Background Ethical decision making in intensive care is a demanding task. The need to proceed to ethical decision is considered to be a stress factor that may lead to burnout. The aim of this study is to explore the ethical problems that may increase burnout levels among physicians and nurses working in Portuguese intensive care units . A quantitative, multicentre, correlational study was conducted among 300 professionals.Results The most crucial ethical decisions made by professionals working in ICU were related to (...) communication, withholding or withdrawing treatments and terminal sedation. A positive relation was found between ethical decision making and burnout in nurses, namely, between burnout and the need to withdraw treatments , to withhold treatments and to proceed to terminal sedation . This did not apply to physicians. Emotional exhaustion was the burnout subdimension most affected by the ethical decision. The nurses' lack of involvement in ethical decision making was identified as a risk factor. Nevertheless, in comparison with nurses , it was the physicians who more keenly felt the need to proceed to ethical decisions in ICU.Conclusions Ethical problems were reported at different levels by physicians and nurses. The type of ethical decisions made by nurses working in Portuguese ICUs had an impact on burnout levels. This did not apply to physicians. This study highlights the need for education in the field of ethics in ICUs and the need to foster inter-disciplinary discussion so as to encourage ethical team deliberation in order to prevent burnout. While foregrounding the historiography of HIV and AIDS in the South African context, this article analyses AIDS as simultaneously existing in three spheres: first, virtually – as the subject matter of electronically measurable research; second, academically – as a topic of research in the discipline of History; and third, actually – as a complex health concern and signifier that, via the field of Medical and Health Humanities, could allow for new collaborations between historians and others interested in understanding AIDS. Throughout, (...) the central focus is the discipline of History and the global trends that become evident when examining metrics about AIDS research, particularly those that show the hierarchies of knowledge ‘production’, the reinforcement of disciplinary boundaries, and the discrepancy between the amount of research ‘produced’ by scientific and humanities disciplines. Overall, the article suggests that ‘post-AIDS’ is not currently helpful to health historians working on South African and other majority world contexts. More specifically, the article reflects on what AIDS histories still need to be written, and I argue that Medical and Health Humanities could provide a space for historians to work within and across disciplinary boundaries given the ever evolving remit of AIDS histories, temporalities, and narratives. Entiendo esta última como praxis de un “dispositivo” que identifico como el dispositivo decolonial pues sus relaciones de saber/poder son una práctica contra-hegemónica dentro de las dinámicas onto-epistemológicas de reproducción de aquello que Aníbal Quijano llamó “Colonialidad del poder”. El artículo observa como el cine comunitario sigue los dos estadios propuestos por la pedagogía decolonial como pasos ineludibles (...) hacia la emancipación de los sujetos subalternos. 1- la puesta en crisis de los saberes y las identidades hegemónicas, lo que se logra desde la identificación critica de su situación histórica y el aprendizaje de los artificios del lenguaje audiovisual en tanto aparato de reproducción ideológica colonial-capitalista. 2- Una propuesta teleológica por una vida decolonializada que emerge tanto de la apropiación tecnológica del lenguaje audiovisual desde el cual realizan su narración, su film, como también de las relaciones sociales “Otras” de producción de su mensaje. This publication features the stories and experiences of pharmacy professionals who identify as members of historically underrepresented groups. This collection of personal essays presents significant events in the lives of those in the pharmacy community whose experiences have been shaped by their race, ethnicity, gender or gender presentation, sexual orientation, ability, language, mental health, or other factors. The perspectives from the narratives highlight the importance of diversity, equity, and inclusion in the healthcare sector. The authors of the narratives also reflect (...) on their experience to consider what they wish would have happened in the experience, to offer advice for others that may be faced with similar situations. Access to these stories will deepen the collective understanding among pharmacy colleagues, patients, and society of the experiences that individuals from historically underrepresented groups within pharmacy have experienced. Serious mental health disorders are increasing among college students and university counseling services are often overburdened. Mobile applications for mental health have been growing exponentially in the