Research into moral decision-making has been dominated by sacrificial dilemmas where, in order to save several lives, it is necessary to sacrifice the life of another person. It is widely assumed that these dilemmas draw a sharp contrast between utilitarian and deontological approaches to morality, and thereby enable us to study the psychological and neural basis of utilitarian judgment. However, it has been previously shown that some sacrificial dilemmas fail to present a genuine contrast between utilitarian and deontological options. Here, (...) I raise deeper problems for this research paradigm. Even when sacrificial dilemmas present a contrast between utilitarian and deontological options at a philosophical level, it is misleading to interpret the responses of ordinary folk in these terms. What is currently classified as “utilitarian judgment” does not in fact share essential features of a genuine utilitarian outlook, and is better explained in terms of commonsensical moral notions. When subjects deliberate about such dilemmas, they are not deciding between opposing utilitarian and deontological solutions, but engaging in a richer process of weighing opposing moral reasons. Sacrificial dilemmas therefore tell us little about utilitarian decision-making. An alternative approach to studying proto-utilitarian tendencies in everyday moral thinking is proposed. (shrink)

Mackie drew attention to the distinct semantic and metaphysical claims made by metaethical realists, arguing that although our evaluative discourse is cognitive and objective, there are no objective evaluative facts. This distinction, however, also opens up a reverse possibility: that our evaluative discourse is antirealist, yet objective values do exist. I suggest that this seemingly farfetched possibility merits serious attention; realism seems committed to its intelligibility, and, despite appearances, it isn‘t incoherent, ineffable, inherently implausible or impossible to defend. I argue (...) that reflection on this possibility should lead us to revise our understanding of the debate between realists and antirealists. It is not only that the realist‘s semantic claim is insufficient for realism to be true, as Mackie argued; it‘s not even necessary. Robust metaethical realism is best understood as making a purely metaphysical claim. It is thus not enough for antirealists to show that our discourse is antirealist. They must directly attack the realist‘s metaphysical claim. (shrink)

The Theory of Planned Behavior predicts that a combination of attitudes, perceived norms, and perceived behavioral control predict intentions, and that intentions ultimately predict behavior. Previous studies have found that the TPB can predict students’ engagement in plagiarism. Furthermore, the General Theory of Crime suggests that self-control is particularly important in predicting engagement in unethical behavior such as plagiarism. In Study 1, we incorporated self-control in a TPB model and tested whether norms, attitudes, and self-control predicted intention to plagiarize and (...) plagiarism behavior. The best statistical fit for the path-analytic model was achieved when a direct path from self-control to plagiarism engagement was specified. In Study 2, we added a measure of perceived behavioral control and split the measurement of norms into descriptive and injunctive components. This study found that both self-control and perceived-behavioral control additively contributed to the prediction of plagiarism and the path-analytic model achieved its best fit when direct paths from perceived norms to plagiarism behavior were specified. These studies suggest that setting strong anti-plagiarism norms, such as by the use of honor codes, and seeking to enhance students’ self-control may reduce engagement in plagiarism. (shrink)

Some disability activists argue that disability is merely a difference. It is often objected that this view has unacceptable implications, implying, for example, that it is permissible to cause disability. In reply, Elizabeth Barnes argues that viewing disability as a difference needn’t entail such implications and that seeing such implications as unacceptable is question-begging. We argue that Barnes misconstrues this objection to the mere difference view of disability: it’s not question-begging to regard its implications as unacceptable, and the grounds that (...) Barnes offers for potentially blocking some of these implications fail to explain our conviction that it’s impermissible to cause disability. (shrink)

