Many phylogenetic systematists have criticized the Biological Species Concept (BSC) because it distorts evolutionary history. While defenses against this particular criticism have been attempted, I argue that these responses are unsuccessful. In addition, I argue that the source of this problem leads to previously unappreciated, and deeper, fatal objections. These objections to the BSC also straightforwardly apply to other species concepts that are not defined by genealogical history. What is missing from many previous discussions is the fact that the Tree (...) of Life, which represents phylogenetic history, is independent of our choice of species concept. Some species concepts are consistent with species having unique positions on the Tree while others, including the BSC, are not. Since representing history is of primary importance in evolutionary biology, these problems lead to the conclusion that the BSC, along with many other species concepts, are unacceptable. If species are to be taxa used in phylogenetic inferences, we need a history-based species concept. (shrink)

Metaphorical analogies have been popular in different forms of reasoning, theatre and drama analogy among them. From the semiotic perspective, theatre is arepresentation of reality. Characteristic to theatrical representation is the fact that for creating representations of reality it uses, to a great extent, the materiality andcultural codes that also constitute our everyday life; sometimes the means of representation are even iconically identical to the latter. This likeness has inspirednumerous writers, philosophers and, later, social scientists to look for particular similarities (...) between social life, drama and theatre. In this paper I chose twoparticular approaches from the social sciences that make use of the metaphorical analogy of theatre in quite different, yet, to certain extent, also overlapping ways — Victor Turner’s concept of “social dramas” from anthropology and Erving Goffman’s “dramaturgy” of social interactions from sociology. The former bases hisanalogy more on the structure of the dramatic text and on a key resemblance in the (dramatic) conflict, whereas the latter builds his analogy on the principles ofperforming used in theatre, and regards characters and roles as major resemblances between action on stage and in social space. This paper examines these key resemblances and sheds light on what kind of interpretations of culture and society emerge when theatre analogies are put into action. In the concluding section some general problems, related to extended metaphors and analogical explanations the researcher needs to face with, are discussed. (shrink)

While a growing number of firms are being evaluated on environment, social and governance criteria by sustainability rating agencies, comparatively little is known about companies’ responses. Drawing on semi-structured interviews with companies operating in Italy, the present paper seeks to narrow this gap in current understanding by examining how firms react to ESG ratings, and the factors influencing their response. Unique to the literature, we show that firms may react very differently to being rated, with our analysis yielding a fourfold (...) typology of corporate responses. The typology captures conformity and resistance to ratings across two dimensions of firm behaviour. We furthermore show that corporate responses depend on managers’ beliefs regarding the material benefits of adjusting to and scoring well on ESG ratings and their alignment with corporate strategy. In doing so, we challenge the idea that organisational ratings homogenise organisations and draw attention to the agency underlying corporate responses. Our findings also contribute to debates about the impact of ESG ratings, calling into question claims about their positive influence on companies’ sustainability performance. We conclude by discussing the wider empirical, theoretical and ethical implications of our paper. (shrink)

Bayesian methods have become among the most popular methods in phylogenetics, but theoretical opposition to this methodology remains. After providing an introduction to Bayesian theory in this context, I attempt to tackle the problem mentioned most often in the literature: the “problem of the priors”—how to assign prior probabilities to tree hypotheses. I first argue that a recent objection—that an appropriate assignment of priors is impossible—is based on a misunderstanding of what ignorance and bias are. I then consider different methods (...) of assigning prior probabilities to trees. I argue that priors need to be derived from an understanding of how distinct taxa have evolved and that the appropriate evolutionary model is captured by the Yule birth–death process. This process leads to a well-known statistical distribution over trees. Though further modifications may be necessary to model more complex aspects of the branching process, they must be modifications to parameters in an underlying Yule model. Ignoring these Yule priors commits a fallacy leading to mistaken inferences both about the trees themselves and about macroevolutionary processes more generally. (shrink)

