Born in 1900–1901 with the publication of Edmund Husserl’s Logical Investigations, phenomenology, as a critical method of reflection on consciousness and its cognitive achievements against its naturalisation in the natural sciences, has undergone many changes and developments. Critiques of both its methods and tasks have emerged, plus it has served as an inspiration for numerous thinkers, including Max Scheler, Martin Heidegger, Jean-Paul Sartre, Gabriel Marcel, Simone de Beauvoir, Maurice Merleau-Ponty, Jean-Luc Nancy, Michel Henry, Emmanuel Levinas, Hans-Georg Gadamer, Paul Ricoeur (...) and Jacques Derrida, in their attempts to address the question of value, the meaning of being, existence, the lived body, the Other, life, art, history and language in original and fresh ways. The current paper reflects upon the question of what the fate of phenomenology in the twenty-first century could be by considering some of the recent work presented at the first conference of the South African Centre for Phenomenology held at the University of Johannesburg earlier this year. The existence of an animal soul and problems of animal ethics are often discussed in the German philosophical literature of the 18th century, especially in response to the cartesian theory of the beast machine. The following paper presents firstly a view into the early discussions and doctrines about animal souls (e.g., Winkler, Meier). It unfolds secondly some strategies for the legitimation of the death of animals, including contemporary concepts of soul, mainly under the influence of Leibniz. The third part (...) examines some fundamental concepts of obligations to animals within the discussion of natural rights (e.g., Thomasius, Kant). With regard to current debates on the ethical implementation of AI, especially two demands are linked: the call for explainability and for ultimate human responsibility. In the medical field, both are condensed into the role of one person: It is the physician to whom AI output should be explainable and who should thus bear ultimate responsibility for diagnostic or treatment decisions that are based on such AI output. In this article, we argue that a black box AI indeed creates a (...) rationally irresolvable epistemic situation for the physician involved. Specifically, strange errors that are occasionally made by AI sometimes detach its output from human reasoning. Within this article it is further argued that such an epistemic situation is problematic in the context of ultimate human responsibility. Since said strange errors limit the promises of explainability and the concept of explainability frequently appears irrelevant or insignificant when applied to a diverse set of medical applications, we deem it worthwhile to reconsider the call for ultimate human responsibility. Befahigung ist in den letzten Jahrzehnten zu einem zentralen Begriff sowohl in der politischen Philosophie als auch in der Sozialpolitik geworden. Was damit gemeint ist, ist freilich umstritten. Der Band versucht, die Bedeutungsgehalte des Befahigungsbegriffs und daruber seine Leistungsfahigkeit fur die sozialphilosophische und die politische Diskussion zu klaren. Dabei bleibt die Autorin nicht bei der Beschaftigung mit dem Capabilities Approach nach Martha Nussbaum und Amartya Sen stehen, sondern analysiert vor allem die Rezeptionen des Befahigungsansatzes und zwar speziell im Bereich der (...) theologischen Ethik. Als zentrales Problem sowohl des Capabilities Approach als auch der theologischen Ethik wird deren Liberalismusfahigkeit herausgearbeitet. Evolutionary biology tries to explain the adaptability of different traits including social behaviour. However, it does not and cannot say anything about what is ‘good’ or ‘bad’ behaviour. If scientists try to do so they risk being put into the same category as ideologists and political demagogues. Evolutionary biology can tell us something about the phylogeny of certain types of behaviour including xenophobia. It can describe which constraints can lead to the outbreak of such behaviour, without thereby legitimating this behaviour.

