Although corruption is ubiquitous, attitudes toward it differ among countries. Until the 1997 OECD Convention, the U.S. had been one of the only two countries with an explicit extraterritorial anti-bribery law, the Foreign Corrupt Practices Act (FCPA) of 1977. The FCPA employs a two-pronged approach to control the supply side of corruption: (1) anti-bribery provisions; and (2) accounting (books and record and internal controls) provisions. I offer evidence, albeit indirect, to show that the FCPA had limited success. The OECD Convention (...) adopts the same two-pronged approach, but, since it is a multilateral treaty, is likely to be more successful provided that enforcement is vigorous enough. The signatory nations effectively form a cartel to reduce the cost of doing business. As with any cartel, however, each multinational corporation has an incentive to deviate. Thus, the mutual enforcement of the agreement is crucial for its success. However, the two-pronged approach is not sufficient, since internal control does not adequately monitor decisions made at the top level. I argue that the two lessons drawn from the U.S. experience are: (1) law enforcement must be credible; and (2) internal controls alone are not sufficient. Stronger and more effective corporate governance within an appropriate regulatory framework is needed to ensure that multinational corporations conduct their business in an ethical manner. (shrink)

This article investigates differences in structural tendencies between Japanese newspaper editorials and front-page columns. Although intuitively recognized by Japanese people, such differences have tended to be empirically overlooked in discourse or rhetoric research. This study compares the two text types, specifically focusing on the location of the main topic in the text item rather than the main thesis, the former of which has received less empirical attention than the latter in Japanese discourse research. The study analyzed 30 editorials and 30 (...) front-page columns from three major Japanese newspapers. The results show that the editorials have an early placement pattern, whereas the columns tend to have delayed introductions. These differences were statistically significant, empirically demonstrating how the intuitively recognized structural tendencies between the two text types crucially differ. The finding that there is a systematic early placement of the main topic in Japanese editorials is indicative of a basic common feature among languages in the editorial genre. From a methodological perspective, the study demonstrates the validity of the index of the main topic location as an analytical tool to distinguish different textual structures. (shrink)

In Kagaku no Sekai to Kokoro no Tetsugaku, Mr.Michio Kobayashi features on Descartes' theory of minds as "subjecitive-active consciousness", and defends it against the materialist movement. I show that Kobayashi's method has a difficulty for defending existence of our minds because Descartes didn't allow the scientific investigation of our mental experience from outside,and so cannot appropriately grasp the significance of other minds.

