This article contains the Spanish translation of the entry “Staat”, of Hermann Heller, with an introduction to his political and juridical thought.

El artículo pone de relieve el papel axial del bien común sobrenatural en la doctrina tomista de la legitimidad política. Con el fin de estudiar esa tesis en la Escuela Tomista contemporánea, el autor se centra en el tratamiento del tema de las relaciones entre Iglesia y Estado en la obra de un importante filósofo tomista del siglo XX, Julio Meinvielle (+1973).

El presente artículo se introduce en la cuestión de la reversión del poder a partir de las posiciones de Suárez sobre el origen de la potestad política. A continuación aborda el problema en autores representativos de la segunda escolástica. Por último, con el ejemplo de los sucesos posteriores a 1808 en los reinos americanos de la monarquía castellana, intenta determinar si es dable sostener en la realidad objetiva alguna forma de reversión del poder a la comunidad.

En la doctrina del derecho internacional de Hermann Heller el dato fundamental del orden jurídico lo constituye la presencia de unidades decisorias soberanas, individualizadoras del derecho. Heller agrega que, paradojalmente, la existencia del derecho positivo depende de la acción legibus soluta de tales unidades comunitarias. Aunque obligados por “principios jurídicos fundamentales”, los Estados, ante una amenaza que los ponga en riesgo y comprometa, por ende, a la totalidad del orden jurídico, pueden modificar a éste último parcialmente. Así pues, respecto del (...) orden jurídico positivo, el Estado permanece como elemento determinante. Y, dado que en el orden internacional no hay una civitas maxima, sino pluralidad de Estados, serán éstos quienes libremente determinen el derecho internacional público. El Estado nace y perdura como una cierta realidad social y existe como sociedad política –con la legitimidad correspondiente- aun cuando no entable relaciones jurídico-internacionales de ninguna especie. En conclusión, para Heller si el Estado no aparece ni pervive por decisión del derecho internacional, luego tampoco su potestad se origina en una delegación o distribución de funciones emanada de tal orden normativo. The article treats with one of the major principles of the aristotelian practical philosophy, i. e. the distinction between rational rule and despotic power. The former rests on the rational nature of the subjects and aims to an end which is common both to the superior and to the subjects. On the contrary, neither of those properties are implicated in the latter. This aristotelian thesis, shared by the whole classical natural law theory - from Aquinas to Althusius -, supports authority’s (...) definition as direction toward a common good, and shows social and political life as having an intrinsic value. Finally, the article points out that Aristotle’s theory concerning command contests some of the main psychological, ethical and sociological modern positions (as those of Freud, Kant and Weber), whose conception of command is based upon repression and violence. This article means to show how Aristotelian second scholasticism on the one hand, and Hermann Heller on the other, converge to assert the supremacy of political power, the politicity of positive law, the independence of the political community and its role as a primary subject of international law. These coincidences between the founders of modern international law and the great theoretician of the State become evident not in their respective philosophical premises, but, above all, in their conclusions on the properties (...) they attribute to the political community. Furthermore, as it is also stated in this article, the principles put forward by Vitoria, Suárez and Heller have not lost their deontic value and constitute objective legitimacy bases on which contemporary political processes may be judged. This text proposes some lines of reflection and action related to a project that links philosophy and childhood, whose pedagogical and investigative activity has been developed in the province of Córdoba, Argentina, for more than twenty-five years. To do this we recover an experience of workshops with children and adults, in a continuous process of reflection on childhood and how children think about themselves. That experience focuses on imagining a particular space and time – living together on an island where (...) adults cannot be found--and from there question the forms of decision making and participation – of political action – that children perform in the territories they inhabit. Here it is proposed that the circumstance of incompleteness regarding issues such as politics and sexuality encompass all age situations and, therefore, it is more appropriate to let ourselves be traversed by restlessness and doubt than to accept a preconceived world in which problems quickly find answers, and what you do not know or cannot be located in a fixed category is unknown, ignored, or remains hidden. We propose to start by not postulating any pre-conceived notions regarding childhoods--thinking of them as hypotheses with unexplored names, bodies and thoughts to get to know. Likewise, it is assumed that reflection on teaching practice relocates philosophy teachers as intellectuals who keep universal explanations in their “professorial pockets,” and reinvent themselves by dealing with specific problems, the small discoveries one makes through exchanges with others--those others that, as in the case of children, there is much to learn about and from. This is the ethical and political task that emerges from a continuous reflection on shared action. Welcome, then, to the island where everything is to be decided and participated in, the island of Serendipity. (shrink)