last decade and they are emerging in university settings as a promising tool to promote and intervene in college students' mental health. Additionally, considering the recent covid-19 pandemic, mHealth interventions, due to its nature and possibilities, may play an important role in these institutions. Our main objectives are to explore mhealth interventions in universities, (...) regarding its conceptual framework, acceptability and efficacy outcomes and understand its impact and contributions to address treatment delivery and psychological difficulties resulting from covid-19 pandemic. The literature search was conducted in scientific databases, namely, Web of Science, Pubmed, and Scopus. A search in app stores was not conducted, thus regarding commercially available apps, only those found in our database search were included in our review. We selected studies with mobile applications addressing psychological interventions for college students. A total of 2,158 participants were included in the 8 selected studies and most interventions were delivered through mobile apps only and based in cognitive behavioral therapy. Results suggested that college students accept and adhere to these interventions and preliminary evidence of efficacy was demonstrated in different disorders, such as stress, anxiety, depression and risky behaviors such as alcohol and tobacco abuse and sexual knowledge. We conclude that universities, particularly college counseling services, may benefit from mhealth interventions, not only to address college students' mental health but to decrease some of its difficulties related to lack of human resources. Specifically in covid-19 pandemic context, these interventions may contribute significantly by promoting and delivering psychological interventions at a safe distance. (shrink)

Students in introductory philosophy courses bring with them varied preconceptions about philosophy and its place in their education and their lives. Rather than assuming we all agree on what it is we are doing when we do philosophy, it can be effective to problematize the discussion from the start. Plato’s Apology of Socrates is a useful tool for this. While interpreted by some philosophers as not particularly philosophical, recent approaches by Sellars and Peterson suggest that the Apology is rich with (...) philosophy. Here Plato’s Socrates reveals much about himself and his own understanding of the love of wisdom. By engaging in a process of mutual disclosure and active discovery of what matters to Socrates, we give students an excellent opportunity to find philosophy for themselves. As a result, students not only retain an understanding of key themes from Plato but also develop skills and attitudes well-suited to life-long philosophical engagement. (shrink)

A lack of diversity remains a significant problem in many STEM communities. According to the epistemic approach to addressing these diversity problems, it is in a community’s interest to improve diversity because doing so can enhance the rigor and creativity of its work. However, we draw on empirical and theoretical evidence illustrating that this approach can trade on the epistemic exploitation of diverse community members. Our concept of epistemic exploitation holds when there is a relationship between two parties in which (...) one party accrues epistemic benefits from another party’s knowledge and epistemic location and, in doing so, harms the second party or sets back their interests. We demonstrate that the ironic outcome of this nominal application of the epistemic approach is that it undermines the epistemic benefits which it promises. Indeed, we show that epistemic exploitation undermines the relationships and interactions among community members that produce rigor and creativity. Our central argument is that for communities to reap the benefits of an epistemic approach to diversity, to implement a genuine epistemic approach, they need to develop cultures that ameliorate the harms faced by, and protect the interests of, their diverse community members. Neoliberal ideology and exclusionary policies based on racialized identities characterize the current contexts in North America and Western Europe. Nursing knowledge cannot be abstracted from social, political and historical contexts; the task of examining the influence of race and racial ideologies on disciplinary knowledge and inquiry therefore remains an important task. Contemporary analyses of the role and responsibility of the discipline in addressing race‐based health and social inequities as a focus of nursing inquiry remain underdeveloped. In this article, we examine (...) nursing's engagement with ideas about race and racism and explore the ways in which nursing knowledge and inquiry have been influenced by race‐based ideological discourses. Drawing on Henry and Tator's framework of democratic racism, we consider how strategic discursive responses—the discourses of individualism, multiculturalism, colour‐blindness, political correctness and denial—have been deployed within nursing knowledge and inquiry to reinforce the belief in an essentially fair and just society while avoiding the need to acknowledge the persistence of racist discourses and ideologies. Greater theoretical, conceptual and methodological clarity regarding race, racialization and related concepts in nursing inquiry is needed to address health and social inequities. (shrink)

