This article develops a discursive explanation of mixed constitution: mixed constitutional ideas and discourse generate mixed constitutional design and practice. On that base, it explores the nature, factors, and functions of the mixed constitution in Vietnam. The emergence of competing constitutional ideas (Confucian, socialist, liberal, universal) animates a constitutional discourse in which different actors adhere to different ideas. Consequently, the 2013 Constitution of Vietnam embodies a mixture of the ideas in its provisions on political institutions, economy, and especially human rights. (...) The enforcement of the constitution induces competing claims to constitutional meanings. The mixed constitution is shaped by path dependency and global diffusion of constitutional ideas. Influenced by the Wittgensteinian slogan “Don’t look for the meaning, look for the use,” ordinary language philosophers aimed to defuse various philosophical problems by analyzing key words in terms of what they are used to do or the conditions for appropriately using them. Although Moore, Grice and Searle exposed this error – mixing pragmatics with semantics – it still gets committed, now to a different end. Nowadays the aim is to reckon with the fact that the meanings of a great (...) many sentences underdetermine what we would normally mean in using them – even if the sentence is free of indexicality, ambiguity, and vagueness. This can be so because the sentence expresses a “minimal” proposition or even because it doesn’t fully express any proposition. Many theorists are led to defend “truth-conditional pragmatics” (or linguistic “contextualism”), to find a hidden indexical in every syntactic nook or semantic cranny, or otherwise to pay undue respect to seemingly semantic intuitions and intentions. This paper identifies various such moves and explains what’s regressive about them. (shrink)

There is a simple view of motivation on which desires are like pain-killers; they come in different strengths, and their strength determines their efficacy. That is, the stronger a desire the greater its motivational force and, when two desires conflict, the stronger one “wins out” over the weaker. This view makes it puzzling how anyone could ever exhibit “strength of will” and act on the weaker desire, even when it is a desire for something more highly valued than what is (...) more strongly desired. When the will, as the agent of reason, enters the fray, an explanation of what a person is motivated enough to do must reckon not only with competing desires and their motivational forces, but also with the will’s capacity to be affected by different ones in ways not proportional to their force. However, this complication sheds little light, for if the will must bestow its stamp of approval on a desire before the desire leads to action, then, it would seem, motivational force should be measured by strength of effect on the will. And if that’s the way to measure motivational force, then, since by that measure one always acts on the desire that affects one’s will most, there is no problem of strength of will after all. But the problem seems real, however inapt the label. (shrink)

Taiwan is an island country situated in the northwest Pacific, close to the southeast of China. The land area is about 36,000 square kilometers. The population of Taiwan is about 23 million, and it consists of the majority Han ethnic groups and dozens of minority groups who are collectively called “Formosan,” an appellation for indigenous peoples in Taiwan. Formosans can be divided into Pingpu and Gaoshan by their living area. In recent years, marriages between Taiwanese, Mainland Chinese, and Southeast Asians (...) have increased significantly. Because of the genetic background of the Taiwanese people, it was thought to be highly beneficial for Taiwan to establish a biobank specifically designed for the Taiwanese population, as it would enable large-scale cohort studies to be carried out for common diseases occurring in Taiwan. Volatile compounds, such as nitric oxide and ethylene gas, play a vital role as signaling molecules in organisms. Ethylene is a plant hormone that regulates a wide range of plant growth, development, and responses to stress and is perceived by a family of ethylene receptors that localize in the endoplasmic reticulum. Constitutive Triple Response 1 (CTR1), a Raf‐like protein kinase and a key negative regulator for ethylene responses, tethers to the ethylene receptors, but undergoes nuclear translocation upon activation of ethylene (...) signaling. This ER‐to‐nucleus trafficking transforms CTR1 into a positive regulator for ethylene responses, significantly enhancing stress resilience to drought and salinity. The nuclear trafficking of CTR1 demonstrates that the spatiotemporal control of ethylene signaling is essential for stress adaptation. Understanding the mechanisms governing the spatiotemporal control of ethylene signaling elements is crucial for unraveling the system‐level regulatory mechanisms that collectively fine‐tune ethylene responses to optimize plant growth, development, and stress adaptation. There is a trend in modern times towards taking the individual’s desire to be the indicator or basis of what the good life would be for the individual. Desire is believed to be an outer expression of an inner voice. The idea is that the individual’s desire shows what matters and therefore what constitutes the good life for her. An assumption is that the desire is knowable. The task for a fulfilled life is to reason out what the desire is (...) and, as a next step, take corresponding rational actions towards its fulfilment. John Rawls is a paradigm case of this approach. What is missing, I believe, in assuming the knowability of desire, is an awareness of the key characteristic of human desire: that is, it is always in a process of formation and change. In this article, I try to explore the problems of seeing desire as capable of being made fully present, by looking at the ideas of Ralph Waldo Emerson, Jacques Derrida, and Adam Phillips. (shrink)