The challenges of higher education can be stressful, anxiety-producing, and sometimes depressing for students. Such negative emotions may influence students’ attitudes toward assessment, such as whether it is perceived as acceptable to engage in plagiarism. However, it is not known whether any impact of negative emotions on attitudes toward plagiarism translate into actual plagiarism behaviours. In two studies conducted at two universities, we examined whether negative emotionality influenced plagiarism behaviour via attitudes, norms, and intentions as predicted by the theory of (...) planned behaviour. In both studies, negative affect predicted plagiarism intentions mediated by perceived norms, and intentions predicted plagiarism behaviour. These findings suggest that students’ negative emotionality is a risk for plagiarism engagement and that higher education institutions should support students’ emotional well-being, especially regarding assessment practices. Guy Jobin | Résumé : Cette étude est consacrée aux effets de la mutation de la question sociale sur le discours magistériel en éthique sociale et politique. Le mot « mutation » désigne le fait qu’aux enjeux socio-économiques qui formaient traditionnellement le noyau dur de la question sociale s’ajoutent d’autres enjeux de nature différente, notamment ceux liés à la reconnaissance morale et juridique des identités individuelles et collectives. Deux thèmes de l’enseignement social de l’Église seront retenus et explorés ici pour (...) tester l’hypothèse d’une répercussion de la mutation de la question sociale sur l’enseignement social de l’Église catholique. Ce sont l’enseignement sur le bien commun et l’enseignement qui condamne la discrimination. Nous concluons qu’il y a bien une ouverture du discours magistériel aux transformations des idées et des jugements dans le domaine éthico-moral. On voit pourtant que, même dans ces conditions, l’arrimage de logiques hétérogènes génère dans l’enseignement social des « tensions » épistémologiques et pratiques qu’on ne saurait minimiser. |: This article studies the effects of the mutation of the social question on the magisterial discourse in social and political ethics. The word “mutation” refers to the fact that to the socio-economical stakes which traditionally formed the hard core of the social question are added other stakes of a different nature, notably those that are tied to the moral and juridical recognition of individual and collective identities. Two themes of the social teaching of the Church are here retained and explored to test the hypothesis of a repercussion of the mutation of the social question upon the social teaching of the Catholic Church. These are the teaching concerning the common good and the teaching that condemns discrimination. We conclude that there is indeed an opening of the magisterial discourse to transformations in ideas and judgments in the ethical moral domain. Yet one can see that, even under those conditions, the coordination of heterogeneous logics generates in the social teaching epistemological and practical “tensions” which cannot be minimized. Guy Jobin | : L’objet de cet article est l’identification de quelques linéaments d’une éthique de la parole croyante dans l’espace public des sociétés démocratiques. Cette éthique sera élaborée à partir de la notion de style, notion qui résulte de récentes recherches sur l’herméneutique du concile Vatican II. Nous proposons une démarche en trois parties sur un objet bien précis, soit la parole des évêques catholiques proposée dans le cadre de débats moraux. Le premier temps de notre démarche sera consacré (...) à la réflexion d’André Naud sur l’éthique de la parole épiscopale. Cette réflexion tardive dans la production théologique de Naud n’a pas été, à notre connaissance, l’objet d’une étude approfondie. Sans prétendre offrir une analyse complète et définitive de ce travail, mais tout en soulignant son caractère pionnier, nous en cernerons les limites pour notre réflexion. Le deuxième temps de la démarche montrera la pertinence du paradigme éthique de la responsabilité pour réfléchir à l’éthique de la parole épiscopale dans l’espace public. Enfin, penser l’éthique de la parole publique des croyants en l’inscrivant dans le paradigme de la responsabilité est un geste théologique, certes, mais il s’appuie sur une pratique, soit celle de la prise de parole à Vatican II. Plus précisément, c’est dans la Constitution pastorale Gaudium et Spes qu’une « pratique » de la responsabilité s’est manifestée. Cette pratique est en fait une pragmatique que nous mettrons en lumière, dans la troisième partie de l’article, par une analyse rhétorique de l’énonciation qui a prévalu dans la rédaction de la Constitution pastorale. | : The object of this article is the identification of some lineaments of an ethics of the believing word in the public space of our democracies. This ethics will be elaborated starting with the notion of style, a notion resulting from recent researches on the hermeneutics of the Vatican II Council. We propose a three-part approach on quite a precise object, namely the word of Catholic bishops uttered within the framework of moral debates. The first part of our approach will dwell on André Naud’s reflection upon the ethics of the episcopal word. This later reflection within Naud’s theological production has not so far been, to our knowledge, the object of a thorough study. Without pretending to offer a complete and definitive analysis of that work, but nevertheless underscoring its pioneer character, we will identify its limits for our reflection. The second part of the approach will show the relevance of the ethical paradigm of responsibility in order to reflect on the ethics of the episcopal word in the public space. Finally, to think out the ethics of the public word of believers while setting it within the paradigm of responsibility is a theological gesture, to be sure, but it is based on a practice, namely that of speaking at Vatican II. More precisely, it is in the Pastoral Constitution Gaudium et Spes that a “practice” of responsibility was manifested. That practice is in fact a pragmatic which, in the third part of the article, we will shed light on through a rhetorical analysis of the enunciation that prevailed in the wording of the Pastoral Constitution. This article suggests a fresh look at gauge symmetries, with the aim of drawing a clear line between the a priori theoretical considerations involved, and some methodological and empirical non-deductive aspects that are often overlooked. The gauge argument is primarily based on a general symmetry principle expressing the idea that a change of mathematical representation should not change the form of the dynamical law. In addition, the ampliative part of the argument is based on the introduction of new degrees of (...) freedom into the theory according to a methodological principle that is formulated here in terms of correspondence between passive and active transformations. To demonstrate how the two kinds of considerations work together in a concrete context, I begin by considering spatial symmetries in mechanics. I suggest understanding Mach's principle as a similar combination of theoretical, methodological and empirical considerations, and demonstrate the claim with a simple toy model. I then examine gauge symmetries as a manifestation of the two principles in a quantum context. I further show that in all of these cases the relational nature of physically significant quantities can explain the relevance of the symmetry principle and the way the methodology is applied. In the quantum context, the relevant relational variables are quantum phases. (shrink)

