Pela análise dos principais argumentos do autor a esse respeito, o artigo procura demonstrar a flexibilidade do conceito de Estado do autor e a importância da filosofia enquanto ponto de intersecção entre a moral e o direito, constituindo-se como (...) instrumento de abordagem fenomenológica das formas de associação humana. This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

Based on the literature on stakeholder management and family firm dynamics, this research analyses the relationship between three constructs: the identification of business families with their family firms, FFs’ orientation toward key non-family stakeholders, and the achievement of better economic performance. Data analyses from 374 family and non-family members of 173 Spanish FFs show that a high level of family identification with their firms affects the orientation of FFs toward key non-family stakeholders in setting corporate goals and that this orientation (...) will lead to higher economic performance only when it is built on family identification with the firm. Our results also show that the significance of both relationships changes with the degree of family involvement in the management of the FF. (shrink)

Fue organizada por el Proyecto Anillos de Investigación “Tecnologías Políticas de la memoria: usos y apropiaciones contemporáneas de artefactos de registro de la violencia política”, de la Universidad Alberto Hurtado, el Museo de la Memoria y los Derechos Humanos y la Universidad Austral de Chile. The contributions in this volume reveal a broad spectrum of Olivi's different scholarly methods, demonstrating his intellectual activity and presenting some of his most original philosophical theories.".

Despite the economic relevance and distinctiveness of family firms, little attention has been devoted to researching their nature and functioning. Traditionally, family firms have been associated both to positive and negative features in their relationships with the stakeholders. This can be linked to different orientations toward corporate social responsibility. Thus, this research aims to identify the approaches that Spanish family firms maintain about social responsibility, based on the model developed by Quazi and O' Brien Journal of Business Ethics 25, 33-51 (...) (2000). An empirical study carried out for 112 Spanish family firms gives support to our initial assumption about these organizations not being a homogeneous group in terms of their orientation towards corporate social responsibility. The differences in perceptions do not seem to be associated to biographical characteristics. These results lead to some relevant academic and practical implications that suggest interesting lines for future research. (shrink)

Se presenta una propuesta de innovación educativa, dirigida al alumnado de Educación Secundaria, fundamentada en el uso de los itinerarios didácticos teatralizados como recurso didáctico con perspectiva de género. Para su confección se pretende una metodología que privilegia los contenidos procedimentales y que fomenta el pensamiento histórico y, por ende, el pensamiento crítico. Los contenidos seleccionados están relacionados con el siglo XVI y XVII y, más concretamente, con la persecución y procesamiento de mujeres por brujería y hechicería por parte del (...) Tribunal de la Inquisición. Para ello se toma como centro de estudio el proceso que se llevó a cabo en Córdoba contra Leonor Rodríguez, lo que llevará al alumnado a reflexionar y a preguntarse sobre los estereotipos de la mujer en la historia, así como en la actualidad, con la intención de formar a una ciudadanía crítica y comprometida. La museografía escolar gana terreno en la virtualidad gracias a la tecnología. Entonces, es necesario establecer la ruta pedagógica para la creación de un museo virtual como espacio de divulgación artística de educación secundaria mediante el uso de las TIC. Por ello, desde la investigación creación, se propone un método teórico-práctico de técnicas artísticas para la generación de obras de arte escolar y las herramientas virtuales en línea para la construcción y montaje en red de la propuesta museográfica 2D y (...) 3D. Como resultado se crea el Museo Virtual de Arte Salesiano con más de 1000 obras. (shrink)

