Humility, in a variety of forms, has been examined in educational contexts in recent years. However, its association with a particular pedagogical method remains an unexplored area of inquiry. Likewise, social justice and student voice are a concern in international education arenas, including in higher education, but are not usually connected to virtue acquisition or demonstration. The student voice for social justice (SVSJ) pedagogical method, based on the framework of Nancy Fraser, seeks to aid practitioners in higher education to ensure (...) that social justice and student voice, mediated by notions of humility, are at the forefront of higher education practices across disciplines. This is accomplished by creating spaces for students’ active participation and voice in course content development and classroom learning. In this paper, we expand philosophical explorations of intellectual humility (IH) and cultural humility (CH) as virtues that mediate teaching and learning practices and interactions in classrooms during SVSJ implementation. This ensures that each student is recognised as an important knowledge holder and that diverse ways of knowing, knowledge systems and cultural traditions are valued in higher education teaching and learning spaces. How can we understand the phenomena of loss and mourning in the Heideggerian framework? There is no established interpretation of Heidegger that gives an elaborate account of the phenomena of loss and mourning, let alone gauges its importance for our understanding and assessment of authentic existence in Heidegger. This paper attempts to do both. First, I give a detailed exposition of Heidegger’s analysis of the phenomena of mourning and loss and show that Heidegger’s analysis of mourning in his early and (...) late work is strikingly in line with his collectivist understanding of Being-with. This demonstrates, contrary to what some of his proponents argue, that Heidegger does not follow the kind of dynamic understanding of Being-with that places the other within fine-grained spaces of possibility. Second, with reference to Heidegger’s existential philosophy, I construct a phenomenology of mourning and grief. Though Heidegger himself fails to explain the relationships in which one mourns after a close other, we can develop a unique phenomenology of mourning with reference to Heidegger, which shows that each loss is singular and can be equiprimordial with one’s own death in opening one to the possibility of an authentic existence. In this new understanding of authenticity, loss is regarded as a powerful force, akin to death, in leading one toward their self-owned existence. (shrink)

Affects are intentional structures of beliefs and desires. Many philosophers have plausibly argued that Spinoza’s theory of ideas is a kind of theory of belief. Yet this claim has rarely been taken into account when it comes to Spinoza’s theory of affects, which is actually a part of his theory of ideas. This paper shows that if this point is taken seriously when regarding Spinoza’s theory of affects we reach significant results about the fifth part of Ethics. To show this, (...) I shall strive to show that all affects depend on some sort of beliefs by analyzing Spinoza’s theory of affects in terms of his theory of ideas, and in particular an affirmation which an idea naturally involves. From this revelation, we will be able to see that Spinoza’s theory of affects presented in the third and fourth parts of Ethics is inconsistent with the fifth part of Ethics in so far as the three therapy methods he describes at the beginning of the fifth part of Ethics are considered. I will also show that arguments by which the soundness of these therapy methods is guaranteed seem actually logically invalid. Finally, I will try to revise Spinoza’s therapy methods by taking all errors and core ideas in Spinoza’s theory of affects into consideration. (shrink)

This article tries to show that Fakhr al-Dīn al-Rāzī, one of Ash‘arī theologians of the contracting period, showed a Mu‘tazila tendency regarding the ontic value of divine attributes and his successors followed him in this regard. The problem of divine attributes, a heated discussion area of theology, has been interpreted differently by the theological sects over centuries. Mu‘tazila scholars before Abu Hāshim al-Jubbāī regarded those attributes as nominally attributed to God. For the first time, with Abu Hāshim, this relation was (...) approached with a realistic attitude: Although divine attributes are not accepted as particular realities, they are viewed as states/ahwāl, the universal model of kalam atomism. The pre-Gazzālī Ash‘arī theologians, on the other hand, ascribed real existence to divine attributes as particular properties, whether they adopted this universal model or not. According to Abū al-Ḥasan al-Ashʿarī, the founder of Ashʿarism, which does not include the universal category in any way, the attributes carried by God’s essence consist of particular qualities. al-Bāqillānī and al-Juwaynī, who, like Abu Hāshim, made room for universals under the name of states, accepted particular qualities that led to universal attributes in a system compatible with Ashʿarism. Muta’akhkhirūn Ash‘arī theologians, building their thought system within the framework of the particular-universal dichotomy, felt the need to apply the theories of universals and predication to overcome the paradox caused by the famous motto “Attributes are neither Him nor other than Him”. On the basis of universal properties that have a lower degree of existence compared to particular properties, Abū al-Ḥasan al-Ashʿarī’s theory of particular attributes is intended to be associated with Abu Hāshim’s theory of universal (state). In this context, the value of divine attributes discussed on the ontic ground by the mutaqaddimūn theologians was drawn to the epistemic ground in the muta’akhkhirūn period. From the first kalām works of Fakhr al-Dīn al-Rāzī to the last kalām works, he was distant from the ontic value of divine attributes. The statement that the derived word “knower”, which is appropriate for being a predicate in the propositional structure, and the infinitive “knowledge”, which is not appropriate for being a predicate, meet the same purpose, and that divine attributes are considered divine essence are the most important indications of this distance. Reviewing the works of prominent theologians, scholars of the time such as Fakhr al- Dīn al-Rāzī, Aḍud al-Dīn al-Ījī, Sa‘d al-dīn al-Taftāzānī, al-Jurjānī, and al-Dawānī, this article aims to demonstrate that Abu Hāshim’s view of the divine attributes in the ontic context was welcomed and that the evaluation of divine attributes shifted from particular realities to universal ones in the ontic context. The meaning of “God is knower” proposition according to the pre-Mu‘tazila in the ontic context will be analyzed. Then, its meaning according to Ash‘arite theologians from their framework of universals, will be investigated. (shrink)

This study revisits the relation between corporate performance and corporate social responsibility in the context of a major shift in firms’ credit risk status. Relying on corporate credit rating as a performance indicator, we examine whether firms under the scrutiny of rating agencies trade-off CSR engagement for credit quality improvement. To explore whether firms adjust their CSR engagement after a focal rating change, we focus on the investment–speculative grade threshold because of its importance in accessing the public debt market. We (...) find that firms that lose the investment grade rating subsequently increase CSR engagement. We also uncover that improving CSR engagement helps firms restore their credit ratings ex post. Our findings support the view of CSR engagement as a valuable risk management strategy. (shrink)

In this study, by the use of Yuan and Lee’s definition of the fuzzy group based on fuzzy binary operation we give a new kind of fuzzy ring. The concept of fuzzy subring, fuzzy ideal and fuzzy ring homomorphism are introduced, and we make a theoretical study their basic properties analogous to those of ordinary rings.

