J.L. Austin has demonstrated that people can do things—bring about social facts — with words. Here we describe how some people do things with things. This is a study of the symbolic use and situated history of material objects during a business negotiation between two German entrepreneurs: of the practical transformation of things-at-hand from objects of use into exemplars, or into forms-at-hand that can be used for the construction of transitory symbolic artifacts. Arranging boxes in a particular fashion can be (...) the equivalent of an illocutionary act, but unlike words things remain on the scene as indexical monuments to prior interactional arrangements. This paper reports on a micro-ethnography of social interaction in an urban plaza in Colombia, focusing on the plaza’s role as an arena for the acquisition of interaction skills. We investigate how children of different ages initiate and sustain interactions with same-age and older peers and the efforts they make to be recognized and ‘visible’. We interpret our data in light of three theories of socialization: Corsaro’s conception of childhood as “interpretive reproduction”, Vygotsky’s model of the “zone of proximal development”, (...) and the “structural approach” to social cognition and development. While a social form like the plaza, which is collectively enacted by members of all age groups of the local community, provides children with an extraordinarily rich array of opportunities to develop social communication skills by interacting with older and younger peers, our analysis also demonstrates that children, as they are building zones of proximal development for themselves, play a central role in assembling, integrating, and sustaining the neighborhood as a face-to-face society. In this fashion, the paper illustrates how the micro-analysis of social interaction can contribute to the analysis of social ‘macro’ forms. (shrink)

Human interaction and communication involve space in multiple ways. This paper examines the spatial and interactional order of a covertly video-taped police interrogation. When the participants enter the interrogation room and become engaged in the interrogation process, the room itself is a constraint and a resource for interaction. While interacting within a built environment, the participants appropriate their material surroundings in ways that constitute a spatial order and make possible certain arguments. This paper examines how the physical structure of the (...) interrogation room is differentially appropriated, used, and filled in by the participants''; territorial and postural manoeuvers over the course of their interaction; and how the spatial structures thus created by the bodily appropriation of the physical locale are subsequently formulated by talk and thereby used as a metaphorical resource to frame the participants'' situated experience. Through this embedded process, the interrogators move the suspect toward confession. (shrink)

This paper investigates how talk and practical action are coordinated during one type of activity involving professional communication: the service-­assessment sequence in hair salons. During this activity, a practical inspection of the haircut must be coupled with sequentially produced verbal acts. Our analysis of four examples reveals that there is no fixed relationship between the organization of talk and practical action. Instead, people manipulate this relationship on a moment-by-moment basis, often coordinating the two into a single, integral package, or relying (...) on one stream of action to achieve progress in the other. These findings imply that some multimodal activities that are brought into alignment may have their own, separate and independent procedural logic and sequencing patterns and that these can be brought into play to create or deal with constraints in each other. The task of this brief presentation is to “establish a dialogue” with Streeck’s text, attempting to fill the hiatus between the answer and the original question that Habermas’ interpretation intended to pose to those wishing to simply dispose of economic and monetary union, ending up by dismantling the political and cultural integration project that inspired the founding fathers. Streeck complains about the “levity” with which many reviewers accepted “as a slogan” the “killer-argument” [Totschlagargument] of the “nostalgic option” provided (...) by the interpretation of his most recent publication and the excuse for his removal from the assembly of “guardians of the Holy Grail”. Now, while acknowledging that in the thesis of the author of Gekaufte Zeit [4] there is no trace of nationalist seeds, which – as Altiero Spinelli observed – “had caused the catastrophe of the two World Wars” [5], Habermas’ critique seizes the unrealistic thoughtlessness of an idea that ends up evoking the system of “European cooperation” between the now impotent national states. We can do without the “specialisation in Europeanism” that according to Streeck, would be required as a preliminary to discuss European policy in the German public arena, but not criticism that is constructive and not defeatist. The article explores the underlying reasons for patients’ self‐perception of being a burden (SPB) in family settings, including its impact on relationships when wishes to die (WTD) are expressed. In a prospective, interview‐based study of WTD in patients with advanced cancer and non‐cancer disease (organ failure, degenerative neurological disease, and frailty) SPB was an important emerging theme. In a sub‐analysis we examined (a) the facets of SPB, (b) correlations between SPB and WTD, and (c) SPB as a relational phenomenon. We (...) analyzed 248 interviews with 62 patients, their family caregivers, and professionals using grounded theory and interpretive phenomenological analysis. SPB appeared as important empathic concern in care situations. Patients expressed many sorts of concerns for others, but also perceived an altered