This article looks at the mutual relations and links between globalisation and the integration of countries within the European Union. As the economic sphere is undergoing unrestrained globalisation, the position and sovereignty of nation-states is being weakened and politics is becoming harnessed to the economy. The relationship between the economy and politics is thus changing and there is a need to regulate the economy at a supranational level. The European Union has the potential to make (...) positive use of the trend towards globalisation and limit its negative impacts on the economic, social, ecological and cultural levels. This requires, however, deeper integration and further harmonisation of the countries of the European Union in the economic and political spheres. In order for the countries to come closer together, as the current situation requires, a European people (or demos) and a European public space must be created. (shrink)

The European Union approach to data protection consists of assessing the adequacy of the data protection offered by the laws of a particular jurisdiction against a set of principles that includes purpose limitation, transparency, quality, proportionality, security, access, and rectification. The EU's Data Protection Directive sets conditions on the transfer of data to third countries by prohibiting Member States from transferring to such countries as have been deemed inadequate in terms of the data protection regimes. In theory, each (...) jurisdiction is evaluated similarly and must be found fully compliant with the EU's data protection principles to be considered adequate. In practice, the inconsistency with which these evaluations are made presents a hurdle to international data-sharing and makes difficult the integration of different data-sharing approaches; in the 20 years since the Directive was first adopted, the laws of only five countries from outside of the EU, Economic Area, or the European Free Trade Agreement have been deemed adequate to engage in data transfers without the need for further administrative safeguards. The most urgent problem facing the European Union is to develop the best approach to conflicts over integration in the fields of culture, economics and foreign policy. The essay argues that a particular form of democratic integration is better than the two predominant approaches. This approach draws on the actual practices of the democratic negotiation of integration that citizens engage in on a daily basis but which tend to be overlooked and overridden in the dominant (...) approaches. The dialogic relationship between individuals and the cultural space of Europe embodies cultural definitions, political definitions and individual definitions. As individuals draw from Europe as a cultural space and strive to identify and define themselves, definitions are created against an “other,” leading to Europe being defined against the “other.” Identity is established through difference, and in this, the relationship between the EU—a force of integration—and Europe as a cultural space is strained. As boundaries change through the European (...) class='Hi'>Union, transforming the cultural space of Europe, the “other” against whom individuals have traditionally defined themselves is also transforming. This article asks if the integration of Europe through the European Union is resulting in the political mobilization of xenophobia and thereby transforming the cultural space of Europe into a xenophobic space. As many academics and professionals have argued that xenophobia in Europe has been on the rise since the 1990s, this paper will question how the relationship between the European Union—as a force of European integration—and Europe—as a cultural space—is contributing to the construction of xenophobia. This essay deals with conditions, challenges and perspectives concerning the legal system of the European Union after the Lisbon treaty has entered into force. It starts out by recalling constitutional principles such as primacy, direct effect and consistent interpretation of the European legal order on the one hand and the relationship of cooperation between the Court of Justice and national courts – notably pointing out the importance of the preliminary procedure (Article 267 TFEU) – on the other (...) hand. In addition, characteristics of the legal system of the European Union such as the integration of national legal systems are highlighted. It is accentuated that the legal community of the European Union depends on the acceptance by all 27 Member States. Furthermore, the normative quality of European law-making is discussed as well as the necessity for a sufficient democratic legitimation of European Law. As impressively illustrated by the financial crisis, the European Union is much better equipped with possibilities to effectively fulfil regulatory tasks than any Member State. The author shows developments with regard to European Union citizenship, non-discrimination, the Charter of Fundamental Rights - that is now equipped with binding character – and the vertical distribution of competences between the European Union and the Member States, including explanations relating to subsidiarity requirements and their judicial review. The purpose of the present contribution is to explore how the ECJ seeks to respect the principles underpinning national welfare systems, notably social solidarity, whilst ensuring that Member States comply with the substantive law of the European Union, in particular with the Treaty provisions on the fundamental freedoms and EU citizenship. It