to understand the causes of this process, as well as providing keys that allow us to approach it in a lucid manner. What actually is changing radically relates to mode of knowing which affects all areas. We have witnessed, in different fields of knowledge, the passage of mental mode (dual) to the non-dual mode of knowledge. I propose what I consider a decisive (...) factor for this: take the non-dual knowledge model as a means to escape the traps that induces the mental model (dual). Hence, it seems coherent to affirm that we are directing us to a trans-religious and post-theist spirituality, laden with riches. I will offer, from the non-dual perspective, a brief reflection on the relationship between spirituality (non-dual) and commitment. (shrink)

El objetivo del trabajo consiste en analizar la interpretación de la teología de Epicteto propuesta recientemente por Keimpe Algra, la cual sugiere interpretar el lenguaje personalista de ciertos pasajes de las Disertaciones como una herramienta pedagógica bajo la cual se esconde un núcleo ortodoxo. Señalaré algunas dificultades importantes que presenta la interpretación de Algra, dificultades que obligan a concluir que la interpretación tradicional (la cual interpreta el personalismo de dichos pasajes en sentido literal, i.e., como expresión de una concepción teísta (...) y personalista de la divinidad) permanece en pie. [Theism and Theology in Classical Yoga] .

Nel breve spazio del presente lavoro, intendo dar conto dell’“habitus teologico” che caratterizza lo stile filosofico di Alasdair MacIntyre : “religiously musical” è infatti — a mio avviso — il più insolito, e allo stesso tempo il più suadente, epiteto attribuito al filosofo scozzese dai teologi James Gustafson e Stanley Hauerwas. Tale habitus è altresì esaltato dalla diffusa propensione a saldare insieme — senza apparente soluzione di continuità — il modus philosophandi macintyriano e alcune recenti figure della teologia cristiana post–liberale (...) e post–moderna, di cui ci occuperemo in seguito: soprattutto la “teologia narrativa” di Hans Frei, George Lindbeck, et. al., ma anche la “radical orthodoxy” di John Milbank, Catherine Pickstock, Graham Ward, et. al. Sebbene MacIntyre non abbia replicato direttamente a simili tentativi di “appropriazione teologica” del suo pensiero, ritengo, comunque, che i tempi siano maturi per riconoscere — a lui e al “tomismo analitico” — un ruolo sui generis nell’evoluzione della tradizione aristotelico–tomista del XX secolo : ruolo distinto, ma non separato, rispetto a quello coevo di quanti — in ambito continentale — hanno tenacemente proseguito la ricerca filosofica e teologica nel solco di Tommaso, come ad esempio Marie–Dominique Chenu, Yves Congar, Cornelio Fabro, Etienne Gilson, Jacques Maritain, Edith Stein, et al. Os fenómenos religiosos ocupam um lugar central na vida dos crentes, na dinâmica dos grupos, na coesão das comunidades locais e na ordenação global das sociedades nacionais e transnacionais. Incidindo sobre a dimensão ideológica da religiosidade, o presente artigo pretende contribuir para um entendimento mais alargado da secularização, seus contornos sociais e consequências individuais nas sociedades ocidentais contemporâneas. Nele se revisita a tese weberiana da Secularização e seus efeitos ao nível da significação religiosa, dos estatutos/papéis religiosos e da extensão pela (...) qual se vive o religioso. Discute-se a privatização da religião e a consolidação numa religião mais transferida para a privacidade de cada um. A regressão ocorrida ao nível do efeito global e totalizante da religião assiste à procura de novas formas/rumos espirituais. A secularização vê-se transfigurada em pós-secularização, momento oportuno para a reformulação das teorias sociológicas da religião. O mundo contemporâneo é plural e secularizado, desenvolvendo-se crenças fora dos contextos institucionais, associadas a uma atitude religiosa mais pragmática. Espelho das sociedades ocidentais contemporâneas, a realidade portuguesa aproxima-se de uma posição pluralista em matérias religiosas. A relação do cristão leigo com a Igreja transformou-se, passando-se de uma fé de obrigação para uma fé de convicção. (shrink)

Neste texto, são expostos os pontos de vista do Kant crítico e do primeiro Fichte acerca de Deus, e as dificuldades tanto teóricas como prácticas que envolvem a concepção de um Deus teísta, quando se filosofa a partir de um método transcendental, de maneira que, mais do que de um Deus, se deveria falar antes do divino.