self‐understanding that did not meet mutual expectations within relationships. In SPB associated with WTD three constellations were found: (a) WTD to unburden others; (b) patients decided against hastening death to prevent being a further burden to others (in these cases, the SPB counteracted the wish to die); and (c) both wishes for and against dying were sustained by SPB. These patients often felt paralyzed and suffered deeply. Family caregivers felt emotionally touched by SPB and tried to unburden patients by caring and compassion. We concluded that the impact of SPB on a WTD and the various meanings the facets of SPB have in balancing relationships need to be worked out individually. Palliative care names as one of its central aims to prevent and relieve suffering. Following the concept of “total pain”, which was first introduced by Cicely Saunders, PC not only focuses on the physical dimension of pain but also addresses the patient’s psychological, social, and spiritual suffering. However, the goal to relieve suffering can paradoxically lead to a taboo of suffering and imply adverse consequences. Two scenarios are presented: First, PC providers sometimes might fail their own ambitions. If all other (...) means prove ineffective terminal sedation can still be applied as a last resort, though. However, it may be asked whether sedating a dying patient comes close to eliminating suffering by eliminating the sufferer and hereby resembles physician-assisted suicide, or euthanasia. As an alternative, PC providers could continue treatment, even if it so far prove unsuccessful. In that case, either futility results or the patient might even suffer from the perpetuated, albeit fruitless interventions. Second, some patients possibly prefer to endure suffering instead of being relieved from it. Hence, they want to forgo the various bio-psycho-socio-spiritual interventions. PC providers’ efforts then lead to paradoxical consequences: Feeling harassed by PC, patients could suffer even more and not less. In both scenarios, suffering is placed under a taboo and is thereby conceptualised as not being tolerable in general. However, to consider suffering essentially unbearable might promote assisted dying not only on an individual but also on a societal level insofar as unbearable suffering is considered a criterion for euthanasia or PAS. ZusammenfassungEs ist in der Literatur weithin bekannt, dass im Gesundheitswesen auf unterschiedlichen Ebenen Allokationsentscheidungen getroffen werden. Während es auf der Makroebene um gesellschaftlich-politische Strukturfragen geht, stehen die Akteure der Mikroebene vor der Aufgabe, begrenzte Ressourcen in einer Organisation sinnvoll einzusetzen. In den ethischen Analysen der Mikro-Allokationsebene werden zumeist Entscheidungen der Healthcare Professionals thematisiert, weil sie eine unmittelbare Auswirkung auf die konkreten Patienten haben. Weniger in den Blick geraten Allokationen des Managements, welche die Rahmenbedingungen für Ressourcenzuteilungen beim Patienten betreffen. Hierbei geht (...) es nicht bloß um den Einsatz von Sachmitteln, sondern auch um den Personaleinsatz. Das Personalmanagement ist damit in wichtige Allokationsentscheidungen eingebunden und trägt eine dreifache Verantwortung: für die Gesundheit der Patienten, der Mitarbeiter und der Organisation. Der vorliegende Beitrag geht der Frage nach, welche Aspekte der Allokationsethik aus der Sicht des Personalmanagements in einem Krankenhaus zu bedenken sind, um der dreifachen Verantwortung gerecht zu werden. Dadurch zeigt sich, dass Allokationsethik in einem Krankenhaus nicht adäquat erfasst werden kann, ohne sich mit dem Personalmanagement zu beschäftigen, da das Personal die wertvollste Ressource ist, die es in einem Krankenhaus zu allozieren gilt. Spengler’s Untergang des Abendlandes (The Decline of the West) (1918–22) was a sensational success in its own time, but has since slipped into oblivion. In this article I attempt to restore those aspects of his doctrine which could speak to us today and alert us to a crisis of the European Geist and its survival exigencies. This involves a reorientation on several issues on which our present perspectives differ from those that were current 100 years ago, such as the precedence (...) of his philosophical approach over the historical approach; the diminished importance of his extensive analysis and depiction of defunct civilisations, which serve at best as illustrative material rather than as direct comparisons on a somewhat risky notion of “simultaneity.” I also propose more relevant criteria in justification of his Faustianism (its sources and inception), and, not least, point to a differentiation between prediction and prognosis. The intention is to highlight the rationale behind Spengler’s enquiries into history—namely to situate Western civilisation in the overall scheme of human civilisations by alerting us to a decisive crossroads. This required of its author a means of identifying the symptoms that we must be aware of in order to sustain our world without tumbling unawares into a major catastrophe. The Untergang does not compulsorily wipe our civilisation out unless we provoke this to occur; instead, our civilisation may merge or blend peacefully with whatever culture(s) may be waiting to inaugurate a new cycle. ZusammenfassungDer Artikel wirft einen kritischen Blick auf die gegenwärtige Theorie und Praxis palliativer Versorgung, auf ihren Umgang mit dem Sterben und mit Sterbenden und auf die zugrundeliegende Leitvorstellung von einem guten Sterben. Dabei wird Foucaults Begriff der Biomacht als Beschreibungs- und Deutungskategorie zu Rate gezogen. Weil mit Palliative Care das Anliegen verfolgt wird, ein gutes Sterben zu ermöglichen, sind vielfältige Kriterienkataloge und Messinstrumente entstanden, um die Behandlungen nach wissenschaftlichen Maßstäben zu planen und ihren Erfolg zu bestimmen. Im Lichte des Begriffs (...) der Biomacht zeigen sich potenziell