This essay deals with American fiction between the early 1850s, when Hawthorne and Melville produced their best work, and the first novels of Howells and James in the early 1870s. The familiar notion that this was the period of transition from pre-Civil War Romanticism to postwar Realism tells us nothing in particular about it. Yet we need some historical frame in which to place both of the later efforts of Hawthorne and Melville and the apprentice work of the next generation (...) of novelists. To this end, I propose to examine a few examples of the popular fiction that held at least quantitative dominance of the field. Hawthorne and Melville believed that the unprecedented sales of a new kind of stories by women writers contributed significantly to the loss of audience they both suffered in the early 1850s; and not only Howells and James but also Mark Twain showed in their early careers an unacknowledged attraction toward the procedures of the popular novelists along with a conscious effort to escape from them...the type of best-seller that appeared in the 1850s was an accidental creation rather than the result of conscious contrivance on the part of either authors or publishers. In fact, it caught the publishers by surprise. According to the author's sister , Susan Warner's The Wide, Wide World was rejected by "almost all the leading book firms in New York," and the manuscript was returned with the comment "Fudge!" written on it by a reader for Harper's. Miss Warner, a thirty-one-year-old spinster, was the daughter of a once prosperous New York lawyer who had fallen into financial difficulties. The story resembles Charlotte Bronte's Jane Eyre to the extent that its heroine is an orphan exposed to poverty and psychological hardships who finally attains economic security and high social status through marriage. But the American writer places much more emphasis on the heroine's piety, and the book sets an all-time record for frequency of references to tears and weeping.Henry Nash Smith, professor of English at the University of California at Berkeley, received the John H. The application of evolutionary theory to human behavior has elicited a variety of critiques, some of which charge that this approach expresses or encourages conservative or reactionary political agendas. In a survey of graduate students in psychology, Tybur, Miller, and Gangestad (Human Nature, 18, 313–328, 2007) found that the political attitudes of those who use an evolutionary approach did not differ from those of other psychology grad students. Here, we present results from a directed online survey of a broad sample (...) of graduate students in anthropology that assays political views. We found that evolutionary anthropology graduate students were very liberal in their political beliefs, overwhelmingly voted for a liberal U.S. presidential candidate in the 2008 election, and identified with liberal political parties; in this, they were almost indistinguishable from non-evolutionary anthropology students. Our results contradict the view that evolutionary anthropologists hold conservative or reactionary political views. We discuss some possible reasons for the persistence of this view in terms of the sociology of science. (shrink)

Community custom has played a limited but important role in the law of property. In addition to a few major historic examples such as mining camp rules and whaling, property law sometimes relies on community custom, for example in adverse possession, nuisance law, and beach access. This Article proposes an informational theory of custom in property law. Custom is subject to a communicative tradeoff in the law: all else being equal, informationally demanding customs require an audience with a high degree (...) of common knowledge. General customs already known throughout society do not require much extra publicity from the law, and the law can easily draw on such customs. By contrast, customs that vary by community raise the question of the need for processing by non-expert audiences, i.e., outgroup dutyholders and government officials. This tradeoff helps explain the differential receptiveness to various customs and the process by which they are formalized if they are adopted into the law. The information-cost theory suggests that enthusiasts and skeptics of custom have both tended to ignore this process. The theory is then applied to some suggestive evidence from grazing customs and the pedis possessio doctrine in mining law, under which miners have pre-discovery rights to the spot being worked. Finally, the information-cost theory of custom sheds some light on the history and controversies over the numerus clausus and on the question of baselines of property entitlements in the law of takings.
