Este artigo apresenta a diferenciação do conceito de poder no pensamento de Jürgen Habermas em duas obras. Na primeira, a Teoria da ação comunicativa, o autor introduz uma concepção de poder reduzida à ação racional com respeito a fins, enquanto, na segunda, Facticidade e Validade, Habermas introduz um conceito de poder comunicativo, em oposição ao poder administrativo.A apresentação dessa diferenciação indica uma abertura da própria ideia de ação comunicativa para a política e para os princípios do Estado de direito. Na (...) medida em que o procedimentalismo e o uso público da razão implicam constantes disputas que envolvem comunicação e poder, Habermas apresenta o poder comunicativo com potências radicalmente democráticas. O conceito fornece bases para a esfera pública influenciar politicamente o sistema político por meio de um modelo extraordinário de circulação do poder político nos processos deliberativos. (shrink)

El artículo aborda la cuestión de cuál es el valor que deben de atribuirse a las razones económicas en la justificación racional de una decisión legislativa y cuál es el papel que el análisis económico del derecho puede jugar en la evaluación ex ante y ex post de la legislación. En concreto, se señalan las potencialidades y las limitaciones del uso del instrumental del análisis económico del derecho en los hoy obligados estudios de impacto normativo. Una de las lagunas más fuertemente denunciadas en el ámbito de la teoría y de la ciencia jurídica ha sido su focalización casi exclusiva en el momento de la interpretación y aplicación del derecho. El modelo de jurista y de enseñanza del derecho continúa centrado en el momento aplicativo del derecho en el que la ley, la norma, es considerada un dato previo, un material básico a partir del cual el jurista despliega sus artes interpretativas, exegéticas, sistematizadoras, argumentativas y retóricas. Los juristas se formaron y se siguen formando en nuestras facultades de derecho para resolver problemas de lege data y no de lege ferenda, están entrenados para aplicar e interpretar normas jurídicas pero no para crearlas o evaluarlas. Durante mucho tiempo nuestra cultura jurídica ha desdeñado el estudio y el cultivo de una “ciencia de la legislación” que vaya más allá del estudio de los tradicionales problemas de técnica legislativa, para explorar las condiciones y posibilidades de la argumentación racional en el ámbito legislativo. Resumen: En el presente trabajo intentaremos analizar cierta serie o tradi-ción de reflexiones sobre el conocimiento científico que lo caracteri-zan por su discontinuidad en relación al conocimiento ordinario osentido común. El origen de esta serie puede localizarse en la obrade Gaston Bachelard y su peculiar estudio de los actos epistemológicoscon los que se rompe con el pasado en una disciplina científica. Estosactos contrastan con lo que este autor califica como el “mitocontinuista” del empirismo. Esta posición será apropiada porAlthusser y desarrollada (...) por sus discípulos Balibar y Pêcheux. Inten-taremos mostrar que el factor común de la discontinuidad no consti-tuye una posición monolítica, sino que cabe reconocer, en las posi-ciones que consideramos, maneras diversas de entender la naturale-za de la misma. En este sentido, la revisión de las posiciones queAlthusser efectuó en su “autocrítica” constituye un punto de obser-vación privilegiado del abanico de alternativas que algunos de susdiscípulos desarrollarían sobre bases diversas. -/- Abstract In the present paper we analyze a tradition of reflections onscientific knowledge which distinguish it because of its“discontinuity” with common sense or ordinary knowledge. The beginning of this tradition can be traced back to Gaston Bachelardand his peculiar study of the epistemological acts which allows ascientific field to break with its past. The study of these acts helps toovercome what Bachelard considers is the empiricist myth ofcontinuity of knowledge. Bachelard’s views were retaken by Althusser and further developed by his students Balibar and Pêcheux.We will try to show the common commitment with discontinuity isnot an homogeneous view. Consequently we will try to showdifferences in the understanding of discontinuity. While children’s experiences of online risks and harm is a growing area of research in New Zealand, public discussion on the matter has largely been informed by mainstream media’s fixation on the dangers of technology. At best, debate on risks online has relied on overseas evidence. However, insights reflecting the New Zealand context and based on representative data are still needed to guide policy discussion, create awareness, and inform the implementation of prevention and support programmes for children. This research report (...) presents findings from a quantitative study regarding different aspects related to risks and online safety. It looks at the online experiences that children find bothersome and upsetting and explores the hurtful behaviours they encounter or engage in, both online and in person. Evidence regarding exposure to different types of potentially harmful online content is also presented. Another relevant contribution is the insights related to excessive internet use.The findings presented in this report are based on data from 2,061 New Zealand children aged 9-17. We hope the findings will contribute to the development of policies, practices and services designed to support New Zealand children to safely take advantage of the opportunities available to them online. Research and practice about self-determination in the context of disability has centred on teaching skills and providing support to help people with impairments to be independent. However, limited research exists about the impact of Information and Communication Technologies, in particular social media and mobile devices, on the development of self-determination skills among people with disabilities. This paper presents the findings of a qualitative study which collected data from observations, a researcher diary, focus groups, individual interviews and data from social media. (...) The focus of the study was on young people with vision impairments who were transitioning to university life. The study found that the participants developed self-determination skills by using and adapting collaborative and interactive online tools and mobile devices according to their transition needs. This finding expands the understanding of the implications of new technologies for young people with disabilities’ personal development and the enhancement of self-determination. (shrink)