Scholars are divided over the question of whether managerial aspirational talk that contradicts current business practices can contribute to corporate social responsibility (CSR). In this conceptual article, we explore the rhetorical dynamics of aspirational talk that either impede or foster CSR. We argue that self-persuasive CSR rhetoric, as one enactment of aspirational talk, can attract attention and scrutiny from organizational members. Continued adherence to this rhetoric, however, creates and perpetuates tensions that lead to a vicious circle of disengagement. A virtuous (...) circle, by contrast, requires a shift toward an agonistic rhetoric that transcends tensions by rearticulating aspirations in concurrence with situated understandings of responsible corporate practice. Our arguments contribute to a better understanding of how communication becomes constitutive of CSR and address the debate on decoupling between talk and action. (shrink)

Every healthcare organisation enacts a multitude of policies, but there has been no discussion as to what procedural and substantive requirements a policy writing process should meet in order to achieve good outcomes and to possess sufficient authority for those who are asked to follow it.Using, as an example, the controversy about patient’s refusal of blood transfusions, I argue that a hospital wide policy is preferable to individual decision making, because it ensures autonomy, quality, fairness, and efficiency.Policy writing for morally (...) controversial medical practices needs additional justification compared to policies on standard medical practices and secures legitimate authority for HCO members by meeting five requirements: all parties directed by the policy are represented; the deliberative process encompasses all of the HCO’s obligations; the rationales for the policy are made available; there is a mechanism for criticising, and for evaluating the policy. The use of social media as a recruitment tool for research with humans is increasing, and likely to continue to grow. Despite this, to date there has been no specific regulatory guidance and there has been little in the bioethics literature to guide investigators and institutional review boards faced with navigating the ethical issues such use raises. We begin to fill this gap by first defending a nonexceptionalist methodology for assessing social media recruitment; second, examining respect for privacy and investigator (...) transparency as key norms governing social media recruitment; and, finally, analyzing three relatively novel aspects of social media recruitment: the ethical significance of compliance with website “terms of use”; the ethics of recruiting from the online networks of research participants; and the ethical implications of online communication from and between participants. The guidelines followed by many educational boards recommend behavioristic practices for dealing with student discipline; however, Lawrence Kohlberg's idea of organizing schools as “just communities” suggests a more promising approach. It translates to the school context the core principle of Habermas's discourse ethics: those norms to which all concerned agree are valid. In such democratically organized schools, students engage in less violence and take greater responsibility for safeguarding each other's welfare. Public debates about rules and handling transgressions generate knowledge regarding (...) shared norms, promote role-taking abilities, and foster ego-syntonic commitment to democratic values. Such participatory experiences may contribute to constituting ego identity. Whereas identity politics relies on particularistic affiliations and emphasizes demarcations between social groups, ego identity is based on a commitment to universal moral values. This commitment allows individuals to develop and sustain a sense of coherence, continuity, and uniqueness, and it fosters democratic cooperation and social cohesion. In their recent book Buchanan and Powell claim that there is moral progress. Their analysis focuses on increasing inclusiveness, yet they also suggest other dimensions as possible indicators-improvements in the concept of morality and refinements in moral motivation. In the following I present empirical data on changes in moral understanding that occurred during the second half of the 20th century in Germany. These changes concern an increasing delimitation of the moral realm, the rise of an ethics of responsibility, the displacement (...) of an orientation to super ego dictates by a more ego-syntonic type of moral motivation. This research largely follows the ‘cognitivist’ paradigm which I start off defending against Haidt’s counter proposal of moral intuitionism. Feasible explanatory factors for the changes documented are put forward-processes of secularization and changes in socialization styles-and their interpretation as indicators of moral progress is discussed. The paper ends with brief speculations concerning possible reasons for current moral regressions. (shrink)

Excerpt: 1. Introduction This chapter provides insight into the diverse ethical debates on genetics and epigenetics. Much controversy surrounds debates about intervening into the germline genome of human embryos, with catchwords such as genome editing, designer baby, and CRISPR/Cas. The idea that it is possible to design a child according to one’s personal preferences is, however, a quite distorted view of what is actually possible with new gene technologies and gene therapies. These are much more limited than the editing and (...) design metaphors suggest. Such metaphors are therefore highly problematic phrases in the context of new gene technologies, for two reasons. On one hand, to design a child of choice by modifying the genome would require modifying any gene of choice, which is more than can be done with current gene technologies, such as CRISPR/Cas. On the other hand, a modification of genes would need to be enough to create any characteristic of choice in the future child. The latter presupposes the assumption of genetic determinism. Moreover, the CRISPR/Cas technology can not only be used in a potentially therapeutic manner at the germline level. In addition, there is the (more likely) scenario of a future clinical therapeutic use of these new gene technologies for modifying the DNA