Im Feld der Künste und der Kulturellen Bildung ist die Auseinandersetzung mit Migration und globaler Ungleichheit heute allgegenwärtig. Dies gilt auch für das globale Volkstheater von Milo Rau und seine Inszenierung Lam Gods. Postkoloniale Theorien kritisieren seit geraumer Zeit die unkritische Reproduktion von Prozessen des Otherings in Kunst und Pädagogik (Castro Varela/dhawan 2009). Im Rahmen der response wird die Kritik postkolonialer Pädagogik an Formen der Repräsentation von Differenz innerhalb des Kunstfelds und der Kulturellen Bildung skizziert und auf der Basis einiger (...) Videoausschnitte und des Materials der Method Labs in Bezug auf die Inszenierung Lam Gods reflektiert. In den Fokus wird die Frage gerückt, wie ein künstlerisch pädagogischer Umgang mit Differenz vor dem Hintergrund globaler Ungleichheit aussehen kann, der die bestehenden Muster kultureller Hegemonie nicht reproduziert? Background: Islam and Muslims are underrepresented in the medical literature and the influence of physician’s cultural beliefs and religious values upon the clinical encounter has been understudied. Objective: To elicit the perceived influence of Islam upon the practice patterns of immigrant Muslim physicians in the USA. Design: Ten face-to-face, in-depth, semistructured interviews with Muslim physicians from various backgrounds and specialties trained outside the USA and practising within the the country. Data were analysed according to the conventions of qualitative research using (...) a modified grounded-theory approach. Results: There were a variety of views on the role of Islam in medical practice. Several themes emerged from our interviews: (1) a trend to view Islam as enhancing virtuous professional behaviour; (2) the perception of Islam as influencing the scope of medical practice through setting boundaries on career choices, defining acceptable medical procedures and shaping social interactions with physician peers; (3) a perceived need for Islamic religious experts within Islamic medical ethical deliberation. Limitations: This is a pilot study intended to yield themes and hypotheses for further investigation and is not meant to fully characterise Muslim physicians at large. Conclusions: Immigrant Muslim physicians practising within the USA perceive Islam to play a variable role within their clinical practice, from influencing interpersonal relations and character development to affecting specialty choice and procedures performed. Areas of ethical challenges identified include catering to populations with lifestyles at odds with Islamic teachings, end-of-life care and maintaining a faith identity within the culture of medicine. Further study of the interplay between Islam and Muslim medical practice and the manner and degree to which Islamic values and law inform ethical decision-making is needed. (shrink)

After the establishment of the independent Slovak Republic, legal and institutional ground rules were set for providing asylum to foreigners present on the territory of the Slovak Republic. The national legislation of the last twenty years was adopted in compliance with international treaties and the European Union instruments covering asylum matters. In the field of asylum policy, the Slovak Republic complies with its traditional pillars and supports new forms of protection following the new challenges faced by the international community. The (...) currently valid Asylum Act regulates the international protection of aliens in the Slovak Republic, by defining the conditions and procedures related to granting asylum and provision of subsidiary protection and temporary shelter. The Asylum Act also covers the rights and obligations of different categories of persons, stay in asylum facilities and, partially, the integration of persons that are granted asylum. This article describes and analyses the development of the Slovak asylum legal framework and the concept of asylum policy. Furthermore, it looks at different protection statuses granted to foreigners and finally deals with the refugee migration trends in the Slovak Republic. (shrink)

This essay interrogates the common assumption that good care is necessarily human care. It looks to disruptive fictional representations of robot care to assist its development of a theory of posthuman care that jettisons the implied anthropocentrism of ethics of care philosophy but retains care’s foregrounding of entanglement, embodiment and obligation. The essay reads speculative representations of robot care, particularly the Swedish television programme Äkta människor (Real Humans), alongside ethics of care philosophy and critical posthumanism to highlight their synergetic critiques (...) of neoliberal affective economies and humanist hierarchies that treat some bodies and affects as more real than others. These texts and discourses assist me in proposing a theory of care that regards vulnerability as the normative effect of posthuman vital embodiment, as opposed to an anomalous state that can be overcome or corrected via neoliberal practice. Celem artykułu jest prześledzenie kariery wojskowej wojewody krakowskiego Mikołaja Zebrzydowskiego oraz próba znalezienia odpowiedzi na pytania, w jakim stopniu wpłynęła ona na jego cywilną działalność oraz pomogła w budowie prestiżu Zebrzydowskiego i jego rodziny. Badania zostały przeprowadzone na podstawie źródeł rękopiśmiennych oraz wydanych drukiem (księgi Metryki Koronnej, akta skarbowe oraz skarbowo-wojskowe, korespondencja, diariusze), jak również literatury przedmiotu. Przyjęta na wstępie badań teza zakładała, że służba wojskowa – najpierw w charakterze rotmistrza jazdy, później zaś hetmana nadwornego – odegrała istotną rolę w (...) życiu Zebrzydowskiego, znacznie przyczyniając się do rozwoju kariery urzędniczej oraz pozwalając na gromadzenie przezeń majątku, zwłaszcza