The first impacts of climate change have become evident and are expected to increase dramatically over the next decades. Thus, it becomes more and more pressing to decide who has to compensate those people who suffer from negative impacts of climate change but have neither contributed to the problem nor possess the resources to cope with the consequences. Since the frequently invoked Polluter Pays Principle cannot account for all climate-related harm, I will take a closer look at the much more (...) controversial Beneficiary Pays Principle. It is argued that, appropriately qualified, the Beneficiary Pays Principle can help to identify additional duty-bearers. Based on these results, I briefly comment on three different policy options to generate funds for compensation. (shrink)

Properly speaking, the corporation, considered as an entity distinct from its members, cannot be morally responsible for wrongful corporate acts. Setting aside (in this abstract) acts brought about through negligence or omissions, we may say that moral responsibility for an act attaches to that agent (or agents) in whom the act "originates" in this sense: (1) the agent formed the (mental) intention or plan to bring about that act (possibly with the help of others) and (2) the act was intentionally (...) brought about through bodily movements over which that agent had direct control (i.e. the kind of direct mental control that I have over the body I refer to as "my" body) and through which the agent carried out his (mental) intention or plan. Corporate acts do not thus originate in some corporate entity distinct from its members because the corporation has neither a mind to form intentions nor a body it directly controls: it lacks the proper mind/body unity. Instead, corporate acts originate in individual autonomous human beings who make up the corporation and who intentionally bring about corporate acts through their own bodily movements. Such human individuals, and not "the corporation," are morally responsible for corporate acts. Moreover, to say that an entity is "morally responsible" for a wrongful act is to say that the entity is liable to blame and punishment. But it is not possible to impose blame and punishment on a corporation without inflicting it on corporate members. Thus, to say that a corporation (as an entity distinct from its members) is "morally responsible" for a wrongful corporate act is to imply that a (possibly innocent) corporate member legitimately may be punished for something for which another entity was morally responsible. This violates the moral principles that underlie blame and punishment. To hold that the corporation can be morally responsible for its acts is to adopt a dangerous organicism. (shrink)

This book, which was completed just before Jean Hampton’s untimely death in April 1996, is an admirable hybrid. Although it successfully achieves its stated purpose of “acquaint[ing] the student of political philosophy both with [its] questions and with the various answers to them proposed by philosophers since the ancient Greeks”, it is, at the same time, quite an original work—one that can be read with real profit by professional philosophers as well as students.