Background: The present study compared the effects of a traditional resistance training and resistance training combined with cognitive task on body composition, physical performance, cognitive function, and plasma brain-derived neurotrophic factor levels in older adults. Methods: Thirty community-dwelling older adults were randomized into TRT and RT+CT. Exercise groups performed a similar resistance training program, twice a week over 16 weeks. Cognitive Training involved performing verbal fluency simultaneously with RT. Exercise sessions were performed 2-3 sets, 8-15 repetitions at 60-70% of 1-repetition (...) maximum. Body composition, physical function, cognitive performance, and BDNF levels were assessed before and after intervention period. Results: The physical performance was similarly improved in response to both TRT and RT+CT. However, exclusive improvements on cognitive function and BDNF levels were observed only after RT+CT. Conclusion: The RT program associated with a cognitive task, improved physical and cognitive performance in healthy older adults. (shrink)

En este artículo exponemos los presupuestos que permiten una reflexión crítica sobre la esfera pública desde una perspectiva marxista. Hemos partido de la consideración del contexto de discusión reciente sobre las ideas políticas de Marx y de la relevancia del concepto de esfera pública para mostrar la importancia de algunos de sus conceptos críticos para la filosofía política. El texto es producto de una investigación dedicada a la elaboración de un marco conceptual que persigue el desarrollo de un análisis crítico (...) de la esfera pública en la actualidad y en el que se ha establecido que algunas cuestiones claves, vinculadas a los conceptos de lenguaje y experiencia, se encontraban presentes en la obra de Marx. En este sentido, el texto presenta una novedosa reflexión al tratar la actualidad del pensamiento de Marx desde el análisis de un problema político contemporáneo que permite poner en evidencia las implicaciones críticas y radicales que poseen sus fundamentos filosófico-críticos para los discursos y las instituciones políticas contemporáneas como la esfera pública. This chapter argues that from a particularly weak recombination principle and plausible assumptions about the nature of parthood and location, it follows that it is possible that the mereological structure of the material world and that of space-time fail to correspond to one another in very radical ways. The chapter suggests, moreover, that rejecting the possibility of such failures of correspondence leaves us with a choice of no less unappealing alternatives. Socially responsible consumption reflects a consumer's political and ethical act. Its measurement is dependent on the socio-economic and cultural context. Consequently, measurement instruments reflecting various behaviour profiles of global consumers have been developed. This study employs a Latin-American-specific measurement instrument to compare socially responsible consumption behaviours in Colombia, Mexico and Peru, countries with the same cultural cluster, that is they reflect a set of values shaped by religion, family, a sense of authority and a nationalist bias in their cultural pattern. (...) The empirical test included confirmatory factorial analysis exercise, factorial invariance analysis and a contrast analysis of variance. The results for the three Latin American countries show the following. (i) The Mexican consumer, compared to the Peruvian and Colombian one, exhibits a stronger tendency to evaluate external practices of corporate social responsibility as a criterion of consumption. (ii) The rationality of the Mexican consumer is better in terms of consumption volume of products, resources and services. Finally, (iii) Peruvian and Mexican consumers (vs. Colombian consumers) exhibit a tendency to assess the responsible practices of companies in labour matters more as a consumption criterion. This study provides empirical evidence of the context-dependent nature of measuring socially responsible consumption. For practitioners, identifying consumer profiles based on the market context enables them to customise goods and services. Moreover, policymakers should implement a sustainable consumption agenda with public policy guidelines tailored to the specific context. (shrink)