Burnout is characterized by emotional exhaustion and caused by exposure to excessive and prolonged stress related to job conditions. Moreover, burnout is highly prevalent among health care professionals. The aim of this study is, first, to examine the mediating role of social support over the effect of burnout in health care professionals and, second, to explore potential gender differences. A convenience sample of 1,035 health professionals from Ecuador, including 608 physicians and 427 nurses, was surveyed using the Maslach Burnout Inventory, (...) Social Support Survey, and General Health Questionnaire as measures of burnout, social support, and general health, respectively. Social support was found to mediate the negative effects of burnout on health regardless of gender. Differences across the three dimensions of burnout and health are further discussed, along with their implications for designing effective burnout interventions for health care professionals in Ecuador. The goal of this research is to analyze the heterogeneity of family firms in the normative attention to their non-family stakeholders. With this aim, we suggest that the psychological process of top family managers in terms of individual affective commitment to their firms is a key variable to explain that heterogeneity. However, we also suggest a moderator effect of the family stakeholder salience in the relationship between the managers' affective commitment to the firm and the establishment of firm goals toward (...) non-family stakeholders. The results of a hierarchical regression analysis on data obtained from 207 family executives show a significant positive influence of managers' affective commitment on the establishment of goals related both to internal and external non-family stakeholders. In addition, we can observe a negative moderator effect of the family utilitarian power—as an indicator of the family stakeholder salience—on the relationship between the family managers' affective commitment and the goals related to non-family employees. In this paper we examine Husserl’s ethics contribution to the understanding of human action determined by self-responsibility. We admit that self-responsibility is that ‘capacity’ of any subject to take a reflective stance on himself and his life. In this sense, the subject only experiences fully being responsible when guides his reason in the multidimensionality of his actions, aiming at a personal and cultural renewal. To show this, we firstly analyze the project of renewal of man and culture in the personalist (...) ethics proposed by Husserl, viewed from the history of parricide Karamazov. Secondly, we inquire about one of the two dimensions of human personality, self-awareness and presence of oneself, to approach the complex intentional act in which this selfconsciousness takes place. Thirdly, we analyze how the ability of self-determination, the other key dimension of the person, makes possible the self-appraisal by which the new man values his actions, motives, means and ends. We conclude that the self guides his life in full participation and emotional manifestation out of experiences that strengthen the ‘self’ and the ‘us’. (shrink)

The objective structured clinical examination is a method for assessment clinical competencies and skills. However, there is a need to improve its design in psychology programs. The aim of this study was to analyze the effect of the different scenario's presentation order with different complexity/difficulty on the autonomic stress response of undergraduate students undergoing a Psychology OSCE. A total of 32 students of Psychology Bachelor's Degree were randomly selected and assigned to two OSCE scenarios of different complexity. While undergoing the (...) scenarios, participants heart rate variability was analyzed as an indicator of participant's stress autonomic response. Results indicate that the order of presentation of different complexity/difficulty scenarios affects the autonomic stress response of undergraduate Psychology students undergoing an OSCE. Students who underwent the high-complexity scenario first, reported significantly higher autonomic stress response than students who began the OSCE with the low-complexity scenario. Highly complex or difficult scenarios require good executive functions or cognitive control, very sensitive to autonomic stress responses. Therefore, OSCE design will benefit from placing easy scenarios first. (shrink)

Several studies have highlighted that reading comprehension is determined by different linguistic skills: semantics, syntax, and morphology, in addition to one’s own competence in reading fluency. On the other hand, according to the Linguistic Interdependence Hypothesis, linguistic skills developed in one’s own native language facilitate the development of these skills in a second one. In this study, we wanted to explore the linguistic abilities that determine reading comprehension in Spanish and in English in Secondary Education students. To do this, 73 (...) Secondary Education Students participated in this study. The students carried out a battery of tasks in English and Spanish, all of them related to reading comprehension and different linguistic skills, which included syntactic awareness tasks, synonymy judgment tasks, and morphological awareness tasks. The results indicated a positive correlation between linguistic competencies in both languages, which were determined by school year, with a lower performance in the 1st year than in the 3rd year. Moreover, we found more skills with correlations in English reading comprehension than in Spanish. Finally, reading comprehension in L1 was mainly explained English reading comprehension, while English reading comprehension was predicted by grade, and syntactic awareness, as well as Spanish reading comprehension. This could be explained by the different levels of exposure to L1 and L2 of sample subjects, as the linguistic variables have different influences on the reading comprehension of both languages. Proposed lie-detection technology based on neuroscience poses significant challenges for the law. The law must respond to the science with an adequate understanding of such evidence, its significance, and its limitations. This paper makes three contributions toward those ends. First, it provides an account of the preliminary neuroscience research underlying this proposed evidence. Second, it discusses the nature and significance of such evidence, how such evidence would fit with legal practices and concepts, and its potential admissibility. This paper defends an inferential conception of scientific representation. It approaches the notion of representation in a deflationary spirit, and minimally characterizes the concept as it appears in science by means of two necessary conditions: its essential directionality and its capacity to allow surrogate reasoning and inference. The conception is defended by showing that it successfully meets the objections that make its competitors, such as isomorphism and similarity, untenable. In addition the inferential conception captures the objectivity of the cognitive representations (...) used by science, it sheds light on their truth and completeness, and it explains the source of the analogy between scientific and artistic modes of representation. I argue against theories that attempt to reduce scientific representation to similarity or isomorphism. These reductive theories aim to radically naturalize the notion of representation, since they treat scientist's purposes and intentions as non-essential to representation. I distinguish between the means and the constituents of representation, and I argue that similarity and isomorphism are common but not universal means of representation. I then present four other arguments to show that similarity and isomorphism are not the constituents of scientific representation. I (...) finish by looking at the prospects for weakened versions of these theories, and I argue that only those that abandon the aim to radically naturalize scientific representation are likely to be successful. It is shown that the before-before (or Suarez-Scarani) experiment refutes hidden variable models with a deterministic (“realistic”) nonlocal part, whereas experiments violating Leggett-type inequalities refute models with biased random local part. Therefore the claim that Gröblacher et al. (Nature 446:871–875, 2007) present “an experimental test of nonlocal realism” is misleading, and Marek Żukowski’s (Found. Phys. 38:1070, 2008) comment misses the point. A new experiment is suggested.