Philosophers have long been involved in the pursuit of a goal shared by researchers in psychiatry and the cognitive sciences: understanding the relationship between the functioning of the human mind and human well-being or suffering. For this reason there is a very large area of overlap between philosophical and psychiatric research. The overlap is particularly significant in the domain of practical ethics, which is concerned with understanding the moral dimension of policies and actions in the real world. This chapter reviews (...) two distinct domains in which psychiatry and practical ethics overlap. First, issues in practical ethics arise out of new advances in psychopharmacology, including clinical and non-clinical use of new antidepressants drugs, the clinical use of placebo medications, and psychiatric drugs which enhance human cognition; these issues are frequently grouped under the banner of "neuroethics." Second, the understanding of fundamental questions in moral philosophy is being driven forward by evidence from psychology and psychiatry. Evidence from autism and the personality disorders is shedding light on the nature of moral motivation, while evidence from addiction and compulsion is generating progress in understanding moral responsibility. Finally, some areas are highlighted in which the science of psychiatry may benefit from the application of existing work in moral philosophy and practical ethics. (shrink)

What is the status of faith-based discourse (and by extension, of the discourse of conviction) in societies characterized by a plurality of moral and religious options? How do the various factions found within a pluralized public setting receive faith-based discourse? Moreover, how does a faith-based speaker square the self-affirmative move towards the other with his or her own particular beliefs? These concerns raise the questions of “what one should do” and “how one should speak” in order to maintain a lively (...) and liveable tension between affirming one’s convictions, on the one hand, and nurturing social cohesion, on the other. Despite the negative judgement which has been cast upon the art of persuasion since the beginning of modernity, a rhetorical approach to these questions is possible ; one which I will endeavour to demonstrate in this article. I begin by pleading, along with many other contemporary authors, for a return to a right understanding of rhetoric. The art of persuasion offers a fruitful theoretical framework for developing a heuristics aimed at understanding faith-based discourse in the context of liberal democracy. Rhetoric can in no way be reduced to mere ideological manipulation. I continue reflecting on these questions by presenting two models for faith-based discourse in the public sphere, viz., the models proffered by Hollenbach and O’Malley, both of whom reflect on Vatican II. The note puts forward the idea of revealed desirability, a novel instrument, which like revealed preference is observable from choice and important for individual and social welfare. We provide the axiomatic underlying individual’s choice model, preliminary experimental results that support the idea, and an appealing allocation rule that uses the revealed desirability information along with the revealed-preference information.

I address the recent debate between Meehan and Vaidman concerning the claim made by the former for a new problem to quantum mechanics. I argue that while Meehan's incompatibility claim does hold in the situation he presents, it does not genuinely involve considerations that can limit quantum state preparation, nor does it introduce new constrains over possible interpretations of quantum theory.

