This paper addresses the fairness of microcredit interest rates. Since microfinance institutions provide credit for the poor at relatively high prices, the fairness of their interest rates has been repeatedly debated. We first apply Rawls' principles of justice to the case of microcredit interest rates and suggest some limitations related to the hypothesis of rationality of the borrowers and the level of inequality. We then suggest another framework based on the analysis of the distribution of the benefits generated by the (...) transaction to assess the fairness of interest rates. We conceptualize this as the distribution of the bargaining range between the borrowers' and the institutions' reservation price and discuss what these reservation prices could be in the context of microfinance. The article focuses on the historical resources of the China’s model. Understanding the model is one of necessary preconditions of an analysis of China’s dynamic rise and development in recent decades. First, the article analyses the concept of historical development of multiple civilisations and modernities. It then examines the characteristics of China’s old civilisation and the associated model. It ends by showing how the historical Silk Road lives on in an updated modernised global version.

O artigo trata da questão dos direitos humanos quanto ao potencial de consenso entre culturas através do diálogo intercultural. Trata-se de uma contribuição para superar os confrontos entre civilizações e a imposição coercitiva de direitos humanos sobre outras culturas. O paper mostra que a promoção intercultural de direitos humanos entre culturas individuais que se reconhecem mutuamente é uma das formas efetivas de resistência contra a falta de reconhecimento. Todavia, é mister uma formulação dos direitos humanos embasada nos valores de culturas (...) individuais e no diálogo entre elas. A interpretação aqui adotada é uma contribuição para criar ‘unidade na pluralidade’, i.e. uma universalidade de direitos humanos dentro da pluralidade de culturas. (shrink)

The article deals with the theme of updating of Cuba’s economic model mainly from the perspective of economic and political philosophy and its interdisciplinary contexts. First, it examines the historical origins of Cuba’s socialist model and the subsequent changes after the fall of the Eastern Bloc. Second, it analyses the actualization of Cuba’s model in the first two decades of the 21st century, that is, mainly the introduction of market and private ownership to complement planning and public ownership. Third, it (...) explains the codification of these changes in the new constitution. Forth and finally, it focuses on an interpretation of international cooperation both in Latin America, especially within the framework of the two pink tides, and with other partners in global interactions, particularly China. This will make it possible to understand the updated Cuba’s model, which the author has coined strategic socialism with Cuban characteristics. (shrink)

On Conditions of Participation: The Deficits of Public Reason The paper analyzes the conditions of civic participation that are elucidated by criticism of the deficits of public reason. The interpretation proceeds in three steps. First, the idea of public reason and discourse is analyzed, followed by an explanation of democratic deficit and of the social deficit in the second and third steps, respectively. These deficits are analyzed as an essential limit to political and social conditions of the participation of citizens. (...) The analysis focuses thereby on the theory of public reason by one of the most influential political philosophers of the last decades, John Rawls. The paper identifies two main pitfalls in his theory: first, the deficit following from an inadequate integration of an individual into society, which, in this case, represents democratic deficit, second, the deficit linked with underrating the socio-distributive dimension of justice, which means a social deficit. The aim of this paper is very modest. First, we want to assess how different strategies of naturalization might deal with the need of using folk psychology in legal domain. Second, we want to check whether folk psychology is indeed indispensable in the legal domain. Third, we want to describe possible problems with one strategy of naturalization, i.e. radical naturalization with classical elimination. Our conclusion will be that despite various attempts, every project of naturalization of law will have to resolve (...) the tension between law and folk psychology and such resolution would not be achieved by simple reduction or elimination of folk psychology. A variety of non-standard solutions might be in place to resolve this tension. We will only outline those strategies here. (shrink)

The abstract Everyone who gets to know deeper with the Nietzsche philosophy is forced to think about a mutual relationship of a culture and a biology. The main problem to correct show of above relationships is the understanding of the meaning of a language with reference to the culture and the biology. Considerations which are represented here are inspired by the Nietzsche philosophy. They are split by three parts. In the first part there is shown the meaning of the language (...) to create the herd in the Nietzsche philosophy. The second part develops his qualification of the language as a shortening of communication. The final part tries to refer the functioning of the language to the sphere of a biological human being. As I think, only the biological perspective permits to overstep the rhetoric of the individualism expressed in the Nietzsche philosophy by the opposition among weak and strong, or else among a priest and a superman. Thanks to drawn consequence from accepted by Nietzsche of the reduction my to the animal sort we are forced to the reversal of the perspective of his thought. The herd is not a centre to create the superman as the aim of the all mankind, but the sense of the exceptionality of an each subject is a centre to a fixation of the reproduction of the genetic definite population. This article was written on the occasion of the 100th anniversary of the Institute for Social Research in Frankfurt am Main, where the Frankfurt School was founded and continues to evolve. From philosophical and interdisciplinary perspectives, the article focuses on the trichotomic characteristics of critical theory, specifically: critique, explanation, and normativity. It looks first at the founding of the Institute for Social Research; second, at the emergence of critical theory at the Institute; and third, at how these ideas evolved. It (...) identifies trichotomy underpinning Horkheimer’s approach to critical theory. In the conclusion, the revisions made to critical theory in the later stages of development are considered. [Democracy, the public and civil society].