is submitted that in order to reconcile those two interests the ECJ has taken the view that nationals of the host Member State must show a certain (...) degree of financial solidarity with the nationals of other Member States who have established a ‘genuine or real link’ with the society of that State. With a view to establishing the existence of such a link, national authorities of the host Member State must engage in a case-by-case assessment of the personal circumstances of the EU citizen claiming social benefits. However, Förster is an important exception to the individual application of the ‘genuine or real link’ test. Although Förster does not overrule Bidar as a matter of principle, it exempts the host Member State from examining the personal situation of economically inactive students who apply for maintenance grants or student loans but have not yet completed a five-year period of residence. It explains that political theorists and scientists alike have viewed European integration as a laboratory for exploring how far the nation state, and the forms of domestic and international politics to which it gave rise, has been affected by the various processes associated with globalization. It discusses the Charter of Rights and Constitutional Treaty of the EU and suggests that the EU can be plausibly characterized as (...) an intergovernmental organization of an advanced kind, a nascent federation of states, and a new form of post-national and post-state entity. Political theorists aiming to articulate normative standards for the EU have almost entirely focused on whether or not the EU suffers from a ‘democratic deficit'. Almost nothing has been written, by contrast, on one of the central values underpinning European integration since at least the European Coal and Steel Community (ECSC), namely solidarity. What kinds of principles, policies, and ideals should an affirmation of solidarity commit us to? Put another way: what norms of socioeconomic justice ought to (...) apply to the EU? This is not an empirical or narrowly legal question. We are not trying to gauge the degree of attachment there currently is in the EU by, for example, citing the latest Eurobarometer poll. We are also not attempting to state the implicit rationale followed by the Court of Justice in its recent ‘solidarity’ jurisprudence, let alone trying to fix what the Commission might mean by it. In this article, I ask the more fundamental question underlying both the legal and the empirical questions: What principles of social solidarity ought to apply between states and citizens of the emerging European polity? This question has rarely been asked or answered by political theorists in an EU context, so we are entering largely uncharted territory. The article develops a tripartite model of EU solidarity in Section 2, and then applies it to the case of free movement of persons in Section 3. (shrink)

The supranational law of the European Union represents a uniquely powerful, far-reaching, and controversial instance of the growth of international legal governance, one that has forever altered the political and legal landscape of its Member States. The European Union is strategically committed to the development of nanotechnology and its industrial exploitation. However, nanotechnology also has the potential to disrupt human health and the environment. The EU claims to be committed to the safe and responsible development of nanotechnology. In this sense, the EU has become the first governing body in the world to develop nanospecific regulations, largely due to legislative action taken by the European Parliament, which has compensated for the European Commission’s (...) reluctance to develop special regulations for nanomaterials. Nevertheless, divergences aside, political bodies in the EU assume that nanotechnology development is controllable and take for granted that both the massive industrial use of nanomaterials and a high level of environmental and health protection are compatible. However, experiences such as the European controversy over agri-food biotechnology, which somewhat delegitimized the regulatory authority of the EU over technological safety and acceptability, arguably show that controllability assumptions are contestable on the grounds of alternative socio-economic and cultural preferences and values. Recently developed inclusive governance models on safety and innovation, such as “Responsible Research and Innovation”, widely claim that a diversity of considerations and issues are integrated into R&D processes. Even so, the possibility of more radically alternative constitutions of socio-technical safety seems to be seriously limited by the current ideology of innovation and economic imperatives of the global, knowledge-based, capitalist economy. The European Union’s common agricultural policy (CAP), in addition to its primary production and farm income goals, is a large source of funding for environmentally friendly agricultural practices. However, its schemes have variable success and uptake across member states (MS) and regions. This study tries to explain these differences by demonstrating differences between policy levels in the understanding of the relationship between nature and farming. To compare constructs and values of the respective policy communities, their discursive construction as (...) it appears in the main strategic EU and MS agricultural policy documents is analysed. The theoretical framework integrates elements from existing frameworks of CAP and environmental discourse analysis; specific agri-environmental