dzięki nadaniom dóbr królewskich. Bezpośrednia oraz pośrednia analiza źródeł oraz opracowań pozwoliła pozytywnie zweryfikować przyjęte założenia badawcze. Mikołaj Zebrzydowski nie należał do najwybitniejszych rotmistrzów epoki Stefana Batorego oraz Zygmunta III, ale służba wojskowa odegrała znaczącą rolę w jego karierze. Zdobyte w toku wypraw wojennych zaufanie Stefana Batorego, a zwłaszcza jego najbliższego współpracownika, kanclerza oraz hetmana koronnego Jana Zamoyskiego, zaprocentowało nadaniami urzędów oraz dóbr królewskich i pozwoliło Zebrzydowskiemu wspiąć się na szczyt hierarchii senatorskiej oraz położyć podwaliny pod potęgę rodziny. Ciekawe, że formy aktywności wojskowej Zebrzydowskiego zmieniają się wraz z rytmem jego awansów. Rotmistrz jazdy nadwornej w latach 1576–1582, a następnie wojska kwarcianego zostaje wraz z uzyskaniem starostwa krakowskiego strażnikiem stolicy państwa, po czym jako wojewoda lubelski i hetman nadworny dowodzi znaczącymi – w owych czasach – oddziałami wojskowymi. Wydatki, poczynione w związku z działaniami wojennymi, zwracają się jednak nie tyle dzięki dochodom z żołdu, ile dzięki łasce królewskiej i zaufaniu Zamoyskiego. (shrink)

U članku pod gornjim naslovom su sličnosti i razlike metafizičkih počela Aristotela i Tome Akvinskog iskazane analizom argumentacije koja je sržna za obje ove metafizike: o postojanju Nepokretnog pokretača, Čistog akta. Tom analizom je pokazano da, iako im argumentacija ima istu logičku strukturu i isto polazište – promjenu bića – ipak ih je razlika u shvaćanju metafizičkih počela samog bića dovela do različitih zaključaka. Tako je ovdje pokazano da je za Aristotelovu metafiziku supstancije zadnja zbiljnost bića supstancijalna forma, koje svoje (...) zadnje utemeljenje ima u Čistom aktu, Nepokretnom pokretaču, dok za metafiziku bitka Tome Akvinskog zadnja zbiljnost bića jest bitak, koji svoje zadnje utemeljenje ima također u Čistom aktu, ali koji je shvaćen kao Čisti akt bivstvovanja, Subzistentni bitak. Stoga je za Aristotela Čisti akt isključivo oblikovatelj ostale stvarnosti ukoliko je svršni uzrok te nema, niti može imati, kao Nepokretni pokretač, ikakav drugi uzročni utjecaj na ostalu stvarnost, dok je za Tomu Akvinskog Nepokretni pokretač nužno Čisti akt bivstvovanja čije djelovanje je stvaranje.In this article the similarities and differences of Aristotle’s and Thomas Aquinas’ metaphysical principles are set forth by analyzing the core arguments of their metaphysics: principally, those concerning the existence of the Unmoved Mover, also called Pure Act. The analysis shows that although their arguments have the same logical structure and the same starting point – the fact that beings change – different conceptions of the metaphysical principles of being nevertheless lead to different conclusions. Therefore, this article shows that within Aristotle’s metaphysics of substance, the ultimate actuality is the substantial form which has its last ground in Pure Act, the Unmoved Mover. On the other hand, Thomas Aquinas believes that the ultimate actuality is existence, which also has its last ground in Pure Act, but the Act of Existence, or Subsistent Existence. Therefore, Aristotle’s Pure Act is a mere giver of forms and the final cause of reality. This Pure Act does not have, nor it can have any other causal influence on the rest of reality, while Aquinas’ Unmoved Mover is necessarily the Pure Act of Existence whose activity we call creation. Welcome to the 25th volume 1st issue of Cumhuriyet Theology Journal. With this issue, we are excited and happy to be 25 years old. Cumhuriyet Theology Journal has gained a rapid momentum with its format and publishing principles, and managed to attract the attention of the world of science. With the Isnad Citation System developed within the Cumhuriyet Theology Journal and the work-shops held in 2018 and 2019, a number of decisions were taken to increase the publication quality of Theology (...) Field Journals and many of them were implemented. The third workshop was carried out virtual on 26 December 2020 under the name of "Social Sciences Academic Publishing Workshop III" in cooperation with Atatürk High Insti-tution of Culture, Language and History and Sivas Cumhuriyet University. The theme of the workshop was determined as "Refereed Journal Publishing". Preparations for our 4th workshop have begun. In this sense, our journal continues its mission of being both a new ecole and a school with an effort to increase the quality of academic publishing. Moreover, we have also announced the preliminary review form and the review form for the blind review process. We examine Turkish and English titles, summaries, and keywords to make sure that they correspond to the field’s terminology. Furthermore, we require proper nouns and concepts/terms to be written in the reference style of TDV Encyclopaedia of Islam. We also particularly require for the articles to use the Isnad Citation Style. To improve the academic quality of the journal, we have also checked the article up for plagiarism. The articles that are marked with a result above %15 are returned to the authors with a plagiarism report. It might be right to note here that we have been getting more attention from scholarly world day by day with our mission and standards. The journal has received 93 articles between January 1- March 1, 2021 from the academic world. All articles went through the pre-review process to check the referencing and transliteration style before testing them using a plagiarism checker. We then have forwarded the articles that successfully passed the plagiarism check to our reviewers. Following this process, we have been able to offer to you 25 articles three of which are in English at this issue. We are delighted to offer you the various ranges of themes and topics with this new issue. Stoga ce se