The value of solidarity, which implies mutual concern and support, is often conveyed in our everyday moral and political language. But what is its conceptual relationship with justice? Influential positions in this debate may argue for the opposition between the two concepts: justice is impartial and universal, while solidarity is partial and limited. The present paper aims to shortly explore a range of theories that may exemplify possible answers to this position, from communitarian and realist views, which ultimately confirm the (...) opposition, to political solidarities, which claim an instrumental need for solidarity as a reaction to injustices. Special attention will be paid to Habermas’s compatibilist account of solidarity as the “reverse side” of justice. The paper contends that a compelling answer should preserve the difference between the two spheres and the essential features of solidarity by also sketching a concept of solidarity as a social duty arising from our moral interdependence. ABSTRACT In times of crisis, interpersonal and group solidarity often emerge as people face critical challenges that threaten their survival. However, it remains unclear whether spontaneous solidarity practices are enough to effectively face such crisis situations. In this paper, we argue that to be fully effective, solidarity must be deployed through all its political tiers, from interpersonal and group relationships to institutional and legal normativity. We contend that solidarity relations can only reach an enduring goal if they solidify into stable (...) principles that can be acknowledged and enacted at the institutional level. Through an examination of recent literature and concrete case studies, the paper investigates the linkages and mutual dependencies between the various levels of solidarity developed throughout the COVID-19 pandemic. This analysis may allow us to answer the question of whether a “Multilevel European Solidarity” is a realistic goal, and what is required to achieve it. (shrink)

Social behaviors rely on the coordination of multiple effectors within one’s own body as well as between the interacting bodies. However, little is known about how coupling at the interpersonal level impacts coordination among body parts at the intrapersonal level, especially in ecological, complex, situations. Here, we perturbed interpersonal sensorimotor communication in violin players of an orchestra and investigated how this impacted musicians’ intrapersonal movements coordination. More precisely, first section violinists were asked to turn their back to the conductor and (...) to face the second section of violinists, who still faced the conductor. Motion capture of head and bow kinematics showed that altering the usual interpersonal coupling scheme increased intrapersonal coordination. Our perturbation also induced smaller yet more complex head movements, which spanned multiple, faster timescales that closely matched the metrical levels of the musical score. Importantly, perturbation differentially increased intrapersonal coordination across these timescales. We interpret this behavioral shift as a sensorimotor strategy that exploits periodical movements to effectively tune sensory processing in time and allows coping with the disruption in the interpersonal coupling scheme. As such, head movements, which are usually deemed to fulfill communicative functions, may possibly be adapted to help regulate own performance in time. (shrink)

As people look for a way to ground their judgments of moral, political, aesthetic claims in the face of the postmodernists who claim nothing can be grounded, Reflective Authenticity attempts to rescue some of the critical ideals of the Enlightenment without falling prey to those who say that the Enlightenment's tenets of objectivity, reason, liberalism makes this impossible and in the face of multiculturalism, difference, and the death of subject, are outdated. Alessandro Ferrara suggests that the notion of reflective (...) authenticity offers the key to a new kind of exemplary universalism which, different from the generalizing universalism typical of modern thought, does not fall under the critique of foundationalism articulated by postmodernist thinkers. Mood profiling has a long history in the field of sport and exercise. Several novel mood profile clusters were identified and described in the literature recently (Parsons-Smith, Terry, & Machin, 2017). In the present study, we investigated whether the same clusters were evident in an Italian language, sport and exercise context. The Italian Mood Scale (ITAMS; Quartiroli, Terry, & Fogarty, 2017) was administered to 950 Italian-speaking sport participants (659 females, 284 males, 7 unspecified; age range = 16–63 yr., M = (...) 25.03, SD = 7.62) and seeded k-means clustering methodology applied to the responses. Six distinct mood profiles were identified, termed the iceberg, inverse iceberg, inverse Everest, shark fin, surface, and submerged profiles, which closely resembled those reported among English-speaking participants (Parsons-Smith et al., 2017). Significant differences were found in the distribution of specific mood profiles across gender and age groups. Findings supported the cross-cultural generalizability of the six mood profiles and offer new research avenues into their antecedents, correlates and behavioral consequences in Italian-language contexts. This article proposes an analysis of a ritual glitch and resulting “misfire” from the standpoint of a phenomenologically informed anthropology of human interaction. Through articulating a synthesis of some of Husserl‘s insights on attention and affection with concepts and methods developed by anthropologists and other students of human interaction, a case is made for the importance of understanding the social organization of attention in ritual encounters. An analysis of a failed toast during President Obama’s 2011 State Visit to the United (...) Kingdom is used to illustrate how attention is directed toward certain participants, actions, and objects – as opposed to others. Affect-loaded empathic reactions are explained by the protracted temporal unfolding of an action whose successful conclusion – or “repair” - is ostensively and publicly delayed. (shrink)