To explore social media use in New Zealand, a sample of 1001 adults aged 18 and over were surveyed in November 2021. Participants were asked about the frequency of their use of different social media platforms (text message included). This report describes how often each of the nine social media sites and apps covered in the survey are used individually on a daily basis. Differences based on key demographics, i.e., age and gender, are tested for statistical significance, and findings summarised.

About thirty years ago, when the Internet started to be commercialised, access to the medium became a topic of research and debate. Up-to-date evidence about key predictors, such as age, is crucial because of the Internet's ever-changing nature and the challenges associated with gaining access to it. This paper aims to give an overview of New Zealand's Internet access trends and how they relate to age. It is based on secondary analysis of data from a larger online panel survey with (...) 1,001 adult respondents. The Chi-square test of independence and Cramer's V were used in the analysis. The study provides new evidence to understand the digital divide. Specifically, it uncovers a growing disparity in the quality of Internet connectivity. Even though fibre is the most common type of broadband connection at home, older adults are less likely to have it and more likely to use wireless broadband, which is a slower connection type. Additionally, a sizable majority of people in all age categories have favourable opinions on the Internet. Interestingly, this was more prevalent among older people, although they report an increased concern about the security of their personal information online. The implications of the results are discussed and some directions for future research are proposed. (shrink)

In this paper I assess the adequacy of no-conspiracy conditions employed in the usual derivations of the Bell inequality in the context of EPR correlations. First, I look at the EPR correlations from a purely phenomenological point of view and claim that common cause explanations of these cannot be ruled out. I argue that an appropriate common cause explanation requires that no-conspiracy conditions are reinterpreted as mere common cause-measurement independence conditions. In the right circumstances then, violations of measurement independence need (...) not entail any kind of conspiracy (nor backwards in time causation). To the contrary, if measurement operations in the EPR context are taken to be causally relevant in a specific way to the experiment outcomes, their explicit causal role provides the grounds for a common cause explanation of the corresponding correlations. This research report presents findings about the extent and nature of digital self-harm among New Zealand teens. Digital self-harm is broadly defined here as the anonymous online posting or sharing of mean or negative online content about oneself. The report centres on the prevalence of digital self-harm (or self-cyberbullying) among New Zealand teens (aged 13-17), the motivations, and outcomes related to engaging in this behaviour. The findings described in this report are representative of the teenage population of New Zealand by (...) gender, ethnicity and age. Key findings are: Overall, 6% of New Zealand teens have anonymously posted mean or negative content online about themselves in the past year. Teenagers’ top reasons for this behaviour were: making a joke, wanting to show resilience, looking for friends’ sympathy, and seeking reassurance of friendship. By exploring the nature and extent of this behaviour, we are providing the online safety community, schools and parents with insights about a complex and, to some extent, hidden phenomenon involving New Zealand teens. Over the last ten years the sharing of nude images or videos (sometimes known as “sexting”) by young people has emerged as a concern. Despite this, no research had been conducted on the prevalence of the sharing of nudes among young New Zealanders. This study addresses this and raises important questions for all those with a role in supporting young people’s healthy development. We believe this report makes an important contribution to the overall understanding of young people’s experience of these (...) behaviours. However, it only provides a snapshot, and more work is required to understand how best to support young people as they navigate the challenges and potential risks. This report is being released as part of a larger project exploring young people’s experiences of digital risk and harm, carried out by a partnership between Netsafe and the Ministry for Women. While children’s interaction with digital technologies is a matter of interest around the world, evidence based on nationally representative data about how integrated these tools are in children’s everyday life is still limited in New Zealand. This research report presents findings from a study that explores children’s internet access, online skills, practices, and opportunities. This report is part of Netsafe’s research project Ngā taiohi matihiko o Aotearoa - New Zealand Kids Online, and our first publication as a member of Global (...) Kids Online. Generating insightful, reliable evidence about New Zealand children’s online experiences is vital to develop adequate support that reflects children’s experiences and needs. This, in turn, will help them to manage online risks and potential harm from behaviours such as cyberbullying, harassment, and other forms of abuse and intimidation. (shrink)