discourses, their elements and interplay, are identified. The six discourses suggested here are ‘Productivism’, ‘Classical neoliberal’, ‘Ecological modernisation’, ‘Administrative’, ‘Multifunctionality’ and ‘Radical green’. The discourse analysis of selected documents reveals that there are indeed differences in how farming and the environment are generally conceptualised at different levels of CAP decision-making. At EU level, farming is primarily understood as a sector whose main task is to produce food (‘Productivism’), and the environment is used as a justification for CAP payments (‘Multifunctionality’). At the national/regional level, Rural Development Programmes reflect different value systems: in England, environmental protection is mainly seen as sound management of natural capital (‘Classical neoliberal’); in Finland, a benefit for producers and conscious consumers (‘Ecological modernisation’); in Croatia, a necessity limiting productivity (‘Productivism’) and imposed by an external authority (‘Administrative’ discourse). This diversity shows that differences can visibly manifest despite the Commission constraining the discursive space, helping to explain the differential implementation and success of environmental measures. The European Union (EU) has been challenged by several crises lately. In addition to Brexit, the Euro crisis, and the migration crisis; global issues such as the coronavirus pandemic and the Russian attack on Ukraine affected the EU. The migration crisis, on the one hand, differs from the above-mentioned crises with one remarkable feature. The member states have no real consensus about forming a common migration policy. Besides, for geographic reasons, some member states put much more burden on (...) immigrants. Agreeing on immigration becomes impossible for the border countries on the migration route and also transit countries. The paper argues that, unlike the other crises of the EU, the migration crisis reinforces EU integration in such a way that disputes between member states prevent the EU from making institutional changes about the issue. The study results assume that the other above-mentioned crises, on the other hand, stimulated institutional change throughout the EU. In light of this information, this study evaluates, using a method of relevant literature review and comparing the arguments of the researchers, how the migration issue became a subject of dispute between member states by evaluating the 2015 crisis. The concept of Europeanization has become very popular in studies of European integration and particularly in analyses on the post-communist countries undergoing extensive transformation on the road to European Union membership. Although the Europeanization process has been quite successful in the countries of Central and Eastern Europe (CEE), the same scenario has not played out in the western Balkans region. With the purpose of analysing the effectiveness and impact of the Europeanization process in the western Balkans, (...) the main subject of the paper is Bosnia and Herzegovina’s EU-related reform processes. Although Bosnia has been undergoing thorough Europeanizing reforms since the late 1990s, when the country entered the Stabilization and Association Process (SAP), it is still an unstable and dysfunctional country. That makes it the perfect case for assessing the possible shortcomings of the Europeanization process. Thus far, most scholars have concluded that domestic political elites in Bosnia are the only party responsible for Bosnia’s political deadlock. However, this paper analyses the continued Bosnian deadlock from a different perspective, trying to figure out the degree of responsibility the European Union shares in the country’s Europeanization process. Although uncooperative Bosnian political elites are to a great extent responsible for the continued political and social status quo, EU leaders are not faultless either. In fact, so far European leaders have often appeared to be deeply divided, incoherent, and short-sighted in terms of Europeanization policies in Bosnia, thus further deepening the political deadlock in the country. Therefore, we can ask whether Bosnia represents a litmus test which the EU has failed. (shrink)

It is a fact that in the European Union there is a strengthening of right-wing extremism, radical right movement, populism and nationalism. The consequences of the economic crisis, such as a decline in living standards, losing of jobs, rising unemployment especially among young people, undoubtedly goes in favor of strengthening the right-wing extremism. In the research, forms of manifestation will be covered of this dangerous phenomenon and response of the institutions. Western Balkan countries, as a result of right-wing (...) extremism, are especially sensitive region on possible consequences that might occur, since there are several unresolved political problems, which can very easily turn into a new cycle of conflicts, if European integration processes get delayed indefinitely. Legal concepts and notions are deeply affected by religions, ethics, philosophy and the culture of a particular nation. As Friedman Comparing legal cultures, Dartmouth, Aldershot, 1997, p. 34) highlights, understanding legal culture is a crucial factor as it both affects their translation and interpretation and consequently has an impact on the application of law. This increases in importance, for example, in the context of the principle of mutual trust and recognition of judgments assumed by the European Union as (...) the cornerstone of judicial co-operation