Dr Bawa-Garba, a senior paediatric trainee who had been involved in the care of a child who died shortly after admission to hospital, was convicted of gross negligence manslaughter and subsequently erased from the medical register. We argue that criminalisation of doctors in this way is fraught with ethical tensions at levels of individual blameworthiness, systemic failures, professionalism, patient safety and at the interface of the regulator and doctor. The current response to alleged manslaughter during clinical care is not fit (...) for purpose because of its narrow focus on criminalisation and punishment of individual doctors. The justice system fails to take into account systemic issues in a sufficiently proper and informed way particularly in respect of human factors involved in decision-making. It is easier to convict individual doctors for gross negligence manslaughter than it is to effect legal accountability upon organisations. If educational reflections are used to apportion blame, then this could impact detrimentally on honesty and the duty of candour, with negative implications for patient safety. Regulatory processes should not be deployed without consideration of context. There is an urgent need for a fresh and open evaluation of professional and societal expectations from the regulator that should include positive action as well as those that are proportionately punitive. Justice and patient safety would be served better by more sophisticated contextualisation through an approach that balances accountability in healthcare with failures that can occur within complex systems, and by working to a radical shift towards a just culture. In 2014, Lord Saatchi launched his ultimately unsuccessful Medical Innovation Bill in the UK. Its laudable aim was to free doctors from the shackles that prevented them from providing responsible innovative treatment. Lord Saatchi’s principal contention was that current law was the unsurmountable barrier that prevented clinicians from delivering innovative treatments to cancer patients when conventional options had failed. This was because doctors feared that they might be sued or tried and convicted of gross negligence manslaughter if they deviated from (...) standard practice. Concerns about fear of the law and potential negative effects on medical practice are not new. Fear of litigation has been suggested as the reason for doctors practising “defensive medicine,” by opting for treatments regarded as “grievance-resistant,” rather than clinically indicated, for example, by ordering diagnostic tests or performing certain procedures, which are not strictly medically necessary. Whilst this claim is plausible and apparently accepted by the courts, there is limited empirical evidence in support of it so far as practitioners in the UK are concerned. In this paper, we report on our empirical research which provides a snapshot of medical opinion to begin to rectify this gap. We ran focus groups of different medical specialties, asking what these medical practitioners thought the barriers to medical innovation to be. We found that fear of the law was not the principal barrier to be lowered, and that the answer was far more multifaceted. (shrink)

International migration is an important issue for many high‐income countries and is accompanied by opportunities as well as challenges. South Asians are the largest minority ethnic group in the United Kingdom, and this diaspora is reflective of the growing diversity of British society. An empirical study was performed to ascertain the faith‐based values, beliefs, views and attitudes of participants in relation to their perception of issues pertaining to end‐of‐life care. Empirical observations from this study, as well as the extant knowledge‐base (...) from the literature, are used to support and contextualise our reflections against a socio‐legal backdrop. We argue for accommodation of faith‐based values of migrants at end‐of‐life within normative structures of receiving countries. We posit the ethically relevant principles of inclusiveness, integration and embedment, for an innovative bioethical framework as a vehicle for accommodating faith‐based values and needs of migrants at end‐of‐life. These tenets work conjunctively, as well as individually, in respect of individual care, enabling processes and procedures, and ultimately for formulating policy and strategy. (shrink)