Research on transition to higher education and young people with disabilities has increased in recent years. However, there is still limited understanding of transition issues and how digital technologies, such as social media and mobile devices, are used by this group of students to manage these issues. This article presents the findings of an empirical study that addressed this matter based on young people’s views and experiences. The qualitative study was conducted in the context of a group of students with (...) vision impairments transitioning to a New Zealand university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The study shows that, like their non-disabled peers, the students actively engaged with interactive and collaborative digital technologies to make sense, individually and collectively, of different transition issues before, during and after the first academic trimester of their university journey. A growing number of young people with disabilities is pursuing university education. Available research on the impact of Information and Communication Technologies on this matter has mainly focused on assistive technologies and their compensatory role for the adjustment of this group of students to the tertiary setting. However, limited research has looked at the role played by digital technologies such as social media and mobile devices in the transition to university, a critical period of change for all students but more (...) challenging for those with impairments. This paper presents the findings of an empirical study that investigated the experiences of students with vision impairments aged 18 to 24 who were transitioning to a New Zealand university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The study found that new technologies play several enabling roles that help students to manage diverse transition challenges. These roles not only include aspects such as impairment compensation, communication, information, and learning but also support arrangement, collaboration, and social connection and participation. By incorporating in the analysis the potential of digital tools, the article updates and expands the understanding of the role of ICTs in higher education from experiences and views of young people with vision impairments. The transport sector is one of the largest sources of greenhouse gas emissions in New Zealand. To address this issue, the government is planning a set of actions to be implemented in the next 15 years. One of these actions deals with transport emissions and targets for a reduction in light vehicle travel. However, to achieve this goal, there is a need for both an updated assessment of effective interventions and an analysis of their relevance and applicability to the New (...) Zealand context. This report seeks to close the gap by conducting a narrative literature review of a collection of existing literature, supplemented with some targeted searches. With the focus on evidence relevant to New Zealand’s largest and fastest growing urban environments, the report identified 24 publicly available research outputs from around the world (mainly from Western European countries). The papers assessed differ not only in the type of research method and analysis applied but also the form of intervention (s) evaluated, the duration of the intervention and follow-up periods, the characteristics of the population groups or intervention sites studied, the measures, results and metrics relevant to New Zealand, and the outcomes of the interventions. Although these differences may represent a challenge in terms of comparability and transferability, they also provide opportunities and lessons for policy-and decision-makers. Finally, the report discusses the implications of the review and its findings and provides some directions and recommendations for future research, policy and practice for the measurement and evaluation of interventions. Government agencies in New Zealand are not required to systematically collect data on online hate speech, thus, there is a lack of longitudinal evidence regarding this phenomenon. This report presents trends in personal experiences of and exposure to online hate speech among adult New Zealanders based on nationally representative data. The findings from this study are also compared with results from a similar research study conducted in 2018. In addition, this report explores people’s perceptions about other issues related to hate (...) speech. The goal of this study is to fill some knowledge gaps regarding the extent and nature of hate speech in New Zealand. It also seeks to provide reliable and robust evidence to inform public conversation on the topic and the implementation of strategies and activities to ensure all New Zealanders, no matter what their characteristics, are safe online to benefit from the multiple opportunities of the digital environment. La eterna cuestión de la justicia ocupa un lugar central en la cosmovisión que Dante expresa alegórica e icónicamente en la Divina Comedia. La encontramos como atributo de Dios que da a cada uno según sus méritos, pero cuyo Amor le mueve a conmiserarse de los hombres, pues la justicia de las obras humanas no puede alcanzar a su Creador según igualdad, ni puede a restituir todo lo que de Él recibe y le es debido. La justicia también traspasa todos (...) los círculos por los que transita el peregrinar de Dante y da razones del estado de las aquellas almas que encuentra no sólo en el infierno, sino también en el purgatorio, en el limbo y en el paraíso. Un análisis global de la justicia dantiana pone a la luz la profunda huella de la tradición teológico-bíblica cristiana, de la filosofía clásica —sobre todo aristotélica—, así como la síntesis de ambas en el legado de Santo Tomás de Aquino, a quien Dante destaca entre los sabios del Paraíso —adelantándose así al que, unos años después, será el parecer de la propia Iglesia. Dante Alighieri hace suyo el magisterio filosófico-moral de Santo Tomás y ello se pone muy de manifiesto en lo que se refiere a la concepción dantiana de la justicia. (shrink)