Wie müsste eine faire Lösung des Klimaproblems aussehen? Wie sollten wir Pflichten und finanzielle Lasten der nötigen CO2-Reduktionen verteilen, wenn es dabei gerecht zugehen soll und keiner übervorteilt werden darf? In meiner Antwort auf diese ethischen Fragen stütze ich mich auf einen Grundsatz, den Angela Merkel formuliert hat: Jeder Mensch hat das Recht, genauso viel CO2-Emissionen zu verursachen wie jeder andere. Anders als die Bundeskanzlerin, die den Grundsatz nur langfristig in die Tat umsetzen will, plädiere ich dafür, dass die Gleichberechtigung (...) aller in Sachen CO2-Ausstoß schon unter dem Nachfolge-Regime des Kyoto-Vertrags gelten soll. In einem ersten Schritt soll die Steigerung der weltweiten CO2-Emissionen angehalten werden. Um das auf gerechte Weise zu bewerkstelligen, werden in feiner Stückelung Rechte zum CO2-Ausstoß (die sog. Mikro-Zertifikate) ausgegeben, und zwar zunächst für genau so viel CO2, wie die Menschheit zur Zeit insgesamt pro Jahr in die Luft bläst. Wer CO2 emittieren will, gleichgültig wo, wie und wozu, darf das nur gegen Entwertung einer entsprechenden Anzahl an Mikro-Zertifikaten, sonst macht er sich strafbar. Die Mikro-Zertifikate werden auf einer weltweiten Börse gehandelt; ihr Preis ergibt sich aus Angebot und Nachfrage. Mein Vorschlag unterscheidet sich in zweierlei Hinsicht von den Versteigerungen der CO2-Zertifikate, wie sie bislang konzipiert und organisiert worden sind. Einerseits sollen am Ende alle Emissionen klimaschädlicher Gase in den Handel mit Mikro-Zertifikaten einbezogen werden. Andererseits wird das Geld, das durch die Versteigerung der Mikro-Zertifikate zusammenkommt, in regelmäßigen Abständen und ohne Abzüge an jeden einzelnen Menschen ausgezahlt. Das ist einfach, fair und transparent. In einem zweiten Schritt sind die weltweiten CO2-Emissionen drastisch zu verringern: Nach einer siebenjährigen Verschnaufpause (in der sich Produzenten und Verbraucher auf die erforderlichen Anpassungen vorbereiten können) beginnen die sieben dürren Jahre der CO2-Politik: Jahr für Jahr werden 10% weniger Mikro-Zertifikate ausgegeben. Am Ende dieser Durststrecke haben sich die weltweiten CO2-Emissionen halbiert, und die Klima-Investitionen sind dahin geflossen, wo sie dem Klima am stärksten nutzen und wo das am wenigsten Kapital verschlingt. Scholars who doubt the existence of general political obligations typically criticize and reject theories of obligation based on individual moral principles, for example, consent, fairness, or a natural duty of justice. Astronger position can result fromcombining different principles in a single theory. I develop a multiprinciple theory of political obligation, based on the principle of fairness, a natural duty of justice, and what I call the “common good” principle. The three principles interact in three main ways: “cumulation,” combining the separate (...) state services that different principles cover; “mutual support,” combining the force of different principles in regard to the same state services; and simple overlap. The resulting theory is able to satisfy the main conditions for an adequate theory of obligation: demonstrating that all or nearly all inhabitants of society have moral requirements to obey the law, and that these extend to the full range of state services. This paper discusses the criteria for acceptably holding citizens partly responsible for wrongs their state or its agents commit. Some proposed criteria are not, it argues, appropriately sensitive to the particular coercive relation between state and citizen. Others, which are, conceive of it wrongly and fail to match our judgments about a range of cases. Alternative criteria of breadth and joint authorship, built around Christopher Kutz's account of participation, better match these considered judgments as well as linking them to a (...) more powerful theoretical framework. Understanding citizens' responsibility will mean understanding these criteria more fully. (shrink)

Should the current members of a community compensate the victims of their ancestor’s emissions of greenhouse gases? I argue that the previous generation of polluters may not have been morally responsible for the harms they caused.I also accept the view that the polluters’ descendants cannot be morally responsible for their ancestor’s harmful emissions. However, I show that, while granting this, a suitably defined notion of moral free-riding may still account for the moral obligation of the polluters’ descendants to compensate the (...) current victims of their ancestors’ actions. A concept of transgenerational free-riding is defined. Objections to the idea of using free-riding as part of a theory of justice are rejected. Two different views of moral free-riding are contrasted, with consequences for the amount of compensation to be exigible from the polluters’ descendants. Some final considerations are devoted to the possible relevance of this free-riding-based view for other issues of historical injustice. (shrink)

This paper argues that an analysis of the dissatisfactory outcomes of international negotiations concerning climate change must take into account procedures of political decision‐making in democracies. Although the normative ideal of republican democracy has means of dealing with such dissatisfactory results, political processes in republican democracies take too much time and risk becoming stuck in tragic or dilemmatic decision structures when facing challenges such as climate change. Consequently, this paper discusses possibilities for redesigning republican democratic institutions to counter‐act these negative (...) forces. Vor allem aber sind sie entgegen verbreiteter Ansichten auch moralische Akteure, das heißt, sie sind grundsätzlich fähig, den moralischen Standpunkt einzunehmen, auch wenn sie dies in der Praxis selten tun. What does it matter if the climate changes? This kind of question does not admit of a scientific answer. Natural science can tell us what some of its biophysical effects are likely to be; social scientists can estimate what consequences such effects could have for human lives and livelihoods. But how should we respond? The question is, at root, about how we think we should live—and different people have myriad different ideas about this. It is widely recognized that changes are occurring to the earth’s climate and, further, that these changes threaten important human interests. This raises the question of who should bear the burdens of addressing global climate change. This paper aims to provide an answer to this question. To do so it focuses on the principle that those who cause the problem are morally responsible for solving it (the ‘polluterpays’ principle).
