Frege claims that the laws of logic are characterized by their “generality,” but it is hard to see how this could identify a special feature of those laws. I argue that we must understand this talk of generality in normative terms, but that what Frege says provides a normative demarcation of the logical laws only once we connect it with his thinking about truth and science. He means to be identifying the laws of logic as those that appear in every (...) one of the scientific systems whose construction is the ultimate aim of science, and in which all truths have a place. Though an account of logic in terms of scientific systems might seem hopelessly antiquated, I argue that it is not: a basically Fregean account of the nature of logic still looks quite promising. Plotinus is the first Greek philosopher to hold a systematic theory of consciousness. The key feature of his theory is that it involves multiple layers of experience: different layers of consciousness occur in different levels of self. This layering of higher modes of consciousness on lower ones provides human beings with a rich experiential world, and enables human beings to draw on their own experience to investigate their true self and the nature of reality. This involves a robust notion of (...) subjectivity. However, it is a notion of subjectivity that is unique to Plotinus, and remarkably different from the Post-Cartesian tradition. Behind the plurality of terms Plotinus uses to express consciousness, and behind the plurality of entities to which Plotinus attributes consciousness, lies a theory of human consciousness. It is a Platonist theory shaped by engagement with rival schools of ancient thought. (shrink)

Why does Frege claim that logical axioms are ‘self‐evident,’ to be recognized as true ‘independently of other truths,’ and then offer arguments for those axioms? I argue that he thinks the arguments provide us with the justification that we need for accepting the axioms and that this is compatible with his remarks about self‐evidence. This compatibility depends on philosophical considerations connected with the ‘critical method’: an interesting approach to the justification of axioms endorsed by leading philosophers at the time.

Commentators regularly attribute to Frege realist, idealist, and quietist responses to metaphysical questions concerning the abstract objects he calls ‘thoughts’. But despite decades of effort, the evidence offered on behalf of these attributions remains unconvincing. I argue that Frege deliberately avoids commitment to any of these positions, as part of a metaphysical separatist policy motivated by the fact that logic is epistemologically autonomous from metaphysics. Gordon Baker in his last decade published a series of papers (now collected in Baker 2004), which are revolutionary in their proposals for understanding of later Wittgenstein. Taking our lead from the first of those papers, on "perspicuous presentations," we offer new criticisms of 'elucidatory' readers of later Wittgenstein, such as Peter Hacker: we argue that their readings fail to connect with the radically therapeutic intent of the 'perspicuous presentation' concept, as an achievement-term, rather than a kind of 'objective' mapping (...) of a 'conceptual landscape.' Baker's Wittgenstein, far from being a 'language policeman' of the kind that often fails to influence mainstream philosophy, offers an alternative to the latent scientism of Wittgenstein's influential 'elucidatory' readers. Workplace bullying is a significant issue confronting the nursing profession. Bullying in nursing is frequently described in terms of ‘oppressed group’ behaviour or ‘horizontal violence’. It is proposed that the use of ‘oppressed group’ behaviour theory has fostered only a partial understanding of the phenomenon in nursing. It is suggested that the continued use of ‘oppressed group’ behaviour as the major means for understanding bullying in nursing places a flawed emphasis on bullying as a phenomenon that exists only among nurses, (...) rather than considering it within the broader organisational context. The work of Foucault and the ‘circuits of power’ model proposed by Clegg are used to provide an alternative understanding of the operation of power within organisations and therefore another way to conceive bullying in the nursing workforce. Plotinus holds an important position in the history of late ancient philosophy on the concept of human agency. On the one hand, he follows Plato in regarding a human agent as one who self-identifies with the rational soul, becomes one from many, and acts from reason (Republic, 443de). On the other hand, due to the view characteristic of the second century CE that destiny causally determines the sensible world and sophisticated debates concerning freedom and determinism up to, and during, the (...) second century CE, Plotinus develops Plato’s view further in an effort to meet the challenges posed by earlier determinists. The position he develops in the Enneads is a dynamic synthesis of Platonic, Peripatetic, Stoic, and Middle-Platonic theorizing on human causation that shows how one can be a self-determining agent even while living in a world governed by destiny. I argue that the key to understanding Plotinus’ theory of human agency is to understand the role that consciousness plays since he holds that in order to be the sole causal source of our actions, and therefore truly self-determining, we must derive our premises for action from Intellect. Important for my purposes is his peculiar view that Intellect is also “in ourselves” (V.1.10.5-8) and can be reached by turning inwards and ascending upwards which is possible through possessing a unique mode of consciousness, namely awareness (sunaisthēsis). This book offers a radical challenge to accounts of the common law's development. Contrary to received jurisprudential wisdom, it maintains there is no grand theory which will explain satisfactorily the dynamic interactions of change and stability in the common law's history. Offering original readings of Charles Darwin's and Hans-Georg Gadamer's works, the book shows that law is a rhetorical activity that can only be properly appreciated in its historical and political context; tradition and transformation are locked in a mutually reinforcing (...) but thoroughly contingent embrace. In contrast to the dewy-eyed offerings of much contemporary work, it demonstrates that, like life, law is an organic process rather than a miraculous one. In short, common law is a perpetual work-in-progress - evanescent, dynamic, messy, productive, tantalising, and bottom-up. (shrink)

This book explores eight exemplary cases from the United Kingdom, the United States and Australia that show the law as a living, breathing and down-the-street experience. It explores the social circumstances in which the cases arose and the ordinary people whose stories influenced and shaped the law as well as the characters and institutions that did much of the heavy lifting. By examining the consequences and fallout of these (...) decisions, the book depicts the common law as an experimental, dynamic, messy, productive, tantalizing and bottom-up process, thereby revealing the diverse and uncoordinated attempts by the courts to adapt the law to changing conditions and shifting demands. I meet many people who think that the evils of Communism can be combated by Catholicism. This seems to me a dangerous error. What are the evils of Communism as it has developed? First, adherence to a rigid and static system of doctrine, of which part is doubtful and part demonstrably false. Second, persecution as a means of enforcing orthodoxy. Third, a belief that salvation is only to be found within the Church and that the True Faith must be spread throughout the world, by force if necessary. (These are the beliefs of Communists.) Fourth, that the priesthood, which alone has the right to interpret the Scriptures, has enormous power, physical east of the Iron Curtain and spiritual over the faithful in partibus. Fifth, that this power is used to secure an undue share of wealth for the priesthood at the expense of the rest of the population. Sixth, that bigotry, and the hostility that it engenders, is a potent source of war. Every one of these evils was exhibited by the Catholic Church when it had power and would probably be exhibited again if it recovered the position it had in the Middle Ages. Any effort to understand how law works has to take seriously its main players – judges. Like any performance, judging should be evaluated by reference to those who are its best exponents. Not surprisingly, the debate about what makes a 'great judge' is as heated and inconclusive as the debate about the purpose and nature of law itself. History shows that those who are candidates for a judicial hall of fame are game changers who oblige us to rethink what it (...) is to be a good judge. So the best of judges must tread a thin line between modesty and hubris; they must be neither mere umpires nor demigods. The eight judges showcased in this book demonstrate that, if the test of good judging is not about getting it right, but doing it well, then the measure of great judging is about setting new standards for what counts as judging well.