This article introduces Transition 2.0, a paradigm shift designed to study and support students with disabilities' transition to higher education. Transition 2.0 is the result of a qualitative study about how a group of young people with vision impairments used digital technologies for their transition to university. The findings draw from observations, a researcher diary, focus groups, individual interviews, and data from social media. The article discusses a conventional view of transition, referred to here as Transition 1.0, which has dominated (...) disability-related research and service provision in higher education. It counters this view by further developing the conceptual framework for Transition 2.0. The findings expand current conceptual approaches to transition by incorporating in the analysis the role played by digital tools such as social media and mobile devices. Procura-se identificar as produções bibliográficas recentes em vários campos de conhecimento e seus limites e avanços epistemológicos para entender outras relações sociais e os novos contextos diaspóricos na produção de sexualidades, raça, gênero, afetividade e corpo na pós-colonialidade.

El cambio climático es uno de los mayores desafíos a los que nos enfrentamos en el siglo XXI. Los niños, niñas y adolescentes son especialmente vulnerables a sus efectos y han levantado su voz exigiendo justicia climática y un mayor reconocimiento en esta lucha ante la falta de atención de los estados. Aunque se han mejorado sus derechos para participar en la toma de decisiones, todavía no se han visto acciones concretas, especialmente en el sur global. En este artículo se (...) propone el concepto de «reconocimiento recíproco de capacidades» como una manera de empoderar a los niños, niñas y adolescentes. Resumo: Este artigo busca compreender a situaçáo filosófica de alguns dos autores cujas vidas e cujos pensamentos estiveram entre Kant e Hegel. Romantismo alemáo foi como ficou conhecida esta época. Dentre seus primeiros autores, estiveram Friedrich Schlegel e Novalis, além de Hölderlin. Tais pensadores buscaram superar a crítica feita por Kant à pretensáo do conhecimento filosófico de alcançar a verdade absoluta, as coisas como sáo em si mesmas. Essa superaçáo, contudo, jamais conseguiu, para eles, completar-se – como aconteceria depois no (...) sistema de Hegel, para quem contradições só seriam aceitas como etapas do que chamou de dialética, cuja essência era, ao fim, solucioná-las na figura da síntese. Limitaçáo finita do homem diante do todo do ser, como firmara Kant, era o que ficava para trás com Hegel. Schlegel, Novalis e Hölderlin náo se contentam com a crítica de Kant, mas tampouco acreditam na síntese de Hegel. Parecem sugerir outro caminho para a modernidade ocidental, que náo se jogava na sanha hegeliana pelo saber absoluto sem despertá-la, toda vez, pela consciência crítica kantiana – e que náo se contentava com esta sem sonhar com aquela. Este artículo examina cómo la tragedia griega, especialmente Antígona de Sófocles recupera y amplia el mito. En efecto, el mito encuentra en la tragedia un despliegue tal que en muchas ocasiones llega a competir con el canon mítico. Es también nuestra intención analizar de qué modo opera el mito en la dinámica dramática; esto es, en qué medida le es funcional a la representación trágica. This article examines how the Greek tragedy, especially Sophocles' Antigone recuperates and expands the myth. Since transition to higher education emerged as a research topic in the early 1970s, scholarly inquiry has focused on students without impairments and, what is more, little attention has been paid to the role of digital technologies. This article seeks to address this knowledge gap by looking at the university experiences of a group of first-year students with vision impairments from New Zealand, and the way they use digital tools, such as social media and mobile devices, to manage their transition-related (...) challenges. The article summarises the findings from a longitudinal qualitative project which was methodologically informed by action research (AR). The article explores and discusses scholarly inquiry of transition to university and introduces a conceptual framework which includes five overlapping stages, the transition issues faced by the students and the roles played by digital technologies. The article updates and expands the theoretical understanding of transition to higher education and provides empirical evidence for practitioners to support the needs, inclusion, and participation of young people with disabilities in the tertiary setting. The nature and extent of adults’ engagement in diverse manifestations of technology-facilitated aggression is not yet well understood. Most research has focused on victimization. When explored, engagement in online aggression and abuse has centered on children and young people, particularly in school and higher education settings. Drawing on nationally representative data from New Zealand adults aged 18 and over, this chapter explores the overall prevalence of online aggression with a focus on gender and age. Our findings support the need to (...) also understand adult aggressors’ behaviors to better address the distress and harm caused to targets through digital communications. In the context of business, interactions between individuals generate social systems that emerge anywhere within a corporation or in its relations with external agents. These systems influence the behaviors of individuals and, as a result, the collective actions we usually attribute to corporations. Social systems thus make a difference in processes of action that are often morally evaluated by internal and external agents to the firm. Despite this relevance, social systems have not yet been the object of specific attention in (...) the literature on moral agency in business. To fill this gap, I construct a theoretical framework based on Luhmann’s ideas on social systems and morality. In particular, I argue that morality is a phenomenon that occurs in communication, and an agent can engage in morality in three different ways (as a _moral factor_, an _expressive moral agent_, or a _reflective moral agent_) depending on the functions it plays in communicative interactions. Based on this framework, I argue that social systems in business can be considered moral agents of those types. (shrink)