in the European Union, which would not be possible without the trust in each other’s justice system and the respect for the different legal systems and traditions of the Member States. In that vein, ‘the Third Space’, where legal concepts and notions of multiple origins meet and where their meanings are negotiated, transformed, translated and integrated into various socio-political and cultural contexts has acquired an immense significance. Although there may be natural similarities between legal professions in the European Union, they could differ quite substantially as they are deeply rooted in the history and societal evolution of a country; therefore, they are generally regulated at a national, not a European level. In light of the above, the author intends to perform an in-depth analysis of key terminology in the field of names of legal professions which exist in the Member States of the European Union. The author focuses on the terms which refer to the legal profession of lawyers as they might pose obstacles in translation and interpretation due to different functions and roles these legal professionals play in their legal systems or due to the lack of their equivalents in other legal systems. The terminology is compared to present similarities and differences in their meaning, particularly putting some emphasis on socio-political and cultural contexts. The research methods encompass the analysis of relevant literature and the terminological analysis of the research material, which includes the information on legal professions provided by particular Member States on the European e-Justice portal and relevant national regulations in that respect. Finally, the author draws the conclusion that a thorough analysis of the functions and roles of a particular legal profession in socio-political and cultural contexts is required before the translation and interpretation of the term is provided as it helps to avoid ambiguity and makes legal communication precise. Political integration in the European Union creates the need for a common means of communication among the various linguistic communities in Europe. One way of meeting this need is unilingualism: the use of a single language as a "lingua franca". While this option has been thought to be efficient, this does not mean that we should necessarily choose it. This paper argues that a unilinual Europe will inevitably be unfair despite recent attempts to show otherwise, since non-native (...) speakers of the lingua franca will pick up the costs of learning it while native speakers can free-ride on their efforts. This unfairness provides a reason for preferring alternative means of facilitating communication. In particular, multilingualism - communication through translators and interpreters - may be preferable. (shrink)

The problems of the functioning of religion in the countries of the European Union are extremely complex and ambiguous. The EU is primarily political and economic. It is in these areas that active intra-integration processes are observed: introduction of a single currency, single payment system, actual “blurring” of borders between member states, development of the Constitutional Treaty, orientation towards the creation of a common market, a common transport network, harmonization of educational systems, etc.

What principles of political justice ought to apply to the European Union? This question is particularly relevant considering the deepening integration process that resulted from the crises of the past decade. Habermas’s conception of a transnational democracy allows identification of the methodological components of transnational political justice: to unite in a transnational polity, people belonging to different national communities need a common purpose, principles governing the distribution of constitutional and legislative power and a common political infrastructure that (...) allows them to form democratic will as free and equal citizens. This article attempts to further expand these points through a public goods approach. European policies generate European public goods. These must be produced and accessed based on a fair cooperation scheme. Identifying these specific fairness conditions allows further clarification on how legislative and constitutional power ought to be distributed within the European polity. (shrink)

The purpose of this work is to bring the legal status of third-country citizens closer to that of member states, as a different special regime according to the relative agreements concluded for certain categories of foreigners without disregarding the value of some elements of fact, such as residence, family ties, performance of specific economic activities or interests of international politics for respect of these obligations, with the not always uniform content that the union evidently had to entrust to member (...) states a union of intent through “supervision" as well as the interpretation carried out by The Court of Justice of the European Union which has strongly reduced state's competences aiming at a European integration still in progress and especially after Brexit. Europe is a melting pot of diverse cultures, civilizations and amalgamation of various ethnicities. It is a land which faced many catastrophes, high intensity conflicts and wars. Two world wars have been fought on this land. Almost all the major nations participated directly or indirectly at massive scale. Franco-German axis is a term to explain the relations of both the countries in the context of their mutual cooperation and their significant role in contemporary political affairs of Europe. Post war era (...) 