Bien qu’apparus au début du XX e siècle, ce n’est que dans la deuxième moitié du siècle que l’on observe un changement dans l’engagement évangélique vis-à-vis de la société : d’un retrait du monde à une « ouverture vers l’activité politique », marquée par le thème du combat spirituel pour les territoires. En Afrique de l’Ouest, (...) cette nouvelle visibilité dans l’espace public s’est concrétisée par l’élection de présidents évangéliques, comme Matthieu Kérékou au Bénin en 1996, ou Laurent Gbagbo en Côte d’Ivoire en 2000. Mais au sein d’une même société, les relations entre évangélismes et politique peuvent ainsi être multiples. Wildlife conservation aims to protect the natural world, plant and animal species, and the habitats they form part of and rely on for survival. More particularly, it focuses on species that are considered important, be it from economic, ecological and other perspectives, and preventing harm to these species. While conservation activities, based on common conservation values such as species fitness and biodiversity, are no doubt beneficial to animals in general, there seems to be a fundamental disjoint between this approach and (...) the mainstay of current ethical theories regarding animals, which focus on the treatment and welfare of individual entities. I will argue that the conflict between wildlife conservation and animal ethics arises both in the aims, as well as the application of conservation. In its aims, the focus on species as a whole often comes at a cost to individual animals, and in its application individual animals are often harmed as well. To demonstrate these two points, I will use the case study of the cloning and reintroduction of the currently extinct northern white rhino. I will then conclude that wildlife conservation, while aiming to benefit animals, is fundamentally at odds with any animal ethic that considers individual wellbeing as central. (shrink)

Studies have found that academic dishonesty is widespread. Of particular interest is the case of business students since many are expected to be the leaders of tomorrow. This study examines the cheating behaviors and perceptions of 819 business and engineering students at three private Lebanese universities, two of which are ranked as the top two universities in the country. Our results show that cheating is pervasive in the universities to an alarming degree. We first analyzed the data by looking at (...) the variables gender, college, GPA, and whether the students had taken the business ethics course. We then supplemented this analysis by building an ordered logistic regression model to test whether these independent variables affect the level of engagement in cheating behavior when we control for the other variables. The results show that males engage in cheating more than females and that students with a lower GPA engage in cheating more. We initially find a difference between business and engineering students, but once we control for the other variables, this difference ceases to exist. Our most surprising result is that the business ethics course seems to have a detrimental effect on the cheating behavior of students. Finally, we find that perception plays a key role in defining the behavior of students. The more that students perceive that others are engaging in a certain behavior, the higher the probability that they will engage in the behavior, even if they believe that this behavior constitutes cheating. Jacques Derrida delivered the basis of The Specters of Marx: The State of the Debt, the Work of Mourning, & the New International as a plenary address at the conference ‘Whither Marxism?’ hosted by the University of California, Riverside, in 1993. The longer book version was published in French the same year and appeared in English and Portuguese the following year. In the decade after the publication of Specters, Derrida’s analyses provoked a large critical literature and invited both consternation and (...) celebration by figures such as Antonio Negri, Wendy Brown and Frederic Jameson. This forum seeks to stimulate new reflections on Derrida, deconstruction and Specters of Marx by considering how the futures past announced by the book have fared after an eventful quarter century. In this fifth group of contributions, three philosophers explore the specters of colonialidade, the specifically Brazilian legacies of Portuguese and European coloniality. Carla Rodrigues opens the dialogue by exploring the haunting and melancholy provoked by colonial forms of violence and shows how confronting Brazilian necropolitics sustains the Derridean legacy; Rafael Haddock-Lobo offers a meditation on the difficulties of being before the law and standing before specters as a means of being justly haunted by the others of