This text is an integrated and comprehensive account of theories of justice and judgement in contemporary political and moral philosophy. It offers a critical examination of judgement and normative validity in the recent works of Rawls, Habermas, Ackerman, Michaleman, and Dworkin. Ferrara demonstrates how the understanding of justice and normative validity, since the linguistic turn in philosophy, is defined in terms of reflective judgement. This demonstration comprises of an historical overview of the judgement model in contemporary political philosophy that focuses (...) on Rawls on ` justice as fairness' and Habermas on the discourse theory of law and the public sphere. This article examines recent theories of democratic citizenship as well as the institutional separation of religion and politics in light of shortcomings with the traditional secularization thesis. Due to the fact that juridical norms and forms of consciousness develop at a more rapid pace than religious ones, received accounts of both democratic equality and toleration need to be reconceptualized. Questions concerning the legitimacy and neutrality of religious reasoning in democratic politics, as pursued in the work of Rawls and Habermas, also (...) need to be informed by further reflection on the confessional context and other empirical features of post-secular societies. The author applies philosophy in order to get to a better understanding of pragmatics, and pragmatics in order to get a better understanding of philosophy. The book starts with a chapter on the non-cancellability of explicatures and the role that this idea plays in the resolution of Grice’s circle, and proceeds (...) with the discussion of other topics in which explicatures or cancellability play an important and decisive role. While the reader proceeds in the reading of this book, they accumulate notions and pieces of knowledge which will be of invaluable use when arriving at the chapter on conversational presuppositions, where the author expresses his most radical views: namely that presuppositions are indeed cancellable, contrary to what many believe. I defend the ethical fittingness theory (EFT), the thesis that whenever it is legitimate ethically to evaluate a representational artwork for the perspective it embodies, such evaluation systematically bears on the work's artistic value. EFT is a form of radical moralism, claiming that the systematic relationship between the selected type of ethical evaluation and artistic evaluation always obtains, for works of any kind. The argument for EFT spells out the implications of ethically judging an artwork for its perspective, where such (...) an ethical evaluation is understood as an assessment of how well the work's ethical perspective fits extra-fictional reality—how appropriate, correct, or true the perspective is. The argument shows that the ethical legitimacy of judging a work for its perspective ipso facto proves the judgment's art-critical relevance. Hence, the argument effectively amounts to a reductio ad absurdum of theories that admit the legitimacy of ethically judging artworks this way, but deny or qualify the judgment's relevance to artistic merit. Since EFT is stated conditionally, the argument need not indicate how often artworks are subject to this type of ethical evaluation. Nonetheless, I make a case for the relevance of EFT to actual art criticism and contemporary philosophical debate. (shrink)

The recent debate on pragmatics and the law has found ways to circumvent an important distinction, originally drawn by Dascal and Wróblewski (1991), between the historical law-maker, the current law-maker, and the ideal/rational law-maker.1 By insisting on the relationship between the rational law-maker and contextualism and textualism (see Manning 2005, 2006), I want to redress this fault in current discussions. In this paper, I start with general considerations on pragmatics, intentionality in ordinary conversation, and intentionality in the context of judiciary (...) proceedings and legal texts. I then move on to considerations on rationality as a prerequisite for understanding the law and on the rational law-maker, an ideal construct proposed by Dascal and Wróblewski (1991). I argue that contextualism (of the moderate kind) is the best way to carry out the program by Dascal and Wróblewski on interpretation and the rational law-maker (also see considerations by Fish 2005); (on contextualism see Dascal and Weizman 1987). I argue that bearing in mind the rational law-maker postulated by Dascal and Wróblewski is a guidance to interpretation of statutes whose texts create interpretative difficulties. I conclude by saying that the considerations on the rational law-maker constitute a compromise between Scalia’s (1997) textualism and contextualism (see Manning 2005, 2006 on the divide between textualism and contextualism). The article reconstructs Habermas’ view of capitalism from the 1970s to his most recent writings. It takes its starting point from Wolfgang Streeck’s claim that Habermas has failed to acknowledge that the real enemy of democracy is not bureaucracy but capitalism and that, therefore, he underestimates the role of capitalism in shaping the global order. It first returns to the diagnoses of late capitalism that Habermas developed in the 1970s and early 1980s and then moves on to some of his (...) later writings. This will reveal that there was indeed a shift of emphasis from a critique of capitalism to a critique of technocracy, but not because of Habermas’ unawareness of the role of capitalism in shaping reality. Rather, he has come to objectify capitalism while looking for legal and political tools for reining it in instead of looking for possible alternatives to it. (shrink)

