ABSTRACT Foregrounding Hegel’s political cosmology allows us to set his dialectic-speculative theory of the political world in contrast both to ideal theories and to historicist-positivist theories. Against these positions, Hegel upholds his “realism of the idea”: the claim that a rational world is neither a pre-given whole nor an unattainable ideal, but the dynamic, immanent orientation of reason that continually constructs and animates the world. Hegel’s view of the world thus provides him with a way of reconceiving the relationship between (...) philosophy and actuality. Yet Hegel is somewhat unsystematic in accounting for how the process of political education unfolds in its differentiated moments. This paper pieces together a more systematic account of political education from Hegel’s scattered remarks on the subject in Philosophy of Right. I argue that, once we understand how political education fits into the holistic (...) picture of Hegel’s Rechtsphilosophie, we see that it exercises both a fortifying and a threatening influence on the state: fortifying the state insofar as it habituates individuality to universality in the form of ethical dispositions such as patriotism, threatening the state insofar as it represents a destabilizing tendency toward democratic judgment in the emergence of public opinion. This book has the modest and practical intention of providing students with “a readable paraphrase” of Hegel’s Philosophy of Right and of Marx’s Critique of it. In this the assumption is made that the Ph.R. is difficult beyond need and that it was a reasonable desire of Marx, unfortunately unfulfilled, “to present the philosophy of Hegel in a form comprehensible to the ‘average man’. Hegel certainly had no thought that it was either possible to make speculative (...) class='Hi'>philosophy popular or that the “average man” had any need of philosophy, having his appropriate knowledge of the speculative in the form of religion. Hegel looked back to the 18th century as a time when philosophy was popular, the interest of “enlightened” princes and burghers; it could be popular because it was an abstract reason related to a material presupposition and taking its concreter content underived from a tradition it was mostly bent on destroying. Marx is on the whole a man of the Enlightenment who has learned from Hegel to give his materialism a teleological form somewhat in the manner of the Stoics. He is sure Hegel has perversely reversed the true relation of ideas to individual human beings and that it would be a useful work to purge his philosophy of such “mystification”. Kainz’s paraphrase must be thought a similar transposition of Hegel to a more “natural” standpoint. In one way this is not to be thought objectionable since to students in, or barely emerging from, an Anglo-American empirical tradition Hegel is hardly accessible at all unless through Marxism or else Platonism. In another way the loss is very great: the immanent dialectical development of the Ph.R., in which Hegel placed the philosophical importance of the work, is obscured and rendered unintelligible. Instead one has a loose empirical succession which is easier to follow because plausible reasoning replaces what Hegel would think philosophical proof. (shrink)

ABSTRACT In his famous critique of Hegel’s Philosophy of Right, Marx criticized Hegel’s contention that the general will can be achieved without popular sovereignty. Marx argued that Hegel’s first error lay in his Idealist method, which mistook the realities of the family and civil society as mere emanations of the Idea. This methodological error, according to Marx, led Hegel to misunderstand the rational essence of the state as consisting in a “universal” will that is abstracted from the real (...) will of the people itself, allowing Hegel to defend the pursuit of the good of the whole not by popular government but government by a special bureaucratic, “universal” estate, represented in government by civil servants. However, Marx failed to direct the same type of critique against Hegel’s assertion that the bureaucracy would have the knowledge of the whole that it would need if it were to effectively regulate civil society in the universal interest. This article challenges Honneth's reading of Hegel's Philosophy of Right in The Pathologies of Individual Freedom: Hegel's Social Theory (2001/2010). Focusing on Hegel's method, I argue that this text hardly offers support for the theory of mutual recognition that Honneth purports to derive from it. After critically considering Honneth's interpretation of Hegel's account of the family and civil society, I argue that Hegel's text does not warrant Honneth's tacit identification of mutual recognition with (...) symmetrical instances of mutual recognition, let alone his subsequent projection of symmetrical forms of mutual recognition onto the various spheres of the Philosophy of Right as a whole. I conclude by indicating an alternative way in which Hegel's text might be used to understand contemporary society. (shrink)