The objective of this paper is to reflect on the proper way for Christians to do philosophy, in respect of which I have been inspired by a phrase attributed to Cardinal Newman: “We do not need Christian philosophy. We need Christians making good philosophy.” This sentence can appear controversial, but I believe it is not, if its content is made explicit in an appropriate way. To better develop what I understand Newman to be proposing here, I have added another category (...) to his statement, with the consequence that my own text falls into three sections: 1) on Christian philosophy; 2) on Christian philosophers; 3) on Christians who do philosophy. This is the scheme that we will use to position ourselves as regards the complex issue of the relationship between philosophy and Christianity. (shrink)

In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. “Iatrophilosophy” is defined as the translational discipline between medicine and philosophy that has a double objective, theoretical and practical. It is presented a model of practical iatrophilosophy applied to chronic pain associated with depression and stress—depresalgia—, that expands Phenomenologic, Hermeneutic, Dynamic Psychotherapy (PHD) to the general medical field. It starts from the general model of the medical triad - disease, illness, and sickness- and, in the horizon of Ortega's anthropology, five nuclear metaphors are proposed: greed of the body, anguish of (...) circumstance, personal tear, personal knots, and personal expropriation. These are related to the neurobiological mechanisms of central sensitization, allostasis, and alteration of the hypothalamic-pituitary-adrenal axis. A personal recovery process based on therapeutic concord is proposed. The analysis of chronic pain and other complex health problems can benefit from philosophical methodologies such as clinical hermeneutics. (shrink)

Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. Los marabouts, o morabitos, son líderes religiosos de las cofradías musulmanas sufíes africanas. A ellos deben obediencia los talibes, discípulos, tanto en sus lugares de origen como en la diáspora migratoria, de gran intensidad y tradición en el muridismo. Los marabouts, con sus visitas recurrentes a los diversos lugares de migración, articulan la identidad colectiva a la par que recogen divisas para regresarlas a Senegal, redistribuyendo y también ejerciendo de �grandes hombres�, ricos, dadivosos y santos, moviéndose en el capitalismo financiero (...) contemporáneo con recursos y tradiciones propios. Sus roles se analizan de modo complejo por parte de los estudiosos, a veces como figuras de dominación e incluso de explotación laboral hacia los discípulos; otras veces, como líderes movilizadores de capital social, cultural y económico, cuyas obligaciones redistributivas y morales compensan sobradamente el esfuerzo de la comunidad. Aquí se pretende recoger precisamente la densidad de este debate, y dado que las funciones marabúticas caminan entre las prácticas culturales emancipatorias y dominantes aparentemente a la par. The volume gathers theoretical contributions on human rights and global justice in the context of international migration. It addresses the need to reconsider human rights and the theories of justice in connection with the transformation of the social frames of reference that international migrations foster. In the last decades the concept of objectivity has been criticized by the "new epistemologies". These criticisms favour the consolidation of relativist and subjective positions, which condition the objectivity of scientific knowledge to such an extent that it seems to be a goal impossible to achieve.

This paper reports a European Forum for Good Clinical Practice workshop held in 2011 to consider a research ethics committee training syllabus, subsequent training needs and resources. The syllabus that was developed was divided into four competencies: committee working; scientific method; ethical analysis and the regulatory framework. Appropriate training needs for each, with possible resources, were discussed. Lack of funding for training was reported as a major problem but affordable alternatives were debated. Strengths and weaknesses of this approach were discussed (...) and the resultant proposal will be disseminated through the European Forum for Good Clinical Practice and the research ethics committees of member states. Legal interpreting and translation are some of the oldest and most frequently practised bilingual activities in Hong Kong. The principles and operation of the bilingual legal system actually impinge on the legal interpreting services and the practices of legal interpreting services also in ways impact on the system itself. This study adopts a historical approach to analyse the jurisprudence and administration of legal interpreting in Hong Kong courts from 1966 to 2016, across the 1997 dividing line between British colonial rule (...) and the return of Hong Kong to the government of mainland China. It focuses on the opinions of judges and other participants in courtroom proceedings as recorded in Hong Kong case reports. It is discovered that the jurisprudence of having an interpreter to interpret for participants who do not speak the language of the court is clearly indicated and well versed in the precedents. However, there is a gap between the jurisprudence and the actual interpreting services, mainly caused by the malpractices of the concerned administration department and some of the law enforcement agents working in the frontline. El presente artículo hace mención de los pasos metodológicos que se debiera tener en consideración para realizar una planificación estratégica energética, en función del espacio geográfico estudiado y de la herramienta SIG.