Moral and self-conscious emotions like guilt and shame can function as internal negative experiences that punish or deter bad behaviour. Individual differences exist in people’s tendency to experience guilt and shame. Being disposed to experience guilt and/or shame may predict students’ expectations of their emotional reactions to engaging in immoral behaviour in the form of academic misconduct, and thus dissuade students from intending to engage in this behaviour. In this study, students’ (n = 459) guilt and shame proneness, their expectations (...) of feeling guilt and shame if they engaged in academic misconduct, and their intentions to engage in academic misconduct were measured. Three of the four facets of the guilt and shame proneness scale [GASP: Guilt–Negative-Behavior-Evaluation (NBE), Guilt-Repair, Shame–Negative-Self-Evaluation (NSE)] had significant negative correlations with academic misconduct intentions, and these relationships were mediated by anticipating shame and guilt related to engaging in academic misconduct. These results suggest that for some students expecting to experience negative moral emotions when engaging in academic misconduct may protect them from breaching ethical assessment rules. (shrink)

Pourtant, des questions de fond n’ont jamais reçu de réponse satisfaisante, et ont laissé le sentiment d’une doctrine inachevée et inachevable. Trois observations contribuent à cette insatisfaction : la quasi-absence d’une telle problématique chez Thomas d’Aquin, les désaccords entre certains points de la théorie ainsi (...) qu’entre les auteurs, et les incompatibilités avec certains thèmes centraux de la philosophie de Thomas d’Aquin. - Abstract: The theme of the Metaphysics of the act of being has known a never denied success over the last century, with authors like Gilson, Maritain or Fabro, to name only the most famous. Nevertheless, some important questions have never been fittingly answered, and have left the feeling of an unachieved and unachievable doctrine. Three observations contribute to this disappointment : a quasi-absence of such a problematic in Thomas Aquinas, contradictions between certain points of the theory as well as between the authors, and incompatibilities with certain central themes of the philosophy of Thomas Aquinas. This comment questions the relevance of the Stag Hunt model, employed by Alan Hyde in his contribution to this volume, to the context of international labor standards. Despite Hyde's insistence to the contrary, it is argued that in some cases child labor could create a comparative advantage to developing countries. This shows the difficulty with Hyde's reliance solely on market failures to justify international labor standards. The exclusion of other justifications results in an extremely diluted international labor law.

Israeli courts were recently faced with the question whether an employer is allowed to voice objections to unionization during an organizing drive. Since the legislation fails to provide an answer to this question, it was up to the courts to come up with a solution. The National Labor Court in Histadrut v. Pelephone held that employers have no say and must refrain from any communications whatsoever with the workers regarding the decision whether or not to join the union. The Supreme (...) Court later affirmed this decision. This Article explores this legal question and examines whether this decision was justified, and whether it should be adopted in other countries as well. It first discusses the justifications for the conflicting freedoms in this scenario — the workers’ freedom of association and the employer’s freedom of speech — to appreciate their relative strength in the circumstances. It then examines whether it is possible to achieve a certain balance. To this end, the Article critically reviews the legal mechanisms adopted by other legal jurisdictions in this regard, shedding light on their effectiveness and the difficulties of organizing in practice in each jurisdiction. The main argument advanced in this Article is that the solution has to be purposive — to advance the goals of labor law, specifically freedom of association — and that the purposive analysis must be contextual. A rule prohibiting the employer from voicing opinions is surely an infringement of freedom of speech, and strong reasons are needed to justify it. Whether strong enough reasons exist depends on several contextual factors. Essentially, the question is whether it is possible, given the current context, to secure real freedom of association without such a rule. By context we mean two main things: first, the real-life current experience concerning the struggles of organizing; and second, the existence of alternative legal mechanisms that might address this problem. Dans cet ouvrage, où il s'agit d'appréhender l'univers pascalien sur le plan apologétique, on suit le cheminement de la foi de Pascal à partir de fragments retrouvés après sa mort, textes à l'origine des différentes éditions des Pensées. La structure antithétique et paradoxale de son génie l'a conduit à une quête religieuse sans concession à l'égard de la société de son temps. La fonction dualiste de son écriture aboutit à mettre en valeur la béance séparant le fini de la nature (...) humaine de l'infini de la grâce de Dieu. Seule la médiation christique dans l'histoire a pu combler ce vide de l'homme dans l'humilité de la foi. L'aspect novateur de la quête pascalienne expliquerait alors en grande partie le côté inachevé des papiers. Cinq appendices visent à mettre le texte pascalien face aux modes de pensée du XVIIe siècle. La richesse du texte pascalien demeure malgré tout inépuisable. (shrink)

