Este trabajo analiza los intentos llevados a cabo por Jeremy Bentham y John Stuart Mill para hacer converger algunos de los principales modelos de fundamentación moral: las éticas de la felicidad, como la aristotélica, o la propia ética utilitarista, las éticas del deber de raíz kantiana y las éticas de los derechos.Si conseguimos “reducir”, en primer lugar, las éticas de los derechos al modelo de la ética del deber, podremos simplificar mucho la cuestión y limitarnos a contrastar este (...) último modelo con las éticas de la felicidad, que a su vez deberían converger en la propia ética de la utilidad. No obstante, y aun reconociendo su gran interés, una convergencia completa entre modelos alternativos se revela como imposible. A pesar de los esfuerzos, sobre todo de John Stuart Mill, no es posible una unificación completa de los planteamientos utilitaristas con los de Aristóteles y Kant. J.S. Mill's deep interest in French intellectual, political, and social affairs began in 1820 when, in his fourteenth year, he went to France to live for a year with the family of Sir Samuel Bentham. French became his second language, and France his second home, where he died and was buried in 1873. His interest in history began even earlier when, as a child of seven, he tried to imitate his father's labours on the History of British India; though he (...) never wrote a history in his maturity, study of the past remained a passion and helped shape the philosophy of history that informed his views of society and ethics. His intense interest in contemporary French politics also led him to seek connections between historical developments and present trends, both seen by his from a Radical perspective approproate to what he believed to be an age of transition. The English historians of France, including Walter Scott and Thomas Carlyle, as well as the French, some of whom were themselves political figures, are judged by their historical methods, but those methods are seen as having practical effects in shaping as well as revealing the mind of the times. This volume brings together for the first time the essays, running from 1826 to 1849, that meld these abiding interests. They give as well insights into Mill's personal aspirations, his developing view of comparative politics and sociology, his concern for freedom, and his feminism. During these years Mill worked on a published his System of Logic, Book VI of which shows in condensed form the results of the speculations here developed; reading these essays with that work, which made his reputation as a philosopher, enables one to see the effects of romanticism on analytic thought in a way not as clearly evident even in Mill's Autobiography. Independently important, then, the essays in this volume also enable us to interpret anew the practical and theoretical concerns fundamental to his formative years and maturity. John C. Translation of On liberty, Utilitarianism, selections from Principles of political economy with some of their applications to social philosophy and The utility of religion.

This article focuses on the relationship between morality and law through the debate between William Whewell (1794-1866) and John Stuart Mill (1806-1873), two important moral philosophers of 19th century Britain. Whewell belongs to a tradition maintaining that the basic moral principles can be known intuitively through an inherent faculty such as moral sense or conscience. In the meantime, Whewell argues that the process of knowing these basic principles intuitively is not an irrational process and that the reason is (...) active throughout the whole process of knowing. In this context, the reason is the most basic concept of Whewell's system. In Whewell's system, the will of God is the highest/ultimate good. Relatedly, action in accordance with the will of God is morally right action. On the other hand, utilitarianism, to which Mill belongs, is a moral theory that determines the greatest happiness of the highest number of people as the criterion for morally right action. This theory does not include any metaphysical and theological elements, which argues that morality should be based on experience and introspection. Utilitarianism rejects the claim that there are basic moral principles that can be intuitively known. This approach of utilitarianism makes these two theories natural opponents of each other. One of the topics of the Whewell-Mill debate is the juncture of morality and law. In this context, Whewell's views on the moral-law relationship, Mill's criticism of Whewell on this issue and Whewell's responses to Mill constitute the subject of the article. The main purpose of this study, in which the comparative method is adopted, is to gain new perspectives on the relationship between morality and law. When we focus on the Whewell-Mill debate, we see that Whewell deals with the moral-law relationship on the basis of the concept of right, while Mill deals with the concept of justice. According to Whewell, it is impossible to talk about morality unless there are rights determined by law. In this regard, justice basically means compliance with the law. Like Whewell, Mill accepts that justice is not static but dynamic, and argues that only the utility can determine what just is. Mill objects to Whewell's views on three main criticial points. These are; according to Mill, Whewell first makes law the basis of morality by claiming that it is not possible to talk about morality where there are no laws. Whewell, objecting to this criticism of Mill, states that he does not make law the basis of morality; he says that he needs law to put moral principles into the practice. The second criticism of Mill is that Whewell makes laws the criterion of moral righteousness, which narrows morality down to rights and therefore to law compliance. Whewell objects to Mill, saying that moral rightness is much broader concept than legal rightness. For him, obedience to the law is only part of moral righteousness. Mill’s last criticism is that Whewell made obedience to the law a moral duty, even if it is not just. In