Caracterizar a demanda de atendimento psicológico e compreender a experiência dos profissionais que atuaram na pandemia do COVID-19, em uma plataforma de atendimento psicológico on-line. Realizou-se uma análise documental e entrevista semiestruturada com 20 psicólogos que atuaram no mínimo 6 meses na plataforma entre mar/2020 à dez/2022, em que foram atendidos um total 15.963 pacientes. Dentre as demandas, prevaleceram ideação suicida com planejamento, ansiedade e depressão. O perfil prevalente dos pacientes atendidos na pandemia corresponde à literatura, em períodos não pandêmicos, (...) bem como a prevalência de sintomas ansiosos e depressivos. Porém, destacou o surgimento do alto número de pacientes com ideação suicida, o que sugere um agravamento dos transtornos mentais, despertado pela pandemia, além de uma dificuldade comum aos entrevistados, relacionada a clareza dos critérios clínicos utilizados para determinação da gravidade dos casos. Os psicólogos apontaram dificuldades no manejo destes casos graves, intensificados pelo impacto emocional pandêmico também sentido por eles, junto ao despreparo para sua atuação online, as percebendo como limitações. Apesar do despreparo, a alta demanda incitou os profissionais aderirem as especificidades da modalidade. Estes relataram ter buscado aporte teórico e apoio emocional para manterem os recursos internos, cognitivos e emocionais, necessários ao setting terapêutico. Pode-se concluir que os resultados evidenciaram a importância de se refletir sobre os critérios de avaliação clínica utilizados para compreensão da severidade dos casos, sem deixar de considerar os recursos internos dos pacientes relativos à sua capacidade de sofrer, os quais podem ser identificados quando mantida a capacidade de rêverie do profissional. In this paper, we have considered a dynamical model of Chlamydia disease with varying total population size, bilinear incidence rate and pulse vaccination strategy. We have defined two positive numbers $$R_{0}$$ R 0 and $$R_{1}$$ R 1. It is proved that there exists an infection-free periodic solution which is globally attractive if $$R_{0} 1.$$ R 1 > 1. The important mathematical findings for the dynamical behaviour of the Chlamydia disease model are also numerically verified using MATLAB. In this work, our aim is to investigate the impact of a non-Kolmogorov predator-prey-subsidy model incorporating nonlinear prey refuge and the effect of fear with Holling type II functional response. The model arises from the study of a biological system involving arctic foxes, lemmings, and seal carcasses. The positivity and asymptotically uniform boundedness of the solutions of the system have been derived. Analytically, we have studied the criteria for the feasibility and stability of different equilibrium points. In addition, we have (...) derived sufficient conditions for the existence of local bifurcations of codimension 1. It is also observed that there is some time lag between the time of perceiving predator signals through vocal cues and the reduction of prey’s birth rate. So, we have analyzed the dynamical behaviour of the delayed predator-prey-subsidy model. Numerical computations have been performed using MATLAB to validate all the analytical findings. Numerically, it has been observed that the predator, prey, and subsidy can always exist at a nonzero subsidy input rate. But, at a high subsidy input rate, the prey population cannot persist and the predator population has a huge growth due to the availability of food sources. (shrink)

Significant minority populations confer richness and diversity to British society. Responsive end-of-life care is a universal need that has ascended the public agenda following myriad reports of inadequate provision. Nevertheless, the potential exists for unwitting discrimination when caring for terminally ill patients on the basis of their religion or faith. Recent implementation of the Equality Act 2010, together with the government and professional initiatives, promises to positively impact upon this area of contemporary relevance and concern, although the extent to which (...) facilitative policies can truly enhance patient care will depend upon how these are translated into care at the bedside. The contributions of health professionals will be central in meeting the challenges and seizing the opportunities for meeting the religion and faith interests of patients of South Asian descent. Studies of multiple paternity in mammals and other animal species generally report proportion of multiple paternity among litters, mean litter sizes, and mean number of sires per litter. It is shown how these variables can be used to produce an estimate of the probability of reproductive success for a male that has mated with a female. This estimate of male success is more informative about the mating system that alternative measures, like the proportion of litters with multiple paternity or the (...) mean number of sires per litter. The probability of success for a mated male can be measured both theoretically and empirically, and gives an estimate of the intensity of sperm competition and of a male's “confidence of paternity” upon mating. The probability of success for mated males for ten “exemplar” species of mammals is estimated and they are compared for insights into the functioning of their mating systems. (shrink)