sequence of other cells of the body (somatic genome editing). There is also the option of modifying the epigenome, that is, the spatial configuration of DNA (epigenome editing) (see table 1). Like genetics and genome editing, epigenetics has been at the center of recent popular scientific and ethical discourse as well as scientific debates. The concept of epigenetics has given rise to very different notions of inheritability and responsibility for health, which, however, are oftentimes based on scientifically controversial basic assumptions. That there continues to be covert genetic determinism in the form of epigenetic determinism (see table 2) in debates about epigenetics has been pointed out in ethical analyses of epigenetics. Neither genetic determinism nor epigenetic determinism has been confirmed scientifically. It is therefore important to recognize the concepts that are discussed (and sometimes harshly criticized) in debates about genome editing and epigenetics—for example, concepts about the causal role of DNA for our own life course. This importance is based on the fact that if we understand such controversial concepts, we will be able to remain critical when evaluating scientific knowledge and ethical arguments about genome editing and epigenetics. This chapter, therefore, explains some of these concepts. For an ethical analysis of epigenetics as well as of genome editing, it is necessary to understand and critically reflect upon the underlying concepts of genetic determinism and other, related -isms. The following section offers a detailed introduction to these -isms (section 2; see also table 2). Section 3 provides an ethical analysis of genome editing and epigenetics based on the explanations in section 2. Section 3 focuses on inheritability and responsibility, justice, safety, the problem of consent, and the effects of genome editing and epigenetics on embryos and future generations. This section does not discuss in detail further points that can be found in ethical debates about epigenetics as well as in ethical debates about genome editing. These points include (among others): • fear that the findings of epigenetics and that the methods of genome editing are misused—this also with respect to eugenics and enhancement; • naturalness—an issue we mention in passing a few times in the following analysis; • a possible connection between the genome/epigenome and the concept of human dignity, and the derived danger of instrumentalization and infringement of autonomy when intervening in the genome or epigenome. Since current discourse about ethical issues associated with genome editing focuses mainly on germline interventions, which are, for instance, interventions into a human embryo’s genome, we mainly focus on germline interventions when comparing the debates on genome editing and on epigenetics in section 3. Targeted modifications of the human epigenome, epigenome editing (EE), are around the corner. For EE, techniques similar to genome editing (GE) techniques are used. While in GE the genetic information is changed by directly modifying DNA, intervening in the epigenome requires modifying the configuration of DNA, for example, how it is folded. This does not come with alterations in the base sequence (‘genetic code’). To date, there is almost no ethical debate about EE, whereas the discussions about GE are voluminous. (...) Our article introduces EE into bioethics by translating knowledge from science to ethics and by comparing the risks of EE with those of GE. We, first (I), make the case that a broader ethical debate on EE is due, provide scientific background on EE, compile potential use-cases and recap previous debates. We then (II) compare EE and GE and suggest that the severity of risks of novel gene technologies depends on three factors: (i) the choice of an ex vivo versus an in vivo editing approach, (ii) the time of intervention and intervention windows and (iii) the targeted diseases. Moreover, we show why germline EE is not effective and reject the position of strong epigenetic determinism. We conclude that EE is not always ethically preferable to GE in terms of risks, and end with suggestions for next steps in the current ethical debate on EE by briefly introducing ethical challenges of new areas of preventive applications of EE (III). This article explores the relationship between medicine’s history and its digital present through the lens of the physician-patient relationship. Today the rhetoric surrounding the introduction of new technologies into medicine tends to emphasize that technologies are disturbing relationships, and that the doctor-patient bond reflects a more ‘human’ era of medicine that should be preserved. Using historical studies of pre-modern and modern Western European medicine, this article shows that patient-physician relationships have always been shaped by material cultures. We discuss three activities (...) – recording, examining, and treating – in the light of their historical antecedents, and suggest that the notion of ‘human medicine’ is ever-changing: it consists of social attributions of skills to physicians that played out very differently over the course of history. 1947 legt Hans Blumenberg aus Bargteheide in Holstein an der Christian-Albrechts-Universität zu Kiel seine unter schwierigsten persönlichen Umständen entstandene Dissertation 'Beiträge zum Problem der Ursprünglichkeit der mittelalterlich-scholastischen Ontologie" vor. Hinter diesem Titel verbirgt sich eine mit ständigem Bezug auf die Philosophie Heideggers und seine "Fundamentalontologie' geführte Auseinandersetzung mit dem Denken des christlichen Mittelalters, in dem die Frage nach dem Grund des Seins eine so krisenhafte wie produktive Zuspitzung erfahren hatte. Die Dissertation wird von den Gutachtern Ludwig Landgrebe und Rudolf (...) Schneider mit "ausgezeichnet" bewertet, aber sämtliche Bemühungen, zeitnah einen Verlag für die Arbeit zu finden, scheitern. Blumenbergs brillantes Erstlingswerk blieb mehr als 70 Jahre ungedruckt. Nun wird es erstmals publiziert in einer leserorientierten Edition, die unter anderem Übersetzungen der zahlreichen altsprachlichen Zitate wie auch ein "Verzeichnis der Referenzliteratur" bietet, das die Lücke des im Original fehlenden Literaturverzeichnisses schliesst und dieses darüber hinaus durch heute zugängliche Ausgaben ergänzt.