For a long time, the sections of the Philosophy of Right dedicated to the relations among states have been neglected by contemporary International Relations theories. However, especially since the end of the Cold War, this discipline has finally reconsidered Hegel’s theory, in particular by stressing two aspects: the thesis of an ”end of history” implied in it; and, more generally, the primacy of the state in international politics. This paper suggests a different interpretation. It argues that, in order (...) to really understand Hegel’s theory of international relations, it is necessary to consider how it is related to the momentous changes that occurred in the wake of the French Revolution and to previous philosophical developments in the Age of Enlightenment. Indeed, the convergence of these two aspects in his own philosophy of history should suggest that, according to Hegel, by the early nineteenth century international politics had finally entered a new era in which states would still interact as the foremost actors, but would be bound nonetheless by an unprecedented awareness of their historical character. This paper attempts to clarify the conceptual foundations of sovereignty in Hegel’s Philosophy of Law in order to provide an answer to this question and thus be able to evaluate the scope of contemporary sovereignty and the adequacy of its claims. As will be seen, Hegel constructs his own position in critical dialogue with Hobbes’ and Kant’s approaches, with more or less explicit references. The development of this article is divided into three parts. In the first, the Hegelian conception (...) of sovereignty is presented in the framework of his organicist understanding of the state, taking into account both its internal and external aspects. The second, analyses Hegel’s theoretical foundations of war and his position in international relations. Finally, the scope of sovereignty today is discussed in the light of Hegelian thought. Hegel’s account of conscience at the conclusion to the chapter on morality in the Philosophy of Right has had more than its share of detractors. Theunissen tries to explain why the account is “so meager,” Findlay deems it “thoroughly scandalous,” and Tugendhat goes so far as to label it the pinnacle of a “no longer merely conceptual, but rather moral perversion.” Even commentators committed to rescuing Hegel’s discussion of conscience from such extreme reproaches agree that it is “one-sided” (...) and “problematic.” The source of this widespread conclusion about Hegel’s political incorrectness is not difficult to discern. In the wake of the nationalistic excesses and horrors of the last two centuries, there is an understandable suspicion about the motivations underlying claims that “the state cannot recognize conscience in its distinctive. form, that is, as subjective knowing”. When Hegel declares that the “formal subjectivity” of conscience, as the final achievement of morality, is “on the verge of turning into something evil”, he seems clearly out of step with the reigning liberal political traditions, traditions that regard the individual’s freedom to abide by his or her conscience as both an unassailable right and an inherent good. Despite the enormous and growing interest in Marx and the availability of Marx's writing in paperback, it is scandalous how little care has been taken in producing careful texts and English translations of Marx's work. O'Malley's edition is an outstanding exception. It is carefully and intelligently edited. The result makes available an extremely interesting text of Marx. A number of scholars have already argued that in this early critique, one can discover some of the earliest formulations of distinctive Marxian themes. (...) Now the reader can judge for himself, for this is the first full English translation of Marx's Critique. But this Critique is not only extremely important for understanding Marx's intellectual development, it also helps to make Hegel's Philosophy of Right come alive. Marx's fundamental ambivalence toward Hegel is evidenced here. It is clear that Marx is still very much under Hegel's influence and we can see how deeply Hegel is shaping Marx's thought, but there is also a toughness and incisiveness in Marx's criticism of Hegel. O'Malley has provided a very extensive introduction which not only provides the necessary background for understanding this text but also explores the role of this work in the totality of Marx's development. Altogether this edition shows a care and judiciousness which is exceptional. It eminently serves the purpose of making an important text accessible.--R. J. B. (shrink)

The most valuable political theoretical contribution made by Marx's idea of socialism is towards the resolution of the seeming opposition of mass democracy and rational government. Marx follows Hegel's redefinition of political rationalization as the actualization of the nascent self?consciousness of the existing ethical world when he uses socialism as a statement of those tendencies of bourgeois society that will create the perspectives of social awareness that allow mass democracy. This thesis is made against aspects of the interpretation of (...) Marx's relation to Hegel in Bolshevik political theory. I claim that the Bolshevik idea of socialism as the militant political intervention of the dictatorship of the proletariat develops, through Engels, a position taken with respect to Hegel's philosophy of right in Marx's Rhenish Journal articles. This idea is, however, pre?Hegelian in the sense that it is open to a democratic criticism based on the philosophy of right understood in an alternative fashion. In his writings after leaving the Rhenish Journal and up to the Economic and Philosophical Manuscripts Marx makes this alternative available, and the notion of socialism he arrives at here turns on an awareness of the contradictions which make the militant political imposition of freedom impossible. Whereas for Bolshevism socialism is to be imposed on existing society, for Marx it is more the development within that society that makes possible mass democratic freedom. (shrink)