1945, congenial atmosphere of synchronization between both the countries replaced three century old French- German hostility. This tandem performed active role not only in the politically integrated European nation but also they played a vital role in the formation of single currency euro as well. Comparatively their functioning is becoming slow but they are still necessary for future of Europe. It is a general impression that the FrancoGerman alliance is facing critical phase, or in other words they are no longer being capable to act as the twin motor of European integration but Euro pe do not have an appropriate replacement. As far as the future of Franco-German relationship or leadership is concerned it acted necessary of European Union’s twin motor in the past but in recent years national interest became more supreme than the interest of European Union as a whole. The article offers a concise view on the problems related to the compatibility of the religious clauses in the Polish Constitution with the principles and standards of the European Union and with the constitutional regulations of other individual member states. The author particularly demonstrates to what extent Poland is different or even unable to enter this community and fully participate in the integration of the continent. In the first part of the article, the author studies the content (...) of the Polish basic law provisions on religion, in the second—the corresponding European Union regulations and similar rules in force in the individual nations of the continent. The article concludes that the constitutional provisions on religious matters demonstrate that regulations in the Polish basic statute are not more confessional than those established in other European Union countries. But the current trend indicates several interesting features structurally different, or asymmetric, to the experiences with the evolution of key notions of political philosophy in relation to the past experience with the development of statehood. Most of what has been written on the ECSC/ EEC/ EC/ EU, has not been done by international relations (IR) theorists, but by comparativists, sociologists, historians, anthropologists, legal scholars, and many others. These writings are in general classified as intergovernmentalist, federalist, and supranationalist (functionalist and neo- functionalist) in most accounts of the theoretical perspectives on the EU (Webb 1983, Rosamond 2000). Wiener and Diez 2004 add a rational choice institutional category, as well, as they think that the policy analysis within (...) the polity developed into an autonomous brand of literature. It is only Andrew Hurrell in his chapter in Fawcett and Hurrell 1995, who makes an attempt to present the EU, as a regional integration, from the point of view of diverse IR approaches. Drawing on his classification scheme, I conduct an inquiry of the IR theories about European unification from the point of view of whether they allow for the iteration of the European experience in other parts of the world or not. The basic conclusion is that almost all IR work on Europe falls in the inter- governmentalist category, which tends to conceptualize the European Union as representing an n of 1. (Inter- governmentalism is the choice of realism and neo-realism, English School, and neoliberal institutionalism.) Within the liberal IR paradigm, there is a tension between law-focused and security-focused approaches, on the one hand, and economic approaches, on the other. The first believe in the possibility of multiple integrations, while the latter does not think that they are desirable. Ordoliberalism is often recognized as a powerful ideational source during the Euro crisis; however, there is no pure ordoliberal vision of European integration, and ordoliberal ideas have been used to support both Eurosceptical and Europeanist positions during the crisis. This article reconstructs the ordoliberal theoretical and political debate on European integration and argues that there exist two ordoliberal paradigms of European integration: one bottom-up, whereby the commitment to liberal economic policies at the national level (...) is the precondition for a liberal international order; the other top-down, whereby a liberal international order can help the establishment of a liberal order at the national level. The article compares two ordoliberal visions of the international order: Wilhelm Röpke’s ‘liberalism from below’ (which follows the bottom-up logic) and Viktor Vanberg’s ‘competitive federalism’ (which follows the top-down logic). Then, it explores the ordoliberal political debate on two episodes of the European integration process – the Maastricht Treaty and the Euro crisis – to argue that the bottom-up and the top-down logics underpinned, respectively, Eurosceptical and Europeanist arguments. As Artificial Intelligence (AI) becomes more and more pervasive in our everyday life, new questions arise about its ethical and social impacts. Such issues concern all stakeholders involved in or committed to the design, implementation, deployment, and use of the technology. The present document addresses these preoccupations by introducing and discussing a set of practical obligations and recommendations for the development of applications and systems based on AI techniques. With this work we hope to contribute to spreading awareness on the (...) many social challenges posed by AI and encouraging the establishment of good practices throughout the relevant social areas. As points