We present some equivalent conditions for a quasivariety \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$${\mathcal {K}}$$\end{document} of structures to be generated by a single structure. The first such condition, called the embedding property was found by A.I. Mal′tsev in [6]. It says that if \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$${{\bf A}, {\bf B} \in \mathcal {K}}$$\end{document} are nontrivial, then there exists \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$${{\bf C} \in \mathcal{K}}$$\end{document} (...) such that A and B are embeddable into C. One of our equivalent conditions states that the set of quasi-identities valid in \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$${\mathcal{K}}$$\end{document} is closed under a certain Gentzen type rule which is due to J. C'est un fait que nous distinguons entre la connaissance quantitative et la connaissance qualitative. L'analyse de cette distinction remonte à l'Antiquité. Depuis Aristote, elle semble être acceptée comme définitive. L'épistémologie réaliste du Stagirite Justine la distinction par la différence objective entre les catégories de qualité et de quantité, irréductibles l'une à l'autre. Selon cette optique, les deux modes de connaissance nous offrent deux perspectives différentes sur le monde matériel. Ces deux perspectives se complètent l'une l'autre. Il faut tout de même (...) se demander si les deux sont jugées également nécessaires pour la connaissance sensible du monde perceptible. La question est d'autant plus importante qu'on considère la connaissance sensible comme point de départ du processus intellectuel qui mène, ou doit en principe mener, à la connaissance substantielle de la réalité matérielle. C'est peut-être faire un faux pas que de placer une pensée d'Aristote en épigraphe à un essai sur un livre dont l'auteur est partisan de l'empirisme logique. Que les adhérents de l'École de Vienne veuillent bien excuser notre manque de tact, mais le mot du Stagirite nous semble tout indiqué pour servir de pensée liminaire au thème que nous nous proposons d'aborder.

La notion de cause fait corps avec le cadre noétique du système dans lequel elle apparaît. Elle ne peut pas être plus large ou plus profonde que le système lui-même. Qui veut comprendre le sens qu'on donne au concept de cause, doit faire une étude épistémologique du contexte dont il fait partie. Une telle analyse doit éviter de s'enfermer dans le cercle vicieux auquel l'expose le rôle tout à fait fondamental que joue la notion de cause dans la formation du (...) système. En effet l'idée qu'on se fait de la causalité exerce une influence déterminante sur l'ensemble des affirmations de base sur lesquelles repose le complexe d'explications philosophiques ou scientifiques. The paper presents studies related to positive psychology that have been conducted in Poland. The article is based on a review of texts available in the databases of Google Scholar and EBSCO published by Polish researchers in the years 2001–2021. The selection criterion was the presence of some concepts in the title and/or abstract of articles that are constructs of positive psychology. Thirty intentionally selected articles were analyzed in terms of research objectives, variables, and measurement tools they described. In this (...) way, a picture of research interests and methods of research on human and organization from the perspective of positive psychology was obtained. It seems that the main subjects of interest of Polish researchers were problems related to positive human qualities, life satisfaction, and mental well-being with a growing interest in positive society. The most common variable to study was life satisfaction, and the most frequently used measuring tool was the SWLS. It was concluded that there is a need for scientific exchange and integration within Polish researchers and the international community of positive psychologists. (shrink)

This article relates to the CJEU’s understanding of the concept of the spouse in Case C-673/16 and its effect on the process of law application by Polish administrative courts. The authors considerations are based on the assumption that the CJEU’s interpretation of EU law in Coman and Others is of a dynamic-deliberative nature, based on functional rules, and that at the same it time takes into account a specific legal and socio-cultural context in which one of the fundamental freedoms guaranteed (...) by EU law is implemented. This judgment, as authors underline, confirms that a proper understanding of the current legal context of the concept of a spouse requires that the social and cultural context and the plurality of values arising from different lifestyles be taken into account in the application and interpretation of the law, all with a view to empowering the individual in his or her relationship with the State and raising the level of protection of human rights. Authors observe in the practice od Polish administrative courts that this CJEU’s judgment is important in the argumentative layer, but not decisive for the resolution of the case in specific situations where there is a need to address the effect of same-sex marriage in a case related to the implementation of the EU right to free movement. In this context authors consider whether the justification for rulings of administrative courts may be sought in John Gray’s concept of modus vivendi liberalism. (shrink)