We study how changes in unemployment risk affect firms’ productivity and whether firm-initiated policies can mitigate the moral hazard problem created by increases in unemployment insurance benefits that might decrease workers’ incentives to work hard. We focus on state-specific changes in UIB levels as a quasi-natural experiment. While a large body of research has examined UIBs, including their effect on unemployed workers, few studies investigate whether UIBs have any impact on a firm’s overall productivity. Using data on firm-level total factor (...) productivity and state-level UIBs, we find a negative association between productivity and UIBs. We also find that the negative association is weaker for firms with higher employee-welfare indices than for firms with lower indices, suggesting that the adverse effect of higher UIBs on productivity is mitigated by policies that benefit workers’ welfare. More specifically, we find that among policies that are under the umbrella of corporate social responsibility, a subset of employee-welfare policies are more effective in managing moral hazard problems than other policies. In searching for an appropriate utility function in the expected utility framework, we formulate four properties that we want the utility function to satisfy. We conduct a search for such a function, and we identify Pareto utility as a function satisfying all four desired properties. Pareto utility is a flexible yet simple and parsimonious two-parameter family. It exhibits decreasing absolute risk aversion and increasing but bounded relative risk aversion. It is applicable irrespective of the probability distribution relevant to the prospect (...) to be evaluated. Pareto utility is therefore particularly suited for catastrophic risk analysis. A new and related class of generalized exponential (gexpo) utility functions is also studied. By living together in a residential community, and by showing and sharing the process of art making, to what extent can aesthetic, cultural, and social issues and concerns expressed by artists be interpreted by local residents? These are the main issues addressed in this essay. 1 The artistic and aesthetic education provided in the community gradually opened up a dialogue not only between foreign artists as guests and Japanese spectators as hosts, but also between art and people, culture and culture, and people and people within the local community. Outline of the Project The Cultural Exchange House, situated in Yamaguchi prefecture, has accommodated about forty artists-in-residence from abroad for over ten years. The forty artists who have stayed there include painters, potters, sculptors, photographers, pianists, musicians, composers, poets, and writers. Artists are responsible for their travel and living expenses. The use of the house is provided without charge and the needs of the artists are met by volunteers. About half of the artists have been German and the rest from Britain, Belgium, United States, Holland, and Australia. Male and female artists have been nearly equally represented.Beginning with three, there are now sixteen volunteers who felt that the creation of a cultural environment, or more specifically the creation of access to the world of art was important for the community. They saw the need for the local community to provide children and adults with aesthetic experiences that could enrich their internal and external worlds. Increasing numbers of children were leaving the community to attend schools and get jobs, with little possibility of returning. The volunteers felt that one of their roles was to educate children and their parents so that they could encounter values different from their own, develop self-confidence, and take pride in the local community which had such cultural opportunities. I examine the tension between biopolitics and necropolitics through three themes that I have perceived and that are related to my life in Japan. First, I examine the transformation of hospitals and medical care, particularly for the elderly, through my experience of sharing the end of my mother’s life. Modern medicine has made great achievements in treating diseases that used to be fatal, but it has become institutionalized in the context of Big Pharma interests, with no insight into the natural (...) ageing and death of human beings. Second, I discuss how the ecological worldview on parasitism and symbiosis has been distorted by industrial logic, drawing on the work of my esteemed friend and parasitologist Professor Koichiro Fujita, who passed away in 2021. Finally, with regard to the Covid-19 pandemic, I would argue that it is not a sudden phenomenon triggered by a new virus, but in a sense a disaster that has been prepared for decades and must be seen as a war using bioengineering and epidemiology as weapons, rather than tanks and bombs. Product recommendation system is realized by applying business rules acquired by data maining techniques. Business rules such as demographical patterns of purchase, are able to cover the groups of users that have a tendency to purchase products, but it is difficult to recommend products adaptive to various personal preferences only by utilizing them. In addition to that, it is very costly to gather the large volume of high quality survey data, which is necessary for good recommendation based on personal preference (...) model. A method collecting kansei information automatically without questionnaire survey is required. The constructing personal preference model from less favor data is also necessary, since it is costly for the user to input favor data. In this paper, we propose product recommendation system based on kansei information extracted by text mining and user's preference model constructed by Category-guided Adaptive Modeling, CAM for short. CAM is a feature construction method that can generate new features constructing the space where same labeled examples are close and different labeled examples are far away from some labeled examples. It is possible to construct personal preference model by CAM despite less information of likes and dislikes categories. In the system, retrieval agent gathers the products' specification and user agent manages preference model, user's likes and dislikes. Kansei information of the products is gained by applying text mining technique to the reputation documents about the products on the web site. We carry out some experimental studies to make sure that prefrence model obtained by our method performs effectively. (shrink)

What is the meaning of “Japanese” culture? In earlier ages, it was about temples, Noh plays, Kabuki, Utamaro and Wabi-sabi. These traditional icons have, since the Meiji era (1868-1912), been identified as typically Japanese. Are they, however, still relevant today? Has there been any crucial mutation in the cultural identity of Japan? In the contemporary era, more and more people associate Japanese culture with Manga, animation and video games, in other words with cultural developments of the post-World War II era. (...) The Japanese Government has actively promoted the popularity of these new aspects of Japanese culture as evidenced in their eagerness to adopt the expression “Cool Japan,” inspired by its British predecessor’s “Cool Britannia.” Everyone does not share that perception though. Following the 11th March 2011 series of disasters, Japanese artist Tadasu Takamine (1968-) worked on a critical questioning of Japanese society and culture, culminating in a work titled Tadasu Takamine's Cool Japan that was shown at the Art Tower Mito, in Ibaraki Prefecture (2012). The present essay reflects on and develops further the message conveyed by Takamine about contemporary Japanese cultural identity. (shrink)

Determining the nature of binding in grapheme-color synaesthesia has consequences for understanding the neural basis of synaesthesia and visual awareness in general. We evaluated type- and token-based letter-color binding using a synaesthetic version of the object-reviewing paradigm. Although mean response times failed to reveal any significant differences between synaesthetes and control participants, RT analyses with ex-Gaussian distributions revealed that the response facilitation in the synaesthesia group reflected type representations exclusively, while response facilitation in the control group, who learned letter-color associations, (...) was dominated by token representations. Thus, letter-color associations in associator synaesthetes are type-based, and do not involve binding to object tokens, consistent with their subjective reports. Contrary to recent studies that failed to find differences between synaesthetes and non-synaesthetes with behavioral measures, response time distribution analyses indicate that color sensations in synaesthetes are not simply the extreme form of normal letter-color associations, and cannot be attributed to demand characteristics.