This paper discusses Ronald Allen’s article, Naturalized Epistemology and the Law of Evidence Revisited, and reflects on how epistemology can contribute to our understanding of the evidentiary proof process. I first situate Allen’s critique of recent philosophical scholarship, distinguishing between general theoretical accounts of proof (including the theory that Allen and I have defended), on one hand, and the applications of specific epistemological concepts or issues to law, on the other. I then present a methodological picture that diverges in some (...) respects from the one that emerges from Allen’s critique. In discussing this alternative methodological picture, I explain how epistemology can contribute to legal evidence and proof while avoiding the problems that Allen identifies. (shrink)

Gracias a la inclusión del testimonio heraclíteo, resulta posible rastrear la presunta consolidación de la tesis sobre los nombres primarios y los secundarios como el eje de la separación entre dos planos de realidad (uno estable y uno móvil) (...) y de la teoría de las Ideas -es decir, como la base de la epistemología platónica presente en los diálogos de madurez-. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. En este número se tratan, a partir de Kant, diversos sentidos de tales nociones en el contexto actual: la perspectiva de la Economía constitucional de Buchanan, la concepción de la sociedad abierta de Popper, la teoría de la justicia de Rawls y la concepción filosófica de la vida social y política de Ortega y Gasset.

This article explores the role of conventions in the normalization of cocoa production in Ecuadorian Amazonia. Convention theory provides key theoretical tools for understanding coordination among agents. However, conventions must be understood as cultural constructions with a strong Eurocentric background that must be substantially modified in originally non-European contexts. A creative application of convention theory can partially overcome bifurcation among Western and non-Western rationalities. First, it shows that Western values and forms of coordination are heterogeneous, conflictive and opposing. Second, it (...) provides key insight for understanding the transformation of subaltern subjectivities generated from non-Western rationalities that are closely associated with subjugated knowledges. Third, in applying the concept of compromise, it allows one to understand cognitive hybridization and coordination among indigenous and Western agents and thus the complexities of processes of resistance, subversion and empowerment carried by indigenous communities. This article is focused on how cocoa production in Ecuadorian Amazonia serves as an example of the confluence and coordination of indigenous (using the concept of “Good Living” or Sumak Kawsay) and Western conventions. The assertion of Sumak Kawsay is understood as a relevant transformation of Ecuadorian post-colonial relations. It is shown that relevant industrial upgrading processes are justified by, among others, Sumak Kawsay repertoires. Additionally, dialogue on knowledge and compromise among conventions, and especially concerning Sumak Kawsay and the market, have been key facets shaping the development of a differentiated quality strand that has promoted relevant changes in the subaltern positioning of indigenous farmers in the cocoa commodity chain. Se realizó una investigación con el objetivo de elaborar actividades que relacionan los elementos teóricos con la práctica desde la asignatura Defensa Civil, para contribuir a la participación de estudiantes universitarios y habitantes de la comunidad "Los Coquitos" en la prevención, mitigación o solución de los problemas ambientales que la afectan. Se aplicó un pre-experimento que permitió comprobar la efectividad de las actividades desarrolladas. Esta propuesta favoreció la vinculación de la escuela con la comunidad desde la protección del medio ambiente. (...) A research was carried out with the aim of designing tasks that relate theoretical elements with the practice in Civil Defense to contribute to the participation of university students and inhabitants of Los Coquitos community in the prevention, lessening or solution of the environmental problems it faces. A pre-experiment was applied which allowed to test the effectiveness of these tasks.