Information Retrieval systems benefit from the use of long queries containing a large volume of search-relevant information. This situation is not common, as users of such systems tend to use very short and precise queries with few keywords. In this work we propose a modification of the Latent Dirichlet Allocation (LDA) technique using data from the document collection and its vocabulary for a better representation of short queries. Additionally, a study is carried out on how the modification of the proposed (...) LDA weighted vectors increase the performance using relevant documents as feedback. The work shown in this paper is tested using three biomedical corpora (TREC Genomics 2004, TREC Genomics 2005 and OHSUMED) and one legal corpus (FIRE 2017). Results prove that the application of the proposed representation technique, as well as the feedback adjustment, clearly outperforms the baseline methods (BM25 and non-modified LDA). (shrink)

I argue that the opening line of the _Phaedrus_ proleptically encapsulates the major themes of the dialogue and that paying attention to the opening line enables us to strengthen the identification of psychagogy as the key unifying thread of the whole dialogue. In particular, I argue that the opening line foreshadows the quarrel between Lysias and Socrates over the practical guidance of Phaedrus’ soul; the prominence of friendship in the philosophical form of life; the pertinence of Socrates’ one-on-one, custom-built speeches, (...) vis-à-vis the later conceptualization of rhetoric; the definition of the soul as a source of never-ending movement; as well as the origin (_arché_) and destiny (_télos_) of human souls, following the lines of the Palinode. Government agencies in New Zealand are not required to systematically collect data on online hate speech, thus, there is a lack of longitudinal evidence regarding this phenomenon. This report presents trends in personal experiences of and exposure to online hate speech among adult New Zealanders based on nationally representative data. The findings from this study are also compared with results from a similar research study conducted in 2018. In addition, this report explores people’s perceptions about other issues related to hate (...) speech. The goal of this study is to fill some knowledge gaps regarding the extent and nature of hate speech in New Zealand. It also seeks to provide reliable and robust evidence to inform public conversation on the topic and the implementation of strategies and activities to ensure all New Zealanders, no matter what their characteristics, are safe online to benefit from the multiple opportunities of the digital environment. Martín de Azpilcueta and his fellow Spanish Scholastics writing and teaching at the University of Salamanca during Spain’s Golden Age are rightly pointed to by historians of economic thought as being major contributors toward, if not outright founders of modern economic theory. Among these is the theory of time-preference for which Azpilcueta has repeatedly been given the credit for discovering. However, this discovery is a curious one given how the same man, Azpilcueta, condemned usury in general during his whole life. (...) If Azpilcueta did in fact discover this theory and fully understand its implications, we would reasonably expect him to have questioned his support for the ban on charging an interest on a loan. This paper, therefore, challenges the claim that Azpilcueta understood and revived time-preference theory and shows how his understanding was much more nuanced, and, at times, inconsistent. (shrink)

Este artigo discute como os conceitos de mediação e representação se articulam na reflexão de Carl Schmitt em alguns de seus primeiros escritos e preparam o terreno para a formulação da ideia de representação política em um de seus trabalhos mais conhecidos: Teoria da Constituição. O procedimento mediante o qual se traduz uma realidade amorfa ou um coletivo em forma de representação política se atém à noção de presentificar algo ausente ou tornar visível algo invisível. Toda ideia entra no mundo (...) empírico como hóspede forasteiro e para ganhar existência ou visibilidade necessita de uma decisão soberana pela sua representação.