European philosophy in Brazil; finally, Marcelo Moraes continues the theme of Europe as a specter-producing machine and invokes specifically the presences of indigenous and Afro-Brazilian political resistances with the aim of deconstructing coloniality. Ethical constructivism holds that truths about the relation between rationality, morality, and agency are best understood as constructed by correct reasoning, rather than discovered or invented. Unlike other metaphors used in metaethics, construction brings to light the generative and dynamic dimension of practical reason. On the resultant picture, practical reasoning is not only productive but also self-transforming, and socially empowering. The main task of this volume is to illustrate how constructivism has substantially modified and expanded the agenda of metaethics by (...) refocusing on rational agency and its constitutive principles. In particular, this volume identifies, compares and discusses the prospects and failures of the main strands of constructivism regarding the powers of reason in responding to the challenges of contingency. While Kantian, Humean, Aristotelian, and Hegelian theories sharply differ in their constructivist strategies, they provide compelling accounts of the rational articulation required for an inclusive and unified ethical community. This article argues that cruelty, as a willingness to see or orchestrate the suffering of others, is not an unfortunate side-effect of neoliberal theories put into practice but is constitutive of the neoliberal project from its theoretical inception. Drawing on Lisa Duggan’s concept of ‘optimistic cruelty’ and treating the canonical texts of neoliberal economic theory as literary artefacts, the article develops this argument through a close reading of one of the central architects of the neoliberal project, the philosopher and economist (...) Friedrich Hayek. The first part of the article examines how Hayek attempts to justify the brutality of the market order he imagines – the catallaxy – by arguing that this brutality is the natural consequence of the spontaneous evolutionary processes that move civilisation forward. The second part brings to the fore the eugenicist undertones that suffuse this vision, despite Hayek’s apparent rejection of Social Darwinism. I analyse how Hayek’s market order operates through a series of disciplinary and biopolitical technologies that use pain, frustration, punishment and stigmatisation to eliminate bad habits, practices and subjectivities. These cruel mechanisms enable the catallaxy to sort between productive and unproductive lives to ensure that available resources are directed towards the former – even if it means that the others might be left to die. As such, cruelty is an affective atmosphere that permeates the catallaxy. (shrink)

The volume “Conceptualizing Friendship in Time and Place” brings together reflections on the meaning and practice of friendship in a variety of social and cultural settings in history and in the present time, focusing on Asia and the Western world.

Transgender individuals and families throw existing taxonomic classification systems of identity into perplexing disarray, illuminating sociolegal dilemmas long overdue for critical sociological inquiry. Using interview data collected from 50 cisgender women from across the United States and Canada, who detail 61 unique partnerships with transgender and transsexual men, this work considers the pragmatic choices and choice-making capacities of this social group as embedded within social systems, structures, and institutions. Proposing the analytic constructs of “normative resistance” and “inventive pragmatism” to situate (...) the interactional processes between agency and structure in the everyday lives of this understudied group of cisgender women, this work theorizes the liminal sociolegal status of an understudied family form. In so doing, it exposes the increasingly paradoxical consolidation and destabilization of sociolegal notions of identity, marriage, normativity, and parenthood—challenging, contributing to, and extending current theoretical and empirical understandings of agency and structure in twenty-first-century families. Antonin Artaud, words, drawings, and the extreme and traumatic condition of an individual who pushed back the boundaries of history, of his own time, in Europe’s darkest days. Such is my scope in the pages that follow. This essay examines the drawings produced by Artaud between 1944 and 1946. They offer a particularly helpful starting point for a series of reflections on, on the one hand, a concept of identity that had emerged and re-emerged with a new critical awareness following (...) the close of the Second World War, and on the other, how – leaving behind a modernism in which the cracks were clearly showing – it is from madness and suffering that the contemporary notion of the individual is reborn. According to a traditional account, moral cognition is an achievement gained over time by sharing a practice under the guidance and the example of the wise, in analogy with craft and