u radu porediti odredjena internacionalna, evropska i nacionalna pravna akta, kako bi se ukazalo na ona pravna resenja koja su u stanju da osiguraju vrednosti koje su neophodne za samo?opredeljenje i jednakost pojedinaca. Celem artykułu jest przedstawienie wybranych wątków związanych ze sprawowaniem przez Mikołaja Zebrzydowskiego urzędu starosty krakowskiego (1585–1620). Autor skoncentrował się na trzech kwestiach: objęciu starostwa, zaangażowaniu Zebrzydowskiego w sprawowanie wymiaru sprawiedliwości oraz wpływie rokoszu sandomierskiego (1606–1608) na działalność grodu krakowskiego. Główną podstawę źródłową tekstu stanowią krakowskie akta grodzkie, przechowywane w Archiwum Narodowym w Krakowie. Będąc studium przypadku, artykuł bada problem z perspektywy historycznoprawnej, krytycznie analizuje źródła oraz korzysta z metod statystycznych i porównawczych. Dzięki ich wykorzystaniu udało się odtworzyć przebieg czynności, które (...) doprowadziły do objęcia starostwa przez Zebrzydowskiego w 1585 r. Z zestawienia działalności Zebrzydowskiego z Janem Zamoyskim i Gabrielem Tarnowskim wynika, że jego zaangażowanie w sprawowanie wymiaru sprawiedliwości nie było duże, chociaż większe niż poprzednika i następcy. Limitując roki, Zebrzydowski chętnie powoływał się na sprawy prywatne, ale jego następca czynił to jeszcze częściej. Duży wpływ na funkcjonowanie starostwa miał rokosz sandomierski. Sąd nie działał przez ponad trzy i pół roku, urząd przez ponad 17 miesięcy, a kancelaria grodzka przez niecały rok. W sporze o położoną na Wawelu kamienicę starościńską, który stanowi symbol konfliktu Zebrzydowskiego z Zygmuntem III, rację należy przyznać królowi, pełnoprawnemu właścicielowi budynku, chociaż jego postępowanie w tej sprawie zaostrzało napięcie. Pandit Gopinath Kaviraj of Varanasi, India was a well-known interpreter of the Hindu Tantric traditions, who also practiced kundalini yoga according to his own understanding of four sequential paths. This study attempts to reconstruct the stages of Kaviraj's system of Tantric yoga by analyzing and integrating innumerable partial discussions scattered throughout his writings, in an effort to reveal the hidden structure of transformations. Primary research materials include collections of Kaviraj's essays on the Hindu Tantric traditions written in Bengali and Hindi, (...) and his philosophical notebook, Svasambedana . ;The concepts of formal and material ontologies, developed for linguistic theory by Ashok Kumar Gangadeen, are adopted in analyzing the category structure of Kaviraj's four paths. A synchronic methodology is used to present Kaviraj's interpretations of the Kashmir Saiva, S akta Tantric and Sahajiy a Vaisnava traditions in relation to known Tantric concepts and practices, found in the classical texts and secondary literature on these traditions. Categories that belong to the material ontologies of the various Tantric sects are examined for trans-sectarian thematic unity and for explicating the processual patterns that constitute the formal ontology which Kaviraj sees as underlying his own four paths. This formal ontology is based on the principle of increments of consciousness by which kundalini/ develops. ;Each of Kaviraj's Tantric paths incorporates orthodox Hindu forms of spiritual realization, but utilizes different means to them, as well as moves beyond them to uniquely Tantric forms of integral realization. Technical terms are discussed from the relevant traditional Hindu perspective and then from their revalorization in relation to uniquely Tantric forms of yogic realization. ;Kaviraj's systemic perspective on the architectonics of his four Tantric paths is also reconstructed and systematized from various schemata found in Svasambedana. Analyses are concerned both with structural replication and with understanding the series of paths as a single continuum based on laws of dialectical synthesis. Finally, there is a discussion of Kaviraj's supreme integral yoga , his own advanced practice for universal integral Self-realization, as taught by his guru and other adepts of the Jnanaganj asram of Tibet. An inquiry is made into its kala-structure, and it is suggested to be an innovative fifth path which utilizes the structure of the other four paths for the bestowal of universal grace. (shrink)

Günümüzde neredeyse tüm bilimsel birikime online erişim vasıtasıyla ulaşmak mümkündür. Türkiye’de din bilimleri alanında yapılan araştırmalar da kütüphanelerin sınırlarını aşıp tüm dünyaya ulaşmayı hak etmekte-dir. Cumhuriyet İlahiyat Dergisi sahip olduğu format ve yayın ilkeleriyle uluslararası yayın kriterlerini karşılayarak son beş yılda çok hızlı bir (...) ivme kazanmış ve ilim dünyasının dikka-tini çekmeyi başarmıştır. Dergimiz bünyesinde geliştirilen İsnad Atıf Sistemi ve dergimizin öncülüğünde gerçekleştirilen çalıştaylar ile de İlahiyat Alan Dergilerine örneklik teşkil et-mektedir. Bu anlamda dergimizin hem yeni bir ekol oluşturduğunu hem de yazarlarımızdan aldığımız çok sayıda olumlu geri bildirimlere dayanarak akademik yayıncılığın kalitesini artıran bir okul vazifesi gördüğünü söylemek mümkündür. Dergimizin yeni sayısının yayınlanması vesilesi ile sizlerle iki güzel haberi paylaş-maktan mutluluk duyuyoruz. İlki Cumhuriyet İlahiyat Dergisi Scopus’ta taranan Türkiye menşeili ilahiyat dergileri arasında uluslararası atıf puanı ile 1. Sıraya yükselmiştir. Şu anda ilgili Indexte Türkiye menşeili üç ilahiyat dergisi bulunmaktadır. İkinci olarak ESCI indekste yer alan Dergimizin Web of Science tarafından izlenmesine devam edilmektedir. Yaklaşık iki yıldır süren izleme sürecinin sonunda dergimizin AHCI veya SSCI indekslere kabul edilme durumu bu yılın sonuna kadar sonuçlanacaktır. Web of Science temsilcileriyle görüşmele-rimiz ve dergi olarak akademik, etik ve teknik her türlü gerekliliği yerine getirmiş olmamız nedeni ile olumlu bir sonuç beklemekteyiz. 