The Author proposes to describe the possible foundations of a Trinitarian theism that may be a philosophically adequate translation of the Johannine declaration: “God is love”, introduced by some contemporary thinkers as a key to resolving some aporias within classic theism. This is done by way of analysis of Trinitarian ontology and relational ontology, for which there is an attempt to provide a shareable phenomenological basis. The paper then goes on to questions of epistemology (hyperphatic theology) linked to the ability (...) of human reason and human language to express the categories introduced in this analysis, categories that are nothing else but a renewed philosophical appreciation of the terminology proper to Trinitarian speculation. Alasdair MacIntyre ao realizar uma série de críticas à moralidade e filosofia moral modernas e contemporâneas defende a tese de que o desacordo moral e a ausência de justificação racional para a moralidade é fruto do abandono do elemento teleológico da ética, especialmente do abandono da ética aristotélica, o que o leva a propor a retomada da ética teleológica de Aristóteles. Essa retomada é justificada com a teoria da racionalidade das tradições, por meio da afirmação de que o modo tradicional (...) de investigação é o melhor e que a tradição aristotélico-tomista corresponde a uma tradição moral superior às suas rivais. Com sua adesão a essa tradição MacIntyre vai apontar Tomás de Aquino como o teórico que conseguiu reunir todas as características do modo tradicional de investigação moral, integrando a tradição aristotélica e a agostiniana, o que fez com que o próprio MacIntyre se aproximasse e se apropriasse cada vez de elementos fundamentais do Tomismo. O Tomismo de MacIntyre, por sua vez, sofre uma série de críticas e objeções, especialmente em relação às tensões que se estabelecem no interior do pensamento do autor, que em After Virtue prometia um pensamento secular e pragmático. Este trabalho tratará dessa tensão e de algumas críticas direcionadas ao Tomismo de MacIntyre. (shrink)

En el presente artículo se analizan los tres ejes del debate en la polémica que hace unos años han mantenido Antonio Diéguez Lucena y Francisco José Soler Gil: i) la causación mental y su posible explicación en clave naturalista, ii) los méritos y límites explicativos de una posible alternativa teísta y iii) la conveniencia o no de una metodología naturalista en filosofía.

The aim of this paper is to answer the question of whether the two evolutionary debunking arguments (EDA) which, in my interpretation, can be developed from memetics (the argument of contagion and the argument of belief in belief) successfully undermine both the internalist and the externalist rationality of theism. The EDA against the rationality of religious belief try to prove that if such belief is caused by processes that do not track the truth, then this belief is unwarranted or even (...) false. I will argue that the contagion argument is not valid due to the theoretical weakness of memetics, while the argument of belief in belief may be partly valid, since it is logically independent of the memetic approach. Finally, I will examine a possible refutation of that argument based on the thesis that the propositional belief in God is not decisive for the adaptive explanation of the complex system of religion. I will show, briefly, that this does not save theism from another EDA based on the adaptive nature of religion. (shrink)

The philosophical thought of Massimo Cacciari and the conceptual issues of « open theism » are two speculative routes apparently very distant from each other. This contribution highlights the common goal in their going to the root of philosophic problems in order to seek an answer: they think of a divine way of becoming explaining the reason of both the reality of the world and the paradoxical reality of human freedom. The two routes tend to converge and recover concepts pertaining (...) to the Trinitarian speculation whose philosophical « translation » in philosophy passes, today, through the relational and trinitarian ontology, and also the « iperphatic » theology. In this convergence there is ground for thinking not only a truly Trinitarian theism, but also a Trinitarian philosophy, which considers Trinity as the essential summit of a good metaphysics. From Analytic Philosophy to Theism: Antony Flew After the great idealistic systems, the advent of nihilism and the formulation of pragmatism, philosophy restarts again creatively. To understand this rise, I will argue about the essential relationship that philosophy should have with science. Then I will delineate, in line with Antony Flew’s history, the main philosophical arguments atheists present in analytic philosophy, and the characteristics that take the old arguments. The treaty of Lisbon makes European Union (EU) accession to the European Convention on Human Rights (ECHR) an obligation of result. The issue has been intensely discussed for more than thirty years, arguing that such accession is necessary in view of the need to ensure the ECHR standard of fundamental rights protection in Europe. This question again gains prominence as the EU member states and the institutions seek to agree on the negotiation directives of EU accession to the ECHR. The (...) process brings up the difficulties involved in creating a mechanism which would both facilitate the autonomy of the EU legal order and enable individuals to bring claims against the EU to the European Court of Human Rights (ECtHR). This involves the questions how it would be possible to ensure quick access to justice, and whether the ECtHR would continue to apply the doctrine of equivalent protection in relation to EU even after the latter becomes bound by the ECHR. The article argues that EU accession to the Convention is a prominent political step ensuring coherence of human rights protection mechanism in Europe. (shrink)