In the global world, momentous migratory tides have produced hyper-pluralism on the domestic scale, bringing citizens with radically different conceptions of life, justice and the good to coexist side by side. Conjectural arguments about the acceptance of pluralism, the next best to public reason when shared premises are too thin, may not succeed in convincing all constituencies. What resources, then, can liberal democracy mobilize? The multivariate democratic polity is the original answer to this question, based on an interpretation of Rawls (...) which revisits Political Liberalism in the light of The Law of Peoples . The unscrutinized assumption is highlighted, often read into Rawls’s Political Liberalism , that a polity moves homogeneously and all of a piece from religious conflict to modus vivendi, constitutional consensus and finally to overlapping consensus. Among today's Italian philosophers, Massimo Cacciari is perhaps the most assiduous commentator of Dante. Philosophy, Mysticism, and the Political collects all of Cacciari's writings on Dante to this day, from his masterful analysis of St. Francis of Assisi in Dante's Paradiso and Giotto's frescoes to a new consideration of Dante's "European" idea of empire as a federation of nations, peoples, and languages. Cacciari does not force Dante into any philosophical straitjacket. Rather, he walks with Dante, takes notes, asks questions, raises (...) issues, and tries to understand the Divine Comedy in Dante's terms. Cacciari approaches Dante's Ulysses and the theologico-philosophical vertigo of Paradiso not as a critic but from the point of view of a faithful, assiduous, perceptive, sometimes perplexed, and sometimes worshipful reader. It has been argued that the thirteenth and fourteenth centuries were a crucial period in the medieval development of the idea of contagion. Theologians and physicians cooperated in devising a conceptual model based on medical literature (Hippocratico-Galenic and Avicennian) and formulated primarily to explain the origin, transmission, and development of contagious diseases, but that was flexible enough to be applied to a number of other different phenomena (the communication of sin and vices, love sickness, fascination, etc.). This article explores the (...) ways in which Albert the Great contributed to the formation of this broad and highly articulated notion of contagion. First, he provided a systematic analysis of the mechanisms of pathogenesis and transmission of contagious diseases (in particular, pestilences and leprosy). Moreover, his interests encompassed several different forms of contagion, including the powers of stones (e.g., the attractive virtue of the magnet) and animals, the influences of the woman’s body and mind (mulier menstruata and vetula), fascination. Albert also provided different models for the explanation of the “contagious influence” (mechanical explanation based on physical contact, the Avicennian theory of psychosomatic transformations, the Avicennian doctrine of the power of the soul over external bodies, spiritual transmission of sins). As a result of his investigation into the mechanisms of disease transmission, air contamination, noxious influences, and fascination, Albert came to problematize the usual idea of natural causality based on the principle of contact between substances, and to test the potentials and limits of action at-a-distance. In particular, the present paper will examine Albert’s views on some of the phenomena explained through the concept of contagion: pestilences, leprosy, the basilisk, the menstruating woman, and fascination. This volume highlights important aspects of the complex relationship between common language and legal practice. It hosts an interdisciplinary discussion between cognitive science, philosophy of language and philosophy of law, in which an international group of authors aims to promote, enrich and refine this new debate. According to the doctrine of the Great Year, after a long period of time the same astral configurations reappear and the planets return to their original positions. The end of a world cycle is marked by a natural cataclysm, after which the world is restored to its original state and history repeats itself. This article deals with Albert the Great’s views on the Great Year, focussing on two of his early theological works (the De iv coaequaevis and the Sentences commentary). (...) The evidence here provided offers a comprehensive overview of the variety of contexts and themes which Albert considers to be related to the Great Year. He is fully aware of the many doctrinal implications of the concept of the Great Year. His analysis is deeply embedded in the astronomical discussions on the phenomenon of the precession of the equinoxes. A predominantly scientific approach is evident in the care with which he distinguishes the different types of Great Year. The major contribution of these works to the debate lies in the analysis of the impact of the Great Year on Christian eschatology and, more generally, in the investigation of the relationship between astrology and physics, on the one hand, and eschatology, on the other. Riassunto: La geomanzia, una disciplina divinatoria importata dal mondo arabo, prosperò nel medioevo latino. Di fronte a tale popolarità traduttori e autori di trattati geomantici, filosofi, teologi e letterati si interrogarono sulla sua validità, sulle sue implicazioni filosofiche e sulla visione del mondo che essa presupponeva. Il presente contributo esamina questo dibattito. In particolare, si ricostruisce lo statuto epistemologico della geomanzia nei suoi rapporti con l’astrologia. Il problema della scientificità della geomanzia viene discusso anche nel contesto dell’azione della causalità celeste (...) sul mondo sublunare. Sono esaminati i ruoli del geomante e dell’interrogante ed è analizzato il concetto di intentio, che rimanda ad un’analisi psicologica peculiare della geomanzia. Caratterizza la geomanzia anche una dimensione rituale fatta di prescrizioni preliminari e di invocazioni da rivolgere alla divinità. Quanto detto impedisce di ridurre la geomanzia ad una semplice tecnica divinatoria; essa appare piuttosto una forma di sapienza rivelata solo al geomante esperto e moralmente degno, che attinge così la conoscenza di eventi futuri e cose nascoste. Da questa breve ricostruzione emerge l’articolata natura della geomanzia, contraddistinta, nella sua originaria versione araba, da una marcata impronta religiosa e da uno stretto, benché ambiguo, nesso con la profezia Islamica.: Geomancy, a divinatory discipline imported from the Arab world, flourished in the Latin Middle Ages. In the attempt to explain the popularity of geomancy, translators and authors of geomantic writings, philosophers, theologians, and other scholars addressed such issues as its validity, its philosophical implications, and the worldview it presupposed. This paper explores this debate, delineating the epistemological status of geomancy in relation to astrology. The problem of the scientificity of geomacy will be discussed with regard to the celestial influences on the sublunary world. In addition, the different roles played by both the geomancer and the consultant are examined. Attention will be paid to the concept of intentio, which implies a psychological analysis peculiar to geomancy. Geomancy is also characterized by ritual elements such as both preliminary prescriptions and invocations of God, meaning that it is not an ordinary divinatory technique, but a form of wisdom revealed only to experienced and upright geomancers, who can thus obtain knowledge of future events and hidden things. From this analysis emerges the complex nature of geomancy, whose original Arabic version had a prominent religious character and a close, albeit ambiguous, link with Islamic prophecy. (shrink)