15 Haziran ve 15 Aralık’ta olmak üzere yılda 2 sayı ve 1 özel sayı yayınlamayı mis-yon edinmiş olan dergimiz yeni yayın döneminde de yoğun bir ilgiye mazhar olmuştur. 1ocak – 15 Mart 2020 döneminde Din Bilimlerinin birçok alanından 86 makale değerlendi-rilmek üzere dergimize ulaşmıştır. Yayın ilkelerimiz ve İsnad Atıf Sistemi gözönünde bulun-durularak gerçekleştirilen ön kontrolden sonra makaleler intihal tespit programı kullanıla-rak kontrol edilmiştir. Ön kotrolü tamamlanan ve benzerlik oranı %15’in altında olan maka-leler hakem değerlendirme sürecine gönderilmiştir. Bu sayımızda, söz konusu 86 çalışma içinden ön değerlendirme ve intihal taramasın-dan geçen, hakemlerimizin de akademik içerik açısından yayımlanmasını uygun bulduğu 25 orijinal araştırma makalesi sizlerin dikkatine sunulmuştur. Ayrıca bu sayımızda hakem süreci tamamlanan 14 makale Dergi Yayın Kurulumuz tarafından Aralık sayımızda yayın-lanmak üzere kabul edilmiştir. 15 Haziran 2020 itibariyle dergimizi tarayan ulusal ve uluslararası indeksler hakkın-da da sizlere bilgi sunmak istiyoruz. Although the Refugee Convention 1951 generally provided that contracting states should recognise those who came within its definition as refugees, it did not prescribe how contracting states should determine this in order to enable them to balance this obligation with their national interests. However, evidence from the background and drafting of the Refugee Convention 1951 suggests that the provisions that a contracting states would implement in order to protect its interests would be commensurate with the human rights spirit of the (...) treaty. This implied that contracting states would act fairly in balancing the competing interests in devising status determination policies and would take into account decent considerations. But, from a theoretical viewpoint, it is arguable that some recent asylum determination policies have been based on the threats posed by asylum seekers. Asylum seekers have come to be blamed for contributing to the national issues that some contracting states face and as such, some contracting states have adopted draconian measures as a result. Cumhuriyet Theology Journal has gained a very rapid acceleration in the last five years by meeting the international publication criteria with its format and publication principles and has managed to attract the attention of the scientific world. The Isnad Citation Style developed within our journal and workshops con-ducted under the leadership of our journal are examples of the Theology Field Journals. We are pleased to announce two important news in this issue. The first is that the 2nd Edition of the Isnad Citation System is available to you, and the second is the addition of the Arabic language option to our journal. We also particularly require for the articles to use the Isnad Citation Style. To improve the academic quality of the journal, we have also checked the article up for plagiarism. The articles that are marked with a result above %15 are returned to the authors with a plagiarism report. It might be right to note here that we have been getting more attention from scholar-ly world day by day with our mission and standards. The journal has received 73 articles between July 1- Sptember 15, 2019 from the academic world. All articles went through the pre-review process to check the referencing and transliteration style before testing them using a plagiarism checker. We then have forwarded the articles that successfully passed the plagiarism check to our reviewers. Following this process, we have been able to offer to you 40 articles, a bookreview and a symposium review at two our issues. We are delighted to offer you the various ranges of themes and topics with this new issue. Gayretimin bir kısmı bilim dünyasına hizmet, ama diğer çok mühim bir gayesi ise; koskoca bir İslam aleminin yitirmiş olduğu kendine hürmeti, güveni ve insanlık tarihindeki yerini hatırlatmak, kaybettiklerini inşa etmek içindir. Prof. Dr. Fuat Sezgin Prof. Dr. Fuat Sezgin anısına ithaf ettiğimiz Felsefe ve Din Bilimleri Özel Sayımıza hoşgeldiniz. Prof. Dr. Fuat Sezgin, 24 Ekim 1924 tarihinde Bitlis’te dünyaya gelen Fuat Sezgin, il-kokulu Doğubayazıt’ta, ortaokul ve liseyi ise Erzurum’da bitirdikten sonra 1943 yılında İstanbul’a geldi. İstanbul Üniversitesi şarkiyat (Doğu bilimi) Araştırmaları (...) Enstitüsü’nde ünlü Alman şarkiyatçı Prof. Dr. Hellmut Ritter’in (1892-1971) öğrencisi olan Sezgin, Ritter’in tavsiyesi üzerine İslâm bilimlerine yöneldi. 1951’de İstanbul Üniversitesi Edebiyat Fakülte-si’den mezun olduktan sonra Arap Dili ve Edebiyatı alanında “Buhârî’nin Kaynakları Hakkın-da Araştırmalar” başlıklı teziyle doktorasını tamamladı. Bu çalışmasıyla, hadis kaynağı olarak İslâm kültüründe önemli bir yere sahip olan Buhârî’nin sözlü kaynaklar yerine yazılı kaynaklara dayandığı tezini ortaya attı. Doçent unvanını 1954 yılında alan Sezgin, 1960 askeri darbesinin ardından üniversi-telerden uzaklaştırılan 147 akademisyen arasında kendi adının da bulunması üzerine 1961’de Türkiye’den ayrıldı ve çalışmalarına Goethe Üniversitesi’nde (Frankfurt) devam etti. Câbir bin Hayyân hakkında hazırladığı ikinci tezini 1965’te Goethe Üniversitesi Doğa Bilimleri tarihi Enstitüsü’ne sunan ve bir yıl sonra profesörlüğe yükseltilen Sezgin, aynı yıl kendisi gibi şarkiyatçı olan Ursula Sezgin ile Evlendi. Alanında şimdiye kadar yazılan en kapsamlı eser kabul edilen Geshichte des arabisc-hen Schrifttums (Arapça Yazma Eserler Literatürü Tarihi) başlıklı kapsamlı eserinin ilk cildini 1967’de yayımlayan Sezgin, 1978’de Kral Faysal İslâmi İlimler Ödülü’ne lâyık görüldü. Bu ödül nedeniyle kendisine takdim edilen maddi desteği değerlendirerek 1982’de Goethe Üniversitesi Arap-İslâm Bilimleri Tarihi Enstitrüsü’nü, ertesi yıl ise bu enstitü bünyesinde, tarih boyunca Müslüman