Este artigo considera a marcante instabilidade da Filosofia nos currículos da Educação brasileira, assim como seu desaparecimento como disciplina, na versão aprovada da Base Nacional Comum Curricular. Apresenta as prováveis alterações que esse documento promoverá na Educação, referente à formação de professores, ao impacto político e à autonomia docente na criação de aulas, para, então, dedicar-se aos espólios filosóficos restantes na Base, sobretudo àqueles relativos à ética. Mostra que a dimensão ética atravessa o documento e está presente nas “Competências Gerais” (...) a serem desenvolvidas ao longo da Educação Básica, sendo, portanto, uma preocupação de todas as áreas do conhecimento, sobretudo no que se refere às Tecnologias Digitais de Informação e Comunicação e à sustentabilidade ambiental. Volta à definição de ética no documento e às suas bases, a saber, justiça, solidariedade e livre-arbítrio; problematiza seus sentidos e marca algumas incoerências. Evidencia que o documento, apesar de incentivar que a Educação dos jovens esteja, de um lado, voltada àquilo que fizemos e sabemos do mundo, por outro, para o aberto e indeterminado; dá ênfase excessiva à busca de soluções e ao aprendizado de respostas, dando prioridade, no que respeita à Filosofia, à resposta socrática para a questão “O que é o ser humano?” Destaca a ideia apresentada no documento de que o nosso tempo requer uma “nova mentalidade”, regida por uma “ética diferente”, e defende que é por meio do contato com modos de pensar filosóficos, presentes nos textos primários de Filosofia, trabalhados por professores habilitados para isso, que os estudantes tornar-se-ão competentes e hábeis nos dois principais sentidos éticos da Base – 1) da nossa relação com a natureza, com o Planeta e seus bens finitos; e 2) da relação consigo mesmo, o modo de ser. Ainda que a autora tenha se debruçado, em várias ocasiões desde 1984, sobre o problema da ideologia na obra postumamente publicada por Lukács, o objetivo geral do presente artigo é trazer comentários adicionais sobre o tema, decorrência de pesquisa mais profunda não só da Ontologia do ser social, mas também do próprio itinerário intelectual do filósofo húngaro. Autores que abordaram o tema são revisitados, configurando-se assim um quadro geral mais complexo da questão em tela.