apprenticeship. This model captures an important feature of practical reason, that is, its incompleteness, and highlights our dependence on others in obtaining moral knowledge, coherently with the socially extended mind agenda and recent findings in empirical psychology. However, insofar as it accords to exemplars’ decisive authority to determine the standard (...) of correctness for moral cognition, the model does not offer protection against arbitrariness and discrimination. The article argues that to understand the socially distributed nature of practical knowledge, we have to discard the notion of exemplars and reconceive of others as having equal normative standing. This claim allows us to revisit the conception of autonomy as key to distributed practical knowledge. While autonomy does not amount to selfsufficiency and self-reliance, it does demand independence of judgement and stands in contrast to servility, submission, and other sorts of defective ways of relying on others. The requirement of equal standing provides the basis for distinguishing between proper and improper reliance on others. Metaethical constructivism is the view that insofar as there are normative truths, they are not fixed by normative facts that are independent of what rational agents would agree to under some specified conditions of choice. The appeal of this view lies in the promise to explain how normative truths are objective and independent of our actual judgments, while also binding and authoritative for us. -/- Constructivism comes in several varieties, some of which claim a place within metaethics while others claim (...) no place within it at all. In fact, constructivism is sometimes defended as a normative theory about the justification of moral principles. Normative constructivism is the view that the moral principles we ought to accept are the ones that agents would agree to or endorse were they to engage in a hypothetical or idealized process of rational deliberation. -/- Metaethical constructivist theories aim to account for the nature of normative truths and practical reasons. They bear a problematic relation to traditional classifications of metaethical theories. In particular, there are disagreements about how to situate constructivism in the realism/antirealism debate. These disagreements are rooted in further differences about the definition of metaethics, the relation between normative and metaethical claims, and the purported methods pertinent and specific to metaethical inquiry. The question of how to classify metaethical constructivism will be addressed in what follows by focusing on the distinctive questions that constructivist theories have been designed to answer. Section 1 explains the origin and motivation of constructivism. Sections 2–4 examine the main varieties of metaethical constructivism. Section 5 illustrates related constructivist views, some of which are not proposed as metaethical accounts of all normative truths, but only of moral truths. Feminist philosophers of biology bring the tools of feminist theory, and in particular the tools of feminist philosophy of science, to investigations of the life sciences. While the critical examination of the categories of sex and gender (which will be explained below) takes a central place, the methods, ontological assumptions, and foundational concepts of biology more generally have also enjoyed considerable feminist scrutiny. Thought experiments play an important epistemic, rhetorical and didactic function in Galileo’s dialogues. In some cases, Salviati, Sagredo and Simplicio agree about what would happen in an imaginary scenario and try to understand whether the predicted outcome is compatible with their respective theoretical assumptions. There are, however, also situations in which the predictions of the three interlocutors turn out to be theory-laden. Salviati, Sagredo and Simplicio not only disagree about what would happen, but they reject each other’s solutions as question-begging (...) and somtimes even dismiss each other’s thought experiments as misleading or nonsensical. The aim of this article is to analyze the deontic character of norms of competence, more than to define a concept of competence. Competence is here understood as a power given by the legal system to a certain authority, as the capacity to create, modify or extinguish legal relations or positions. Only a couple of theses are examined to evaluate whether these norms have an autonomous deontic character, a complex modality or present a combination of independent characters. The relevance of (...) the answers is related to questions about responsibility, coercion and legal consequences.Resumen:El objeto del artículo es analizar el carácter deóntico de las normas de competencia, más que definir el concepto de competencia. En este caso, la competencia es entendida como un poder conferido por el sistema jurídico a ciertas autoridades, como la capacidad de crear, modificar o extinguir relaciones jurídicas o posiciones. Sólo un par de tesis son examinadas, a fin de evaluar si esas normas tienen un carácter deóntico