of novelty, the paper elaborates on an integrated view that combines both human rights and ethical concepts to reap the benefits of the two approaches. Moreover, it proposes innovative recommendations, such as those on redress and governance, which add further insight to the debate. Finally, it incorporates a specific focus on the Italian Constitution, thus offering an example of how core legislations of Member States might contribute to further specify and enrich the EU normative framework on AI. This paper is interested in the interdisciplinary characteristics of European integration studies. It explores how the institutional and intellectual, internal and external boundaries of this interdisciplinary field are shaped. For this purpose, it discusses two interlocking dynamics that are most important: on the one hand, the European Union actively attempts to mobilise European integration studies to contribute to building a united Europe by providing specific spaces, resources, and infrastructures for academic research and the public (...) dissemination of results. On the other hand, the external and internal boundaries of this interdisciplinary field are shaped by the movements and interactions of scholars from different academic backgrounds. Together, the different academic strands and policies coproduce the interdisciplinary field of European integration studies. Suggesting avenues for future research, the conclusion recommends analysing key debates in the context of European integration in terms of boundary objects around which academics, policy-makers, and publics can engage with each other and points to specific sites for further observations of these processes of coproduction. This paper argues for a fundamental overhaul of the current competence constellation in the EU, which is necessary to address the problem that the current arrangement does not respect the important values that it is supposed to uphold, namely those of democracy, subsidiarity and national diversity. While pretending otherwise, it effectively contains neither negative nor positive EU integration in areas of Member State competence. Furthermore, it enables European integration of these areas through even less accountable intergovernmental mechanisms. (...) It will be argued that the root cause of this problem is that demarcation of competences as a method to contain the EU does not work, because such an approach of ‘categorical federalism’ is bound to fail, especially in the EU context since it is incompatible with the functionality that is written in the legal order’s DNA. It is therefore proposed to dispose of demarcation as a way to contain EU action and instead to openly recognise the inevitable broadness of the EU’s powers while containing the exercise of these powers through a democratisation of the legislative process. The paper tables a number of proposals that on the one hand enhance the EU’s formal legislative powers, while on the other hand strengthen national parliaments in their powers politically to review proposed EU legislation. European citizenship is a nested membership in a multilevel polity that operates at member state and union levels. A normative theory of supranational citizenship will necessarily be informed by the EU as the only present case and will be addressed to the EU in most of its prescriptions, but should still develop a model sufficiently general to potentially apply to other regional unions as well. The Article first describes three basic characteristics of such a polity — democratic representation (...) at the supranational level, internal freedom of movement between member states, and regional limits to external geographic expansion — and argues that a multiplication of such regional unions would contribute to a more just and peaceful international order. Building on this modification of Kant’s model for a global confederation of republics, the contribution explores three alternative approaches for strengthening democratic citizenship in the European Union: a statist approach that aims at transforming the EU into a federal state, a unionist approach whose goal is to strengthen union citizenship vis-a`-vis member state nationality, and a pluralist one that specifies citizenship norms for each level and balances them with each other on the basis of the current state of federal integration. These approaches are then compared with regard to their implications for three policy questions: general status differences and inequality of rights amongst EU citizens living in their country of nationality, EU citizens residing in other member states, third-country nationals, and EU citizens residing outside the territory of the Union; voting rights in European, national, and local elections; and access to Union citizenship and to member state nationality. This article explores the tension between an understanding of Europe as purveyor of a certain kind of cultural, spiritual or religious identity and the more or less bureaucratic project of European construction undertaken in its name. The central axis of this tension is the theoretical relationship between identity and legitimacy. The classical modern problem of nation-state building involves integrating the legitimating force of collective identity into the institutions of the state. How does the project of European construction respond (...) to an analogous challenge? This article develops this theoretical question by turning to two canonical positions concerning the relation between institutional legitimacy and its cultural, spiritual or religious under-pinnings - Montesquieu and Weber. It then returns to the founding documents of the EU in order to interrogate the legitimacy of the EU in light of the concept of European identity. (shrink)