John Venn w Formal Logic zbudował pewien system sylogistyki, będący jedną z realizacji idei kwantyfikacji orzeczników. Interesującą rekonstrukcję tego systemu zaproponował V.I. Markin. Markin posługuje się pięcioma funktorami pierwotnymi {aa,ai,ia,ii,e}. Wyrażenia elementarne SaaP,SaiP,SiaP,SiiP oraz SeP są czytane odpowiednio: wszelkie S są wszelkimi P, wszelkie S są pewnymi P, pewne S są wszelkimi P, pewne S są pewnymi P oraz żadne S nie są P.Markin podaje aksjomatykę dla tego systemu. Proponuje też reguły translacji jego formuł na język sylogistyki klasycznej, o aksjomatyce (...) Łukasiewicza {SaS, SiS, MaP/\SaM ε SaP, MaP/\MiS ε SiP} oraz reguły translacji odwrotnej.To sformułowanie sylogistyki Venna można uprościć przez przyjęcie konwencji notacyjnej:SφΨP / SφP/\PΨS SφP/\PΨS / SφΨP dla φ,Ψε{a,ι}.Proponowana jest nowa aksjomatyka dla sylogistyki Venna z mocnym rozumieniem zdań szczegółowo-twierdzących. Badane są związki logiczne między sylogistyką Venna i systemem Łulasiewicza. Zostaje sformułowany system z mocnym rozumieniem zdań szczegółowo-twierdzących. Ludwik Borkowski has constructed a quantifier-less calculus of names (BRN1), which is regarded as a base system here. The system can be extended with the use of the deductive power of rules of introduction and omission of functors π and σ (BRN2), which serve here as the substitutes of quantifiers. If we adopt the extensionality rule for the functor of singular inclusion (REε), we obtain yet another extending of the system (BRN3) accompanied by simultaneous considerable reduction of the primary rules. The analysis of the notion of need reveals two possible approaches to it — an objectivist and a subjectivist one, In the former, needs are regarded as conditions necessary for a subject’s normal functioning, existence in society, or, most broadly, for the preservation of the subject’s identity, A need is attributed to a given person on the ground of studying real links between the subject’s postulated character and external states of things, and so needs are independent of any inner condition (...) of the given person’s wants, preferences, desires etc. In the subjectivist approach, need is regarded as the subject’s inner condition marked by a sense of want along with the concomitant motive. The notion of value may be connected with both approaches to need; value can be defined as something which meets objective needs half way, or as something that satisfies a person’s own subjective needs. Every definition of value has important consequences for the exercise of normative research. Objectivism goes along, among other theories, with absolutism, paternalism or ascetism, whereas subjectivism fits relativism, phenomenalism or hedonism. Historical materialism supplies strong evidence in support of both of these axiological approaches, However, it is the validity of the subjectivist approach that seems to be propped by more arguments. But then, subjectivism has to cope with the problem of valuating needs. (shrink)

SYLLOGISTIC WITH NEGATIVE TERMS IN THE SEMANTICALLY TRANSPARENT FORMULATION S u m m a r y The paper refers to the classic works of Polish authors (Kukasiewicz, SleszyNski, Zawirski) and comprises the idea of proof by ecthesis (originally formulated by Borkowski) with the use of list notation to show that the five diagrams by Euler, which provide a starting point for SleszyNski’s analysis, adequately formulate the system of syllogistic with negative terms (IwanuX and Wedberg’s axiomatization).

The article concerns the situation of the judicial application of the law where the entity applying the law refers in a decision-making process to moral principles. The decision should be based on the directives of interpretation, which indicate the need for such a determination of the meaning of the applicable norms so that it remains in harmony with commonly accepted moral rules of the society. The equity has one more purpose; namely, it allows for the process of decision-making—and not just (...) for the process of unifying the decisions—since the mere rule does not specify the algorithm of undertaking them. This rule thus assumes that it will be further specified by phronesis judge who in a given situation will determine—for the purposes of a particular decision—a hierarchy between the criteria of substantive justice “embedded” in this rule. The reference to equity stands for the concretization of an unspecified general rule. We deal here with an indefinite general rule, the application of which is facilitated by a reference to rightness. (shrink)

The aim of this article is to demonstrate that the theory of changes in perspectives allows a different presentation of the problems which arise from a loss of recognition as an element of punishment, particularly in reference to others, the entire structure of the interaction is changed. Communicative conditions of moral discourses assume that every participant of the argumentation process takes place in all spheres of social life and can assume the perspective common to all other participants. The main task (...) of criminal law is, then, the protection of elementary aspects of one’s role as a participant of interaction without which the chain of mutual recognition and understanding could be freely and at any moment infringed by any given participant of interactions, i.e. the protection of such rights. In the following paper sources of a constitution are put in question in general, and more specifically, the constitutional culture of the European Union Law is being investigated in-depth with regard to principles of deliberative democracy and rulings of the Court of Justice of the European Union. The change of a law application paradigm as well as the change of a legal systems’ nature are taken into account.

Researchers from diverse disciplines, including organismal and cellular physiology, sports science, human nutrition, evolution and ecology, have sought to understand the causes and consequences of the surprising variation in metabolic rate found among and within individual animals of the same species. Research in this area has been hampered by differences in approach, terminology and methodology, and the context in which measurements are made. Recent advances provide important opportunities to identify and address the key questions in the field. By bringing together (...) researchers from different areas of biology and biomedicine, we describe and evaluate these developments and the insights they could yield, highlighting the need for more standardisation across disciplines. We conclude with a list of important questions that can now be addressed by developing a common conceptual and methodological toolkit for studies on metabolic variation in animals. (shrink)