bilim insanlarının icat ettiği 800’den fazla bilimsel alet ve düzene-ğinin modellerinin sergilendiği İslam Bilim ve teknoloji Müzesi’ni kurdu. Bu müzenin bir benzerini 2008 yılında istanbul’da kuran Sezgin, 2010 yılında Prof. Dr. Fuat Sezgin İslam Bilim Tarihi Araştırmaları Vakfı’nın kuruluşuna öncülük etti. Kahire Arap Dili Akademisi, Şam Arap Dili Akademisi, Fas Rabat Kraliyet Akademisi, Bağdat Arap Dili Akademisi, Türkiye Bilimler Akademisi şeref üyeliği de dâhil olmak üzere çok sayıda ödül ve nişana layık görülen Sezgin’e; Erciyes Üniversitesi, Atatürk Üniversitesi, Süleyman Demirel Üniversitesi ve İstanbul Üniversitesi tarafından fahri doktora unvanları verildi. Frankfurt am Main Goethe Plaketi, Almanya Üstün Hizmet Madalyası, İran İslâmi Bilimler Kitap Ödülü ve Cumhurbaşkanlığı Kültür ve Sanat Büyük Ödülü ile taltif edildi. Prof. Sezgin’in öncülüğünde kurulan İstanbul İslâm Bilim ve teknoloji tarihi Müzesi, Kültür ve Turizm bakanlığı 2016 özel Ödülü’ne lâyık görüldü. Arapça, Süryanice, İbranice, Latince ve Almanca başta olmak üzere 27 dil bilen Prof. Dr. Fuat Sezgin, 30 Haziran 2018’de İstanbul’da vefat etti ve Gülhane Parkı’ndaki İstanbul İslâm Bilim ve teknoloji tarihi Müzesi’nin bahçesine defnedildi. Vefatının ardından, 2018/6 sayılı Cumhurbaşkanlığı genelgesi ile 2019 yılı “Prof. Dr. Fuat Sezgin Yılı” olarak ilân edildi. Cumhurbaşkanlığı genelgesinde "İslam kültür ve medeniyetinin daha iyi anlaşılmasını sağlamak ve onu yeni nesillere en doğru şekilde aktarmak amacıyla yapılacak söz konusu çalışmalara ilgili tüm kamu kurum ve kuruluşlarınca her türlü destek ve katkının sağlanması hususunda gereğini rica ederim." İfadelerine yer verilerek Fuat Sezgin’in ülke sathında anlatılması ve düşüncelerinin anlaşılması için çeşitli faaliyetlerin yürütülmesi istenmişti. Koordinasyon Merkezi olarak da Kırıkkale Üniversitesi seçildi Dünyanın önde gelen bilim tarihçilerinden olan, İslam Bilim Tarihi alanındaki çalışmaları bulunan Prof. Dr. Fuat Sezgin’i gelecek nesillere tanıtmak, fikirlerini anlatmak amacıyla Sivas Cumhuriyet Üniversitesi tarafından da birçok faaliyet yapıldı. Dünyanın önde gelen bilim tarihçilerinden Prof. Dr. Fuat Sezgin’e, İslam Bilim Tarihi alanındaki çalışmalarından dolayı Üniversitemiz tarafından “Fahri Bilim Doktoru” unvanı verildi. Prof. Dr. Sezgin’e fahri bilim doktoru unvanı verilmesi dolayısıyla Üniversitemiz Kül-tür Merkezi’nde düzenlenen tören İstiklal Marşımızın okunması ve saygı duruşuyla başladı. Programa Rektörümüz Prof. Dr. Alim Yıldız, Sivas Belediye Başkan Yardımcısı Ah-met Özaydın, Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Uzun, öğretim elemanları ve öğrenciler katıldı. Rektörümüz Prof. Dr. Alim Yıldız yaptığı açış konuşmasında, "İnsanlara İslam bilimlerinin gerçeğini tanıtmak, benlik duygularını olumsuz etkileyen yanlış yargılardan onları kurtarmak ve ferdin ehemmiyetine olan inancı kazandırmak amacıyla İslam Bilimi Tarihi araştırmalarına adanmış bir ömürdür Prof. Dr. Fuat Sezgin Hocamız. Öyle büyük bir otoritedir ki onu anmadan, onun hazırladığı eserlere bakmadan, bilim tarihiyle, İslam tarihiyle ilgili ortaya bir şeyler sunabilmek çok zordur. Bilim tarihinin en çalışkan, en birikimli bilim insanlarından biridir. İslam tarihine, İslam düşüncesine, İslami eserlere ve bilim dünyasına vermiş olduğu katkılarıyla bir medeniyet kâşifi, eşi bulunmaz bir değer ve ‘darbeler neden kötüdür’ sorusunun mücessem cevabıdır Prof. Dr. Sezgin. Bizim medeniyet ve kültürümüzde kültür, sanat ve beşerin, Yaratıcının her eserinde müşahede ettiği güzellikleri, çeşitli yol ve yöntemlerle ortaya koymasının vasıtasıdır. Bilgiyi hikmetle taçlandırıp irfana ulaştırmadıkça hiçbir şeyi yerli yerine oturtamayız." dedi. Konuşmanın ardından Rektör Yıldız, 93 yaşındaki Prof. Dr. Fuat Sezgin’e cübbe giydirdi. Daha sonra Sezgin katılımcılara ‘Arap İslam Tarihinden Bazı İzlenimler’ konulu ders verdi. Prof. Dr. Fuat Sezgin, “İnsanların bilgi tarihi ile ilgili verileri yazılı olarak kaydetme gayreti, politik tarihe olana nispetle tesadüflere ve keyfi değerlendirmelere göre çok geri zamanlarda oldu. İslam bilim tarihi yüksek ve kaliteli görüşleri yansıtır. Bunları burada sunamayacağım. Birçoğunu Arap-İslam tarihi adlı kitabımın bugüne kadar çıkmış olan 17. cildinde kaydetmeye çalıştım. Onu İstanbul’da Gülhane Parkı’nda İslam Tarihi Araştırmaları Vakfı yayınları arasında bulabilirsiniz.” dedi. Prof. Dr. Sezgin “Bilimler tarihinin verilerini değerlendirmekte, yaşanılan zamanın etüt şartını gözden kaçırılmasının esas olması gerektiğini anladım ve henüz kitabımı yazma-ya başlamadan rastladığım Fransız Coğrafya tarihçisi Joseph Toussaint Renaud (1795-1867)’un şu sözleri beni çok etkilemişti. “Tesadüf teknik ve sanatın ilerlemesinde çok büyük bir rol oynamaz. İnsanlar buluşlarında devamlı bir şekilde birden bir sıçrayışla değil, adım adım hareket eder. Her zaman aynı hızda değil, fakat devamlı olarak insan icat etmez. Olanı ilerletir.” ifadelerine yer verdi. Konuşmasının sonunda Prof. Dr. Sezgin, “Benim 65 yıldır yaymaya çalıştığım Arap İslam bilimleri tarihi hemen hemen her gün beni hayata bağladı. İslam dünyasında büyük bir hızla ilerleyen bilimler MS. 8. yüzyıldan itibaren Fransa ve İngiltere’ye diğer taraftan 10 ve 11. yüzyıldan itibaren Sicilya’ya ve İtalya’ya 9. yüzyıldan itibaren Bizans’a ulaştılar. Avrupa-lılar teknik bilimleri diğer bilimlere nazaran daha kolay anlıyor ve alabiliyorlardı. Bu anlam-da onlar 16. yüzyılda bazı yönlerde Müslümanlara ulaşmaya hatta onları geçmeye başladılar.” ifadelerini kullandı. Programın sonunda Rektörümüz ve Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Duman, Prof. Dr. Fuat Sezgin’e tezhipli bir tablo hediye ettiler. 2019 Prof. Dr. Fuat Sezgin Yılı kapsamında Sivas Cumhuriyet Üniversitesi Merkezî Kütüphanesi’ne Prof. Dr. Fuat Sezgin’in ismi verildi. Ayrıca Üniversitemiz Rektörlüğü tarafından düzenlenen 5’inci Hazan Şiir Dinletisi Sezgin anısına ithaf edilmiştir. 