autónomo o presentan una combinación de características independientes. Legal philosophy is a general and systematic reflection about fundamental questions regarding law. The fact that despite the efforts of contemporary jurists terms like ‘legal philosophy’, ‘legal theory’ and ‘jurisprudence’ do not have established meanings is one of the reasons behind the dispute regarding the function and validity of legal philosophy; a second issue worth considering is the transformations of law due to diverse influences such as globalization or theories on human rights. This article intends to establish common ground for (...) the discussion surrounding this issue by revisiting some of the differences between the two main western traditions, the article then proceeds to describe the general perception and evolution of jurisprudence.Resumen:La filosofía del derecho es una reflexión general y sistemática sobre las cuestiones fundamentales del derecho. El hecho de que términos como “filosofía del derecho”, “teoría del derecho” y “jurisprudencia” no tengan significados delimitados e indisputables, a pesar de los esfuerzos de los juristas contemporáneos, es una de las razones que junto con las transformaciones del derecho en virtud de la globalización y las teorías sobre derechos humanos han dado lugar a diversas disputas sobre la función y validez de la filosofía del derecho. En este artículo se pretende establecer una base común para la discusión en torno a estos problemas mediante la revisión de algunas de las diferencias que las dos principales tradiciones occidentales para después describir la precepción general y evolución de la filosofía del derecho. In this study I focus on the complementation patterns of commissive shell nouns in Ghanaian English (GhE). Commissive shell nouns are a type of illocutionary shell noun, i.e. a noun that encapsulates a content that is usually expressed in a complement or even separate clause or sentence thereby ascribing it an illocutionary force. I use the usage-based approach to the study of language and investigate the behavioral profile of these nouns in GhE. I apply descriptive statistics to data that have (...) been collected from the Corpus of Global Web-based English (GloWbE). The study provides evidence for the characterization of GhE usage norms, and thus contributes to the scholarly knowledge on this variety of English. It also sheds light on the contribution that the meaning-related and ultimately cognitive perspective can offer in describing the complementation patterns of illocutionary nouns in Postcolonial Englishes (PCEs). This essay examines phrenological tools as instruments of matchmaking and focuses on the personal ad as a site for producing and exchanging knowledge about individuals. It shows how cranial measurement produced character profiles for the purpose of judging suitable marriage partners and how users integrated those profiles into personal advertisements published in the Water-Cure Journal. A popular but contested science of the mind, phrenology maintained that one could truly know others and oneself through measuring “organs” of the mind via protrusions (...) on the skull. While much has been written about phrenology, less attention has been paid to its focus on marriage and mating and to how users enrolled phrenology to find and judge the viability of a mate. Focused on the American context in the 1850s, this essay will show that notions of race and gender, heredity, and marital “relations” were embedded in the shorthand of phrenological measurements and personal ads. This chapter aims to situate Kant’s account of practical reason in metaethical debates. First, it explains the reasons why it is legitimate and instructive to discuss Kant’s relevance in contemporary metaethics, hence addressing some issues about the intended scope of metaethics and its relation to practical reason and psychology. Second, it defends an interpretation of Kant’s conception of autonomy, which avoids some paradoxes traditionally associated with self-legislation. Third, it shows that constructivism best captures Kant’s conception of practical reason and of (...) its authority. Kantian constructivism is defended as a self-standing metaethical theory, which is designed to account for the objectivity and unconditional authority of practical knowledge, on the basis of standards congruent with shared subjective experience. This version of constructivism, adopting a “dialogical” interpretation of the autonomy of rational will, explains how finite rational agents are obligated and bound by the moral law. (shrink)