Purpose: To determine the relative value that patients place on consent for procedures in the emergency department (ED) and to define a set of procedures that fall in the realm of implied consent. Methods: A questionnaire was administered to a convenience sample 134 of 174 patients who were seen in the ED of a Midwestern teaching hospital. The questionnaire asked how much time they believed was necessary to give consent for various procedures. Procedures ranged from simple (venipuncture) to complex (procedural (...) sedation). Results: Participants valued a simple blood draw at a low mean of 1.02 minutes of extra time and a lumbar puncture at a high mean of 7.78 minutes. Of all participants 52% and 48% noted a time-value of ?0? time on blood draw and intravenous line starts, respectively, indicating that they desire no additional consent for these procedures. Conclusion: Defining a set of ED procedures covered under implied consent will be difficult because many patients value formal consent for even the simplest procedure. (shrink)

The problem of deviant causation has been a serious obstacle for causal theories of action. We suggest that attending to the problem of deviant causation reveals two related problems for causal theories. First, it threatens the reductive ambitions of causal theories of intentional action. Second, it suggests that such a theory fails to account for how the agent herself is guided by her reasons. Focusing on the second of these, we argue that the problem of guidance turns out to be (...) related to a number of other issues in the literature on action explanation, and that it is much more general: it threatens not only causal theories but any theory of action. Finally, we suggest that a certain version of the view that acting has a constitutive or formal aim can overcome this problem. (shrink)

I give shape to a neglected debate in metaphysics, the debate over the ontological priority between individuality and collectivity. I distinguish the debate from more familiar ones in the recent literature and articulate what I call ontological collectivism, the view that collectivity is prior to individuality. I defend the in-principle intelligibility of the view from forceful general objections and argue that not only is it coherent but also of significant interest to the literature: it allows for overlooked alternatives on a (...) variety of central discussions. Este artículo, siguiendo al filósofo francés Vladimir Jankélévitch, desvela la ética de la resistencia como una vía frente a la imposibilidad de perdonar en casos de violencia extrema y, en particular, cuando no hay arrepentimiento por parte del victimario. La senda de la resistencia configura, entonces, no solo el compromiso y la necesidad de mantener vivo el recuerdo del horror y la preciosa ipséité, sino la posibilidad de re-sentir y re-significar el silencio como un modo de dignificar a las víctimas, (...) sin permitir que el lugar de lo moral sea usurpado por lo jurídico o lo legal. La tesis central que queremos sostener aquí se rige por la siguiente afirmación: si no podemos perdonar, por lo menos podemos resistir. La resistencia está relacionada con el deber de la memoria y con la recuperación de la voz silenciada de las víctimas en el espacio público. This article, following the teachings of the French philosopher Vladimir Jankélé-vitch, presents the ethics of resistance as a path facing the impossibility of pardon in cases of extreme violence and, in particular, when there is no remorse on the part of the violence performer. The path of resistance shapes, therefore, not only the commitment and the need to keep alive the memory of the horror and the cherished ipséité, but also the possibility to feel again and redefine silence as a way to honour the victims without allowing the moral stance to be usurped by the judicial system or the rule of law. The central thesis that we would like to hold here is based on the following statement: If we cannot forgive at least we can resist. Resistance concerns the duty of memory and the recovery of the silenced voice of victims in the public space. (shrink)

El reto de todas las sociedades, tanto a nivel de lo que se ha denominado formación (Bildung) como de lo que constituye la institucionalización jurídico-política, es el problema del mal que se concretiza a la manera de la banalización y destrucción de la humanidad misma. La filosofía práctica kantiana asume este desafío y plantea un proyecto ético-político que pasa a través de lo pedagógico y estético. El propósito de este artículo es hacer una exploración en torno a las posibilidades de (...) configuración moral y jurídica de tos sujetos a partir de los planteamientos kantianos, contrastándolas con la dificultad permanente que para ellas representa el mal radical. Para esto se procederá a través de cuatro apartados. El primero versará sobre los presupuestos antropológicos o rasgos humanos que se convierten en condición de posibilidad tanto de la moralización como de la normalización. El segundo tendrá como tema la legislación ético-moral ahondando en el concepto de autonomia. El tercero planteará la relación entre ética y política a través de lo jurídico para, finalmente, esbozar algunas conclusiones. (shrink)

