The existing literature treats of several investigations with a certain bearing on the question which is roughly indicated by the title “Imperatives and Logic.” Some of those investigations, however, are entirely outside the scope of the present work.Mally sets himself the task of developing a “Logik des Willens” constituting a parallel to the usual logic, the “Logik des Denkens". In order to emphasize its independence, the author also calls this “Logik des Willens” “Deontik”, and he conceives it as being based (...) on the “Wesensgesetze” of will in the same way as the usual logic is conceived as being based on the “Wesensgesetze” of thought. The author develops a formalistic deductive system on the basis of 5 axioms of demands, including the axiom that there is at least one fact which is unconditionally demanded, and through a lengthy series of theorems he arrives at the sentence that what is unconditionally demanded is identical with what is actually the case: “was sein soll, ist Tatsache”. Similarly, the author develops a system of axioms for “right” volition, including the axiom that right volition is non-contradictory. (shrink)

C'est l'occasion pour lui de souligner à la fois tout ce que la théorie du droit moderne doit au normativisme, mais aussi les profondes différences de conception dans le camp positiviste entre la conception idéelle des normes de Kelsen et le programme empiriste dont se réclament les (...) réalistes scandinaves, dans la lignée d'Hägerström. Antérieur aux grands écrits accessibles de Ross, qui vont marquer un tournant vers le positivisme logique, ce texte constitue un témoignage important pour la compréhension du débat réalisme-normativisme. The author finds attitude rather than belief to be motivating force in human actions. The idea of purity of science does not forbid the scientist to express his personal judgments; what it does is to demand that he should himself realize that in doing so he trespasses the limits of science and, moreover, that he should make others realize it. The essential difference between social engineering and technology is that in social life it is steadily necessary to choose from among (...) conflicting values. In his work, On Law and Justice, Alf Ross sought to explain law in scientific/empirical terms, in terms that would require no recourse to what he called “metaphysics” or “idealism.” The result is a sort of translation of legal rules and official actions into propositions of behavior, predictions of behavior, and shared ideology. The present work raises questions about the tensions within Ross's work(s), and discusses the places where Ross's analysis seems to fall short of its ambitions. (...) In this article, I discuss Alf Ross's claim that the concept of a legal right is best understood as a technical tool of presentation, which ties together a disjunction of operative facts and a conjunction of legal consequences, and that rights statements render the content of a number of legal norms in a convenient manner. I argue that while Ross's analysis is appealing, it is problematic in at least three respects. I also argue, however, that despite these difficulties (...) Ross's analysis deserves our continued attention, because the fundamental idea—that the concept of a legal right must be understood functionally—is sound. (shrink)

This article addresses a pertinent challenge to Scandinavian realism which follows from the widespread perception that the fundamental philosophical premises on which the movement relies, are no longer tenable. Focusing on Alf Ross’s version of Scandinavian realism which has often been at the centre of critical attention, the author argues that Ross’s theory can survive the fall of logical positivism through an exercise of philosophical reconstruction. More specifically, he claims that it is possible to dismount Ross’s realist (...) legal theory almost intact from its commitments to logical positivism and embed it into an alternative naturalist philosophical program that is currently very strong in contemporary philosophy. In so doing, the author applies a narrow Quinean conception of naturalism, also known as replacement naturalism, which differs from a broader inclusive conception which has been applied by other scholars in the field but which leaves the philosophical crisis of Scandinavian realism unsolved. Ross's Kritik der sogenannten praktischen Erkenntnis pertains more to moral philosophy than to the philosophy of law, even if its contents are important for the latter, too. Its main objective is to show the theoretical groundlessness of any evaluative judgment. This happens when Ross takes the behaviourist approach of reducing psychology to physiology, which opens up fruitful comparisons with Marxist materialism, and in particular with that of Georges Politzer. Another fundamental question concerns the assumption that theoretical nihilism would (...) lead to practical nihilism, as argued by Theodor Geiger (but denied by Ross). And yet, if Geiger is right, can this have no effect on people's everyday lives? (shrink)

Alf Ross propose une théorie juridique qu’il veut “véritablement” réaliste, c’est-à-dire susceptible de dissoudre les problèmes auxquels se heurtent la théorie normativiste de Kelsen et la théorie réaliste américaine et de reconstruire leur discours de manière scientifique. L’originalité de Ross réside dans son concept de norme de compétence que Ross analyse, avant d’autres et notamment Searle, comme des règles constitutives. Contrairement à ce que de nombreux commentateurs ont soutenu, ce concept de norme constitutive ne contredit pas la (...) théorie réaliste de Ross. Éclairées à la lumière des premiers écrits de Ross, les normes de compétence sont des rationalisations capables d’exprimer la prédisposition des destinataires des normes à reconnaître certains faits comme droit. Este artículo explora el comportamiento semántico de términos jurídicos en función predicativa. Se aborda particularmente la propuesta explicativa elaborada por Alf Ross primeramente en Tû-Tû y posteriormente en On Law and Justice. Se argumenta, en primer lugar, que su explicación presupone dos teorías semánticas diversas y conjuntamente incompatibles. Por un lado, una versión explícita de la teoría semántica verificacionista del empirismo lógico y, por el otro lado, una versión implícita y abreviada de la teoría semántica inferencialista. En segundo lugar, (...) se pone de manifiesto que la literatura prácticamente ha descartado la primera de estas teorías por insatisfactoria y actualmente considera a la segunda teoría bastante plausible para explicar el comportamiento semántico de estos términos. En tercer lugar, se argumenta que la noción de referencia, de acuerdo con Ross, no cumple un rol explicativo relevante en la semánica de estas expresiones lingüísticas. (shrink)