Especially over the past twenty years, a number of analytic philosophers have embraced the idea that the world itself is vague or indeterminate in one or more respects. The issue then arises as to whether it can be the case that the world itself is indeterminate in all respects. Using as a basis Chinese Madhyamaka Buddhist thought, I offer two reasons for the coherence and intelligibility of the thesis that all concrete things are themselves indeterminate with respect to the ways (...) they are. The first reason draws on a notion reminiscent of the picture of reality as an amorphous lump, while the second reason makes use of the relativity of conceptual perspectives and determinations. Assuming that the world is the mere totality of all concrete things, I show that there is a genuine metaphysical possibility of the world’s being indeterminate in all respects. (shrink)

In response to the Covid-19 pandemic, online learning has been carried out in many countries with different types of online learning models being promoted and implemented. In the global pandemic continues, the education environment is forced to change from traditional classroom or blended teaching mode to online learning teaching model. With the outbreak of COVID-19, China was the first to announce that online courses are to be implemented in February 2020. In China, whether online learning can replace traditional offline teaching (...) has become a topic worth discussing. Therefore, this study investigates university students in China by questionnaires and discussions of this topic. The study is based on the Push–Pull Mooring model. Based on 854 valid responses collected from an online survey questionnaire, structural equation modeling was employed to examine the research model. The results show that push effects, pull effects, and mooring effects all significantly influence users' switching intentions from offline to online learning platform. Finally, this study explores whether push–pull–mooring can be a reference for promoting and implementing online learning courses in Chinese colleges and universities in the future after the pandemic. In China, there have been numerous reports that doctors or other health care workers have been attacked by patients or members of patient’s families. From 2000 to 2003, there were 502 reports of violence against health care workers in the city of Beijing, in which 90 health care workers were wounded or disabled. From January 1991 to July 2001, in Hubei Province, 568 attacks on health care facilities and workers were reported, and some health care workers were even killed. In (...) Jiangsu Province, from 2000 to 2002, violent events against health care facilities and workers increased by 35% every year, with an average of 177 such events occurring each year. Those acts of violence have been attributed, in part, to the inadequacy of the legal system for handling medical disputes that was in effect prior to 2002. (shrink)

A number of analytical philosophers have recently endorsed the view that the world itself is indeterminate in some respect. Intriguingly, ideas similar to the view are expressed by thinkers from Chinese Madhyamaka Buddhism, which may shed light on the current discussion of worldly indeterminacy. Using as a basis Chinese Madhyamaka thought, together with Jessica Wilson’s account of indeterminacy, I develop an ontological conception of indeterminacy, termed ontic indeterminacy, which centres on two complementary ideas—conclusive indeterminability and provisional determinability. I show that (...) OI is well-equipped to tackle several issues of worldly indeterminacy. My overarching aim is to present a viable and sustainable perspective on the subject of indeterminacy to enrich analytical philosophers’ insights into the intricate nature of reality. (shrink)