Ce fut celui de Guy Suarès (1932-1996), homme de théâtre, de radio et de télévision, qui s'est particulièrement attaché, par ses traductions et ses mises en scène, à mieux faire connaître la culture hispanique (Lorca, Neruda, Bergamin...) et a dirigé la Comédie de la Loire à Tours à l'invitation d'André (...) Pedro Abelardo apresenta na sua obra uma teoria da virtude de natureza, à primeira vista, aristotélica. Ao que parece, essa concepção também contém diferentes elementos estoicos, que não se opõem necessariamente à visão do Estagirita. Todavia, o essencial da interpretação da Escola do Pórtico acerca da virtude difere da explicação dada por Aristóteles. No presente estudo, pretendemos examinar, primeiro, a índole da virtude como habitus na obra de lógica de Abelardo. Nesse caso, não há dúvida de que predomina a influência (...) aristotélica. Em seguida, indicamos outras particularidades da virtude encontradas, desta vez, em tratados éticos e teológicos do nosso protagonista, as quais se revelam antes de caráter estoico. Em suma, projetamos identificar as diferentes fontes antigas e os principais intermediários latinos usados por Abelardo para elaborar a sua própria teoria da virtude. Trata-se de deixar clara a influência filosófica dominante em Abelardo sobre essa questão da virtude, já que este lógico não pode harmonizar teses substancialmente inconciliáveis. Peter Abelard in his work presents a theory of virtue, which is, at first sight, of Aristotelian nature. It seems that this view also contains different Stoic elements, but they are not necessarily opposed to Stagirite's vision. However, the essentials of the Stoa School about virtue differ from the explanation given by Aristotle. In this paper, we intend to examine, first, the nature of virtue as habitus in Abelard's work on logic. In this case, there is no doubt that Aristotle's influence on this topic predominates. Next, we specify other features related to virtue found, this time, in ethical and theological treatises of our protagonist that appear to be basically Stoic. In short, we want to identify the different ancient sources and the main Latin mediators used by Abelard to elaborate his own theory of virtue. In other words, we would like to shed light on the predominant philosophical authority on Abelard's theory of virtue since this logician cannot harmonize theses that are fundamentally irreconcilable. Gauge symmetries provide one of the most puzzling examples of the applicability of mathematics in physics. The presented work focuses on the role of analogical reasoning in the gauge argument, motivated by Mark Steiner’s claim that the application of the gauge principle relies on a Pythagorean analogy whose success undermines naturalist philosophy. In this paper, we present two different views concerning the analogy between gravity, electromagnetism, and nuclear interactions, each providing a different philosophical response to the problem of the applicability (...) of mathematics in the natural sciences. The first is based on an account of Weyl’s original work, which first gave rise to the gauge principle. Drawing on his later philosophical writings, we develop an idealist reading of the mathematical analogies in the gauge argument. On this view, mathematical analogies serve to ensure a conceptual harmony in our scientific account of nature. We further discuss the construction of Yang and Mills’s gauge theory in light of this idealist reading. The second account presents a naturalist alternative, formulated in terms of John Norton’s account of a material analogy, according to which the analogy succeeds in virtue of a physical similarity between the different interactions. This account is based on the methodological equivalence principle, a simple conceptual extension of the gauge principle that allows us to understand the relation between coordinate transformations and gravity as a manifestation of the same method. The physical similarity between the different cases is based on attributing the success of this method to the dependence of the coupling on relational physical quantities. We conclude by reflecting on the advantages and limits of the idealist, naturalist, and anthropocentric Pythagorean views, as three alternative ways to understand the puzzling relation between mathematics and physics. The paper portrays the influence of major philosophical ideas on the 1935 debates on quantum theory that reached their climax in the paper by Einstein, Podosky and Rosen, and describes the relevance of these ideas to the vast impact of the paper. I claim that the focus on realism in many common descriptions of the debate misses important aspects both of Einstein's and Bohr's thinking. I suggest an alternative understanding of Einstein's criticism of quantum mechanics as a manifestation of the (...) same methodological principles that served him in the construction of the special and the general theories of relativity. These principles address, in a very specific way, the relation of the theoretical mathematical representations to the represented physical systems. These ideas, I claim, played a key role in the influence of the paper on later works that changed our understanding of quantum theory despite the rejection of EPR's central conclusion. (shrink)