We are still unable to correctly identify the true crisis in Europe: whether it is a question of a lack of a demos or cratos; whether it is the democracy, legitimacy, or justice that is inadequate; whether we are facing a problem of intelligibility or of too little politicization. The article begin the analysis with three hypotheses: (1) none of the attempts to explain the crisis that focus on a single deficit or weakness seems satisfactory, so the discussion should focus (...) on the way these types of deficiencies are expressed and the extent to which each one of them is involved. For this very reason, it makes no sense to entrust the entire solution to the strengthening of one single criterion (participation, effectiveness, or communication, for example). (2) Polarizing the legitimacy framework around two possibilities (input and output) seems to be a simplification that does not do justice to the intricate way in which the results and the procedures, effectiveness and consent are related in a democracy. (3) The resulting description cannot be less complex than that which it is attempting to describe, so the task of repairing EU legitimacy should be carried out through a sophisticated division of labor (between institutions, criteria, and values). The process of European integration may be one of the most interesting manifestations of a general problem in today’s societies: how to reconstruct political authority to confront the new challenges of communal life. The Schuman Plan was enthusiastically endorsed by the Benelux countries, France, Germany, and Italy, but the United Kingdom declined to participate, refusing to accept the supranational role of the projected High Authority. The treaty Establishing the European Coal and Steel Community (ECSC) was signed in Paris on 18 April 1951. The European Economic Community (EEC) has provided the core framework for the process of European integration. The Single European Act (SEA) also inserted into the EEC (...) Treaty a number of specific new legal bases for Community action. The treaty provisions were superseded by the Treaty on European Union (TEU), which provides the legal basis for the common foreign and security policy (CFSP). The Reform Treaty was to shed the form, language, and symbols of a European Constitution in favor of having another amending treaty, similar in nature to the SEA, Treaty of Amsterdam (TA), or Treaty of Nice (TN). Ulrich Beck, Jean-Marc Ferry et Jürgen Habermas voient dans l’Union européenne la réalisation d’une démocratie postnationale, capable de se hisser au niveau des enjeux actuels. Les signes de cette réalisation ne se font toutefois pas jour dans des valeurs abstraites, mais dans l’expérience de l’européanisation, lors des commerces transfrontaliers. Après avoir présenté ce paradoxe dans les textes, nous suggérons que l’accent mis sur les expériences ordinaires tient à la place occupée par le droit dans la construction européenne. Le contrôle (...) des libertés de circulation par la Cour de justice de l’Union européenne, caractéristique du marché intérieur, est à l’origine d’une intégration plus large, qui a étendu les droits des opérateurs économiques et forgé le statut de citoyen européen. La jurisprudence de la CJUE a en effet permis d’élargir la portée des droits transnationaux, dans la continuité du droit cosmopolitique kantien, sans dissoudre les États membres dans une association supranationale. Une affiliation postnationale, alternative au modèle de la souveraineté étatique classique, semble ainsi se concrétiser dans l’Union européenne. Cependant, nous suggérons que le crédit accordé à la construction, par la jurisprudence de la CJUE, de la citoyenneté postnationale, risque d’occulter les effets problématiques d’une intégration judiciaire vouée à être essentiellement négative. Through Foreign Direct Investment, multinational corporations make a positive impact (...) on economies around the world. In addition to contributing to the local development of areas where they setup subsidiaries, multinational corporations are a form of integration of a local economy into the global economy. In the Romanian economy, multinational corporations play a decisive role, representing the companies with the highest turnover, but also the most desired employers for those looking for a job. The significance of colonialism and decolonization for the dawning of European integration and their subsequent bearing on notions of European identity still constitute a largely unexplored field within research. In seeking to problematize and amend this state of things, this article embarks on charting a set of historical developments which provide a case for arguing that theoretical and empirical studies on the nexus of European integration and European identity need to pay much closer attention (...) to questions pertaining to colonialism and decolonization. As such, the article seeks to offer a glimpse of what it takes to be a critical background against which scholarly debates on contemporary notions of European identity need to be considered. Such an approach, it is suggested, should be of particular value for research trying to come to terms with Brussels' current endeavour to foster a collective sense of European identity in the Union. In expanding on this exact point, the article also broaches the question concerning all those `non-European' territories in Africa, South America