A propósito do Livro SWINBURNE, Richard. Deus Existe? Tradução de Agnaldo Cuoco Portugal. Brasília: Academia Monergista, 2015. 192p.

The paper presents the results of a preliminary study aimed at examining the validity and reliability of the newly constructed questionnaire Questionnaire on teaching for critical thinking. Conceptually, the paper is based on the generic model of teaching for critical thinking and its key dimensions. 209 teachers and educators (formal and non-formal education) in the Republic of Croatia participated in the study. The research participants were asked to complete an online survey questionnaire. The design of the questionnaire items followed the (...) mentioned generic model. The initial version of the survey questionnaire contained 46 items, and after the analyses, 36 items were retained. Factor analysis was performed and 6 factors were extracted (and 6 scales were constructed). Reliability of all scales is satisfactory – the coefficients of the internal consistency type Cronbach alpha range from.73 to.92. Through the conducted validation, the first research steps were taken in the confirmation of the validity and reliability of the questionnaire on teaching for critical thinking. In conclusion, the application of the questionnaire on teaching for critical thinking in further research can contribute to the improvement of teaching for critical thinking in the Republic of Croatia, and can thus contribute to the development of students’ critical thinking competency. This article provides a study of the legal regulations of the European enforcement order and the uniform enforcement of judgments without the exequatur procedure, which have been in place between the member states of the European Union for five years already. In the Lithuanian civil procedure law it details the implementation of Regulation (EC) No. 805/2004 of the European Parliament and of the Council of 21 April 2004 for creating a European Enforcement Order for uncontested claims in the national law (...) of Lithuania. The aforementioned legal act of the European Union has been implemented in Lithuania with the adoption of the Republic of Lithuania Law on the Implementation of the European Union and International Legal Acts regulating civil procedure of 13 November 2008. O tema central do artigo que se segue diz respeito a uma abordagem que Heinrich Heine faz quanto à religião e seu encontro com a filosofia, em específico o tratado no Livro II da obra Contribuições à História da Religião e Filosofia na Alemanha publicada em 1835. Nesse sentido, será explicitada em um primeiro momento uma espécie de fideísmo heiniano que serve como instrumento para a motivação de sua tese da realização do declínio religioso quando aliado à filosofia. O método (...) empregado pelo poeta utiliza-se da análise de elementos sócio-históricos observando a conjuntura de diversos momentos, dentre eles a revolução filosófica como resultado do protestantismo luterano. Por fim, como pretende-se demonstrar, a religião desfrutada na Alemanha contemporânea de Heine, qual seja o cristianismo, tem uma destituição de seu caráter teísta, fazendo com que a religião se transforme em um puro deísmo. Las pretensiones del autor son: (i) Describir la versión modal de la prueba ontológica propuesta por Charles Hartshorne, una versión que enfatiza la anomalía modal del concepto de Dios, que demuestra que las dos únicas alternativas metafísicas coherentes son el positivismo y un teísmo basado en la noción de “necesidad bajo condiciones tautológicas”, y que vindica esta última opción apelando a una filosofía del proceso inspirada en Whitehead y cuya herramienta conceptual básica es la distinción entre existencia y actualidad. Evaluar la propuesta de Hartshorne, defendiéndola frente a equivocaciones frecuentes y desarrollándola en al menos dos aspectos, incluyendo un análisis del proyecto de Russell de reducir las proposiciones modales a enunciados de alcance, y proponiendo una concepción iterativa de la modalidad. A filosofia prática de Kant, ou seja, o nuclear da sua ética, juntamente com o "primado da razão prática sobre a especulativa" e a "religião nos limites da simples razão", com seu acento no "mal radical", têm inegáveis afinidades com a - e em certos casos influxo da - tradição cristã. O próprio