We assume that people have a need to make statements, and construct a model in which this need is the sole determinant of voting behavior. In this model, an individual selects a ballot that makes as close a statement as possible to her ideal point, where abstaining from voting is a possible (null) statement. We show that in such a model, a political system that adopts approval voting may be expected to enjoy a significantly higher rate of participation in elections (...) than a comparable system with plurality rule. Keller & Miller (K&M) briefly mention and promptly dismiss the idea that genes for harmful mental disorders may confer certain advantages to affected individuals. However, the authors fail to consider that the same genes (in low doses or reduced penetrance) may be adaptive for relatives, and that this may in part explain why they are retained in the gene pool. In lieu of an abstract, here is a brief excerpt of the content:Theorizing the Language of LawJesús Rodríguez-Velasco (bio)Law transforms reality, de iure and de facto, inasmuch as it attempts to bridge the gap between that which is done de facto and that which is regulated de iure. It is standard practice, for Alfonso X of Castile,1 to reinvent the means of writing the law. He does not limit himself to compiling or revising existing legal statutes; rather, he elevates (...) the corpus of the law to the level of juridical science. Dominating the meaning of the word—its hermeneutics and its relation to truth, lies, rhetoric, history, and poetry—is also the key to dominating juridical discourse itself and its capacity for creating certainty. Or, at least, for controlling uncertainty. Uncertainty, that is to say, the ambiguity in the interpretation of the relationship between words and things, appears to be one of the targets of Alfonsine juridical science.It is in the institutions that one can best study this desire for control. In particular, the need for control becomes visible in the court and the places related to it (the palace, chamber, or bedroom), codified by the law in order to put justice into action, in the representation of power, in cultural exchange, in education, and in recreation. Here legislation acquires a special significance with respect to the word, to narration, and to rhetoric. This is a philological problem: How does one compose and administer a text capable of controlling its own interpretation? How does one transpose this same dynamic to the institutions? How does one transmit this notion from the institution to those who inhabit it and who are, after all, the subjects of the legal science?It is therefore fitting to examine legislation about legal discourse, which is, in itself, the theory of law—not, however, in its abstract aspects but rather in the concrete elements of the formation of a legal vocabulary, in the way in which words, whose semantic and hermeneutic problems are clear, give life to this legal vocabulary. How is legal discourse constructed? In what way is it transmitted? What are the consequences of its dissemination? In what way is the law in charge of words, in particular, those expressed in the institutions?Perhaps the problem is philological, in the sense supposed by Giambattista Vico. Vico, in his Principi per una scienza nuova [1: 10] proposed that the study of philosophy, as a science of truth could not exist independently without a philology, the origin of the conscience of certainty (coscienza del certo). Attaching myself, then, to this idea of certainty (although not, of course, from Vico’s perspective) throughout this study I shall call “the space of certainty” the theoretical and conceptual construction (which is of both a philological and textual character) stipulated by the legislator in an attempt to control the distinct concepts related to the legal word, its institutional statute and its legal, moral, and cultural hermeneutics. I shall thus attempt to understand the meaning of this space of certainty, in what way it has been constructed, and how it affects legal, political, social, and cultural mechanisms. [End Page 64]1Law and KingIn the first title of the first Partida, Alfonso outlines the virtues of the laws.2 In addition, this first law discusses the overall structure of the Siete partidas, as if, in fact, they were nothing more than a lengthy and virtuous discourse about the law. It makes sense as the Partidas are not only a legal code capable of being enforced but also an enormous manual on legal theory. The law(s) and legal doctrine, then, come together to form the first expression of legal science. Going further than compilations of Roman law such as the Liber augustalis,3 further than the scientific expressions of jurisprudence of specialists from Bologna, the Île-de-France, and Orleans utroque iure,4 the Partidas—and I should like to insist on this—can be considered a constitutional legal text. In this sense the Partidas attempts to regulate the actual material from which the laws are made: language. Entre enero y febrero de 1970, el norteamericano Saul Kripke impartió tres importantes conferencias en la Universidad de Princeton que posteriormente se publicaron bajo el titulo de El nombrar y la necesidad. En dichas conferencias el autor, además de hacer una fuerte crítica a las teorías descripcioncitas, abordó temas de primer orden, como son el de los nombres, la referencia, la rigidez, la modalidad y la necesidad. Este artigo tem por propósito expor as análises realizadas pelo filósofo J. Chasin em relação ao tema da política no âmbito da formação social brasileira, cuja determinação central, nos seus termos, é ter-se constituído pela via colonial. Intentamos, inicialmente, mostrar a interrelação entre as pesquisas chasinianas sobre o pensamento de K. Marx especialmente a crítica à política (consubstanciada na expressão determinação ontonegativa da politicidade), e suas descobertas sobre a sociabilidade nacional. No interior dessa relação de potencialização recíproca, destacamos o debate (...) chasiniano sobre o politicismo, modo de proceder típico da burguesia atrófica brasileira, para o qual esta conseguiu arrastar, em momentos decisivos, muitos agrupamentos e individualidades que se arvoram de esquerda. Phylogenetic trees are meant to represent the genealogical history of life and apparently derive their justification from the existence of the tree of life and the fact that evolutionary processes are treelike. However, there are a number of problems for these assumptions. Here it is argued that once we understand the important role that phylogenetic trees play as models that contain idealizations, we can accept these criticisms and deny the reality of the tree while justifying the continued use of trees (...) in phylogenetic theory and preserving nearly all of what defenders of trees have called the “importance of tree thinking.”.