and elsewhere that are incorporated into the present-day European Union, but which, nevertheless, hardly ever surface as such in studies on the EU and its politics of European identity. Governing Europe is the first book to systematically link Michel Foucault's hypotheses on power and 'governmentality' with the study of European integration. Through a series of empirical encounters that spans the fifty-year history of European integration, it explores both the diverse political dreams that have framed means and ends of integration and the political technologies that have made 'Europe' a calculable, administrable domain. The book illustrates how a genealogy of European integration differs from (...) conventional approaches. By suspending the assumption that we already know what/where Europe is, it opens a space for analysis where we can ask: how did Europe come to be governed as this and not that? The themes covered by this book include: * the different constructions of Europe within discourses of modernization, democratization, insecurity and 'governance' * the imprint of modernism, liberalism, ordoliberalism, neoliberalism and crime on the identity of the European Community/European Union * the historical relationship between European government and specific technologies of power, technologies as diverse as planning, price control, transparency and benchmarking. Union Citizenship as currently implemented in the European Union introduces a distinct concept of citizenship that necessitates an adequate normative approach. The objective of this paper is to assess EU Citizenship against the theoretical background of multilateral democracy. This approach is specifically suited for this task, as it does not rely on a nation-state paradigm or the presumption of a further transformation into a federation or union. We propose three criteria by which to assess multilevel citizenship: (...) equal individual rights, equal sovereignty of peoples and the balancing of individuals' and peoples' interests. We argue that the current practice of Union Citizenship does not fully meet the proposed standards, regarding equal rights within and equal access to, the political system. Based on our assessment, we propose reform options of access to national and supranational citizenship and argue for supranational participation rights and equal transnational rights to gradually re-establish full membership for individuals. The 1950s were a frenetic moment in the European integration process during which the European Economic Community (EEC), the ultimately abortive Free Trade Area (FTA), and subsequently the European Free Trade Association (EFTA) were all negotiated. Trade unions showed keen interest in these schemes; moreover, their own highly institutionalised cooperation suggested they might come to play a key role in shaping them. And yet scholars have argued how divergent traditions and domestic pressures precluded the emergence of (...) a coherent trade union platform on European unity. While not rejecting the structural weaknesses of union internationalism in this regard, this article asks why union centres nevertheless continued to engage with one another on the integration question. Focusing on the British Trade Unions Congress (TUC) and deploying a transnational approach to best understand the interaction between the national and international levels, it shows that union linkages still offered the TUC and its counterparts a valuable chance to learn from and persuade others – and even their governments – of their views, objectives and affairs. Such trade union diplomacy was thus in and of itself valuable despite wider union spats and misgivings, and did at times impact the broader language and approach of the countries involved. (shrink)

European integration questions the relationship between nation and state. It under-mines traditional sovereignty and weakens the need for statehood. Minority nationalist movements have in many cases adopted the European theme, adjusting their ideology and strategy accordingly. Some have used “new regionalist” themes to construct new systems of action below and beyond the state. Europe provides opportunities for territorial movements and grants some minority protections. There are differences between Western Europe and Central and Eastern Europe because of the (...) evolution of state structures. The prospective European constitution risks formalizing the European Union as a two-level game of states and the Union, with little room for regional and minority claims. (shrink)

The spreading phenomenon of Euroscepticism is manifested in critical practices in discourse that oppose European integration. This paper explores Euroscepticism as an element of discourse, which cannot only be measured as party positions or individual attitudes. Based on this understanding, our argument is twofold. Firstly, Euroscepticism relates to the unsettled and principally contested character of the European Union (EU) as a political entity: its basic purpose and rationale, its institutional design and its future trajectory. It correlates (...) with pro-European discourse and the attempts to promote the (democratic) legitimacy of the EU. Secondly, we argue that Euroscepticism unfolds primarily through mass media. As such, it is given public expression through general news values, drama and narratives that are targeted to draw the attention of the wider audience. Understanding this responsive and public nature of Euroscepticism leads us, in the end, to a comprehensive typology of six forms of polity evaluation of the EU. (shrink)
