The question of cognitive endowment in animals has been fiercely debated in the scientific community during the last couple of decades (for example, in cognitive ethology and behaviourism), and indeed, all throughout the long history of natural philosophy (from Plato and Aristotle, via Descartes, to Darwin). The scientific quest for an empirical, evolutionary account of the development and emergence of cognition has met with many philosophical objections, blind alleys and epistemological quandaries. I will argue that we are dealing with conflicting (...) philosophical world views as well as conflicting empirical paradigms of research. After looking at some examples from the relevant literature of animal studies to elucidate the nature of the conflicts that arise, I propose, in strict Darwinian orthodoxy, that cognitive endowments in nature are subject to the sort of continuum and gradation that natural selection of fit variant forms tends to generate. Somewhere between the myth of “free” humans and the myth of “behaviourally conditioned” animals lies the reality of animal behaviour and cognition. In the end, I hope to have softened up some of those deep-seated philosophical problems (and many quasi-problems) that puzzle and dazzle laymen, scientists and philosophers alike in their quest for knowledge about the natural world. This paper investigates the question of which place in the history of political ideas may be assigned to the Constitutional Debate in Herodotus’ _Histories_, 3.80-82. It is shown that the Herodotean debate represents the earliest extant example of a social theory, in which a variety of distinctly social ordering principles are weighed against each other with normative arguments and in isolation from all sorts of divine authorisations. The article divides into three parts. The first part gives an account of the (...) theoretical predecessors to the classical social theory first evidenced in the Constitutional Debate. The second part consists of an exposition of the socio-intellectual progressions clustered in the Herodotean debate, focussing on developments in constitutional thinking and argumentative evolvement. This is the first English translation of the first work of Otto von Gierke, arguably the greatest historian of ideas of the nineteenth century. Community in Historical Perspective includes much of the first volume of Das Deutsche Genossenschaftsrecht, originally published in 1868, and the texts translated here have become essential reading for anyone interested not only in the history of ideas and alternatives to conventional socialism and liberalism, but also, as recent experience has shown, contemporary European affairs. Von Gierke's (...) represented an unparalleled attempt to justify a political programme of structural pluralism, and to interpret the entire course of European history from the Dark Ages onwards as a progressive interaction between 'fellowship' (or 'comradeship') and 'lordship' (or 'sovereignty'). This interaction was to generate a polity of autonomous associations within a constitutional state based upon consent and federal unity, and von Gierke here laid the basis for a distinctively Germanic programme of federalism and quasi-pluralism, with a strongly nationalist emphasis upon the unique capacity of Germans, despite long periods of absolute rule, for corporate self-management.