problematische Aspekte dieser Entwicklung, die im bioethischen Diskurs üblicherweise verborgen bleiben. Indem die Lebensqualität von Sterbenden verbessert und zu diesem Zweck nicht allein körperliche Beschwerden, sondern auch psychisches, soziales und spirituelles Leiden gelindert werden soll, verschreibt sich die Palliative Care-Bewegung in einer Weise der Steigerung des Lebens, die den Einzelnen überfordern kann und seinen eigentlichen Bedürfnissen womöglich nicht gerecht wird. Frequently, historical comparisons are asymmetrical in the sense that they investigate one case carefully while limiting themselves to a mere sketch of the other case which serve as comparative reference point. The debate on the German Sonderweg and the rich historical literature originating from this debate can serve as examples. This article reconstructs the pros and cons within this controversial debate, reports its results and puts it into a broader historical context. It analyzes the comparative logic implied by the Sonderweg (...) thesis and argues that the interpretation of modern German history in the sense of a Sonderweg can only be maintained if related to the question why Germany turned fascist and totalitarian in the interwar period while other societies did not, and if Western countries are selected as units of comparison. The choice of comparative reference points turns out to be decisive and partly dependent on normative priorities and conventions. The article points to dangers and opportunities inherent in asymmetrical comparison. (shrink)

This paper highlights the role of Lewis’ Principal Principle and certain auxiliary conditions on admissibility as serving to explicate normal informal standards of what is reasonable. These considerations motivate the presuppositions of the argument that the Principal Principle implies the Principle of Indifference, put forward by Hawthorne et al.. They also suggest a line of response to recent criticisms of that argument, due to Pettigrew and Titelbaum and Hart, 621–632, 2020). The paper also shows that related concerns of Hart and (...) ZusammenfassungIn den letzten Jahren wird intensiv darüber diskutiert, ob und in welcher Weise das Gewissen im Kontext der Apotheke zu schützen ist. Der Status quo in Deutschland und Österreich sieht keine gesetzliche Regelung für dieses Problem vor. Der ethische Rahmen für eine Bewältigungsstrategie im Umgang mit dem Problem der Gewissensfreiheit in der Apotheke wird deutlich gemacht. Unter Anwendung des rechtsethischen Verhältnismäßigkeitsprinzips wird das Problem mit Berücksichtigung des deutschen und österreichischen Verfassungsrechts sowie der Europäischen Menschenrechtskonvention auf individueller, korporativer und gesellschaftlicher Ebene (...) analysiert. Auf individueller Ebene sind die berechtigten Interessen und Güter des Apothekers einerseits und der Patientin andererseits durch eine grundrechtliche Verhältnismäßigkeitsprüfung zu einem schonenden Ausgleich zu bringen. Auf korporativer Ebene legitimiert das auf der Religions- und Weltanschauungsfreiheit basierende Selbstbestimmungsrecht die ideologisch profilierte Apotheke als Organisation und kann in der Binnenbeziehung der Apotheke einen Loyalitätskonflikt verursachen. Auf gesellschaftlicher Ebene stehen vier Optionen der proaktiven rechtspolitischen Gestaltung der Gewissensproblematik zur Verfügung: sozialstaatlich, libertär, professionsbezogen und kommunitär. Wie Konflikte auf individueller oder korporativer Ebene gelöst werden können, hängt von den Optionen ab, die auf gesellschaftlicher Ebene gewählt werden. Für den Fall einer Änderung des Status quo wird für zwei Lösungsansätze argumentiert: a) die Einführung einer qualifizierten Gewissensklausel für Apotheker (mit Beratungs-, Verweis-, Notfall- und Verständigungspflicht); b) die auf einen Kompromiss zwischen ideologisch profilierter pharmazeutischer Korporation (Apotheke oder Apothekervereinigung) und Sozialstaat abzielende „weiche“ kommunitäre Option. Healthcare ethics consultation has been developed, practiced, and analyzed internationally. However, only a few professional standards have evolved globally in this field that would be comparable to standards in other areas of healthcare. This article cannot compensate for this situation. It contributes to the ongoing debate on professionalization by presenting experiences with ethics consultation in Austria, though. After exploring its contexts and providing an overview of one of its primary ethics programs, the article analyzes the underlying assumptions of “ethics consultation” (...) as an essential effort on the path to professionalize ethics consultation. Objective Bayesian epistemology invokes three norms: the strengths of our beliefs should be probabilities, they should be calibrated to our evidence of physical probabilities, and they should otherwise equivocate sufficiently between the basic propositions that we can express. The three norms are sometimes explicated by appealing to the maximum entropy principle, which says that a belief function should be a probability function, from all those that are calibrated to evidence, that has maximum entropy. However, the three norms of objective Bayesianism (...) are usually justified in different ways. In this paper we show that the three norms can all be subsumed under a single justification in terms of minimising worst-case expected loss. This, in turn, is equivalent to maximising a generalised notion of entropy. We suggest that requiring language invariance, in addition to minimising worst-case expected loss, motivates maximisation of standard entropy as opposed to maximisation of other instances of generalised entropy. Our argument also provides a qualified justification for updating degrees of belief by Bayesian conditionalisation. However, conditional probabilities play a less central part in the objective Bayesian account than they do under the subjective view of Bayesianism, leading to a reduced role for Bayes’ Theorem.