Should officeholders be held individually responsible for submitting to systemically corrupt institutional practices? We draw a structural analogy between individual action under coercive threat and individual participation in systemic corruption, and we argue that officeholders who submit to corrupt institutional practices are not excused by the existence of a systemic coercive threat. Even when they have good personal reasons to accept the threat, they remain individually morally assessable and, in the circumstances, they are also individually blameworthy for actions performed in (...) their institutional capacity. Sabe-se que, durante alguns períodos da história, a Música e a Matemática foram ciências que compartilharam seus conceitos e discussões. Um dos períodos no qual essa comunhão se deu de maneira significativa foi o Renascimento. A Música era então classificada como ciência e, pertencendo ao grupo das matemáticas, dividia seu espaço com a Aritmética, a quem era subordinada, com a Geometria e a Astronomia. Essa divisão foi transmitida através das obras do filósofo Sevério N. Boécio e prevaleceu durante o século (...) XVI, juntamente da noção de subalternação das ciências, provida na obra de Aristóteles e de seus comentaristas. Contudo, durante a segunda metade do século XVI, o cenário teórico foi sofrendo questionamentos e sendo por vezes reformulado. Tais reformulações tomaram várias formas, todavia, foi no diálogo entre dois autores específicos, Gioseffo Zarlino (1517-1590) e Vincenzo Galilei (1533?-1591), que a estrutura vigente foi realmente abalada. Neste artigo, pretendese mostrar a relevância da subalternação das ciências na discussão metodológica para a pretendida reformulação teórica, visto que um dos problemas metodológicos centrais da demonstração nas ciências matemáticas do século XVI foi a reconciliação entre as condições ideais, que governavam o mundo matemático, no caso específico o da Aritmética, e as condições reais do mundo físico natural. It is assumed that during specific periods in history Music and Mathematics were fields which had shared concepts and topics of discussion. A very well known period in which such a communion was specific prolific was the Renaissance. Music was then a mathematic science classified within the quadrivium. During the Renaissance, this conception was well known through the works of the philosopher Boethius and the notion of the subalternate sciences was disseminated through the works of Aristotle and his commentators. However, in the sixteenth century, reformulations were demanded by a number of authors. In the works of Gioseffo Zarlino (1517-1590) and Vincenzo Galilei (1533?-1591) the question on the classification of Music and Mathematics was specifically relevant in challenging the theoretic framework. Therefore, the aim of this article is to demonstrate the relevant role of the discussion on the subalternation of sciences, as it is known that one of the central methodological problems in the demonstration of sciences during the sixteenth century was the definition and reconciliation of the abstract mathematic object and the natural object. Although Cultural Studies has directed sustained attacks against sexism and racism, the question of the animal has lagged behind developments in broader society with regard to animal suffering in factory farming, product testing, and laboratory experimentation, as well in zoos, rodeos, circuses, and public aquariums. The contributors to Animal Subjects are scholars and writers from diverse perspectives whose work calls into question the boundaries that divide the animal kingdom from humanity, focusing on the medical, biological, cultural, philosophical, and ethical concerns (...) between non-human animals and ourselves. The first of its kind to feature the work of Canadian scholars and writers in this emergent field, this collection aims to include the non-human-animal question as part of the ethical purview of Cultural Studies and to explore the question in interdisciplinary terms. In this article, the right to health is discussed as a social right and an essential requisite in the construction and guarantee of human rights, more precisely human dignity, considering this right as a complex but effective process in the transformation of the social reality. In the first place, the activities of the public power and its difficulties to guarantee universal access to health are highlighted. This scenario ends up inhibiting the practice of the right to health and prevents users (...) from enjoying and using it. In that sense, this article challenges and explores some alternatives to solidify and put in practice the right to health in Brazil. Departing from the analysis of the Unified Health System and social participation in Brazil, this article discusses the judicialization of health in the country, highlighting the difficulties the State faces to equitably offer universal healthcare to society. This context offers an opportunity for reflection and a paradigm change, from the “judicialization of health” to the “judicialization of health policies.” Finally, the public health policies adopted by other countries are emphasized, in the attempt to construct the empowerment of human beings in the practice of their rights, particularly social participation and the discussion about the States’ responsibility to put their citizens’ right to health in practice. In conclusion, the political and collective construction of the right to health needs to be encouraged, distinguishing the legitimate interests of the different interlocutors involved. (shrink)