Religious beliefs are defined as thinking, feeling and behaving in accordance with the beliefs and teachings of a religious system. In other words, religious beliefs are indicative of the role of religion in the individual and social life of people, as well as adherence to values and beliefs in daily life, performing religious practices and rituals and participating in activities of religious organisations. Religious beliefs are a set of dos and don'ts, and values are considered one of the most important (...) psychological supports that can provide meaning in all moments of life and save a person from meaninglessness by providing explanatory support in specific situations. In addition, work conscience is defined as a feeling of inner commitment to comply with agreed-upon requirements for work. In other words, work conscience means heartfelt satisfaction and practical commitment to the tasks that a person is supposed to perform properly, in a way that there will be no negligence in performing the duty even if no supervisor oversees the activity. Given the significant role of nurses in hospitals, especially during the coronavirus disease 2019 (COVID-19) pandemic, the religious beliefs of healthcare employees have become more important. Therefore, the present study aimed to evaluate the effect of religious beliefs on the work conscience of 1800 Muslim nurses in Iraq during the COVID-19 pandemic in 2021. Standard questionnaires were applied to assess the respondents' religious beliefs and work conscience. In addition, data analyses (Cronbach's alpha, Pearson's correlation, etc.) were performed in Statistical Package for the Social Sciences (SPSS). According to the results, religious beliefs have a positive effect on nurses' work conscience (p = 0.822). CONTRIBUTION: The findings of this study showed that the employees of an organisation, especially nurses and healthcare staff, can rely on their religious beliefs and benefit from their advantages in order to strengthen their work conscience during a hard time such as the COVID-19 pandemic. Many physicists regard the flow of time as an illusion. There is an upper level flow of time, the phenomenon of past/present/future; and there is a lower level flow of time which is really a flow of events. Perceptual completion accounts for the lower level flow of time in a few ways: apparent movement; amodal completion; and dynamic change as exemplified by a newly described modal completion that we called happening. It acts like an illusory percept connecting discrete stimuli in (...) all sensory modalities. The past/present/future distinction cannot exist unless an object is perceived to be the same now as it is then. This cognition requires object persistence. Experiments with object persistence suggest the circumstances when that, too, is an illusory percept. The illusory percepts of object persistence and perceptual completion can account for the entire flow of time. Our findings and conclusions are congruent with a few time theories and cosmologies that suggest that the flow of time is an illusion. (shrink)

Das 17. Jahrhundert ist beherrscht von der Maschine. Sie dominiert als technische Konstruktion die Theorien und Praxen der wissenschaftlichen Revolution und bedingt entscheidend den Aufstieg der empirischen Wissenschaften. Als Metapher hat sie Erklärungskraft für barocke Modelle von Welt und Mensch, von Körper und Geist; bildlich repräsentiert sie kulturelle und natürliche, weltliche und religiöse Prozesse. Auch Literatur und Theater sind nicht ohne Maschinen zu denken. Darum geht es in diesem Buch: um die polyfunktionale Figur der Maschine in Bezug auf theater- und (...) literaturästhetische Diskurse und Performanzen. Denn Maschinen haben im rationalistisch-mechanistischen Barockzeitalter nicht nur philosophischen Erklärungswert - sie besitzen zugleich Generierungspotenzial: das Potenzial, Neues und Anderes, Mögliches und Unmögliches zu generieren. Die Poiesis der Maschine in der barocken Theater- und Literaturästhetik steht zur Diskussion. Vorgestellt werden zwei zentrale poietische Prozesse: Die Maschine generiert literarisch-theatrale Möglichkeitsräume auf der Bühne und im Buch. Zum einen setzt die Theatermaschine die barocke Ästhetik des Spektakulären um, gesteigert in der maschinellen Theatralisierung der Welt im Rahmen des barocken Festes. Zum anderen inszeniert die Maschinenliteratur Technikutopien auf der Schnittstelle zwischen Wirklichkeit und utopisch-visionärer Möglichkeit – und steht damit für das noch nicht diversifizierte literarische System der Frühen Neuzeit ein. Den Hauptteil des Buchs bildet ein Repertorium, welches die Werkgruppe der "Theatra Machinarum" erstmals systematisch erfasst: gedruckte, ein- oder mehrbändige Technikschaubücher vom 16. bis 18. Jahrhundert, die reale und imaginierte Maschinen in Bild und Text präsentieren und sich, häufig durch einen theatermetaphorischen Titel, als Inszenierungen von Wissen auf einer Bühne ausstellen. Mereological theories are based on the binary relation “being a part of”. The systematic investigations of mereology were initiated by Leśniewski. More recent authors (including Simons, Casati and Varzi, Hovda) formulated a series of first‐order mereological axioms. These axioms give rise to a plenitude of theories, which are of great philosophical interest. The paper considers first‐order mereological theories from the point of view of computable (or effective) algebra. Following the approach of Hirschfeldt, Khoussainov, Shore, and Slinko, we isolate two important (...) computability‐theoretic properties P (namely, degree spectra of structures, and effective dimensions), and consider the following problem: for a given mereological theory T, is it true that its models can realize every possible variant of the property P? If the answer is positive, then we say that the theory T is ‐universal. We obtain the following results about known mereological theories. Any theory T which is weaker than Extensional Closure Mereology (CEM) is ‐universal. A similar fact is true for the theory GM2. On the other hand, any theory stronger that CEM + (C) + (G) is not ‐universal. In particular, General Extensional Mereology is not ‐universal. (shrink)