2019 yılının Haziran ayı içerisinde ise Üniversitemiz Rektörlüğü öncülüğünde ve İlahiyat Fakültesi Dekanlığınca ile Sivas Merkez Ulu Cami’de merhum Prof. Dr. Sezgin için Kur’an-ı Kerim tilaveti ve Mevlid-i Şerif programı gerçekleştirilmiştir. The question of detention of asylum seekers is specific due to the special situation of detainees (persons who have experienced human rights violations and apply for asylum in receiving country) and due to peculiarities of detention itself (persons have not committed crimes, but come or stay illegally because they have been forced to do so by fleeing from human rights violations). Therefore, lately it raises many discussions at the European level. Sooner or later, discussions influence national laws, as after adopting (...) the EU directives their provisions must be properly transposed into national laws. This article describes the recent documents: the study in Lithuania, the UNHCR guidelines, the EU developments, the Lithuania judicial practice. The authors of the article discuss the latest amendments of the Law on the Legal Status of Aliens (entering into force on 1 February 2012) related to detention of asylum seekers after the transposition of the provisions of the Return Directive. The practice of the Supreme Administrative Court of Lithuania when applying the new detention-related provisions is also reviewed in the article. The authors do not agree with the position of the Supreme Administrative Court of Lithuania that the provisions of the Return Directive are applicable to asylum seekers. The authors pay attention to the case-law of the European Court of Justice, the preamble of the Return Directive and its legal relations with the EU asylum directives. At the end, the conclusions are drawn as to the way that the provisions of the Law on the Legal Status of Aliens should be interpreted in the light of the purposes and provisions of the European Union directives. In order to avoid contradictory practice and at the same time ensure the interests of public order in Lithuania, Article 113(7) of the Law on the Legal Status of Aliens could be applied. (shrink)

In 2011 there are 76 countries of the world still criminalising same-sex sexual acts between consenting adults. In seven of those countries homosexual acts are punishable with death penalty (i.e., Mauritania, Sudan, the northern states of Nigeria, the southern parts of Somalia, Iran, Saudi Arabia, Yemen). Homophobic (transphobic) attitudes are also frequent in many societies. However, the LGBT asylum seekers are frequently left outside the refugee definition due to many refugee qualification problems in LGBT cases. Therefore, in this article the (...) author aims to describe the main refugee qualification problems in LGBT asylum cases (i.e., criminalisation; state protection against non-state persecution; concealment of sexual or gender identity; internal protection) and propose their solutions. Council Directive 2004/83/EC of 29 April 2004 has several important provisions including LGBT asylum seekers into otherwise gender-neutral refugee definition. Today these provisions need to be correctly interpreted and transposed into practice of the Member States. (shrink)

Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at international level (...) due to absence of a single authoritative body to provide guidance on interpretation and application of the 1951 Refugee Convention. Considering that the judgments of the EU Court are part of the EU law, the Member States should develop their national asylum law with due regard being taken to those judgments. By the beginning of 2012, the Court has issued eight judgments on the interpretation of various problematic issues of EU asylum law. This Article analyses the jurisprudence of the EU Court in asylum cases, related to the granting of refugee status and subsidiary protection. It also provides a critical evaluation of those judgments. The main objective of the Article is to familiarise the relevant Lithuanian institutions and lawyers with the first judgments of the EU Court in asylum cases and encourage discussions concerning the application of rules established by the Court in the Lithuanian context. Due to limited size, this Article presents the analysis of two EU Court judgments adopted on interpretation of the 2004 Qualification Directive: Elgafaji v. The Netherlands (2009) dealing with granting of subsidiary protection, and Abdulla and others v. Bundesrepublik Deutschland (2010), dealing with cessation of refugee status. The value of those judgments first of all lies in the guidance they provided to the Member States on such concepts as: protection in a situation of an armed conflict, agents of protection, effectiveness of protection; as well as determination of a relationship between refugee status and subsidiary protection, relationship of the Qualification Directive with the European Convention on Human Rights and Fundamental Freedoms (ECHR), also cessation of protection. Elgafaji decision, while quite liberal with regard to persons seeking international protection, is not so liberally applied in the Member States’ practice and does not in itself guarantee positive outcome of the application of a concrete individual fleeing from an armed conflict, or a liberal approach to granting subsidiary protection in the Member States. Based on Elgafaji judgment it is clear that: Art. 15(b) of the Qualification Directive correspond to Art. 3 ECHR, while Art. 15(c) provides additional protection and in that it expands the Member States’ obligations beyond the ECHR to provide protection to persons fleeing in situations of armed conflict. While not every person arriving from an armed conflict situation would automatically fall under the granting of subsidiary protection, in certain