The paper analyzes recognition in relation to the global legal arrangements. It articulates of an extra-territorial recognition of right-holders by means of the development of a philosophical theory of recognition on the global level. It examines contemporary possibilities of extra-territorial recognition that are bound to the nation-states hitherto. The paper indicates an increasing influence of various transnational agents in order to show (1) the possibilities and limits of extra-territorial recognition based on a state-centric approach, and (2) a demand of supranational (...) recognition. Therefore, it maps the development from thecontemporary international system to the system that can contain also important supranational elements. In its practical consequences, it leads not only to rethinking social, political and legal philosophy but also to a philosophical reinvention of the United Nations because a new supranational stage of recognition requires not only a responsibility of the nation-states but also a direct responsibility of non-state transnationalagents. Věnuje se souboru šestnácti esejí Zotročení svobodou (2010), v němž Petr Bláha mapuje pojetí otroctví u vybraných filosofů v těchto dějinách a koncentruje se zejména na myšlenky autorů evropského kánonu. Postupuje chronologicky, začíná tradičně od antiky a pokračuje až do 20. století. K autorům, kteří měli na Bláhovo stanovisko největší formativní vliv, patří novověcí filosofové, s nimiž sdílí jak témata, tak do velké míry i přístup k nim. S (...) tím souvisí i zájem o ideu svobody, která do určité míry stála v opozici k ideji otroctví. Odtud ve svém paradoxním důsledku pochází myšlenka „zotročení svobodou“. (shrink)

The Law of Peoples and Global Justice: Beyond the Liberal Nationalism of John Rawls The paper deals with the relation of a theory of international justice, specifically John Rawls's philosophy of the law of peoples, and a theory of global justice. In the first part, the paper outlines Rawls's main theses on the international conception of the law of peoples. The second part concerns a problem found in segments of Rawls's theory, specifically his concept of a social contract—contractualism. This problem (...) inadequately approaches the relationship between the individual and the community. The third part deals with the inconsistent points in Rawls's theory contained in part two, i.e. his principles of justice selected with the aid of social contract. In the fourth part, the paper concentrates on the consequences of these limitations for a socially distributive dimension of justice or as an approach for dealing with disproportionate global inequalities. The last part formulates the causes of the limitations of Rawls's theory of international justice and points out the need for a global justice which is socially and inter-culturally considerate. This paper uses a game-theoretic framework to formalize the Hayekian notion of equilibrium as the compatibility of plans. To do so, it imposes more structure on the conventional model of strategic games. For each player, it introduces goals, goal-oriented strategies, and the goals’ probabilities of success, from which players’ payoffs are derived. The differences between the compatibility of plans and Nash equilibrium are identified and discussed. Furthermore, it is shown that the notion of compatibility of plans, in general, differs from (...) the notion of Pareto efficiency. Since the compatibility of plans across all players can rarely be achieved in reality, a measurement is introduced to determine various degrees of plan compatibility. Several possible extensions and applications of the model are discussed. (shrink)

This paper suggests that Nash equilibrium can be interpreted as a conceptual tool for addressing comparative-statics issues on an aggregate level. Together with additional assumptions, Nash equilibrium helps generate testable predictions about changes or differences of behavior induced by changes or differences of exogenous variables. However, Nash-equilibrium behavior, as such, is not subject to empirical testing. Instead, widespread and persistent behavior is modeled as a Nash equilibrium by assumption. The paper argues that this interpretation is in line with the traditional (...) use of an equilibrium concept in price theory. The suggested interpretation is illustrated with the model of public-goods provision. The paper compares this interpretation of Nash equilibrium with other interpretations and discusses its limits. Autor stawia w centrum rozważań koncepcję historii Cieszkowskiego i Hessa. "Prolegomena…" Cieszkowskiego wywarły silne wrażenie na Hessie. Autor "Heiligen Geschichte" przejął koncepcję filozofii czynu Cieszkowskiego, która nie ograniczała się do spekulacji, lecz przenosiła nas do sfery społecznej praktyki.

The character of norms is a relevant issue in the contemporary legal philosophy and in the metaethics. The analysis of Lewis’ sugguestions concerning the fictional statements (sentences “describing” the fiction) prima facie may seem to be useless from the perspective of law. However, the situation is different, due to the fact that it is possible to treat the legal text as the description of possible world. The issue is analyzed in the paper.

The primary purpose of the paper is to present the issue of extrapolation, which is interesting from the perspective of contemporary philosophy of science. For its proper explanation, it is crucial to distinguish it from terms of similar meaning, such as analogy, induction or statistical inference. The second goal is to indicate key differences that exist between extrapolative inference and analogical reasoning. Because of this the ascertaining of the identification of these concepts would be a mistake though, of course, there (...) is no way not to notice certain similarities. (shrink)

W wieku XIX i w I połowie XX filozofowie polscy zamiast filozofią polityczną zajęli się filozofią historii. Tego typu podejście stworzyło istotną kontynuację ideową, pomimo znacznych różnic uwarunkowanych odmiennymi kontekstami polityczno-teoretycznymi. Ta ciągłość wyraża się w dwóch ideach zrodzonych już w XV- i XVI-wiecznej polskiej myśli politycznej, tj. w idei polskiej misji historycznej jako „przedmurza” i w pojęciu specyficznie polskiego umiłowania wolności. Autor artykułu przybliża to zjawisko, prezentując zestaw trzech koncepcji: późnooświeceniową Staszica, romantyczną Cieszkowskiego oraz neoromantyczną Zdziechows- kiego.