Kant terá em alguns momentos reconhecido isso mesmo. Segundo o autor do presente texto, subsistem, contudo, inegáveis divergências. O artigo, escrito a partir de uma declarada 'simpatia metódica, (...) pretende precisar no possível o alcance de umas e de outras, fazendo sobre o tema um balanço positivo. O autor propõe ainda uma hipótese de leitura do Opus Postumum, reconhecendo aqui uma tentativa por parte de Kant no sentido de purificar o seu "teísmo moral" numa direcção que tão pouco é alheia a importantes intuições cristãs. /// Aim of the article is to show that the practical philosophy of Kant, or, in other terms, the core of his ethics, as is the case with the "primacy of the practical reason over the speculative one" and the "religion within the limits of pure reason", with its accent set upon the idea of "radical evil", have undeniable affinities with -and in certain cases influxes from - the Christian tradition. Kant himself seems to have recognized that much at certain moments. For the author of the article, however, there are a few divergences to be reckoned with. In fact, the article, which is clearly written from the standpoint of a declared methodic sympathy, does whatever is possible in order to determine the reach of the ones and of the others, but in the end concludes that the result is a positive one. The author also suggests a reading hypothesis for the Opus Postumum, acknowledging here an attempt on the part of Kant directed towards a purification of his "moral theism" in a direction that as such is no less close to some very important Christian intuitions. Danas su nastavnici suočeni s brojnim izazovima, posebice u Hrvatskoj u kojoj je u tijeku provođenje opsežne reforme obrazovanja. Reforma obrazovanja stavila je u prvi plan drugačiju paradigmu procesa podučavanja i učenja koja zahtijeva od nastavnika neka nova znanja i vještine. Studije i analize pokazale su kako su upravo nastavnici najvažniji faktor ostvarenja obrazovnih ciljeva učenika. Pored stručnih kompetencija, za razvoj znanja, umijeća i stavova učenika od velike su važnosti i pedagoško-psihološko-didaktičko-metodičke kompetencije nastavnika. U ovom se radu uz pomoć (...) podataka prikupljenih upitnikom na uzorku od 115 studenata željelo detektirati u kojoj su mjeri studenti dviju visokoškolskih institucija – Fakulteta hrvatskih studija i Hrvatskog katoličkog sveučilišta – zadovoljni inicijalnom nastavničkom naobrazbom te smatraju li je pogodnom i dovoljnom za izazove koje nosi njihovo buduće zanimanje. Rezultati provedenog istraživanja pokazuju da su studenti u prosjeku zadovoljni kvalitetom studija i nastavničke naobrazbe te da preferiraju postojeći model stjecanja pedagoških kompetencija uz predmetni studij. Rezultati istraživanja analizirani su u kontekstu ispitivanja potrebe za sadržajnim i praktičnim osmišljavanjem novog načina stjecanja nastavničkih kompetencija, odnosno dorađivanjem ili proširivanjem studija nastavničke naobrazbe. Today, teachers are faced with numerous challenges, especially in Croatia, where extensive educational reform is underway. Education reform has placed a new teaching and learning paradigm in the foreground that demands new knowledge and skills from teachers. Studies and analyses show that teachers are the most important factor in reaching pupils’ educational goals. In additional to professional competencies, pedagogical, psychological, didactic, and methodical teacher competencies are of great importance to the development of knowledge. Using survey data from a sample of 115 students, this paper examines the extent to which students of two institutions of higher education – the Faculty of Croatian Studies and the Catholic University of Croatia – are satisfied with their initial teacher education, and whether they consider it appropriate and sufficient for the challenges their future careers hold. The results of this research show that students are, on average, satisfied with the quality of their studies and teacher education, as well as that they prefer the existing pedagogical competency attainment model that is added to the regular subject study. The research results are analysed in the context of examining the need for a new design of such programmes, their refinement or expansion of teacher education study programmes. (shrink)