First published in 1977. Ethics is the most practical branch of philosophy: its immediate concern is with people's actions. Yet most philosophers do little to relate ethics intelligibly to the human situation. In this inquiry into the nature of ethics, William Ash draws on the relevant works of Marx, Engels, Lenin and Stalin to present the theory and practice of Marxist ethics. He offers an explanation of the moral aspect of Marx's dictum: 'The philosophers have only interpreted the world, in (...) various ways; the point, however, is to change it.' The book includes, perhaps for the first time in so considered a form, an assessment of Mao Tsetung's contribution to Marxist moral philosophy, together with the ethical implications of such developments in social practice as the Proletarian Cultural Revolution. The author deals with the question of value by analysing the concept of 'good'; with the question of claims on people and things by analysing the concept of 'right'; with the question of the limits and scope of freedom of choice and action by analysing the concept of 'ought'.' Clearly written in order to 'de-mystify' the subject, the book challenges readers to test the author's enlightened, Marxist approach in terms of the ethical ordering of their own society. (shrink)

This paper questions the dogmatic stance of the domestic courts toward mandatory orders for treatment, arguing that this has the potential to subjugate patients' interests to clinical discretion, and proposing a via media to accommodate the legitimate concerns of all parties.

This paper considers the evaluation of leadership development and reflects on the psychological resistances, political obstacles and cultural impracticalities of developing democratic leadership. The focus is on the development and sustainability of democratic leadership through processes of evaluation. While the authors acknowledge that there exist formidable obstacles to the collective practice of evaluating leadership development, suggestions are made for practitioners and researchers who nonetheless remain interested in democratic leadership.

This paper sketches a historical account of interdisciplinarity. A central claim advanced is that the modern array of scientific and humanistic disciplines and interdisciplinarity emerged together; both are moving targets, which must therefore be studied historically in relation to one another as institutionalized practices. A second claim is that of a steadily increasing complexity; new fields emerged on the boundaries of existing disciplines beginning in the late nineteenth century, followed by multi- and transdisciplinary initiatives in the twentieth, and finally transdisciplinary (...) programmatic research in the late twentieth and early twenty-first centuries. The latter two phases in this development have been driven primarily by funding agencies seeking to move the sciences in particular directions deemed socially or politically desirable (in dictatorships as well as democracies), while the existing disciplines remained in place and new ones came into being. Such policy initiatives have transformed both disciplinarity and interdisciplinarity in unanticipated ways. The question whether multi- or transdisciplinary arrangements produce epistemically better science or scholarship appears not to have been raised, let alone examined, by the policy actors driving their creation. This book describes a program of research in computable structure theory. The goal is to find definability conditions corresponding to bounds on complexity which persist under isomorphism. The results apply to familiar kinds of structures (groups, fields, vector spaces, linear orderings Boolean algebras, Abelian p-groups, models of arithmetic). There are many interesting results already, but there are also many natural questions still to be answered. The book is self-contained in that it includes necessary background material from recursion theory (ordinal notations, (...) the hyperarithmetical hierarchy) and model theory (infinitary formulas, consistency properties). This essay attempts a re-reading of the meaning and import of “synthetic propositions a priori” in the light of two other background concepts in Kantian epistemology: Erklärung and Begründung. The significance of this pair of concepts lies in the fact that they represent the “philosophical motive” of Kant---leading him, inevitably, to take the “transcendental turn”. (And, on this point, I believe that some commentators have reversed the dialectic of Kant’s thinking: they make him take the “transcendental turn” first, and then (...) envision the Erklärung and the Begründung.) And the distinction between the “sensible world” and the “intelligible world” was the consequence. Did this distinction also provide the ontological matrix for the epistemological distinction between “analytic propositions” and “synthetic propositions”? I take that to be evident. What is less evident is that Kant was more interested in the relation between the two worlds than in these worlds in isolation. He was concerned with demonstrating the possibility (i.e., the “transcendental possibility” and not merely the “logical possibility”) of the sensible in the light of the intelligible. This he sought to do by elucidating (with the help of “transcendental arguments”) the a priori conditions of possible experience. This was the hidden dialectic of the transformation of the image of mind, from the Lockean “mirror” to the Kantian “prism”. The synthetic propositions a priori (I argue) articulate the relation of the a priori conditions of experience to the possible objects of experience. (That is why Kant takes the metaquestion, “How are synthetic propositions a priori possible?”, to be the main problem of the Kritik der reinen Vemunft.) The significance of the work of Kant for what we moderns call the “philosophy of science” is noted in the conclusion. (shrink)