Whewell's system, obedience to laws confirming slavery is made a moral duty. Whewell, on the other hand, admits that laws may be immoral from time to time, but states that obedience to these laws is more reasonable than disobeying them; because the problems that will arise from non-compliance with the laws are much greater. What needs to be done is to make sure that more just laws are legislated. However, according to Whewell, legislation is the duty of the jurist, not the moralist. These criticisms made by Mill against Whewell are actually criticisms that is related Mill's own system. Mill neither himself can give satisfactory answers to these criticisms. In conclusion, in the polemic between Whewell and Mill, it is possible to find other different answers of both thinkers regarding the relationship between morality and law. However, it cannot be said that these answers completely solved the problems stated above. (shrink)

It is mainly with an eye to these preliminary articles that Professor Wilhelm Miiller argues for Kant's relevance to contemporary political problems. Miiller begins by drawing an analogy between the Peace of Basle (1795) and the Treaty of Versailles: in both instances, it is claimed, secret reservations at the treaty table, (...) the identification of defeated nation with "guilty" nation, and the deprivation of an entire "guiltless" people of "the most primitive right to live" helped lay the foundations for future wars. Miiller sees in the willful dispersion, through motives of revenge and greed, of the possessions of conquered nations after both World Wars a "reversion to the wildest barbarism." He defends Kant's stricture against standing armies as being "simply and logically irrefutable" in spite of Kant's toleration--understandable in 1795--of limited and voluntary militias adequate for national defense. He infers from Kant's warning against national economic dependency the urgent need to exclude international capitalism from world politics. He suggests that Kant's principle of non-interference in the internal affairs of nations has been violated in the splitting of East from West Germany. And he insinuates that the present form of government in the U.S. is democratic and republican only in name, being in actuality a capitalist oligarchy whose two-party system tends to degenerate into a one-party system. Professor Miiller is entitled to his views. The reader, however, is entitled to a more objective exposition of Kant's essay and perhaps even to hope for a more critical and searching appraisal of Kant's doctrines. One opportunity for the latter surely offers itself in regard to Kant's analogy between personal and international morality. The analogy might conceivably break down over the difficulty of assigning collective moral and legal responsibility. If, as Kant maintains, a state is a moral person, it should follow that it and not merely its constituent members taken singly has moral responsibility for what it undertakes. Leaving aside the question of whether or not Kant thought through the implications of his premise, it is clear that Professor Miiller has not done so. Whereas he considers atrocious the branding of the German people as guilty of international crime in either World War, he allows himself the judgment that the "Christian" people of Europe and America were guilty of mass-murder on both occasions. The inconsistency is evident. In lieu of an abstract, here is a brief excerpt of the content:274 HISTORY OF PHILOSOPHY poisoning, spying, etc., which would render postwar mutual confidence impossible, shall not be countenanced. It is mainly with an eye to these preliminary articles that Professor Wilhelm Miiller argues for Kant's relevance to contemporary political problems. Miiller begins by drawing an analogy between the Peace of Basle (1795) and the Treaty of Versailles: in both instances, it is claimed, secret reservations at the treaty table, (...) the identification of defeated nation with "guilty" nation, and the deprivation of an entire "guiltless" people of "the most primitive right to live" helped lay the foundations for future wars. Miiller sees in the willful dispersion, through motives of revenge and greed, of the possessions of conquered nations after both World Wars a "reversion to the wildest barbarism." He defends Kant's stricture against standing armies as being "simply and logically irrefutable" in spite of Kant's toleration--understandable in 1795--of limited and voluntary militias adequate for national defense. He infers from Kant's warning against national economic dependency the urgent need to exclude international capitalism from world politics. He suggests that Kant's principle of non-interference in the internal affairs of nations has been violated in the splitting of East from West Germany. And he insinuates that the present form of government in the U.S. is democratic and republican only in name, being in actuality a capitalist oligarchy whose two-party system tends to degenerate into a one-party system. Professor Miiller is entitled to his views. The reader, however, is entitled to a more objective exposition of Kant's essay and perhaps even to hope for a more critical and searching appraisal of Kant's doctrines. One opportunity for the latter surely offers itself in regard to Kant's analogy between personal and international morality. The analogy might conceivably break down over the difficulty of assigning collective moral and legal responsibility. If, as Kant maintains, a state is a moral person, it should follow that it and not merely its constituent members taken singly has moral responsibility for what it undertakes. Leaving aside the question of whether or not Kant thought through the implications of his premise, it is clear that Professor Miiller has not done so. Whereas he considers atrocious the branding of the German people as guilty of international crime in either World War, he allows himself the judgment that the "Christian" people of Europe and America were guilty of mass-murder on both occasions. The inconsistency is evident.