Objectives: Technology can assist and support both people with dementia and caregivers. Recently, technology has begun to embed remote components. Timely with respect to the pandemic, the present work reviews the most recent literature on technology in dementia contexts together with the newest studies about technological support published until October 2020. The final aim is to provide a synthesis of the timeliest evidence upon which clinical and non-clinical decision-makers can rely to make choices about technology in the case of further (...) pandemic waves.Methods: A review of reviews was performed alongside a review of the studies run during the first pandemic wave. PsycInfo, CINAHL, and PubMed-online were the databases inspected for relevant papers published from January 2010.Results: The search identified 420 articles, 30 of which were reviews and nine of which were new studies meeting the inclusion criteria. Studies were first sorted according to the target population, then summarized thematically in a narrative synthesis. The studies targeting technologies for PWD were categorized as follows: monitoring and security purposes, sustaining daily life, and therapeutic interventions. Each category showed potential benefits. Differently, the interventions for caregivers were classified as informative, psycho-education programs, psychosocial-supportive, therapeutic, and cognitive/physical training. Benefits to mental health, skills learning, and social aspects emerged.Conclusions: The evidence shows that technology is well-accepted and can support PWD and caregivers to bypass physical and environmental problems both during regular times and during future pandemic waves. Nevertheless, the lack of a common methodological background is revealed by this analysis. Further and more standardized research is necessary to improve the implementation of technologies in everyday life while respecting the necessary personalization. (shrink)

This paper engages with Ferrajoli’s contribution to the philosophical debate on constitutional democracy and in particular his conception of ‘structural entrenchment’, or the basis upon which one can defend the normativity of the Constitution as ‘higher law’, which can trump or limit legislation, without infringing democratic principles. Ferrajoli’s own understanding of ‘structural entrenchment’ is compared to Rawls’s and Dworkin’s arguments in support of it. Ferrajoli’s position is neither grounded on a philosophy of history, as in Rawls, nor on a version (...) of moral realism, as for Dworkin, but on a formal understanding of the nature of fundamental rights, and in a conception of democratic sovereignty as ‘joint ownership.’.