exceptional situations indiscriminate violence may amount to individual threat without invoking personal circumstances. The EU Court departed from the individualisation requirement applied by the European Court of Human Rights in Art. 3 cases and did not also rely on international humanitarian law, by introducing a “sliding scale” formula for establishing an individual threat in armed conflict situation instead. This formula addressed the alleged internal discrepancy between “individual threat” and “indiscriminate violence”. The Abdulla decision brought in the human rights and law enforcement perspectives to the interpretation of cessation clauses, however it represents a rather superficial approach in the context of the analysed concepts (e.g. towards effectiveness of protection provided by the multinational armed forces) and is likely to be incompatible with the latest legislative trends in the EU asylum instruments (e.g. determination of refugee status and subsidiary protection by means of a single procedure) and the recent jurisprudence under the ECHR (e.g. failure to ensure a minimum standard of living may violate the ECHR). Criminalisation, (...) state protection against non-state persecution, concealment of sexual or gender identity, internal protection were discussed in the previous article ‘The Refugee Qualification Problems in LGBT Asylum Cases’ by Laurynas Biekša2. In this article the authors aim to describe the main procedural problems in LGBT asylum cases (i. e., credibility assessment, late disclosure, country of origin information and reception) and propose their solutions. Guiding European and international standards are laid down in the Reception Directive3, Qualification Directive4, Procedures Directive5 and UNHCR Guidance Note6. Today these standards should serve as a starting point for identifying the problems LGBT asylum seekers may have during their asylum procedures and for finding possible solutions. (shrink)

Even though the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) does not explicitly address the rights of asylum seekers and refugees, the case law of the European Human Rights Court (ECtHR) confirms that their rights can be successfully defended under this mechanism. In parallel, in its evolving jurisprudence on asylum the Court of Justice of the European Union (CJEU) refers to the Strasbourg case law, where there is a certain interrelationship between these two jurisdictions, in particular (...) given the recent ECtHR pronouncement on “EU Dublin transfers”. The article aims at evaluating protection available for asylum seekers and refugees under the ECHR, while comparing it with protection of asylum relevant fundamental rights under the EU legal order and the most recent jurisprudence of the CJEU in asylum cases. The authors also analyze which of the two systems is more favourable and what are their limitations. Thus, the article offers to students and practitioners a detailed analysis of ECtHR and CJEU jurisprudence in asylum cases through a comparative perspective, as well as the key problematic aspects arising in both jurisdictions and their junction. The jurisprudence of the ECtHR reveals that despite the most developed protection from expulsion under Article 3 of the ECHR, it does not sufficiently secure status for the concerned persons. Effective remedy requirements under the ECHR allow for filling the gaps of national asylum procedures, while recognition of vulnerability and special status of asylum seekers by the ECtHR assist in addressing still commonly prevailing detention problems of asylum seekers in Europe. In the context of family protection, the recognition of positive obligations by states to reunite the refugee families is still rudimentary, thus, clearly Article 3 protection in expulsion cases takes over Article 8. At the same time, the jurisprudence of the CJEU in asylum cases is still inconsistent, as the court sometimes takes decisions without including human rights into its’ analysis (Kadzoev, Arslan, K.), while in other cases refers to the Charter (MA and others), verifies if its’ own decision is in line with the ECtHR jurisprudence (Elgafaji) or shapes secondary legislation in line with Strasbourg arguments and findings (N.S.). Quite likely, the ECtHR practice will have an important influence on the developments of subsidiary protection in the EU, at least in the context of Articles 2 and 3 of the ECHR, and serve as an important reference for interpretation of various concepts under the EU Qualification and Procedures Directives. The comparative analysis of pros and cons of the two mechanisms demonstrates that the main advantage of the ECtHR is individual justice possibility, which is not yet accessible under CJEU preliminary judgement procedure and its input in developing asylum law concepts, such as non-state agents of persecution, internal protection or even subsidiary protection regime under EU asylum law. Thanks to the ECtHR, the realistic possibility to question the application of certain EU norms has emerged (Dublin Regulation). While the ECtHR does not have such a specific competence over asylum issues as the CJEU and is clearly a slow and seriously overburdened mechanism, the pilot judgement procedure seems to be increasingly capable of providing guidelines to the states concerning systematic problems in their asylum procedures. Thus, both jurisdictions in their own ways contribute to strengthening asylum seekers’ protection while forming a common oasis for these individuals in Europe. (shrink)

The 6th of February 2005 marks the deadline of transposition of the EU Council Directive No. 2003/9/EC (Reception Conditions‘ Directive) into national legislation. This article is the second in a series of articles on transposition of the European Union Asylum Directives in Lithuania and remaining concerns.