A partir de la reforma penal ilustrada y el normativismo jurídico contemporáneo, las sociedades modernas han intentado valerse de una culpabilización útil y objetiva, en contraposición a ideas metafísicas y teológicas tradicionales de castigo. Sin embargo, la moralidad social que subyace y acompaña la aplicación del Derecho penal está atravesada por motivos premodernos e intereses técnicos y económicos que han hecho de la racionalidad culpabilizadora un ejercicio complejo; entretejido con nociones como maldad, ejemplaridad, seguridad, control y productividad. El objetivo de (...) este ensayo es entonces mostrar el relativismo de la culpabilidad en las sociedades securitarias actuales y sus avatares en medio de la tensión dada entre poderes legales e ilegales y doctrinas neoliberales y neoconservadoras. We study whether robots can satisfy the conditions of an agent fit to be held morally responsible, with a focus on autonomy and self-control. An analogy between robots and human groups enables us to modify arguments concerning collective responsibility for studying questions of robot responsibility. We employ Mele’s history-sensitive account of autonomy and responsibility to argue that even if robots were to have all the capacities required of moral agency, their history would deprive them from autonomy in a responsibility-undermining way. We will also study whether humans and technological artifacts like robots can form hybrid collective agents that could be morally responsible for their actions and give an argument against such a possibility. Various sources in the literature claim that the deduction theorem does not hold for normal modal or epistemic logic, whereas others present versions of the deduction theorem for several normal modal systems. It is shown here that the apparent problem arises from an objectionable notion of derivability from assumptions in an axiomatic system. When a traditional Hilbert-type system of axiomatic logic is generalized into a system for derivations from assumptions, the necessitation rule has to be modified in a way that (...) restricts its use to cases in which the premiss does not depend on assumptions. This restriction is entirely analogous to the restriction of the rule of universal generalization of first-order logic. A necessitation rule with this restriction permits a proof of the deduction theorem in its usual formulation. Other suggestions presented in the literature to deal with the problem are reviewed, and the present solution is argued to be preferable to the other alternatives. A contraction-and cut-free sequent calculus equivalent to the Hubert system for basic modal logic shows the standard failure argument untenable by proving the underivability of DA from A. (shrink)

A implementação de tecnologias móveis de informação e comunicação no suporte à Saúde Mental tem atraído a atenção das autoridades. Com a ascensão das Inteligências Artificiais, esse movimento pode ser impulsionado de maneira exponencial. Nesse cenário, esta revisão tem como objetivos verificar a aplicabilidade das Inteligências Artificiais (IAs) na Saúde Mental e analisar os aspectos que favorecem a relação entre IAs e usuários. Para tanto, realizou-se uma revisão sistemática nas bases de dados PubMed e Biblioteca Virtual em Saúde, no período (...) de 25 de maio a 23 de junho de 2023. Selecionamos os 100 primeiros artigos mais relevantes com as palavras-chave: “Inteligência Artificial”, “Saúde Mental”, “Chatbots”, “Psicoterapia”, “Psicologia” e suas equivalentes em inglês. Os critérios de inclusão foram: acesso aberto, publicação a partir de 2018, em português ou inglês e menção à atuação de IAs no âmbito da Saúde Mental. Para reduzir o risco de viés, excluímos os estudos que não mensuraram o impacto das intervenções por meio de métodos experimentais ou quase-experimentais. Para a síntese dos dados, delimitaram-se alguns pontos específicos de análise, como “Resultado da intervenção”, “Aspectos que favorecem a relação”, entre outros. Atenderam aos critérios de inclusão 24 estudos, dos quais 17 apresentaram resultados positivos em suas intervenções. O uso de IAs na Saúde Mental possui grande potencial de expansão e os resultados obtidos neste trabalho podem guiar a implementação dessas práticas e futuras pesquisas na área. (shrink)
